We look forward to meeting with you in person and helping you with the procedures to obtain an immigrant visa. The following page is a checklist of all necessary documents for your use. Refer to the accompanying notes for a detailed description of each document and suggestions as to how to obtain it. If you are missing documents when you come to the Embassy for your interview, the processing of your case will be significantly delayed and you will not receive a visa until the documents are processed. Note that no one can assure you in advance that the visa will be issued. The approved immigrant petition does not mean that a visa will automatically be issued. An approved immigrant visa petition signifies that the applicant has demonstrated a relationship with an American citizen or legal permanent resident that qualifies the applicant to apply for an immigrant visa. It is the purpose of the visa interview to determine whether the applicant is eligible under U.S. law to receive the visa. In certain circumstances the visas cannot be printed the following day. Therefore, do not make plans to depart Honduras or buy plane tickets before your visa is issued.

2 Checklist of Required Documents Please see the following pages for further descriptions of the documents and suggestions as to how to obtain these necessary documents. Required Documents 1. Police certificate issued by the Dirección Nacional de Investigación Criminal (DNIC) Description of Required Documents Note that original documents (whether Honduran or American) are required. If you wish to keep the original, please bring the original along with a copy and the original will be returned to you during the interview. 1. Passports: Please make sure that there are no errors in your passport: check your name, date of birth, etc. 2. Photos: Two photographs 2 x 2 size photo. Birth, Death and Marriage Certificate(s): All Honduran birth, and marriage certificates (Expediente de Vida) must be in original issued by the Civil Registry Office Registro Nacional de las Personas in the long format known as the forma literal See sample Short forms of any of these documents will not be accepted and will result in delaying your case. Death certificate are only issued in short form, and will be acceptable. Birth certificates are required for: All beneficiaries, In the case of step-relationships, the biological parent of the beneficiary. 5. Divorce decree(s): If you, your petitioner, or your biological parent were divorced: Honduran decrees you should bring the divorce decree from the Honduran Court Juzgado de Familia, and the Constancia de Divorcio from the Registro Nacional de Personas. Decrees issued in countries other than Honduras must have an apostille: 28 For the US divorce you can bring the original and a copy, a certified copy by the US Court, or have it apostilled. 6. Form DS-260 (the application): All questions must be answered. Each applicant must complete a separate form. Please do not sign them. You can obtain the form DS-260 at the website I-864 Affidavit of Support: The Affidavit of Support from your petitioner must be signed. If your petitioner or joint sponsor (if applicable) is relying on a household member, (HHM) form I-864A must be included as well. To find out whether an HHM s income will be necessary, please consult the I-864P. All forms are available at (click on FORMS)

4 You must also include: A copy of the petitioner s tax return (form 1040) from the last year. If applicable, a copy of the joint sponsor s 1040 form of any applicable HHMs, and, and If applicable, a copy of the passport or legal permanent residence cards of any joint sponsors and HHMs. I-864W for minor (18 years old) biological son/daughter of a US Citizen 9. Evidence of your relationship with the petitioner and between family members: You should be prepared to provide evidence, in addition to your birth or marriage certificate, of your relationship with the petitioner. Such evidence includes (Please see the attached sheet for other examples of evidence of relationship): Photos of the applicant and petitioner together in the past. In the case of step-relationships, include photos from the past of: The applicant and biological parent together and the biological parent and the petitioner together. If the applicant s children are also applying, include photos from the past of: the applicant with his/her children at different ages. 10. Medical Exam: Please see attached page. 11. Fees: All beneficiaries need to pay the Immigrant fee with the National Visa Center (NVC). If not, you must pay in cash $230 in U.S. dollars or the equivalent in Lempiras at the US Consulate Cashier for each beneficiary at the time of the interview. There are no refunds of the visa application fee. 13. Police Certificate: All Honduran, the Antecedentes Penales document should be provided by Dirección Nacional de Investigación Criminal in Comayaguela only, and not from the Juzgado or any other city. If applicable provide the police certificate for: The country of nationality, The country of the applicant s residence at the time of visa interview, and Any other country in which the applicant has resided for one year or more.

5 Police certificates are not required for children under 16. If the beneficiary is between 16 and 17 years old, the presence of the parent will be required, with an identification card, an original and copy, the beneficiary s birth certificate proving that the parent is indeed the biological parent. Please note: that police certificates only have a validity of six months and it is only accepted from Comayagüela, and not from other Honduras cities. The beneficiary will have to bring a new police certificate to the interview, even if one has already been submitted to the National Visa Center.

6 EVIDENCE OF RELATIONSHIP Unfortunately, many documents from the Civil Registry, such as marriage and birth certificates, are not always reliable. Therefore, we need additional evidence of your relationship with the person who filed the petition for you. We are far more likely to issue your visa on the day of the interview if you bring us evidence of this relationship. While it is not required, it is helpful to have both the petitioner and applicant at the interview. Examples of evidence of relationship include the originals of the following documents: If your petition is based upon a MARRIAGE or FIANCE relationship: Birth certificates of children you have together Photos of you and your spouse/fiancé at different stages of your relationship Photos of your marriage ceremony Receipts from money sent to you by your spouse/fiancé Letters exchanged between you and your spouse/ fiancé If your petition is based upon a PARENT/CHILD or SIBLING relationship (with the petitioner or the biological parent in the case of a step-relationship): Family photos with applicant and petitioner at different ages, especially before the petitioner left Honduras The yellow birth registration card issued when the birth was registered Letters exchanged between applicant and petitioner Vaccination/growth certificate Anything else you think might be helpful. Remember, we want to work with you to help you start your new life in the United States.

7 GENETIC (DNA) TESTING In order to qualify for certain classes of visas, an applicant is required to demonstrate to the Consular Officer that he or she has a particular family or blood relationship to the Petitioner. We have carefully considered the evidence presented in your case and have concluded that you have not demonstrated the necessary relationship. One way to demonstrate this relationship is through DNA testing. If you elect to seek DNA testing, you must follow the procedures outlined here. Information for Petitioners residing in the United States The Petitioner must schedule a DNA test appointment with a laboratory that is approved by the American Association of Blood Banks (AABB). A list of AABB-approved laboratories can be found Most of these laboratories are in the United States, although there are also labs in the following countries: Canada, the Dominican Republic and Great Britain. Information for Petitioners Residing in Honduras Petitioners residing in Honduras must choose an AABB lab in the United States (as previously detailed) and then have a DNA test kit sent to the American Embassy in Honduras. A list of AABB-approved laboratories can be found at Then, both the Petitioner and the Beneficiary may request to schedule a DNA test appointment at the U.S. Embassy in Honduras, if they have an address and tracking number of the DNA kit delivered to the Embassy at the link at the top of this page. Once the samples are taken the samples will be sent to the United States AABB Clinic for analysis. Petitioners must request that the selected laboratory in the U.S. send a collection kit for each Beneficiary directly to the following address: American Embassy Consular Section/DNA Specialist Ave La Paz, Tegucigalpa, Honduras Information for the Beneficiary in Honduras Beneficiaries must send an to the American Embassy DNA Account tggdna@state.gov to schedule an appointment. We may take a few weeks to answer your and confirm the appointment. Beneficiaries will be contacted by the American Embassy to schedule an appointment, or if they have an address and the tracking number of the DNA kit that was delivered to the Embassy they can request an appointment at the link at the top of this page. On the appointment day, the Beneficiary must appear in person with two color passport photographs (2"x2"), a valid passport and a photocopy, an address of the petitioner in the United States. Failure to produce satisfactory documentation will result in delays. The Beneficiary must pay a fee in cash (exact change) to the laboratory at the U.S. Embassy at the time of sample collection. The current fee per applicant is US$ 21, or its equivalent in Lempiras.

8 The Petitioner must also check with the laboratory to ensure that a pre-paid envelope is included with the kit. Otherwise, the Beneficiary should provide a pre-paid courier delivery envelope addressed to the selected U.S. laboratory. This envelope will be used to send the Beneficiary's sample for comparison with the Petitioner's sample. Beneficiaries can acquire pre-paid courier deliver envelopes at FedEx, DHL, etc. What Happens Next? If the genetic test results support the claimed relationship, the Consular Section will notify the Beneficiary of the positive results and remind the Beneficiary to complete any pending documentation. If there is no documentation pending, an immigrant visa will be issued. If the genetic test results indicate the claimed relationship does not exist, the petition will be returned to the Department of Homeland Security accompanied by a recommendation by the Consular Section that the petition be revoked. The case will be closed and no further documents or evidence will be accepted by the Embassy. The Consular Section will then notify the Beneficiary with news of the petition's revocation. Important things to Remember about DNA Testing Genetic testing is voluntary; you choose whether or not to do it; The Embassy will only accept results collected from the buccal (oral) swab DNA testing method. This method (removing a small amount of genetic material from the inside of the mouth) is simple, clean, and non-invasive. The cost of testing and all expenses relating to testing (such as doctors' fees, mailing fees, AABB-approved laboratory fees, etc.) are the responsibility of the Petitioner and Beneficiary and must be paid in advance; The Embassy has no role in setting these costs and will not intervene with any laboratory to seek any adjustments in costs; The Embassy does not provide refunds for unused DNA kits nor does it participate in any way in the financial transactions required for DNA testing; For purposes of visa issuance, the Embassy will only accept original genetic test results that have been sent to the Embassy directly by the laboratory conducting the test. This is to ensure all necessary safeguards in conformity with U.S. visa regulations are followed; The Embassy does not assume responsibility for the professional caliber or practice of any of the AABB (American Association of Blood Banks) accredited parentage testing laboratories; Submitting to testing in no way guarantees the subsequent issuance of an immigrant visa; and while the genetic test is pending, all other investigations related to the case will be suspended until the testing process is completed; Petitions returned to the Department of Homeland Security in the United States based on negative results may be revoked or denied by the DHS. The Embassy reminds all applicants that penalties exist for making false statements in the filing of immigrant visa applications.

9 INSTRUCTIONS FOR MEDICAL EXAMINATION Each Immigrant Visa applicant, including children of any age, must undergo a medical examination. All Immigrant Visa applicants must present completed medical exams in a sealed envelope at the time of their immigrant visa interview. Applicants who appear for their interview without medical exam results will be asked to reschedule their Immigrant Visa appointment. Do not open this envelope under any circumstance. Please note that all applicants between two and 14 years of age are now required to take a tuberculin skin test (PPD test) at least four days prior to their Immigrant Visa appointment. The PPD test results must be reviewed by a panel physician hours after the skin test s administration, and in some cases children may need follow-up chest X-rays. As a result, these applicants should plan to have their medical exam in Tegucigalpa at least four days prior to their Immigrant Visa interview. You may select any one of the doctors listed below; they all charge the same price. Each applicant must present to the examining physician: 1. Passport. Please make sure that the name, date of birth, sex and expiration date shown on your passport are correct before taking your medical examination. 2. Photograph, ID size 3. Vaccination card. Please make sure it is current. U.S. law requires certain vaccinations depending on the age and sex of the applicant. Be aware that if you cannot provide a current vaccination card to the physician, you will be required to pay for all of the required vaccinations again. The medical examination is generally valid for 6 months, but those with certain medical conditions will have validities of only 3 months. You will have to repeat your medical examination if: you do not complete the visa process before your medical examination expires, or you change your passport after you have undergone your medical examination. The medical examination is valid for six months, or three months for those with certain medical conditions. Los resultados de la prueba tienen que ser examinados por un medico aprobado de la Embajada adentro de horas después del examen, y en ciertos casos los niños necesitan de tomar una radiografía de Tórax. Para este procedimiento estos solicitantes deberán realizar sus exámenes médicos en Tegucigalpa por lo menos 4 días antes de sus entrevistas. Cada solicitante deberá presentar lo siguiente al momento de ser examinado: 1. Pasaporte: Asegúrese de corregir el nombre, fecha de nacimiento, sexo, y vigencia del pasaporte antes de someterse a los exámenes. 2. Fotografía: tamaño carné 3. Carné de vacunas: Asegúrese de que la tarjeta de vacunas esta actualizado. Las leyes de los Estados Unidos requieren vacunas que dependen de la edad y sexo del solicitante. Tome nota que si usted no puede proporcionar una tarjeta de vacuna completa al doctor o la doctora, usted tendrá que cancelar el pago de todas las vacunas nuevamente.

11 Cuando se presente al Consulado Americano para su entrevista, presente los resultados de su examen médico en el sobre sellado que le entregue el doctor o la doctora. Nadie puede asegurarle con anticipación que su visa será otorgada. La petición aprobada no significa que su visa será otorgada automáticamente. Una petición aprobada significa que el beneficiario ha demostrado una relación apropiada con el ciudadano americano o Residente y que esto califica al beneficiario para solicitar una visa de residencia. El propósito de la entrevista es verificar si el beneficiario es elegible o no para recibir una visa de acuerdo a las leyes de los Estados Unidos. Por favor no haga planes para viajar fuera de Honduras y no compré boletos de avión hasta que su visa haya sido otorgada. Cuando reciba su visa, el solicitante tendrá seis meses para viajar a los Estados Unidos. En ciertas circunstancias las visas no pueden ser emitidas al día siguiente. 14 Vida), deben ser en forma original y deben ser emitidos por la oficina Civil del Registro Nacional de las Personas en la forma larga conocida como forma literal ver ejemplo en el enlace Formas cortas de cualquiera de estos documentos no son aceptadas y causan atraso en el proceso. Solamente se aceptan en forma cortas los certificados de defunción. Partidas de nacimiento son requeridas para: Todos los beneficiarios En el caso de padrastro o madrastra, será de los padres biológicos del beneficiario. 5. Decreto de Divorcio: Si usted, el peticionario o sus padres biológicos están divorciados: En el caso de los divorcios emitidos en Honduras, deberá presentar el Certificado de Divorcio del Juzgado de la Familia de la Corte y la Constancia de Divorcio emitida por el Registro Nacional de las Personas en original. Decretos de divorcios emitidos en otros países que no sean Honduras deberán apostillados: 28 En el caso de los divorcios en los Estados Unidos puede presentar los originales, copias certificados por una Corte de los Estados Unidos o apostillarlos. Si usted desea mantener los originales, presenté una copia para que sean devueltos al momento de la entrevista 6. Formulario DS-260: Conteste todas las preguntas en los formularios. Cada beneficiario debe de completar estas formas. Usted puede obtener la forma en la página Carta de Sostenimiento (Forma I-864): Este formulario y la documentación suplementaria debe ser firmada por el peticionario o co-aval (si aplica). Si se está contando con los ingresos de un miembro de la casa, entregué la Forma I-864A. Para saber si los ingresos del miembro de la casa son necesarios consulte la forma I-864P al ingresar a la página (click on FORMS) Usted deberá incluir:

15 Copia del último año del impuesto del peticionario (forma 1040) Copia del pasaporte estadounidense o tarjeta de residencia. I-864W: beneficiaros menores de 18 años hijos/hijas biológicos de ciudadanos americanos. 9. Prueba de relación con el peticionario y entre los miembros de su familia: Usted deberá de prepararse para presentar prueba de relación, además de su partida de nacimiento y el certificado de matrimonio. Prueba de relación junto con el peticionario como fotos del pasado: Beneficiario y peticionario juntos Si el peticionario es el padrastro/madrastra debe de incluir fotos entre: El beneficiario con el padre/madre biológico(a) juntos Del padre/madre biológico(a) con el peticionario Y si están aplicando los hijos del beneficiario principal entonces de todos los beneficiaros juntos con fotos que incluya de diferentes edades. 10. Examen Médico: Ver el instructivo adjunto 11. Costos: Todos los beneficiarios deben de realizar el pago de la entrevista para Visa de Inmigrante con el Centro Nacional de Visas (NVC). Sino, entonces usted deberá pagar en la Caja del Consulado al momento de la entrevista la suma de $230 dólares o su equivalente en Lempiras, por cada beneficiario. Este pago no es reembolsable. 10. Certificado de Antecedentes Policiales: Si es hondureña (o), el certificado de antecedentes policiales debe de ser de la Dirección Nacional de Investigación Criminal (DNIC) en Comayagüela solamente, y no del Juzgado o de cualquier otra ciudad. Solo si aplica, presente un certificado de antecedentes: Del país de origen del beneficiario (en el caso que sea de otro país) Del país a donde tenga fijada su residencia al momento de aplicar para la visa De cualquier otro país en donde el beneficiario haya vivido por un año o más de un año. No es requerido para menores de 16 años. Si el beneficiario tiene entre 16 y 17 años, se requiere la presencia de uno de los padres biológicos y deberá de presentar copia de la identidad, y partida de nacimiento que pruebe que son hijos biológicos.

Para hacer el trámite deberá pagar L. 200 y presentar su tarjeta de Identidad (original y copia). Si se venció el documento, el beneficiario deberá de presentar una nueva a la entrevista aunque haya enviado uno al Centro Nacional de Visas.

17 PRUEBAS DE RELACION Desafortunadamente, algunos documentos que presentan los beneficiarios al momento de la entrevista como ser certificados de matrimonio y nacimiento, no son confiables. Por lo que, se necesita evidencia adicional con el fin de procesar su aplicación para una visa de inmigrante, por favor presente prueba convincente de relación entre usted y su cónyuge. Aunque no es un requisito, es recomendable que tanto el peticionario como el beneficiario estén presentes durante la entrevista. Presente cualquier documento en original que usted considere necesario para establecer dicha relación. Algunos ejemplos se incluyen: Si su petición es basada en una relación de MATRIMONIO o PROMETIDO(A): Certificados de nacimiento de hijos dentro del matrimonio Fotografías de usted y su cónyuge/prometido(a) de diferentes etapas de la relación. 18 PRUEBA GENETICA ADN Para calificar para algunas categorías de visas, se requiere que el solicitante le demuestre al Oficial Consular que él o ella tenga una relación familiar o consanguínea con el Peticionario. Hemos revisado completamente la evidencia que usted presentó en su caso y hemos concluido que no ha demostrado la prueba de relación familiar necesaria. Una opción es hacerse la prueba de ADN. Si usted escoge hacerse la prueba de ADN, debe seguir el procedimiento que se describe a continuación. Información para el Peticionario que Reside en los Estados Unidos El peticionario debe programar una cita para la toma de muestra con un laboratorio aprobado por la Asociación Americana de Bancos de Sangre (AABB, por sus siglas en inglés). Una lista de los laboratorios aprobados por la AABB puede encontrarse en La mayoría de estos laboratorios se encuentran en los Estados Unidos, pero también existen laboratorios en los siguientes países: Canadá, República Dominicana y Gran Bretaña. Información para el Peticionario que Reside en Honduras Los peticionarios que residen en Honduras deben escoger un laboratorio de la AABB en los Estados Unidos (información anteriormente detallada), el laboratorio envía el estuche de recolección de ADN directamente a la Embajada de los Estados Unidos en Honduras. Una lista de los laboratorios aprobados por la AABB puede encontrarse en Entonces, tanto el peticionario y el beneficiario pueden solicitar una cita de prueba de ADN en la Embajada de EE.UU. en Honduras, o si tienen una dirección de correo electrónico y número de seguimiento de los kit de ADN entregado a la Embajada podrán solicitarla en el enlace en la parte superior de esta página. Una vez que las muestras sean tomadas las muestras serán enviadas a los Estados Unidos AABB Clínica para el análisis. El peticionario debe solicitar al laboratorio en los Estados Unidos que envíe un estuche de recolección de ADN para cada solicitante directamente a la siguiente dirección: American Embassy Consular Section/DNA Specialist Ave. La Paz, Tegucigalpa, Honduras Información para los Beneficiarios Los beneficiarios o el peticionario deben de contactarse a la Embajada Americana para programar una cita a través del correo electrónico tggdna@state.gov o al teléfono (504) ext Lunes y Miércoles - 2:30 a 3:30pm Los beneficiarios serán contactados por la Embajada de Estados Unidos para programar una cita, o si tienen una dirección de correo electrónico y el número de seguimiento de los kit de ADN que se entregó a la Embajada, podrán solicitar una cita en el enlace situado en la parte superior de esta página. Al momento de la cita, el beneficiario debe de presentarse en persona con dos fotos tamaño pasaporte a colores (2 X 2 ), fotocopia del pasaporte, el pasaporte, y una dirección en los

19 Estados Unidos donde desean que les envíen el resultado. Si no se presentan los documentos requeridos, el proceso se demorará. El beneficiario debe pagar por los servicios del laboratorio que le tome la muestra en la Embajada de los Estados Unidos al momento de recolectar la muestra. El costo actual por cada solicitante es de US$21 (cambio exacto) o su equivalente en Lempiras. El peticionario deberá verificar con el laboratorio de los Estados Unidos que un sobre pre-pagado esté incluido en el estuche de recolección. De no ser así, el beneficiario debe de proporcionar un sobre pre-pagado de servicio de encomienda con la dirección del laboratorio en los Estados Unidos. Este sobre será usado para enviar la muestra bucal del beneficiario para ser comparada con la muestra del peticionario. El beneficiario puede adquirir el sobre pre-pagado en Fedex o DHL etc. Qué Sucede Después? Si el resultado de la prueba genética demuestra ser positivo, la Sección Consular se comunicará con el beneficiario para que se presente a la Embajada y complete la documentación pendiente. Si no existe documentación pendiente, la visa de inmigrante será aprobada. Si el resultado de la prueba genética es negativo, la petición será devuelta al Departamento de Seguridad Interna acompañada por una recomendación hecha por la Sección Consular para que la petición sea revocada. El caso será cerrado y la Embajada no aceptará más documentación o evidencia referente al mismo. La Sección Consular notificará al beneficiario informando sobre la revocación. Aspectos Importantes que Deben Recordarse acerca de la Prueba de ADN Someterse a la prueba genética es de carácter voluntario; usted escoge si desea hacérsela o no. La Embajada solamente aceptará resultados bajo el método bucal. Este método consiste en remover una pequeña cantidad de material genético de la parte interior de la boca, es sencillo, limpio y no invasivo. El costo de la prueba y de todos los gastos en que se incurra (tales como honorarios médicos, pago por servicio de envío, pago al laboratorio aprobado por la AABB, etc.) corren por cuenta del peticionario y del beneficiario y deben de pagarse por adelantado. La Embajada no tiene ninguna responsabilidad en cuanto a los costos y no interviene en el ajuste de los costos. La Embajada no suministra reembolsos por estuches de ADN que no sean utilizados ni participa en alguna forma en las transacciones financieras para la prueba de ADN. Para propósitos de emisión de la visa, la Embajada solamente aceptará los resultados originales de la prueba genética de ADN que sean enviados directamente a la Embajada por el laboratorio que hizo la prueba. Esto lo hacemos con el propósito de asegurarnos que el proceso de emisión de visas estadounidenses esté conforme a las regulaciones. La Embajada no asume ninguna responsabilidad por el profesionalismo con que se desempeñe cualquiera de los laboratorios del AABB (American Association of Blood Banks) que estén acreditados para hacer el examen consanguíneo.

20 El enviar la prueba de ninguna manera garantiza la emisión de una visa de inmigrante, y mientras estén pendientes los resultados de la prueba genética, toda investigación referente al caso será suspendida hasta que la misma sea completada. Las peticiones que se devuelvan al Departamento de Seguridad Interna de los Estados Unidos basadas en resultados negativos de la prueba de ADN pueden ser revocadas o denegadas por el Departamento de Seguridad Interna. La Embajada le recuerda a todos los solicitantes de que existen sanciones para aquellos que hagan declaraciones falsas al llenar su solicitud de visa de inmigrante.
