NOTICE OF SETTLEMENT AND PROCEDURES FOR RECEIVING A PARTIAL REFUND OR LOAN MODIFICATION ON YOUR WESTERN SKY LOAN The Michigan Department of Insurance and Financial Services ( DIFS ) and Department of Attorney General ( Attorney General ) authorized this notice, pursuant to a settlement reached between the State of Michigan and Western Sky Financial, LLC, Martin A. Webb, CashCall, Inc., WS Funding, LLC, Delbert Services Corporation, and J. Paul Reddam (the Settling Parties ). This Settlement Notice contains important information about your Western Sky Loan. Our records show that you took out a loan from Western Sky Financial, LLC between January 1, 2010 and December 31, 2013 (a Western Sky Loan ), while you were a Michigan resident. If this is correct, you are a Michigan Borrower who may be entitled to one of these additional benefits if you choose to follow the procedures described in this Settlement Notice: 1) If you have already repaid to the Settling Parties the amount that Western Sky loaned to you plus 7% interest annually, then you may be entitled to a partial refund from the $2.2 million Michigan Settlement Fund and your loan will be marked as paid in full (if outstanding and still owned by one of the Settling Parties as of the Effective Date, as defined below), but only if you complete and file a Claim Form by mail or online on or before September 18, 2015; or 2) If you have not yet repaid to the Settling Parties the amount that Western Sky loaned to you plus 7% interest annually, and the Settling Parties still own your Western Sky Loan, then your loan balance will be reset to the difference between the amount loaned to you and the amount you have repaid and the interest rate on this balance will be reset to 7% annually, but only if you complete and file a Claim Form by mail or online on or before September 18, The Claim Form you must complete to receive one of these additional benefits is enclosed. You may either file your completed Claim Form by mail (using the enclosed prepaid envelope) or you may complete it online at: 1

2 ADDITIONAL INFORMATION ABOUT THE SETTLEMENT: On May 6, 2015 (the Effective Date ), a settlement agreement (the Settlement ) was entered into between DIFS, the Attorney General, and the Settling Parties regarding Western Sky Loans made to Michigan Borrowers. The Settlement resolved an administrative proceeding brought by DIFS captioned: In the Matter of the Department of Insurance and Financial Services v. Western Sky Financial, LLC, and Martin A. Webb, Docket No DIFS, Case No RL, in the State of Michigan Administrative Hearing System (the Administrative Action ). The terms of the Settlement are contained in a Consent Order and Agreement, which you can review online at the Settlement website: The Settling Parties neither admit nor deny the allegations made in the administrative proceeding and contained in the Settlement. The Settling Parties have hired Dahl Administration, LLC as the Fund Administrator. The Fund Administrator will maintain and administer the $2.2 million Michigan Settlement Fund and is conducting the notice and claim process for Michigan Borrowers. Because of the Settlement, your rights and obligations under your Western Sky Loan may change. All Michigan Borrowers will automatically receive certain benefits (see Statement of Benefits below). You may be entitled to additional benefits, but only if you take the necessary steps described in this Settlement Notice. You are not obligated to file a Claim Form seeking these additional benefits. You are not required to pay anyone to file a Claim Form or participate in the Settlement. STATEMENT OF BENEFITS: If you file a timely, valid Claim Form, you are entitled to one of the additional benefits described on Page 1 of this Settlement Notice. The exact benefits you receive will depend on how much you have repaid the Settling Parties on your Western Sky Loan(s) and whether the Settling Parties still owned your loan as of May 6, Whether or not you choose to file a Claim Form, Michigan Borrowers will automatically receive the following benefits: If your loan remains outstanding and is still owned by the Settling Parties as of the Effective Date, then within 45 days of the Settlement, the interest rate on your loan s then-outstanding principal balance will be permanently reset to 7% annually. The Settling Parties may continue to collect on your loan at your current monthly payment amount until you repay the outstanding loan balance (including unpaid principal, accrued but unpaid interest, and future interest on principal at 7% annually) in full. The Settling Parties will stop making any negative credit reports to credit bureaus and will remove any pre-existing credit reports they have made regarding your Western Sky Loan. If your loan is still owned by the Settling Parties, they will not sell or assign your loan to any unaffiliated, third-party collection company. If your loan was sold to an unaffiliated, third-party collection company before May 6, 2015, the Settling Parties no longer own the loan and cannot reset your interest rate or mark your loan as paid in full. The State of Michigan is in the process of identifying and addressing loans that were sold to these unaffiliated companies. 2

3 HOW TO REQUEST ADDITIONAL BENEFITS: Michigan Borrowers who wish to receive the additional benefits described on Page 1 of this Settlement Notice (as applicable to your situation) are required to complete and file a valid Claim Form, either by mail or online, with the Fund Administrator on or before the Claim Deadline of September 18, If you file by mail, your Claim Form must be completed and mailed to the Fund Administrator with a postmark (or other mailing confirmation if by delivery method other than U.S. Mail) dated no later than the Claim Deadline. If you file online, you must complete the online Claim Form process at or before 11:59 p.m. Eastern Standard Time on the Claim Deadline. LATE CLAIMS WILL NOT BE ACCEPTED: The Fund Administrator will not accept or process any Claim Forms filed after the Claim Deadline. If you file an untimely Claim Form, you are ineligible to receive a partial refund or loan modification on your Western Sky Loan described on Page 1 of this Settlement Notice. However, you may pursue other private remedies as permitted or limited by applicable law. RELEASE OF CLAIMS: Michigan Borrowers who request and receive additional relief under the Settlement by submitting a Claim Form agree (and must execute a Release as part of the Claim Form indicating) that they forever and absolutely waive and release any and all claims they may have against the Settling Parties and their affiliates, owners, subsidiaries, heirs, successors, or assigns relating to the origination, making, or servicing of any Western Sky Loan to that Michigan Borrower occurring prior to the Effective Date. However, Michigan Borrowers who execute the Release, but who do not receive any additional relief because their Claim Form is untimely, materially deficient, invalid, or for any other reason, are not bound by the Release. If you have questions or concerns about the terms of the Release or what rights you are giving up if you participate in the Settlement, you should speak to your own attorney. CLAIM FORM PROCESSING: If you complete and timely file a valid Claim Form, you are entitled to the additional relief applicable to your Western Sky Loan described on Page 1 of this Settlement Notice. The appropriate adjustments to your Western Sky Loan will be made within a reasonable time after the Fund Administrator determines that your Claim Form is valid. TAX CONSEQUENCES: Your receipt of a partial refund or loan modification may have tax consequences. DIFS, the Attorney General, and the Settling Parties cannot advise you about any potential tax consequences, which you should discuss with your own tax preparer or attorney. Las partes del acuerdo pueden continuar cobrando su préstamo en su importe de pago mensual actual hasta que pueda volver a pagar el saldo del préstamo pendiente (incluso el capital impago, interés acumulado, pero impago e interés futuro en el capital a un 7% anual) en su totalidad. Las partes del acuerdo dejarán de realizar informes de crédito negativos a las agencias de crédito y eliminarán todos los informes de crédito preexistentes que hayan hecho relativos a su préstamo de Western Sky. 2

7 Si su préstamo está aún en manos de las Partes del acuerdo, no venderán ni asignarán su préstamo a ninguna compañía de cobranzas de terceros, no afiliada. Si su préstamo se vendió a una compañía de cobranzas de terceros, no afiliada antes del 6 de mayo de 2015, las partes del acuerdo ya no poseen más el préstamo y no pueden restablecer su tasa de interés ni marcar su préstamo como pagado en su totalidad. El estado de Michigan está en proceso de identificar y abordar los préstamos que se vendieron a esas compañías no afiliadas. CÓMO SOLICITAR BENEFICIOS ADICIONALES: Los prestatarios de Michigan que deseen recibir los beneficios adicionales descritos en la Página 1 de esta Notificación del Acuerdo (conforme corresponda a su situación) están obligados a completar y presentar un Formulario de Reclamo válido, por correo o en línea, con el Administrador del Fondo antes de la Fecha Límite del Reclamo del 18 de septiembre de Si lo presenta por correo, su Formulario de Reclamo debe ser completado y enviado al Administrador del Fondo con un sello (u otra confirmación de correo postal si el método de entrega es diferente al correo de los Estados Unidos) con fecha anterior a la fecha límite del reclamo. Si presenta su reclamo en línea, debe completar el proceso del Formulario de Reclamo en línea antes de las 11:59 p.m. hora estándar del Este en la fecha límite del Reclamo. LOS RECLAMOS TARDÍOS NO SERÁN ACEPTADOS: El Administrador del Fondo no aceptará ni procesará ningún Formulario de Reclamo presentado después de la fecha límite del reclamo. RENUNCIA DE RECLAMOS: Los prestatarios de Michigan que soliciten y reciban asistencia adicional bajo el acuerdo al presentar un Formulario de reclamo acuerdan (y deben celebrar una Renuncia como parte del Formulario de Reclamo que indique) que renuncian por siempre y en forma absoluta y eximen de todos los reclamos que puedan tener contra las partes del acuerdo, sus afiliados, casas matrices, subsidiarias, herederas, sucesores, o cesionarios en relación al origen, conducción o servicio de cualquier préstamo de Western Sky a un prestatario de Michigan que ocurra antes de la fecha vigente.
