1 RESOLUTION AND ORDER FOR SPECIAL CITY ELECTION WHEREAS, pursuant to the provisions of Chapter 1, Article IV, Section 2 of the Lubbock City Charter, on April 25, 2013, affidavits were filed with the City Secretary's Office by Mr. Ysidro Gutierrez, Mr. Frank Gutierrez, Mr. Leonard Mojica, and Mr. Steve Montcreif seeking a petition to remove Victor Hernandez from the office of District 1 Councilperson; and WHEREAS, said affiants did thereafter within the time limit prescribed by the Lubbock City Charter file with the City a petition supporting the recall of Victor Hernandez from the office of District 1 Councilperson; and WHEREAS, sufficient signatures upon said petition were validated by the City Secretary to submit the recall of the District 1 Councilperson to the qualified voters of District 1; and WHEREAS, Chapter 1, Article IV, Section 2 of the Lubbock City Charter requires that the City Council order and fix a day for holding a recall election in a special election, which pursuant to the Texas Election Code, shall be held at the next available uniform election date on November 5, 2013; NOW THEREFORE: BE IT RESOLVED AND ORDERED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT a Special City Election of the City of Lubbock is hereby ordered to be conducted on November 5, 2013, under the applicable provisions of the Texas Election Code, the Lubbock City Charter and City Ordinances for the purpose of submitting the recall of the District 1 Councilperson to the qualified voters of District 1. SECTION 2. THAT official ballots for the election shall be prepared in accordance with the Texas ElectionCode so as to permit the qualified voters in District 1 of the City to vote for or against the recall of the District 1 Councilperson with the ballots to contain such provisions, markings, and language required by law, and with such measure to be expressed substantially as follows BALLOT MEASURE DISTRICT 1 SHALL VICTOR HERNANDEZ BE REMOVED FROM THE OFFICE OF DISTRICT 1 COUNCILPERSON BY RECALL? FOR: AGAINST: SECTION 3. THAT said City special election shall be held at the places in the City of Lubbock hereinafter designated as voting precincts and in the voting places designated in Exhibit A hereto. Voting places shall be open from 7:00 a.m. to 7:00 p.m., and all voters shall vote in the precinct of their residence unless such precinct shall be consolidated with another precinct as indicated in Exhibit A. SECTION 4. THAT an accessible electronic voting system shall be used for this election, including early voting. At least one accessible voting device approved and certified by the Texas Secretary of State shall be provided in each polling place and in every polling location used to conduct said City special election. Said approved and certified accessible electronic voting system shall be supplied for said City special election by Lubbock County, acting by and

2 through its Elections Administrator. The sealed ballot box procedure established by Subchapter C, Chapter 127, Texas Election Code, shall be used for this election. SECTION 5. THAT the persons named in Exhibit A hereto are hereby appointed Judges and Alternate Judges to conduct said Special City Election on November 5, In the event any named person is unable to serve for any reason, the city secretary of the City of Lubbock is hereby authorized and directed to make such substitutions as may be required and to amend Exhibit A hereto as required. Each presiding judge so named is authorized to appoint the number of clerks authorized by the city secretary of the City of Lubbock, which number shall not be less than two (2) clerks nor more than six (6) clerks. The alternate judges shall serve as presiding judges in the event that the regularly appointed presiding judge is unable to serve. The alternate judges shall be appointed by the presiding judge to serve as one of the clerks in the event that the regularly appointed presiding judge conducts the election. SECTION 6. THAT early voting by personal appearance shall commence on the 21 st day of October, 2013, and end on the 1 st day of November, Said early voting shall be conducted at the locations, days and hours indicated on Exhibit B hereto. SECTION 7. THAT the Mayor, assisted by the City Secretary, is hereby authorized and directed to give notice of the Special City Election as required by law. SECTION 8. THAT the city secretary of the City of Lubbock is hereby ordered to cause publication of this Resolution ordering the Special City Election in a newspaper of general circulation at least once no earlier than the 30 th day nor later than the 10 th day before election day. In addition, a copy of this Resolution shall be posted not later than the 21 st day before election day on the bulletin board used for posting notices of meetings of the governing body and a notice of consolidation shall be posted not less than 20 days before election day at any polling places not consolidated at the last previous election, which notice shall indicate the precinct of consolidation and the location of the new polling place. SECTION 9. THAT the city secretary shall serve a duly certified copy of the Resolution and Election Notice upon each of the presiding judges named in Exhibit A not later than the seventh day after the signing of this Resolution or the 15 th day before election day, whichever is later. In addition, the City Secretary shall deliver a certified copy of this Resolution and the Election Notice on the County Clerk not later than the 60 th day before election day. SECTION 10. THAT this Resolution shall become effective upon final passage by the City Council of the City of Lubbock. 3 RESOLUCIÓN Y ORDEN DE ELECCIONES MUNICIPALES ESPECIALES POR CUANTO, de conformidad con las disposiciones del Capítulo 1, Artículo IV, Sección 2 de la Carta Constitucional de la Ciudad de Lubbock, el 25 de abril de 2013 los Sres. Ysidro Gutierrez, Frank Gutierrez, Leonard Mojica y Steve Montcreif presentaron declaraciones ante la Oficina de la Secretaria municipal, pidiendo la destitución de Víctor Hernandez del cargo de Concejal del Distrito 1; y POR CUANTO, dichos declarantes posteriormente, y dentro del plazo límite prescrito por la Carta Constitucional de la Ciudad de Lubbock, presentaron ante la Ciudad una petición en apoyo de la destitución de Víctor Hernandez del cargo de Concejal del Distrito 1; y POR CUANTO, el suficiente número de firmas en dicha petición fueron validadas por la Secretaria municipal para presentar ante los votantes cualificados del Distrito 1 la propuesta de destitución del Concejal del Distrito 1; y POR CUANTO, el Capítulo 1, Artículo IV, Sección 2 de la Carta Constitucional de la Ciudad de Lubbock requiere que el Concejo Municipal ordene y fije un día para celebrar elecciones especiales de revisión, las cuales tendrán lugar el 5 de noviembre de 2013, fecha más próxima para la celebración de elecciones uniformes, de conformidad con el Código Electoral de Texas; AHORA POR LO TANTO: EL CONCEJO MUNICIPAL DE LA CIUDAD DE LUBBOCK RESUELVE Y ORDENA: SECCIÓN 1. QUE mediante la presente, se ordena la celebración de Elecciones Especiales Municipales de la Ciudad de Lubbock el día 5 de noviembre de 2013, de conformidad con las disposiciones del Código Electoral de Texas, la Carta Constitucional de la Ciudad de Lubbock y las Ordenanzas Municipales, con el fin de presentar ante los votantes cualificados del Distrito 1 la propuesta de destitución del Concejal del Distrito 1. SECCIÓN 2. QUE se prepararán boletas oficiales para las elecciones de conformidad con el Código Electoral de Texas para que los votantes cualificados del Distrito 1 de la Ciudad voten a favor o en contra de la destitución del Concejal del Distrito 1, y tales boletas incluirán las disposiciones, anotaciones y lenguaje exigido por la ley y cuya propuesta se expresará esencialmente de la siguiente manera: PROPUESTA DE BOLETA DEL DISTRITO 1 DEBERÁ SER QUITADO VICTOR HERNANDEZ DEL CARGO DE CONCEJAL DEL DISTRITO 1, POR ELECCIÓN DE REVISIÓN? A FAVOR: EN CONTRA: SECCIÓN 3. QUE dichas elecciones municipales especiales se celebrarán en la Ciudad de Lubbock en los lugares designados más adelante como circunscripciones electorales y en los centros electorales designados en el Anexo A adjunto. Los centros electorales permanecerán abiertos desde las 7:00 de la mañana hasta las 7:00 de la tarde, y todos los electores votarán en la circunscripción correspondiente a su lugar de residencia, a menos que dicha circunscripción haya quedado consolidada con otra circunscripción como se establece en el Anexo A.

4 SECCIÓN 4. QUE se utilizará en estas elecciones un sistema accesible de votación electrónica, incluso durante la votación adelantada. Cada uno de los lugares y centros electorales contará con, al menos, una unidad accesible de votación electrónica, aprobada y certificada por el Secretario de Estado de Texas, para ser utilizada en dichas elecciones municipales especiales. El Condado de Lubbock, en nombre y en representación del Administrador electoral, proporcionará dicho sistema accesible de votación electrónica aprobado y certificado para las elecciones municipales especiales. En estas elecciones se utilizará el procedimiento de cajas electorales selladas establecido en el Capítulo 127, Subcapítulo C, del Código Electoral de Texas. SECCIÓN 5. QUE las personas nombradas más adelante en el Anexo A quedan mediante este documento designadas como Jueces y Jueces Suplentes para llevar a cabo las Elecciones municipales especiales el 5 de noviembre de En el caso de que cualquiera de las personas nombradas no pueda servir por algún motivo, la Secretaria municipal de la Ciudad de Lubbock queda mediante este documento autorizada y podrá hacer las sustituciones que sean necesarias y enmendar el Anexo A adjunto, si así fuera necesario. Cada uno de los jueces presidentes así nombrados está autorizado para nombrar un número de secretarios autorizados por la Secretaria municipal de la Ciudad de Lubbock. Dicho número no será inferior a dos (2) secretarios, ni superior a seis (6). Los jueces suplentes ejercerán como jueces presidentes en el caso de que el juez presidente nombrado no pueda ejercer dicha función. El juez suplente será nombrado por el juez presidente para servir como secretario en el caso de que la elección la lleve a cabo el juez presidente nombrado. SECCIÓN 6. QUE la votación adelantada en persona comenzará el día 21 de octubre de 2013 y terminará el día 1 de noviembre de Dicha votación adelantada se llevará a cabo en los lugares, días y horas indicados en el Anexo B adjunto. SECCIÓN 7. QUE el Alcalde, con la asistencia de la Secretaria municipal, queda mediante este documento autorizado y encargado de anunciar las Elecciones municipales especiales, como lo requiere la ley. SECCIÓN 8. QUE se ordena a la Secretaria municipal de la Ciudad de Lubbock la publicación de esta Resolución, que ordena las Elecciones municipales especiales, en un periódico de circulación general al menos una vez en fecha no anterior a 30 días ni posterior a 10 días antes del día de las elecciones. Además, una copia de esta Resolución será colocada en fecha no posterior a 21 días antes del día de las elecciones, en el tablero de anuncios utilizado para la colocación de avisos de reuniones del cuerpo directivo y un aviso de consolidación quedará anunciado antes del día de las elecciones en los centros electorales no consolidados en las últimas elecciones. Dicho anuncio indicará la consolidación de circunscripciones y el lugar del nuevo centro electoral. SECCIÓN 9. QUE la Secretaria municipal presentará una copia debidamente certificada de esta Resolución y Aviso de Elecciones a cada uno de los jueces presidentes nombrados en el Anexo A, en los siete días siguientes a la fecha de la firma de esta Resolución, o 15 días antes de la fecha de las elecciones, lo que se produzca más tarde. Además, la Secretaria municipal entregará una copia certificada de esta Resolución y del Aviso de Elecciones al Actuario del Condado, en fecha no posterior a 60 días antes de la fecha de las elecciones. SECCIÓN 10. QUE esta Resolución entrará en vigor una vez aprobada por el Concejo Municipal de la Ciudad de Lubbock.
