If your fellow members are not receiving this quarterly newsletter, tell them to call with current address information! or Toll Free if calling from outside of the Kansas City area In mid-february, I was privileged to represent Local Two as I participated in the annual Advisory Committee Meetings conducted by the United Food and Commercial Workers International Union. Opening remarks from International Union President Joe Hansen were followed by reports from Secretary-Treasurer Marc Perrone and Executive Vice Presidents Wayne Handley and Pat O Neill. Handley is the national president of UFCW Canada and O Neill is the director of the organizing department for our international union. On the second day of Advisory Committee meetings, the areas of organizing and growth, in addition to immigration reform, were addressed. Heather McGee, a spokesperson from Demos, a public policy organization working for an America where all have an equal say in our democracy and an equal chance in our economy, provided a presentation on retail s hidden potential. McGee spoke about how raising retail job standards could positively impact working families and consumers in addition to the retail sector itself. An update was also provided by the Strategic Organizing Group of the UFCW International Union. Dan Schlademan, the director of Making Change at Walmart, outlined that group s goals and plans. The UFCW has gone on record in support of principled, comprehensive immigration reform that treats all immigrants with respect and dignity and A Union on the Move calls on policy makers to create a modern, 21 st century legal immigration system that reflects our values. International Union Vice President Esther Lopez, who serves as the Director of UFCW s Civil Rights and Community Action Department, discussed legalization and a path to citizenship, interior enforcement, federal responsibility, border enforcement, and future flow. The final day of meetings began with information on the Affordable Care Act. International Union President Joe Hansen reported on the current status of the ACA. Also included was a discussion of legislation strategy, how ACA regulations affect UFCW local unions, and the status of state and federal exchanges. International Vice President Steve Powell then addressed the Advisory Committee with a report on current legislative and political action. The meeting concluded with presentations by officers from the following UFCW constituency groups: the Women s Network, the Minority Coalition, and the United Latinos. The Advisory Committee meetings were especially significant this year as they served as a precursor to the business to be conducted at the Seventh Regular Convention of the United Food and Commercial Workers International Union in August. I look forward to proudly leading 19 delegates and 3 alternates from Local Two as we attend this important convention in Chicago, Illinois. 4 UFCW Forms Alliance with Food Manufacturers on Senate Immigration Bill On May 7, 2013, the United Food & Commercial Workers International Union (UFCW) and the Food Manufacturers Immigration Coalition (FMIC) announced their partnership on comprehensive immigration reform in a letter sent to the Senate Gang of Eight, praising them for their efforts on S The labor-business coalition is also seeking improvements to the Senate bill in the areas of visa allocation and employment verification. We write in support of the comprehensive immigration reform process and thank you for your critical and constructive efforts in support of this legislation, says the letter signed by UFCW International President Joe Hansen and Barry Carpenter of FMIC. The labor-business coalition said they support the Senate bill s provisions to establish a roadmap to citizenship, protect family based immigration, promote smart, effective border enforcement, implement a workable, transparent employment verification system, and create an occupational visa for non-seasonal, permanent positions. However, Hansen and Carpenter are also calling for commonsense improvements to S. 744 in the areas of visa allocation and employment verification. The labor-business coalition asked for more flexibility when it comes to employment verification. Allowing employers to use SelfCheck in a uniform, nondiscriminatory fashion will create greater transparency for new employees and will enable employers to ensure that their new hires are not circumventing E-Verify, the letter reads. Moreover, the letter outlined: If an employer takes the extra step of deterring identity theft through the uniform use of Self-Check, then the employer should be presumed to have acted in good faith with respect to the E-Verify confirmations it receives. Finally, the labor-business coalition requested that Senators direct the U.S. Departments of Homeland Security and Justice to create regulations that would provide specific rules of the road describing a course of conduct that satisfies employment verification requirements and concurrently avoids anti-discrimination liability. If an employer follows these regulations, then the employer is presumed to have complied with both the verification and antidiscrimination rules, the letter reads. The labor-business coalition said they look forward to working with the Senate to improve S. 744 and seeing comprehensive immigration reform become the law of the land. Local Two members serving on Safety and Ergonomic Committees at Cargill, National Beef, and Seaboard participated in training sessions conducted by Robyn Robbins and Belinda Thielen from the Occupational Safety and Health Office of the UFCW International Union. National Beef (Liberal, Kansas) and Seaboard (Guymon, Oklahoma) employees met together for training in Liberal, Kansas, on May 8. Cargill and National Beef employees from Dodge City, Kansas, attended on May 9. Training focused on the identification of hazards, the evaluation of hazards, and the control of hazards coupled with the recognition that injuries and illnesses are frequently the result of hazards rather than worker wrongdoing or carelessness. OSHA, worker rights, and employer responsibilities were reviewed in addition to the importance of the union s participation in all areas of worker safety. 5 ProgressMissouri Exposes Ties Between Missouri Legislators and Corporate Front Group ALEC On April 25, 2013, Progress Missouri released a detailed research report exposing the influence of the American Legislative Exchange Council (ALEC) in the Missouri Capitol. The report is entitled Exposed: ALEC s Influence in Missouri. It questions who is writing our laws? ALEC is a lobbying group that hosts fancy retreats to bring corporations and state legislators together with the expressed purpose of creating model legislation. The appeal of ALEC rests largely on the fact that legislators receive trips, food, and lodging that amount to a free family vacation. As the St. Louis Post- Dispatch reported after the 2011 ALEC conference in New Orleans, Corporate benefactors made sure Missouri lawmakers attending the conference were well fed and hydrated. In this year s legislative session, more than 40 proposed bills have directly echoed ALEC models. They include classic attacks on working families such as the so-called right to work bill; a castle doctrine law that undermines social security; a bill that created voter registration hurdles for minority, elderly, and disabled voters; and, paycheck deception legislation that seeks to shut workers out of the political process. Rather than worrying about what s best for everyday working families, ALEC members are ceding their elected role in drafting legislation to corporate special interests that worry about stock prices and profits. ALEC s interference with the state legislative process has been viewed so negatively that more than 40 major corporations, including Walmart, Coca-Cola, General Motors, McDonald s, and Amazon.com have cut ties with them. Unfortunately, many notable Missouri politicians remain connected. More than 60 legislators in Missouri have been identified as having ties to ALEC, including Speaker Tim Jones, Majority Leader John Diehl, Lt. Governor Peter Kinder, and State Senator John Lamping. This level of outside influence in the Missouri Capitol is alarming. Missouri s working families would be better off if its elected leaders started caring about the concerns of the people who elected them. They re also installing restrictive voting procedures to reduce the turnout of younger, poorer, minority, and disabled voters. Their goal is to create an unbalanced and unfair economy where wages are as low as possible and profits replace respect for the workers that created them. ABC seeks to level the playing field. By bringing together thousands of workers, our political concerns are amplified to a decibel that is impossible to ignore. Bringing people together that s the heart of ABC. That s when we re strongest. That s when we re capable of winning hearts and minds. That s when we win the political fights that matter. 8 By: Cindi Nance, Recorder, Director of Collective Bargaining, Executive Assistant to the President The pro-business agenda of Missouri s Republican-controlled General Assembly definitely included plans for right to work legislation in the state. Once again, these efforts have been stalled at least for this session. Despite this development, we cannot just sit back and wait for the next anti-labor attack. We must all become educated about what our legislators are doing in Jefferson City and make them aware of how we expect to be represented. So, what is a right to work law? Despite its misleading name, this type of law does not guarantee anyone a job, and it does not protect against unfair firing. By undermining unions, socalled right to work laws actually weaken the best job security protection workers have the union contract. A state right to work law stops employers and employees from negotiating a type of agreement known as a union security clause that requires all workers who receive the benefits of a collective bargaining agreement (contract) to pay their share of the costs of representing them. In addition, these laws say unions must represent every eligible employee, whether or not the employee pays dues. In other words, right to work laws allow workers to pay nothing and still get all the benefits of union membership. As a result, these laws aren t fair to dues-paying members. If a worker (who is represented by a union and doesn t pay dues) is fired illegally, the union must use its time and money to defend that worker, even if that requires going through a costly, time-consuming legal process. But, proponents of right to work laws are not interested in simply providing workers with the choice of joining a union their ultimate goal is to have fewer, or no, unions to represent workers in the state. This would be a serious blow to Missouri workers. According to data from the U.S. Department of Labor and the U.S. Census Bureau, workers in states with these so-called right to work laws have a consistently lower quality of life than in other states. This includes lower wages, higher poverty, less access to health care, and poorer education for children. Why should our state adopt a losing strategy that lowers the standard of living for workers and their families? While labor has been involved in getting out the truth about how right to work for less laws may impact our state, there has also been a lack of unified support in the business community. Some businesses actually oppose the legislation because they recognize the benefits of working with unions and their skilled workers! 10 Making Change at Walmart is a campaign challenging Walmart to help rebuild our economy and strengthen working families. Anchored by the UFCW, Making Change at Walmart is a coalition of Walmart associates, union members, small business owners, religious leaders, community organizations, women s advocacy groups, multi-ethnic coalitions, elected officials and ordinary citizens who believe that changing Walmart is vital for the future of our country. methods in which food is produced, and the prices paid to producers. Why should we get involved? As the largest private employer in the United States and the world, Walmart is setting the standard for jobs. That standard is so low that hundreds of thousands of its employees are living in poverty even many that work full time. The problems extend to workers who toil in unsafe working conditions in subcontracted warehouses and also to workers in developing countries such as China and Bangladesh who make incredibly low wages while manufacturing the goods on Walmart s shelves. That pulls down standards for workers in the United States and around the globe. The company is also a major contributor to widening the gap between the very rich and everyone else. The average full time Walmart associate makes about $15,500 a year. And worse, Walmart is pushing more and more workers toward a permanent part-time status. Meanwhile, the six members of the Walton family heirs to the Walmart fortune and near majority owners of the company have a combined wealth of $93 billion. That s more than the bottom 30% of Americans combined. Because of its size and political influence, Walmart is affecting much more than just working conditions. Although it has gained much fanfare for its efforts in environmentalism, sustainability has mostly been a public relations campaign for Walmart. The company has written hundreds of press releases and thousands of blog posts but made little actual progress in reducing the environmental impacts of its products and business. And, Walmart has an outsized impact on our food system. It is the largest seller of food in this country. That gives Walmart influence over which foods are available to the public, the Across this country, in rural and suburban communities, too many small businesses have closed their doors due to competition from Walmart. Now, Walmart has aggressively set its sights on the final frontier large urban communities like New York City and Los Angeles. Across the country, workers and communities are coming together as one to say enough is enough. It is time for fundamental change at Walmart. For the first time in history, Walmart retail workers have a voice through the Organization United for Respect at Walmart (OUR Walmart). With thousands of members in hundreds of stores in more than thirty states, this courageous group of workers is speaking out and beginning to win improvements in their jobs and their lives. As we have seen throughout history, to truly change a giant like Walmart, the demand has to first come from a company s employees. That is why the work of OUR Walmart is so inspiring and important. The preliminary application for the 2014 scholarship competition will be printed in the 3rd and 4th quarter newsletters. Matthew Vallot (right) is the winner of the 2013 Dwayne Carman scholarship. He is a Local Two member who has been employed at Schulte s Fresh Foods in Jefferson City, Missouri, since August Matt plans to study music education at the University of Missouri in Columbia, Missouri. At MU, he hopes to participate in a variety of musical groups, including Marching Mizzou, the university wind ensemble, a pep band, a jazz combo, and a saxophone quartet.
