Sudáfrica está dispuesta a asumir compromisos iniciales con arreglo al Acuerdo Marco sobre el Comercio de Servicios en los términos que se indican en el "Proyecto de lista ae compromisos iniciales"* que se adjunta. La presente oferta es condicional y Sudáfrica se reserva el derecho de modificarla, ampliarla, reducirla o retirarla en cualquier momento antes de que concluyan las negociaciones sobre servicios. En el proyecto de lista adjunto se presentan en primer lugar las medidas aplicables en forma horizontal. Luego sigue una descripción de las medidas adicionales aplicables a determinados sectores o subsectores y que podrían tener influencia en el acceso al mercado y/o en el trato nacional. Cuando la oferta consiste en consolidar el marco normativo vigente, se emplea el término Bound. Los modos de prestación, es decir, presencia comercial/derecho de establecimiento y movimiento dei personal y de los consumidores, se tratan en términos generales en la sección de la lista correspondiente a los aspectos o medidas aplicables a todos los sectores. Applicable to all sectors Institutional Arrangements Movement of factors of production Personnel and consumers Capital Commercial presence of the right of establishment as pertaining to the sectors/sub-sectors listed below, is subject to ths provisions of the South African Companies Act. Movement of personnel and consumers subject to South African immigration and work permit legislation, regulations and procedures. Entry into and residence in the national territory regulated by the Aliens Act (No. 1 of 1937). For employment in that territory work permit for non-resident persons required. Transfer of current and capital payments into/out of country for commercial purposes must be channelled through an authorized currency-dealing bank for statistical and taxation purposes,

3 Page 3 B. Sectoral Data Business and Professional Accountancy and Auditing Advertising Data processing Legislation applicable: Public Accountants and Auditors Act (No. 57 of 1951). Only persons registered with the Public Accountants' and Auditors' Board may practice as auditors. Only members of recognized professional bodies may perform duties of accounting officer to close corporations. Non-resident accountants and auditors may be registered with the Board only when the prescribed examinations in South Africa have been passed. Only persons permanently resident in the RSA may sit fur such examinations. (Exemption however, if similar approved examinations have been passed outside the RSA). Chartered Accountants Designation (Private) Act of 1927 rules that foreigners may become affiliate members of the SA Institute of Chartered Accountants for a term of residence in the RSA but may not practice except as an employee of a chartered accountant firm. Use of designations and initials of professional bodies reserved for their members.

4 Page 4 Legal services Admission of lawyers (advocates and attorneys) limited to persons having passed recognized examinations. (Practitioners must be conversant with particular legal system in place in the RSA, i.e. Roman Dutch Law. Market research services Surveying, mining and exploration services Construction/ Engineering Consultancy Some work is reserved exclusively for admitted lawyers (e.g. litigation, conveyancing, etc.). Requirements regarding registration and residence are also in force. Non-reserved work: Reciprocal rights of practice, e.g.international tax law and home country law, are acknowledged by RSA legislation.. Code of conduct of regulating organizations follows foreign codes closely.. Regulations in respect of legal registration of professional scientists and engineers (to pursue public safety and health as well as adequate standards of service) in place. on cross-border flow. A statutory body (the SA Council for Professional Engineers) monitors codes of conduct and protects public interest, i.a. on proficiency of engineers. Voluntary membership of a professional association promotes uninhibited rendering of such services.

Financial Banking and securities Deposit-taking Institutions Act, 1990 (Act 94 of 1990) ensures adherence by financial institutions to, and full disclosure of, legal requirements pertaining to such institution:.. Equitable (foreign/domestic) treatment of financial institutions in terms of establishment, shareholding and operations of subsidiaries is also ensured. Appropriate prudential requirements, based on inherent risks of the services and overseen by the SA Reserve Bank (for banks) and the Financial Board (for securities), have to be met. The RSA reserves the right to apply national financial stablilization measures. However, such safeguards follow the Basle Concordat principles. Membership of the Financial Markets is, in the case of natural persons, restricted to South African citizens, whilst corporate membership is unrestricted except in the case of Johannesburg Stock Exchange. Participation by non-residents in the futures market has been approved in principle and the rules of the futures exchange are currently being reviewed to permit such participation. Exchange control : Exchange control currently in place. Capital flows associated with cross-border banking services Laws and regulations with regard to both domestic and foreign controlled financial institutions uniformly applied in South Africa. Equal participation ensured regardless of origin or ownership of financial institutions.

Tourism Foreign stake in new insurance enterprises in South Africa determined by their financial strength, know-how and competitive ability. Movement of capital into South Africa not subject to restrictions, transfer of current and capital payments into/from country to be channelled through authorized currency-dealing banks. Countries within the Southern African Monetary Area (presently encompassing the RSA, Lesotho, Swaziland and Namibia) enjoy free access in each other's monetary and capital markets. Legislation is administered by the SA Tourism Board. Hotels Act (No. 70 of 1965) and related regulations provide for regulation control over grading and licensing of hotels. Tour Guides Act (No. 29 of 1978) and regulations provide for registration of tour guides. SA citizenship or possession of a permanent residence permit required for registration. Operations by tour operators regulated by Travel Agents and Travel Agencies Act (No. 58 of 1983). Insurance legislation accepts principle of foreign interest and participation in domestically operated insurance enterprizes. No other limitations
