1 ORDINANCE NO AN ORDINANCE ORDERING AN ELECTION BY THE QUALIFIED VOTERS OF THE CITY OF FORT WORTH, TEXAS, ON MAY 10, 2014, ON THE QUESTION OF THE ISSUANCE OF AD VALOREM TAX SUPPORTED PUBLIC SECURITIES FOR THE 2014 CAPITAL IMPROVEMENT PROGRAM BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. ELECTION ORDERED That the City Council hereby orders that an election be held on Saturday, May 10, The City Council hereby finds that the date at which said election shall be held is not less than fifteen (15) days nor more than ninety (90) days from the date this Ordinance is adopted. SECTION 2. PROPOSITIONS law: That at said election, the following propositions shall be submitted in accordance with PROPOSITION NO. 1 Shall the City Council of the City of Fort Worth be authorized to issue the public securities of the City as authorized by law at the time of issuance, in one or more series or issues, in the aggregate principal amount of $219,740, with said public securities of each such series or issue, respectively, to mature at the date or dates specified in the issuing instruments, with no such date to exceed forty years from the date of such issuance, and to be sold at such prices and bear interest at such rates as shall be determined by the City Council, for the following street and transportation-related purposes, to-wit: constructing permanent street and drainage improvements; reconstructing, rehabilitating, restructuring, and extending the streets, thoroughfares, intersections, sidewalks, bridges, pedestrianways, bicycleways, streetscapes, collectors, signalization, signage, other traffic and signal controls, street lighting, and median improvements and the acquisition of land therefor in said City; and improvements related to all of the foregoing; and/or contributing toward the funding of any or all of the foregoing; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual Ordinance No Page 1 of 12

2 interest on said public securities and provide a sinking fund to pay said public securities at maturity? PROPOSITION NO. 2 Shall the City Council of the City of Fort Worth be authorized to issue the public securities of said City as authorized by law at the time of issuance, in one or more series or issues, in the aggregate principal amount of $31,440,000.00, with said public securities of each such series or issue, respectively, to mature at the date or dates specified in the issuing instruments, with no such date to exceed forty years from the date of such issuance, and to be sold at such prices and bear interest at such rates as shall be determined by the City Council, for the following parks, recreation, and community center-related purposes, to-wit: constructing new parks, recreation, and community center facilities; purchasing land; improving land; constructing new facilities; renovating existing facilities; enlarging other such facilities; constructing, renovating, or enlarging playgrounds, roadways, parking, drainage, or other supportive infrastructure facilities at or integrated into parks, recreation, and community center facilities; and improvements related to all of the foregoing; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said public securities and provide a sinking fund to pay said public securities at maturity? PROPOSITION NO. 3 Shall the City Council of the City of Fort Worth be authorized to issue the public securities of said City as authorized by law at the time of issuance, in one or more series or issues, in the aggregate principal amount of $12,650,000.00, with said public securities of each such series or issue, respectively, to mature at the date or dates specified in the issuing instruments, with no such date to exceed forty years from the date of such issuance, and to be sold at such prices and bear interest at such rates as shall be determined by the City Council, for the following library system-related purposes, to-wit: expanding the City s library system by constructing and equipping new library facilities; renovating and/or expanding existing library facilities; and the acquisition of land therefor in said City; and improvements related to all of the foregoing; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said public securities and provide a sinking fund to pay said public securities at maturity? PROPOSITION NO. 4 Shall the City Council of the City of Fort Worth be authorized to issue the public securities of said City as authorized by law at the time of issuance, in one or more series or issues, in the aggregate principal amount of $9,285, with said Ordinance No Page 2 of 12

3 public securities of each such series or issue, respectively, to mature at the date or dates specified in the issuing instruments, with no such date to exceed forty years from the date of such issuance, and to be sold at such prices and bear interest at such rates as shall be determined by the City Council, for the following fire safety-related purposes, to wit: constructing and equipping new fire stations; renovating existing fire stations and fire apparatus; and the acquisition of land therefor in said City; and improvements related to all of the foregoing; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said public securities and provide a sinking fund to pay said public securities at maturity? PROPOSITION NO. 5 Shall the City Council of the City of Fort Worth be authorized to issue the public securities of said City as authorized by law at the time of issuance, in one or more series or issues, in the aggregate principal amount of $1,530,000.00, with said public securities of each such series or issue, respectively, to mature at the date or dates specified in the issuing instruments, with no such date to exceed forty years from the date of such issuance, and to be sold at such prices and bear interest at such rates as shall be determined by the City Council, for the following municipal court-related purposes, to-wit: constructing and equipping new municipal court facilities; renovating and/or expanding existing municipal court facilities; and the acquisition of land therefor in said City; and improvements related to all of the foregoing; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said public securities and provide a sinking fund to pay said public securities at maturity? PROPOSITION NO. 6 Shall the City Council of the City of Fort Worth be authorized to issue the public securities of said City as authorized by law at the time of issuance, in one or more series or issues, in the aggregate principal amount of $15,080,000.00, with said public securities of each such series or issue, respectively, to mature at the date or dates specified in the issuing instruments, with no such date to exceed forty years from the date of such issuance, and to be sold at such prices and bear interest at such rates as shall be determined by the City Council, for the following municipal service facility-related purposes, to-wit: constructing and equipping new municipal vehicle maintenance facilities; constructing and equipping new City field operations services facilities; renovating and/or expanding existing City municipal service facilities; and the acquisition of land therefor in said City; and improvements related to all of the foregoing; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes Ordinance No Page 3 of 12

4 in an amount sufficient to pay the annual interest on said public securities and provide a sinking fund to pay said public securities at maturity? PROPOSITION NO. 7 Shall the City Council of the City of Fort Worth be authorized to issue the public securities of said City as authorized by law at the time of issuance, in one or more series or issues, in the aggregate principal amount of $2,350,000.00, with said public securities of each such series or issue, respectively, to mature at the date or dates specified in the issuing instruments, with no such date to exceed forty years from the date of such issuance, and to be sold at such prices and bear interest at such rates as shall be determined by the City Council, for the following animal care and control-related purposes, to-wit: constructing and equipping new animal care and control facilities; renovating and/or expanding existing animal care and control facilities; and the acquisition of land therefor in said City; and improvements related to all of the foregoing; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said public securities and provide a sinking fund to pay said public securities at maturity? SECTION 3. BALLOT That the official ballots to be used in such election shall be prepared in accordance with Sections and of the Texas Election Code, as amended. The ballots shall permit the electors to vote For or Against the aforesaid issuance of public securities and shall be set forth in substantially the following form: PROPOSITION NO. 1 FOR THE ISSUANCE OF PUBLIC SECURITIES FOR STREET AND TRANSPORTATION AGAINST IMPROVEMENTS IN THE AGGREGATE PRINCIPAL AMOUNT OF $219,740, PROPOSITION NO. 2 FOR THE ISSUANCE OF PUBLIC SECURITIES FOR PARKS, RECREATION AND COMMUNITY AGAINST CENTER IMPROVEMENTS IN THE AGGREGATE PRINCIPAL AMOUNT OF $31,440, Ordinance No Page 4 of 12

5 PROPOSITION NO. 3 FOR THE ISSUANCE OF PUBLIC SECURITIES FOR LIBRARY SYSTEM IMPROVEMENTS IN THE AGAINST AGGREGATE PRINCIPAL AMOUNT OF $12,650, PROPOSITION NO. 4 FOR THE ISSUANCE OF PUBLIC SECURITIES FOR FIRE SAFETY IMPROVEMENTS IN THE AGAINST AGGREGATE PRINCIPAL AMOUNT OF $9,285, PROPOSITION NO. 5 FOR THE ISSUANCE OF PUBLIC SECURITIES FOR MUNICIPAL COURT IMPROVEMENTS IN THE AGAINST AGGREGATE PRINCIPAL AMOUNT OF $1,530, PROPOSITION NO. 6 FOR THE ISSUANCE OF PUBLIC SECURITIES FOR MUNICIPAL SERVICE FACILITY AGAINST IMPROVEMENTS IN THE AGGREGATE PRINCIPAL AMOUNT OF $15,080, PROPOSITION NO. 7 FOR THE ISSUANCE OF PUBLIC SECURITIES FOR ANIMAL CARE AND CONTROL FACILITY AGAINST IMPROVEMENTS IN THE AGGREGATE PRINCIPAL AMOUNT OF $2,350, Ordinance No Page 5 of 12

6 SECTION 4. PUBLIC ART (a) (b) In respect to Proposition No. 1 (Street and Transportation Improvements) submitted to the voters, it shall be a part of the contract with the voters that should the proposition be approved at said election, the City Council may determine to expend up to 1% of the aggregate proceeds of the public securities authorized and sold for projects approved by the voters as described in such proposition for public art specifically related to any project described in such proposition, consistent with the public art ordinance approved by the City Council and in effect at the time of the expenditure, and to the extent permitted by law. In respect to Proposition Nos. 2 through 7 submitted to the voters, it shall be a part of the contract with the voters that should any of the propositions be approved at said election, the City Council may determine to expend up to 2% of the aggregate proceeds of the public securities authorized and sold for projects approved by the voters as described in each such proposition for public art specifically related to any project described in such proposition, consistent with the public art ordinance approved by the City Council and in effect at the time of the expenditure, and to the extent permitted by law. SECTION 5. ADDITIONAL TAX AND FINANCIAL INFORMATION The following statements are made in accordance with Section 3.009(b) of the Texas Election Code and provide the information required under that Section that is not otherwise addressed in this ordinance. (a) Taxes sufficient to pay the annual principal of and interest on the debt obligations may be imposed. (b) Based upon the bond market conditions on the date this Ordinance is approved, the maximum interest rate for any series of the debt obligations authorized to be sold by the voters is estimated to be 5.5%, as calculated in accordance with applicable law. Such estimate takes into account a number of factors, including the timing of the issuance of Ordinance No Page 6 of 12

7 (c) (d) (e) debt obligations approved by the voters, the maturity schedule for debt obligations issued by the City, and the expected credit ratings of the proposed debt obligations. The estimated maximum interest rate is provided as a matter of information, but is not a limitation on the interest rate at which the debt obligations, or any series thereof, may be sold. As of the beginning of the City s current fiscal year (October 1, 2013), the aggregate amount of outstanding principal of the City s ad valorem supported obligations is $703,395, As of the beginning of the City s current fiscal year (October 1, 2013), the aggregate amount of outstanding interest on the City s ad valorem supported obligations is $254,810, As of the date of this Ordinance, the ad valorem debt service tax rate of the City of Fort Worth is $ per $ valuation of taxable property. SECTION 6. EARLY VOTING CLERKS (a) (b) (c) Steve Raborn, Tarrant County Elections Administrator, or his successor, shall serve as the early voting clerk for the Tarrant County portion of the election. Frank Phillips, Denton County Elections Administrator, shall serve as the early voting clerk for the Denton County portion of the election. The City Secretary may change the places and/or times contained in Exhibits A-1 and A-2 without further City Council action or approval after consulting with the Tarrant County Elections Administrator and/or the Denton County Elections Administrator and determining that a change in place and/or time is necessary. (a) SECTION 8. VOTING SYSTEM An electronic voting system, as defined in Chapter 121 of the Texas Election Code, shall be used for voting at the regular polling places for said election and for counting the ballots and for tabulating the results. The conduct of the election and the use of the electronic voting system shall be in accordance with the Texas Election Code. (b) (1) The Office of the Tarrant County Elections Administrator, 2700 Premier Street, Fort Worth, Texas, is established as the Central Counting Station for the ballots (c) cast in Tarrant County in said election. (2) The Office of the Denton County Elections Administrator, 701 Kimberly Drive, Denton, Texas, is established as the Central Counting Station for the ballots cast in Denton County in said election. Each of the above-named Central Counting Stations shall appoint an individual, having knowledge and experience in the conduct of elections with the electronic voting system for which each Central Counting Station is established, as Manager of the respective Central Counting Station. The Manager shall be in charge of overall administration of Ordinance No Page 9 of 12

10 (d) (e) (f) (g) (h) the individual County s Central Counting Station and the general supervision of the personnel working at the Station. Each of the Counties named in sub-section (b) above shall appoint an individual trained in the operation of the automatic tabulating equipment as Tabulation Supervisor. The Tabulation Supervisor shall be in charge of the operation of the automatic tabulating equipment in the respective county. Each of the Counties named in sub-section (b) above shall appoint an individual as Assistant to the Tabulation Supervisor. Such Assistant shall assist the Tabulation Supervisor in the operation of the automatic tabulating equipment as directed by the Tabulation Supervisor. Each of the Counties named in sub-section (b) above shall appoint an individual as Presiding Judge of the Central Counting Station. The Presiding Judge shall maintain order at the Central Counting Station and shall have such authority as may be prescribed by the Texas Election Code. The Tarrant and Denton County polling places shall be kept open on May 10, 2014, from 7:00 a.m. to 7:00 p.m., and due returns shall be made to the City Council showing the number of votes cast For and Against Proposition Nos. 1 through 7, inclusive. The locations of the election day polling places for the election are contained in Exhibit B-1, Tarrant County Election Day Polling Sites, and Exhibit B-2, Denton County Election Day Polling Sites, attached hereto. The City Secretary may change the places and/or times contained in Exhibits B-1 and B-2 without further City Council action or approval after consulting with the Tarrant County Elections Administrator and/or the Denton County Elections Administrator and determining that a change in place and/or time is necessary. 11 SECTION 9. NOTICE AND PUBLICATION (a) (b) (c) A substantial copy of this Ordinance shall serve as proper notice of said election, which notice shall be given by posting substantial copies of this Ordinance in both English and Spanish on the bulletin board at the City Hall of the City used for the posting of notices of meetings of the City Council of the City and at three (3) other public places within the City not later than the twenty-first (21 st ) day prior to the date upon which said election is to be held; and substantial copies of this Ordinance in both English and Spanish shall be published on the same day in each of two (2) successive weeks in a newspaper of general circulation in the City, the date of the first publication to be not less than fourteen (14) days nor more than thirty (30) days prior to the date of said election. No later than the twenty-first (21 st ) day before the election, a complete copy of this Ordinance shall be posted on the City s official website together with the notice of the election and the contents of the Propositions and shall remain so posted through the date of the election. A complete copy of this Ordinance shall be posted on election day and during early voting by personal appearance in a prominent location at each polling place at which this election is conducted. SECTION 10. CONTROLLING LAW That in all respects, said election shall be conducted in accordance with the Texas Election Code and the Charter of the City of Fort Worth, Texas. SECTION 11. OPEN MEETING COMPLIANCE That it is hereby officially found and determined that the meeting at which this Ordinance was adopted and said election was called was open to the public and public notice of the time, Ordinance No Page 11 of 12

13 ORDENANZA NO UNA ORDENANZA CONVOCANDO A ELECCIÓN POR VOTANTES CALIFICADOS DE LA CIUDAD DE FORT WORTH, TEXAS, A REALIZARSE EL 10 DE MAYO DE 2014, SOBRE EL ASUNTO DE LA EMISIÓN DE TÍTULOS PÚBLICOS A FINANCIARSE CON FONDOS PROVENIENTES DEL IMPUESTO AD VALOREM PARA EL PROGRAMA DE MEJORA DE CAPITAL DE 2014 EL AYUNTAMIENTO DE LA CIUDAD DE FORT WORTH, TEXAS, ORDENA: SECCIÓN 1. CONVOCATORIA A ELECCIÓN Que por el presente documento el Ayuntamiento ordena la realización de una elección el sábado 10 de mayo de El Ayuntamiento, por este documento, considera que la fecha en que dicha elección deberá realizarse no debe ser menor de quince (15) días ni mayor de noventa (90) días desde la fecha en que se adopta esta Ordenanza. PROPUESTAS Que en dicha elección deberán presentarse las siguientes propuestas de acuerdo a ley: PROPUESTA NO. 1 Deberá el Ayuntamiento de la Ciudad de Fort Worth estar autorizado a emitir títulos públicos de la Ciudad, según lo autorice la ley al momento de la emisión, en una o más series o emisiones, por un monto agregado de capital de $219,740,000.00, con dichos títulos públicos de cada una de esas series o emisiones, respectivamente, con vencimiento en la fecha o fechas especificadas en los instrumentos de emisión, sin que ninguna de esas fechas exceda los cuarenta años desde la fecha de dicha emisión, y para venderse a los precios y devengar los intereses, según lo determine el Ayuntamiento, para los siguientes fines relacionados con el transporte y las calles, es decir: construcción de mejoras permanentes en las calles y drenajes; reconstrucción, rehabilitación, restructuración y ampliación de las calles, autopistas, intersecciones, veredas, puentes, vías peatonales, vías para ciclistas, paisaje de calles, colectores, señalización, letreros, otros controles y señales de tránsito, iluminación en las calles y mejoras en las secciones centrales, así como adquisición de terrenos para ello en dicha Ciudad; y mejoras relacionadas con todo lo anterior; y/o contribución al financiamiento para uno o todos los fines mencionados Ordenanza No Página 1 de 13

14 anteriormente, y deberá el Ayuntamiento estar autorizado a recaudar impuestos y hacer que se evalúen y cobren los impuestos anuales ad valorem en un monto suficiente para pagar el interés anual en dichos títulos públicos y proporcionar un fondo de amortización para pagar dichos títulos públicos en su vencimiento? PROPUESTA NO. 3 Deberá el Ayuntamiento de la Ciudad de Fort Worth estar autorizado a emitir títulos públicos de dicha Ciudad, según lo autorice la ley al momento de la emisión, en una o más series o emisiones, por un monto agregado de capital de $12,650,000.00, con dichos títulos públicos de cada una de esas series o emisiones, respectivamente, con vencimiento en la fecha o fechas especificadas en los instrumentos de emisión, sin que ninguna de esas fechas exceda los cuarenta años desde la fecha de dicha emisión, y para venderse a los precios y devengar los intereses, según lo determine el Ayuntamiento, para los siguientes fines relacionados con el sistema de bibliotecas, es decir: ampliación del sistema de bibliotecas de la Ciudad mediante la construcción y equipamiento de nuevas instalaciones de bibliotecas; renovación y/o ampliación de las instalaciones de bibliotecas existentes; y la adquisición de terrenos para ello en dicha Ciudad; y mejoras relacionadas con todo lo anterior, y deberá el Ayuntamiento estar autorizado a recaudar impuestos y hacer que se evalúen y cobren los impuestos anuales ad valorem en un monto suficiente para pagar el interés anual en dichos Ordenanza No Página 2 de 13

15 títulos públicos y proporcionar un fondo de amortización para pagar dichos títulos públicos en su vencimiento? PROPUESTA NO. 4 Deberá el Ayuntamiento de la Ciudad de Fort Worth estar autorizado a emitir títulos públicos de dicha Ciudad, según lo autorice la ley al momento de la emisión, en una o más series o emisiones, por un monto agregado de capital de $9,285,000.00, con dichos títulos públicos de cada una de esas series o emisiones, respectivamente, con vencimiento en la fecha o fechas especificadas en los instrumentos de emisión, sin que ninguna de esas fechas exceda los cuarenta años desde la fecha de dicha emisión, y para venderse a los precios y devengar los intereses, según lo determine el Ayuntamiento, para los siguientes fines relacionados con la seguridad contra incendios, es decir: construcción y equipamiento de nuevas estaciones de bomberos; renovación de las estaciones de bomberos existentes y equipos contra incendios; y la adquisición de terrenos para ello en dicha Ciudad; y mejoras relacionadas con todo lo anterior, y deberá el Ayuntamiento estar autorizado a recaudar impuestos y hacer que se evalúen y cobren los impuestos anuales ad valorem en un monto suficiente para pagar el interés anual en dichos títulos públicos y proporcionar un fondo de amortización para pagar dichos títulos públicos en su vencimiento? PROPUESTA N NO. 5 Deberá el Ayuntamiento de la Ciudad de Fort Worth estar autorizado a emitir títulos públicos de dicha Ciudad, según lo autorice la ley al momento de la emisión, en una o más series o emisiones, por un monto agregado de capital de $1,530,000.00, con dichos títulos públicos de cada una de esas series o emisiones, respectivamente, con vencimiento en la fecha o fechas especificadas en los instrumentos de emisión, sin que ninguna de esas fechas exceda los cuarenta años desde la fecha de dicha emisión, y para venderse a los precios y devengar los intereses, según lo determine el Ayuntamiento, para los siguientes fines relacionados con tribunales municipales, es decir: construcción y equipamiento de nuevas instalaciones de tribunales municipales; renovación y/o ampliación de las instalaciones de tribunales municipales existentes; y la adquisición de terrenos para ello en dicha Ciudad; y mejoras relacionadas con todo lo anterior, y deberá el Ayuntamiento estar autorizado a recaudar impuestos y hacer que se evalúen y cobren los impuestos anuales ad valorem en un monto suficiente para pagar el interés anual en dichos títulos públicos y proporcionar un fondo de amortización para pagar dichos títulos públicos en su vencimiento? 16 PROPUESTA NO. 6 Deberá el Ayuntamiento de la Ciudad de Fort Worth estar autorizado a emitir títulos públicos de dicha Ciudad, según lo autorice la ley al momento de la emisión, en una o más series o emisiones, por un monto agregado de capital de $15,080,000.00, con dichos títulos públicos de cada una de esas series o emisiones, respectivamente, con vencimiento en la fecha o fechas especificadas en los instrumentos de emisión, sin que ninguna de esas fechas exceda los cuarenta años desde la fecha de dicha emisión, y para venderse a los precios y devengar los intereses, según lo determine el Ayuntamiento, para los siguientes fines relacionados con las instalaciones de servicios municipales, es decir: construcción y equipamiento de nuevas instalaciones de mantenimiento de vehículos municipales; construcción y equipamiento de nuevas instalaciones de servicios de operaciones en el campo para la Ciudad; renovación y/o ampliación de las instalaciones de servicios municipales existentes en la Ciudad; y la adquisición de terrenos para ello en dicha Ciudad; y mejoras relacionadas con todo lo anterior, y deberá el Ayuntamiento estar autorizado a recaudar impuestos y hacer que se evalúen y cobren los impuestos anuales ad valorem en un monto suficiente para pagar el interés anual en dichos títulos públicos y proporcionar un fondo de amortización para pagar dichos títulos públicos en su vencimiento? PROPUESTA NO. 7 Deberá el Ayuntamiento de la Ciudad de Fort Worth estar autorizado a emitir títulos públicos de dicha Ciudad, según lo autorice la ley al momento de la emisión, en una o más series o emisiones, por un monto agregado de capital de $2,350,000.00, con dichos títulos públicos de cada una de esas series o emisiones, respectivamente, con vencimiento en la fecha o fechas especificadas en los instrumentos de emisión, sin que ninguna de esas fechas exceda los cuarenta años desde la fecha de dicha emisión, y para venderse a los precios y devengar los intereses, según lo determine el Ayuntamiento, para los siguientes fines relacionados con el cuidado y control de animales, es decir: construcción y equipamiento de nuevas instalaciones de cuidado y control de animales; renovación y/o ampliación de las instalaciones de cuidado y control de animales; y la adquisición de terrenos para ello en dicha Ciudad; y mejoras relacionadas con todo lo anterior, y deberá el Ayuntamiento estar autorizado a recaudar impuestos y hacer que se evalúen y cobren los impuestos anuales ad valorem en un monto suficiente para pagar el interés anual en dichos títulos públicos y proporcionar un fondo de amortización para pagar dichos títulos públicos en su vencimiento? ARTE PÚBLICO (a) Con respecto a la Propuesta No. 1 (Mejoras en las calles y transporte) que se presenta a los votantes, una parte del contrato con los votantes deberá ser que, en caso que la propuesta sea aprobada en dicha elección, el Ayuntamiento puede determinar gastar hasta el 1% de los ingresos agregados de los títulos públicos autorizados y vendidos para proyectos aprobados por los votantes, según se describe en dicha propuesta, para destinarlo al arte público específicamente relacionado a todo proyecto descrito en dicha propuesta, que sea consistente con la ordenanza sobre arte público aprobada por el Ayuntamiento, que esté vigente al momento de hacer el gasto y en la medida que lo permita la ley. 19 (b) Con respecto a las Propuestas No. 2 a 7 que se presentan a los votantes, una parte del contrato con los votantes deberá ser que, en caso que cualquiera de estas propuestas sea aprobada en dicha elección, el Ayuntamiento puede determinar gastar hasta el 2% de los ingresos agregados de los títulos públicos autorizados y vendidos para proyectos aprobados por los votantes, según se describe en cada una de dichas propuestas, para destinarlo al arte público específicamente relacionado a todo proyecto descrito en dichas propuestas, que sea consistente con la ordenanza sobre arte público aprobada por el Ayuntamiento, que esté vigente al momento de hacer el gasto y en la medida que lo permita la ley. SECCIÓN 5. IMPUESTO ADICIONAL E INFORMACIÓN FINANCIERA Las siguientes declaraciones se hacen de acuerdo con la Sección 3.009(b) del Código Electoral de Texas y proporcionan la información necesaria según esa Sección que no ha sido tratada de otro modo en esta Ordenanza. (a) Pueden aplicarse impuestos necesarios para pagar el monto principal anual y el interés de las obligaciones de la deuda. (b) Basado en las condiciones del mercado de bonos en la fecha de aprobación de esta Ordenanza, la tasa máxima de interés para toda serie de obligaciones relacionadas con la deuda autorizada, a ser vendida por los votantes, se estima en 5.5%, según se calcule de acuerdo con la ley aplicable. Dicha estimación toma en cuenta diversos factores, entre otros la secuencia temporal de la emisión de las obligaciones de deuda aprobada por los votantes, la programación del vencimiento de las obligaciones de deuda emitidas por la Ciudad, y las clasificaciones de crédito esperadas de las obligaciones de deuda propuestas. La tasa de interés máxima estimada se proporciona como un asunto de información, pero no es una limitación en la tasa de interés a la que pueden venderse las obligaciones de deuda, ni ninguna serie de las mismas. 20 (c) (d) (e) A partir del inicio del presente año fiscal de la Ciudad (1 de octubre de 2013), el monto agregado de capital pendiente de las obligaciones a financiarse con fondos provenientes del impuesto ad valorem de la Ciudad es de $703,395, A partir del inicio del presente año fiscal de la Ciudad (1 de octubre de 2013), el monto agregado de interés pendiente de las obligaciones a financiarse con fondos provenientes del impuesto ad valorem de la Ciudad es de $254,810, A partir de la fecha de esta Ordenanza, la tasa de impuesto ad valorem por servicio de deuda de la Ciudad de Fort Worth es $ por $ de valoración de propiedad gravable. (2) La Oficina del Administrador de Elecciones del Condado de Denton, ubicada en 701 Kimberly Drive, Denton, Texas, se establece como Estación Central de Conteo de Votos para las papeletas de voto emitidas en dicha elección en el Condado de Denton. (c) Cada una de las Estaciones Centrales de Conteo de Voto mencionadas anteriormente deberá designar a una persona con conocimiento y experiencia en la realización de elecciones, con el sistema de votación electrónica establecido en cada Estación Central de Conteo de Votos, como Gerente de la respectiva Estación Central de Conteo de Votos. El gerente deberá estar a cargo de la administración completa de la Estación Central de Conteo de Votos y de la supervisión general del personal que trabaja en la Estación. El Supervisor de Tabulación deberá estar a cargo de la operación del equipo de tabulación automático en el respectivo condado. (e) Cada uno de los Condados mencionados en el párrafo (b) anterior deberá designar a una persona como Asistente del Supervisor de Tabulación. Dicho Asistente deberá apoyar al Supervisor de Tabulación en la operación del equipo de tabulación automático, de acuerdo a las instrucciones del Supervisor de Tabulación. (f) Cada uno de los Condados mencionados en el párrafo (b) anterior deberá designar a una persona como Juez Presidente de la Estación Central de Conteo. El Juez Presidente deberá mantener el orden en la Estación Central de Conteo y tendrá la autoridad establecida por el Código Electoral de Texas. (g) Los lugares de votación de los Condados de Tarrant y Denton deberán permanecer abiertos el día 10 de mayo de 2014, de 7:00 a.m. a 7:00 p.m., y deberán hacerse las devoluciones correspondientes al Ayuntamiento indicando el número de votos emitidos A favor y En contra en las Propuestas No. 1 a 7, inclusive.
