1 BETWEEN THE ARGENTINE REPUBLIC AND THE HAGUE CONFERENCE ON PRIVATE INTERNATIONAL law This Host Country Agreement is entered into by and between the Argentine Republic and the Hague Conference on Private International Law (hereinafter referred to as the "Parties"). WHEREAS: The Hague Conference on Private International Law has been working for the progressive unification of private international law since 1893, mainly through the preparation and promotion of international conventions in response to global needs and through measures to support their effective implementation; The Argentine Republic has been a Member of the Hague Conference on Private International Law since 1972; The results obtained by the Hague Conference on Private International Law's Special Programme for Latin American states in furtherance of its mission to provide technical assistance to support the implementation of Hague Conventions in the countries of the Region have been remarkable; and The Hague Conference on Private International Law has expressed its desire to establish a permanent regional office in the City of Buenos Aires in order to facilitate the achievement of the aims and objectives for which it was created.

2 THEREFORE, the Parties agree as follows: ARTICLE 1 1. The Hague Conference on Private International Law (hereinafter referred to as the "Hague Conference") may establish a permanent regional office in the territory of the Argentine Republic (hereinafter referred to as "Argentina") in order to facilitate the achievement of the aims and objectives for which it was created. 2. The Office to be established shall exercise the functions assigned thereto by the Secretary General of the Hague Conference in furtherance of its founding aims and strategic objectives, and, especially, of its mission to provide technical assistance to the States of the Region for the purpose of the implementation of Hague Conventions, including those regarding the international protection of children, family and property relations, as well as international legal co-operation and litigation, and international commercial and finance law. The Office shall also foster international administrative and judicial co-operation by means of a better co-ordination between Central Authorities, judges, officials and other professionals involved in the application of the Hague Conventions, the facilitation of access to information by States of the region, and the development and promotion of the work of the Hague Conference in the Spanish language. 3. The Government of the Argentine Republic shall be represented by the Ministry of Foreign Affairs, International Trade and Worship. ARTICLE 2 The Hague Conference shall possess juridical personality in Argentina, and, in particular, shall have legal capacity to: 1. Contract. 2. Acquire and dispose of immovable and movable property. 3. Institute legal proceedings.

3 ARTICLE 3 The Office shall be under the authority and responsibility of the Hague Conference. However, health and safety regulations and such other legal provisions as may be relevant shall be applicable thereto. ARTICLE 4 Argentina shall not be liable for any actions or omissions on the part of the Hague Conference or any persons working for the Hague Conference. ARTICLE 5 1. In consultation with the Hague Conference, the Argentine Government shall make available office and conference space for the location of the Regional Office, including computing and telephone equipment, and shall absorb the cost related to the installation and operation of the Office, including communication expenses incurred as a result of the Office's business, but excluding personnel costs. For such purpose, on behalf of the Argentine Government, the Ministry of Foreign Affairs, International Trade and Worship shall co-ordinate all such issues as may arise with regard to the implementation of this Agreement between Argentina and the Hague Conference. 2. In respect of communications, Argentina shall grant the Hague Conference, as well as its officials and personnel, the facilities set forth in Article III of the Convention on the Privileges and Immunities of the United Nations adopted on 13 February ARTICLE 6 1. The Hague Conference, its property and assets, wherever located and by whomsoever held, shall enjoy immunity from every form of legal process in the terms of Article II, Section 2, of the Convention on the Privileges and Immunities of the United Nations adopted on 13 February 1946.

4 2. The premises of the Offices shall be inviolable. The property, funds and assets, wherever located and by whomsoever held, shall be immune from search, requisition, confiscation, expropriation and any other form of interference, and may not be expropriated except by reason of public utility stated by law and subject to prior compensation. 3. The archives of the Offices, and in general all documents belonging to it, shall be inviolable. 4. The Hague Conference, its assets, income and other property shall be exempt from: (a) all direct taxes. (b) customs duties and prohibitions and restrictions on imports and exports in respect of articles imported or exported by the Hague Conference for the operation of its Office and in furtherance of its aims and objectives, in accordance with the procedure, methods and regulations laid down to such effect by the Argentine Government for the international organisations of the United Nations System. Articles imported under such exemption shall not be sold or used in the country for commercial purposes, except under conditions expressly agreed with the Government. (c) customs duties and prohibitions and restrictions on imports and exports in respect of its publications. 5. The Hague Conference shall be exempt from such Value Added Tax as may accrue on the property acquired in the country when making important purchases for official use of property. By means of a written agreement, the Parties shall agree on the minimum amount for a purchase to be regarded as important in the terms of this paragraph. Such amount shall be equal to that established for the international organisations of the United Nations System. 6. The Hague Conference may: (a) hold funds or currency of any kind and operate accounts in any currency; (b) transfer its funds or currency from one country to another or within the country and convert any currency held by it into any other currency;

5 (c) open and hold accounts in local or foreign currency in public and / or private financial institutions regulated by the Central Bank of the Argentine Republic pursuant to the rules and regulations in force in Argentina. 7. The Hague Conference may arrange secondments and internships as it may deem necessary applying the relevant policies, procedures and good practices of the Permanent Bureau in The Hague. ARTICLE 7 1. The Government shall apply to those officials working in the Hague Conference Office who have neither Argentine nationality nor permanent residence in Argentina the provisions of the Convention on the Privileges and Immunities of the United Nations adopted on 13 February Hague Conference officials having Argentine nationality or permanent residence in Argentina shall exclusively enjoy the following privileges and immunities: (a) immunity from legal process in respect of all acts performed by them in their official capacity and inherent therein; (b) exemption from taxation on the salaries and emoluments paid to them by the Hague Conference. 3. Moreover, those Hague Conference officials who may be in the country shall be accorded such facilities and courtesies as may be necessary for the efficient discharge of their functions. 4. Such privileges, immunities and facilities are granted to Hague Conference officials in the interests of the Hague Conference and not for the personal benefit of the individuals themselves. The Secretary General of the Hague Conference shall have the right and the duty to waive the immunity of any Hague Conference official in any case where immunity would impede the course of justice or be detrimental to the interests of the Hague Conference.

6 ARTICLE 8 Experts performing missions for the Hague Conference shall be accorded the privileges, immunities and facilities set forth in Article VI, Sections 22 and 23, and Article VII, Section 26, of the Convention on the Privileges and Immunities of the United Nations adopted on 13 February ARTICLE 9 1. Notwithstanding the privileges, facilities and courtesies provided for in this Agreement, all Hague Conference officials and experts on mission shall observe the laws and regulations in force in Argentina and may not interfere with the domestic affairs of the country. 2. The Hague Conference shall co-operate at all times with the Argentine authorities to facilitate the proper administration of justice, secure the observance of Argentine laws and regulations and prevent the occurrence of any abuse in connection with the privileges, immunities, facilities and exemptions mentioned in this Agreement. ARTICLE 10 All differences between the Argentine Republic and the Hague Conference on Private International Law arising out of the interpretation or application of this Agreement shall be settled by means of direct negotiations between the Parties. ARTICLE This Agreement shall become effective on such date as the Argentine Government may notify to the Hague Conference for approval thereof in accordance with its constitutional procedures. 2. This Agreement may be modified by the Parties by means of a written instrument. The modifications agreed upon shall become effective through the procedure laid down in paragraph 1.

7 3. This Agreement may be denounced by either Party at any time through written communication served upon the other by diplomatic means. The denunciation shall become effective a year after service of such communication. IN WITNESS WHEREOF, the Parties hereto sign in Buenos Aires two counterparts in English and Spanish, both equally authentic and each being considered an original, on this seventh day of the month of May in the year two thousand and ten. 8 ACUERDO DE SEDE ENTRE LA REPÚBLICA ARGENTINA Y LA CONFERENCIA DE LA HAYA DE DERECHO INTERNACIONAL PRIVADO La República Argentina y la Conferencia de la Haya de Derecho Internacional Privado, en adelante denominados las Partes, Considerando que la Conferencia de La Haya de Derecho Internacional Privado viene trabajando desde 1893 para la unificación progresiva del derecho internacional privado, esencialmente por medio de la elaboración y promoción de convenciones internacionales que responden a las necesidades globales, y a través de medidas que faciliten su efectiva implementación, Observando que la República Argentina es Miembro de la Conferencia de La Haya de Derecho Internacional Privado desde 1972, Destacando los resultados obtenidos por el Programa Especial para los Estados Latinoamericanos de la Conferencia de La Haya de Derecho Internacional Privado en el cumplimiento de su cometido de asistenta técnica para la mplementación de las Convenciones de La Haya en los países de la región, y Teniendo presente los deseos expresados por la Conferencia de La Haya de Derecho Internacional Privado de instalar en la Ciudad de Buenos Aires una sede regional permanente con el propósito de facilitar el cumplimiento de los fines para los que fue creada,

9 Han convenido lo siguiente: ARTÍCULO 1 1. La Conferencia de La Haya de Derecho Internacional Privado (en adelante la Conferencia de La Haya) podrá establecer en el territorio de la República Argentina (en adelante la Argentina) una sede regional permanente con el propósito de facilitar el cumplimiento de los fines para los cuales fue creada. 2. La Oficina que se establezca tendrá las funciones que le asigne la Secretaría General de la Conferencia de La Haya para la prosecución de sus objetivos fundacionales y estratégicos y, en especial, proporcionar asistencia técnica a los Estados de la región con respecto a la implementación de las Convenciones de La Haya, incluidas aquellas relacionadas con la protección transfronteriza de menores, las relaciones familiares y patrimoniales de la familia, la cooperación jurídica y administrativa y el litigio internacional, y el derecho comercial y financiero internacional. La Oficina también fomentará la cooperación administrativa y judicial internacional a través de una mayor coordinación entre las Autoridades Centrales, jueces, funcionarios y otros profesionales involucrados en la aplicación de las Convenciones de La Haya; la facilitación del acceso a la información por parte de los Estados de la región; y el desarrollo y promoción del trabajo de la Conferencia de La Haya en idioma español. 3. El Gobierno de la República Argentina estará representado por el 'Ministerio de Relaciones Exteriores, Comercio Internacional y Culto. ARTÍCULO 2 La Conferencia de La Haya gozará de personalidad jurídica en la Argentina y, en especial, tendrá capacidad legal para: 1. Contratar. 2. Adquirir y vender bienes muebles e inmuebles. 3. Iniciar procedimientos legales.

10 ARTICULO 3 La Sede estará bajo la autoridad y responsabilidad de la Conferencia de La Haya. Sin embargo, le serán aplicables los reglamentos sanitarios y otras disposiciones legales pertinentes. ARTÍCULO 4 La Argentina no será responsable por actos u omisiones de la Conferencia de La Haya, o de cualquier persona que se encuentre trabajando para la Conferencia de La Haya. ARTÍCULO 5 1. En consulta con la Conferencia de La Haya, el Gobierno Argentino pondrá a disposición espacios de oficina y reuniones para el establecimiento de la Oficina Regional, incluyendo computadoras y equipos de teléfonos, y absorberá los costos relacionados con la instalación y operación de la Oficina, incluyendo gastos de comunicaciones resultantes del funcionamiento de la oficina, pero excluyendo los costos correspondientes al personal. A este fin, el Ministerio de Relaciones Exteriores, Comercio Internacional y Culto coordinará, en nombre del Gobierno Argentino, todas las cuestiones que pudieran surgir con respecto a la implementación del presente Acuerdo con la Conferencia de La Haya. 2. En materia de comunicaciones, la Argentina otorgará a la Conferencia de La Haya, así como a sus funcionarios y personal las facilidades previstas en el Artículo III de la Convención sobre Prerrogativas e Inmunidades de las Naciones Unidas de 13 de febrero de ARTÍCULO 6 1. La Conferencia de La Haya, sus bienes y haberes, cualquiera sea el lugar en el que se encuentren y quienquiera que los tenga en su poder, gozarán de inmunidad de toda forma de procedimiento judicial, en los términos del Artículo H, Sección 2 de la Convención sobre Prerrogativas e Inmunidades de las Naciones Unidas de 13 de febrero de 1946.

11 2. Los locales de las Oficinas serán inviolables. Sus bienes, fondos y haberes cualesquiera sea el lugar en que se encuentren, estarán exentos de registro, requisa, confiscación y secuestro, y no podrán ser expropiados salvo por causa de utilidad pública calificada por ley y previamente indemnizada. 3. Los archivos de las Oficinas y, en general, todos los documentos que le pertenezcan, serán inviolables. 4. Los fondos, haberes, ingresos y otros bienes de la Conferencia de La Haya estarán exentos de: (a) Todo impuesto directo. (b) Los derechos de aduana y las prohibiciones o restricciones sobre los artículos importados o exportados por la Conferencia de La Haya para el funcionamiento de su Oficina y para el cumplimiento de sus fines, conforme al procedimiento, modalidades y normativas establecidos a tal efecto por el Gobierno Argentino para los organismos internacionales del Sistema de Naciones Unidas. Los artículos importados con tal exención no se venderán ni se utilizarán con una finalidad comercial en el país, salvo en las condiciones expresamente convenidas con el Gobierno. (c) Los derechos de aduana y las prohibiciones y restricciones respecto de la importación y exportación de sus publicaciones. 5. La Conferencia de La Haya estará exenta del Impuesto al Valor Agregado que pesen sobre los bienes adquiridos en el país cuando efectúe compras importantes de bienes destinados a uso oficial. Las Partes, mediante acuerdo por escrito, acordarán el monto mínimo para considerar una compra como importante en los términos del presente párrafo. Dicho monto será igual al establecido para los organismos internacionales del Sistema de las Naciones Unidas. 6. La Conferencia de La Haya podrá: (a) Tener fondos o divisa corriente de cualquier clase y llevar sus cuentas en cualquier divisa. (b) Transferir sus fondos o divisa corriente de un país a otro o dentro del país, y convertir a cualquier otra divisa la divisa corriente que tenga en custodia.

12 (e) Abrir y mantener, de conformidad con las leyes y reglamentos vigentes en la Argentina, cuentas en moneda local o extranjera en entidades financieras públicas y / o privadas reguladas por el Banco Central de la República Argentina. 7. La Conferencia de La Haya podrá tomar funcionarios en comisión y pasantes según lo considere apropiado, aplicando las políticas, procedimientos y buenas prácticas de la Oficina Permanente en La Haya. ARTÍCULO 7 1. El Gobierno aplicará a los funcionarios que se desempeñen en la Oficina de la Conferencia de La Haya, siempre que no tengan nacionalidad argentina o residencia permanente en la República, las disposiciones de la Convención sobre Prerrogativas e Inmunidades de las Naciones Unidas de 13 de febrero de Los funcionarios de la Conferencia de La Haya que tengan nacionalidad argentina o residencia permanente en la República, gozarán exclusivamente de los siguientes privilegios e inmunidades: (a) Inmunidad de jurisdicción respecto de todos los actos realizados en el ejercicio oficial de sus funciones, e inherentes a las mismas. (b) Exención de impuestos sobre las retribuciones abonadas por la Conferencia de La Haya. 3. A los funcionarios de la Conferencia de La Haya que se encuentren en el país se les concederán, además, las facilidades y cortesías que sean necesarias para que puedan desempeñar eficazmente sus funciones. 4. Los mencionados privilegios, inmunidades y facilidades se conceden a los funcionarios de la Conferencia de La Haya en interés de la Conferencia de La Haya y no en beneficio personal. El Secretario General de la Conferencia de La Haya tendrá el derecho y el deber de renunciar a la inmunidad de cualquier funcionario de la Conferencia de La Haya cuando dicha inmunidad entorpezca la acción de la justicia o vaya en perjuicio de los intereses de la Conferencia de La Haya.

13 ARTÍCULO 8 Se concederán a los expertos que lleven a cabo misiones de la Conferencia de La Haya las facilidades, privilegios e inmunidades establecidos en el Artículo VI, Secciones 22 y 23 y en el Artículo Vil, Sección 26 de la Convención sobre Prerrogativas e Inmunidades de las Naciones Unidas de 13 de febrero de ARTÍCULO 9 1. Sin perjuicio de los privilegios, facilidades y cortesías previstos en el presente Acuerdo, todos los funcionarios de la Conferencia de La Haya y los expertos en misión, tienen el deber de observar las leyes y reglamentos vigentes en la Argentina y de no interferir en los asuntos internos del país. 2. La Conferencia de La Haya cooperará en todo momento con las autoridades argentinas para facilitar la adecuada administración de justicia, asegurar el respeto de las leyes y reglamentos de la República Argentina y prevenir cualquier abuso de los privilegios, inmunidades, facilidades y exenciones previstos en el presente Acuerdo. ARTÍCULO 10 Toda diferencia entre la República Argentina y la Conferencia de La Haya de Derecho Internacional Privado que se derive de la interpretación o aplicación del presente Acuerdo será resuelta mediante negociaciones directas entre las Partes. ARTÍCULO El presente Acuerdo entrará en vigor en la fecha que el Gobierno Argentino comunique a la Conferencia de La Haya la aprobación del mismo con arreglo a sus procedimientos constitucionales. 2. El presente Acuerdo podrá ser modificado por las Partes, mediante instrumento escrito. Las modificaciones acordadas entrarán en vigor mediante el procedimiento establecido en el párrafo 1.

14 3. Este Acuerdo podrá ser denunciado en cualquier momento por una de las Partes mediante comunicación escrita dirigida a la otra por la vía diplomática. La denuncia surtirá sus efectos al año de efectuada dicha comunicación. HECHO en Buenos Aires, a los siete días del mes de mayo del año dos mil diez, en dos ejemplares originales en español e inglés, ambos igualmente auténticos.
