1 Mr Mihail DUMITRU Deputy Director General, Rural Development Directorate General, Agriculture and Rural Development European Commission 130, Rue de la Loi, B 1049, Brussels, Belgium Madrid, 2 nd March, 2015 Subject: Request for urgent correction of serious deficiencies in the public participation processes in the preparation of rural development programmes in Spain CC: Spanish Regional Authorities/MAGRAMA Dear Mr Dumitru, The undersigned organisations (96 entities representing up to people including associates and staff), are working to achieve a sustainable model of rural development that addresses the socio economic, environmental and territorial challenges of rural Spain, in accordance with current EU regulations on the CAP and European funds and in pursuit of the aims of the EU 2020 Strategy. Public participation is an indispensable element, required by EU law for rural development programming , and obligatory for the authorities who should ensure the involvement and participation of all interested parties. Faced with serious and continued failure of authorities in Spain to comply with these legal requirements, we are turning to the European Commission as guarantor of compliance with Community law, and to your Directorate General as responsible for this area of policy. We consider that the majority of authorities responsible for the regional rural development programmes (RDPs), as well as the State authorities (MAGRAMA) responsible for the national programme, have committed serious and systematic breaches of the legally required process of public participation, in the form of: Failure to identify and promote the involvement of all actors with a legitimate and significant interest in the process, including bodies representing civil society, such as non governmental organisations. Excessively short consultation windows. Insufficient public access to information and unequal access for different actors. Frequent absence of any response to the recommendations made by participants. Failure to complete the participation process and failure to prepare complete national and regional programming documents before sending drafts to the EC, from which time the participation has been largely non existent. Difficulty and in some cases impossibility to access the version of the RDP sent to the EC. 1

2 The EC observation letters to the Spanish authorities raised some of these issues, but the situation remains largely unchanged since the letters were sent. As a result of the inadequate preparation process, the programming documents have serious deficiencies, including incomplete and totally inadequate SWOT analyses with insufficient supporting data and a lack of coherence between the analyses and the proposed measures. As a consequence of the above, we consider there has been a serious breach by Spanish authorities of Delegated Regulation (EU) 240/2014 on the European Code of Conduct on partnership in the framework of the European Structural and Investment Funds, of Regulation (EU) 1303/2013 laying down Common Provisions on EU Funds, especially Article 5 and other Articles in relation to multi level governance, and the Aarhus Convention on "access to information, public participation in decision making and access to justice in environmental matters", ratified by the EU in We therefore request that the European Commission requires the authorities responsible for rural development programming in Spain to take the following steps to correct the current unsatisfactory situation: Immediate publication of the most recent versions of all programming documents as sent to the European Commission, Reactivation or establishment of the necessary communication channels with all interested actors, Participation, in the appropriate time and manner, of bodies representing civil society, including non governmental organisations, until the end of the process, Publication of the responses and assessments by the regional authorities and the State ministry of the contributions to the programming process received from civil society to date. If the deficiencies summarised above are not corrected, we consider that the national and regional RDPs once approved will be null and void, having breached the right of participation in the process of significant representatives of civil society and groups affected by the programmes. The whole process of planning and implementation of the programmes will be negatively affected. We believe there is still time to achieve a rural development programming for that delivers effective solutions for problems on the ground and that responds to the real needs of our rural environment and communities. A RDP can only be effective if it is based on good governance and avoids the damaging inertia of distributing funds in a way that only benefits interest groups established in previous programming periods.
