7 Sentencing Enhancements If you are convicted of one or more alcohol or drug related charges filed against you, AND you are found to be an habitual substance offender, you will be sentenced for the criminal offense AND the court will add time to your sentence for being an habitual substance offender. The additional period of time to which you will be sentenced for being an habitual substance offender will be between one and eight years. If the prosecutor has filed an habitual offender enhancement against you, contending that you have been convicted of two or more prior unrelated felony offenses, you may be found to be an habitual offender. If you are convicted of one or more of the felony charges now filed against you, AND you are found to be an habitual offender, you will be sentenced for the felony offense, AND the court will add time to your sentence for being an habitual offender. If you are charged with a Class D, Class C, Class B, or Class A felony, the minimum period of time to which you will be sentenced as an habitual offender will equal the advisory jail sentence for the offense of which you have been convicted. However, it may be as much as three times the advisory sentence for the offense of which you have been convicted. 9 Suspended Sentences and Probation If you are convicted of a criminal offense and are sentenced to a term of imprisonment, you may be eligible to have all or part of your sentence suspended and served on probation or in a community corrections program instead of in jail or prison. 10 Right to a Lawyer If you wish to have the advice and assistance of a lawyer, it is your obligation to hire a lawyer of your own choosing at your own expense, if you can afford to do so. If you intend to hire an attorney, you must do so within ten days if the charge against you is a misdemeanor, or within 20 days if the charge against you is a felony. This is because a lawyer can inform you of deadlines for filing motions and raising defenses. If those deadlines are missed, the legal issues that could have been raised will be waived, or lost to you. If you are unable to hire a lawyer without unusual hardship, the court will appoint a lawyer to represent you, if you qualify. If you know now that you cannot afford to hire a lawyer and wish to have a lawyer appointed to represent you, you should inform the judge of your request today. If you prefer to hire a lawyer of your own choosing at your expense, but find that you cannot do so and wish to have a lawyer appointed to represent you, you should file a written request with the court as soon as possible. The right to a lawyer is one of the most important rights that you have. Lawyers are educated, trained, and experienced in the law and will know much more about these proceedings than you could know. If you do proceed without the advice and assistance of a lawyer, you will be held to the same standards and requirements to which defendants who do have the advice and assistance of a lawyer are held. All communications with the court are required to be in written form and a copy must be provided to the prosecutor. All written communications should include the cause number of the case or cases in which you are a defendant. Guilty Plea Waiver of Rights If you choose to plead guilty to the charges filed against you,: 1. You waive, or give up, all of the rights to which you would otherwise be entitled; 2. You incriminate yourself by admitting that you committed the charge; 3. You will be convicted based on your own guilty plea without any other evidence or proceedings in the case; 4. You will be sentenced to those penalties authorized by Indiana law. Conduct and Decorum We are conducting initial hearings today for cases which may be filed in different courts. The times and dates of future hearings will differ.
