10 Introduction By Steve Solot President Latin American Training Center-LATC On behalf of the Latin American Training Center-LATC, publisher of the present volume, it has been an honor and pleasure to coordinate the common interests of the three sponsors: American Film Conservancy-AFC, Cesnik, Quintino e Salinas Advogados-CQS and Cowan DeBaets Abrahams & Sheppard LLP CDAS, and the support of the Brazilian Independent Television Producers Association-ABPITV, to offer the current unique, non-profit publication, which provides up-to-date legal and legislative information on Current Financing Mechanisms for Audiovisual Content in Latin America. This is the fifth LATC publication, following Fiscal Incentives for Audiovisual Production and Co-Production in Iberoamerica, Canada and the U.S. (2009), Current Financing Mechanisms for Audiovisual Content in Latin America (2011), The Brazilian Audiovisual Industry: An Explosion of Creativity and Opportunities for Partnerships (2012) and Latin American Cinema Today: The Director s Perspective (2013). Since the early 1990 s numerous government programs have been regularly launched in Latin America aimed at stimulating film production, as well as audiovisual content distribution and exhibition. Together with the increase in international co-production treaties, they have constituted the principal public policy tool for achieving the long-term objectives of a sustainable audiovisual industry, promotion of an audiovisual culture and promoting each countries audiovisual content and image internationally. IX

11 X Current mechanisms for financing audiovisual content in latin america 2 In this new updated publication, we have once again invited a select group of legal and technical experts from each country to prepare a chapter on the principal mechanisms of financing audiovisual content. Also included in each chapter are references to specific legislation of each country for further research and review. As usual, neither LATC nor any of the co-sponsors of the publication are responsible for errors and omissions of information or content in any of the chapters, which are the sole responsibility of the respective authors. Due to frequent changes in legislation, the reader is cautioned to check with local sources and/or the author before taking any investment or production decisions. However, this edition differs from the previous one in two important ways. Given the rapid development and implementation of new technology to the audiovisual industry with its multiple formats, delivery channels and platforms, each author has included specific reference to their corresponding funding mechanisms, where they exist. In addition, as opposed to the previous Spanish-only edition, based on numerous requests, the present volume is provided in a fully bilingual, Spanish-English format, to offer increased access to broader audiences. Qualified technical legal translators have been employed to ensure the accuracy of the translations which also have been submitted to the original authors for approval prior to publication. As with the previous edition, the publication continues to be available in a free PDF format which may be downloaded from the LATC website. It is our hope that this volume, as with the previous LATC publications, will serve as a significant source of information for policy makers, legislators, investors, attorneys, producers, distributors and other professionals in the audiovisual industry to promote the common objective to expand the Latin American audiovisual content industry in a global context. I wish to take this opportunity to thank each author for his or her valuable contribution and time and effort expended to make this publication a reality. Junto con el aumento de los tratados de coproducción internacional, han constituido la herramienta principal de política pública para el logro de los objetivos a largo plazo de una industria audiovisual sostenible, la promoción de una cultura audiovisual y la promoción internacional de contenidos audiovisuales y de la imagen de cada país. En esta nueva y actualizada publicación, una vez más hemos invitado a un selecto grupo de expertos jurídicos y técnicos de cada país para preparar un capítulo sobre los principales mecanismos de financiación de contenidos audiovisuales. También se incluyen en cada capítulo referencias a la legislación específica de cada país para adicional investigación y revisión. Como de costumbre, ni LATC ni ninguno de los copatrocinadores de la publicación son responsables por errores y omisiones de información o contenido en cualquiera de los capítulos, que son responsabilidad exclusiva de los respectivos autores. Debido a los frecuentes cambios en la legislación, se advierte al lector consultar con fuentes locales y/o el autor antes de tomar cualquier decisión de inversión o producción. 16 Preface I By Oliver Kwon Founder and CEO Americas Film Conservancy - AFC The Americas Film Conservancy AFC is pleased to join the Cesnik, Quintino e Salinas Advogados-CQS and Cowan DeBaets Abrahams & Sheppard LLP CDAS in this new initiative of the Latin American Training Center-LATC. As a non-profit foundation which works to protect and preserve Latin America s film heritage through film preservation and restoration, archives and exhibitions, our co-sponsorship of this important publication represents a departure from the AFC focus on the protection and promotion of Latin American film. Since 2002, the majority of AFC programs have sought to support promising filmmakers and film archivists, and to promote events, festivals and awareness campaigns as tools to fulfill the need for attention to developing Latin American film industries. AFC has also partnered in previous LATC projects such as the recent publication, LATIN AMERICAN CINEMA TODAY: THE DIREC- TOR S PERSPECTIVE, published in a bilingual format. AFC views Latin America has one of the largest entertainment markets in the world, representing an area with over 650 million Spanish and Portuguese speakers. It is also an area of talented filmmakers who continue to capture, comment and understand the dreams, ambitions, trials and tragedies of their personal culture and those of their own countries. Promising filmmakers are also ignored as many Latin American production teams remain under-promoted and underfinanced. AFC realizes the need for institutional aid in protecting and promoting Latin American film and works to implement programs to achieve these goals. The present publication offers AFC an opportunity to participate in a monumental effort to consolidate practical information in a single volume, as a source of vital information for filmmakers and other professionals in the Latin American audiovisual industry to promote their respective industries with up-to-date legal and legislative information on Current Financing Mechanisms for Audiovisual Content in Latin America. The previous editions have provided much needed and appreciated guidance for filmmakers, producers, financiers, and governments throughout Latin America in helping them navigate the tax schemes and government programs of their sister Latin American countries. As a practitioner in the field of entertainment law in the U.S., particularly in the areas of film and television, and one who has represented a number of Latin American clients and taken part in a number of LATC programs throughout Latin America, I ve noted that it would very helpful for U.S. and other international professionals in the audio-visual industries to have access to the plethora of information found in the previous editions of this book. Until now, this has been difficult, -but now- with this new bilingual edition, the world of Latin American production subsidies and tax incentives will be readily available to English speakers. Thanks to the rapid change and expansion of the available platforms and media for worldwide distribution of films and television, primarily due to technological advances, the audio-visual industries grow ever more global in scope.
