1 CONVENIO DE INTERCAMBIO ESTUDIANTIL PARA LA COOPERACIÓN EDUCATIVA State University ofnew York at Plattsburgh, New York, Estados Unidos de América La Universidad de Guadalajara Guadalajara, Jalisco, México State University of New York, a través de su campus en Plattsburgh (SUNYP) y la Universidad de Guadalajara (UDEG), acuerdan implementar un Convenio de Intercambio Estudiantil que permita a los estudiantes de SUNYP estudiar en UDEG y estudiantes de UDEG estudiar en SUNYP, de acuerdo con los principios y lineamientos establecidos a continuación. El objetivo de este convenio es enriquecer la experiencia educativa y entendimiento cultural de los estudiantes y académicos involucrados. 1. El objetivo del intercambio es permitir a los estudiantes tomar clases, pero no estudiar con el objetivo de obtener un grado en la institución receptora. Los cursos aprobados en la institución receptora serán normalmente aceptados para la obtención de créditos con el objetivo de obtener un grado en la institución de origen en la cual el candidato está registrado. Será responsabilidad de cada participante en el programa de intercambio el obtener la aprobación oficial de su propia institución de los cursos que llevará en la institución receptora. 2. No están incluidos en el presente convenio los programas ofrecidos por el Centro de Estudios para Extranjeros y el Sistema Corporativo Proulex-Comlex, ambas empresas universitarias de la Universidad de Guadalajara. 3. Dentro del marco de este intercambio, "institución de origen" significará la institución en cual el estudiante esta formalmente inscrito como un candidato a la obtención de un grado, e "institución receptora" significará la institución que ha acordado recibir estudiantes de la institución de origen por un periodo de estudios en modalidad de no obtención de grado. 4. El año académico en el contexto de la institución receptora significa cualquier sesión académica identificada para la inscripción. Se les permitirá a los estudiantes participar en el intercambio durante los semestres de otoño y primavera, en UDEG, y durante el otoño, invierno y primavera en SUNYP.

2 5. La elegibilidad de admisión de los estudiantes participantes será examinada por la institución de origen. La institución de origen respetará los requisitos de admisión e inscripción de la institución receptora. Los participantes estarán sujetos a las reglas generales, regulaciones y restricciones de inscripción de la institución receptora en la selección de cursos. Esto incluye los requisitos de idioma. La institución receptora tendrá la autoridad final en la decisión de admisión. Las obligaciones de las dos instituciones está limitada a intercambiar únicamente estudiantes y no se extiende a sus cónyuges y dependientes. 6. En principio, en cualquier año, cada universidad podrá mandar 1 estudiante por un año académico ó 2 estudiantes por un semestre cada uno, ya sea de nivel de posgrado o pregrado. Sin embargo, este número puede variar en cualquier año, si es acordado por ambas instituciones, previendo que se obtenga un balance en los intercambios bajo los términos del convenio. El periodo normal de intercambio será de un semestre o un año académico. 7. El idioma de instrucción en UDEG es el español. Se acuerda que los estudiantes de SUNYP deben contar con un nivel competente de español para participar en el programa. El idioma de instrucción en SUNYP es el inglés. Se acuerda que los estudiantes de UDEG deben cumplir con los requisitos de idioma establecidos por SUNYP. 8. Ni SUNYP ni UDEG serán responsables por los costos de hospedaje, alimentos, viaje, u otro gasto personal (incluyendo libros). Las partes reconocen que solicitarán a los participantes el pago de estos costos. 9. La institución receptora asistirá a los estudiantes que reciben a asegurar hospedaje apropiado durante el periodo que participarán en el programa. 10. Cada institución tendrá el derecho de solicitar a los participantes contar con una cobertura de seguro aceptable. 11. Los participantes en el programa de intercambio estarán inscritos como estudiantes sin opción de grado en la institución receptora. 12. Los departamentos/divisiones involucradas en el intercambio en la institución de origen proveerán asesoría académica para asegurar que los cursos a llevar en la institución receptora son aceptables por la institución de origen. La institución receptora proveerá la descripción de los cursos y oferta académica para apoyar a la institución de origen en la evaluación de la equivalencia de los cursos. 13. Los participantes en el intercambio estarán regidos por los mismos reglamentos generales de desempeño propios a otros estudiantes en la institución receptora.

Los reportes de los logros académicos serán enviados a la institución de origen del estudiante al término de cada semestre, a más tardar a las 6 semanas posteriores al último día de evaluación final. En la mayoría de los casos serán los reportes de calificaciones, los cuales serán utilizados a discreción de la institución de origen. Los participantes en SUNYP podrán ser requeridos de pagar una cuota en la institución receptora por este servicio. 15. La institución receptora acuerda cumplir con sus responsabilidades bajo cualquier ley inmigratoria aplicable y asistir a los participantes, al máximo de sus posibilidades, a obtener sus visas y otros documentos requeridos por el gobierno del país receptor. 16. Consideraciones económicas intercambiadas entre las dos instituciones se limitarán a aquellas provistas en este convenio. No habrá reembolsos por los gastos, o cuotas compartidas o ingresos que surjan del intercambio, excepto a las provistas en el presente. 17. La institución receptora se reserva el derecho de solicitar la baja de cualquier estudiante cuyo desempeño académico o conducta justifique dicha acción. La institución receptora consultará a la institución de origen antes de finalizar tal acción. 18. Cada parte será responsable de cualquiera o toda responsabilidad, reclamo, pérdida, daño, demanda o juicio (y cualquiera y todos los costos y gastos incluyendo, pero no limitando a cuotas razonables de consultoría y pagos si fuesen impuestos por una corte de jurisdicción competente), que surjan directamente de los actos de la parte o su oficiales o empleados dentro de sus funciones como empleado. Tal responsabilidad no aplica a cualquier responsabilidad, reclamo, pérdida, daño, demanda o juicio que surja de los actos, u omisiones, por o en representación de una tercera parte, u oficiales de tal tercera parte, empleados o agentes. Ninguna de las partes será responsable hacia con la otra parte por daños especiales, indirectos, consecuenciales, punitivos, o daño ejemplar, incluyendo, pero no limitando a, pérdida de ganancias, sin importar la causa y sin importar si la parte ha sido notificada de la posibilidad de tales daños. Ninguna de las partes será responsable por los actos de la otra, ni por los actos de los participantes. 19. Nada en este convenio será utilizado para crear un derecho legal sobre cualquier participante o una tercera parte para implementar sus términos o sujetar a cualquiera de las partes a responsabilidad por cualquier fallo en el cumplimiento de los términos. 20. Ambas instituciones suscriben una política de igualdad de oportunidades y no discriminarán con base en la raza, género, orientación sexual, edad, estatus marital, etnicidad, religión, nacionalidad de origen o discapacidad.

4 21. Este convenio será efectivo por cinco años, del año académico 2010/11 hasta el año académico 2014/2015. Estará sujeto a revisión, modificación o renovación en cualquier momento mediante acuerdo mutuo por escrito. Cualquiera de las partes puede dar por cancelado este convenio por medio de una notificación escrita por lo menos con 90 días de anticipación al próximo semestre académico. La cancelación no afectará a los estudiantes que ya se encuentran comprometidos en el intercambio. Para SUNY - Plattsburgh: Nombre: Bryan R. Las personas que firman este Convenio en representación de UDEG y SUNY Plattsburgh declaran que están debidamente autorizadas para ello.

Universidad de Guadalajara Guadalajara, Jalisco, Mexico The State University of New York, through its Plattsburgh (SUNYP) campus and Universidad de Guadalajara (UDEG), agree to implement a Student Exchange Agreement to allow students from the SUNYP to study at UDEG and students from UDEG to study in SUNYP, in accordance with the principies and guidelines set forth below. The purpose of this agreement is to enhance the educational experiences and the cultural understanding ofthe involved students and faculty. 1. The purpose of the exchange is to enable students to take classes but not to study for a degree at the host institution. Courses passed at the host institution will normally be accepted for credit towards the degree at the candidate's home institution of which he or she is enrolled. It will be the responsibility of each participant in the exchange program to obtain official approval from her/his own institution for courses taken at the host institution. 2. The academic extension programs ofthe UDEG offered by its institutional enterprises, the Centro de Estudios para Extranjeros (CEPE) and the Sistema Corporativo PROULEX - COMLEX are not included in this agreement. 3. Within the framework of this exchange, "home university" will mean the institution in which a student is formally enrolled as a degree candidate, and "host university" will mean the institution that has agreed to receive students from the home institution for a period of study on a non-degree basis. 4. Academic year in the context of the host institution means any academic session identified for enrollment. Students will be allowed to participate in the exchange during fall and spring semesters, at UDEG, and during the fall, winter and spring semesters at SUNYP.

6 5. Student participants will be screened for eligibility for admission by the home institution. The home institution shall respect the admission requirements and enrollment constraints of the host institution. Participants will be subject to the standard rules, regulations, and enrollment constraints ofthe host university in the selection of courses. This inciudes requirements of language proficiency. The host institution shall have final authority on admission decisions. The obligations of the two institutions under this agreement are limited to exchange students only and do not extend to spouses and dependents. 6. In principie, in any given year, each university may send 1 student for one academic year or 2 students for one semester each, at either the graduate or undergraduate leve!. However, this number may vary in any given year, if agreeable to both institutions, provided a balance of exchanges is obtained over the terms of the agreement. The normal exchange period shall be one semester or one year. 7. The language of instruction at UDEG is Spanish. It is agreed that students fram SUNYP must be proficient in Spanish to participate in the programo The language of instruction at SUNYP is English. It is agreed that students from UDEG must meet the language requirements established by SUNYP. 8. Neither SUNYP nor UDEG will be responsible for the costs of room, board, travel, or other personal expenses (inciuding books). The parties acknowledge that they will require the participants to pay these costs. 9. The host university will assist arriving students to secure suitable housing for the period of time that they will be in the programo 10. Each institution shall have the right to requlre that participants obtain acceptable 1l1surance coverage. 11. Participants in the exchange program will be enrolled as non-degree students at the host institution. 12. The departments/divisions involved in the exchange at the home institution will provide academic counseling to ensure that the academic courses taken at the host institution are acceptable to the home institution. The host institution will provide course descriptions and syllabi to aid the home university in course equivalency evaluation. 13. Participants in the exchange will be governed by the same regulations and performance standards that pertain to other students at the host university. 14. Academic achievement reports will be sent to the student's home university at the conciusion of each semester, not later than six weeks after the last day of final examinations. In most cases, this will be university transcripts, used at the discretion of the home institution. Participants at SUNYP may be asked to pay afee to the host university for this service.

The host institution agrees to fulfill its responsibilities under any applicable immigration laws and assist participants, to the fullest extent possible, in obtaining visas and other documents required by the government ofthe host country. 16. Monetary consideration exchanged between the two institutions will be limited to that provided for in this agreement. There shall be no reimbursements for expenses, or sharing of fees or revenues arising from the exchange, except as provided for herein. 17. The host institution reserves the right to require the withdrawal of any student whose academic standing or conduct warrants such action. The host institution will consult with the home institution before finalizing such action. 18. Each party shall be responsible for any and all liability, claim, loss, damage, suit or judgment (and any and all costs and expenses including but not limited to reasonable counsel fees and disbursements if assessed by a court of competent jurisdiction), arising directly out of the acts of that party or its officers or employees acting within the scope of their employment. Such responsibility does not apply to any liability, claim, damage, suit or judgment arising from acts done, or omissions made, by or on behalf of any third party, or such third party's officers, employees or agents. Neither party shall be liable to the other for special, indirect, consequential, punitive, or exemplary damages, including, but not limited to, loss of profits, regardless of cause and regardless of whether that party has been notified of the possibility of such damages. Neither party shall be liable for the acts of the other, nor shall they be liable for the acts of participants. 19. Nothing in this agreement shall be construed to create a legal right in any participant or other third party to enforce its terms or to subject either party to liability for any failure to comply with its terms. 20. Both institutions subscribe to a policy of equal opportunity and will not discriminate on the basis of race, gender, sexual orientation, age, marital status, ethnicity, religion, national origin, or handicap. 21. This agreement shall be effective for five years, from the 2010/11 academic year through the 2014/15 academic year. It shall be subject to revision, modification or renewal at any time by mutual written agreement. Either party may terminate the agreement by written notice submitted at least 90 days in advance of the next academic semester. Termination would not affect students airead y engaged in the linkage.
