1 PERSETUJUAN Dl BIDANG KERJASAMA KEBUDAYAAN DAN PENDIDIKAN ANTARA PEMERINTAH REPUBLIK INDONESIA DAN PEMERINTAH KERAJAAN SPANYOL Pemerintah Republik Indonesia dan Pemerintah Kerajaan Spanyol, selanjutnya disebut "Para Pihak"; BERKEINGINAN untuk mempererat hubungan persahabatan antara kedua negara dan bangsa serta meningkatkan sating pengertian dan pengetahuan bersama melalui hubungan kebudayaan, pendidikan, kepemudaan dan olah raga; DIILHAMI oleh komitmen bersama untuk meningkatkan upaya pengembangan kerjasama dalam bidang-bidang tersebut, didasarkan pada asas persamaan, saling menghormati dan saling menguntungkan; MEYAKINI bahwa i<erjasama merupakan instrumen nyata untuk memperdalam sating pengertian antara kedua bangsa; BERDASARKAN pada hukum dan peraturan perundang-undangan yang berlaku di masing-masing negara; TELAH MENYETUJUI hal-hal sebagai berikut: Pasal1 Kebudayaan Para Pihak akan mendorong pengembangan hubungan diantara kedua negara dalam bidang kebudayaan melalui: a. Promosi dan fasilitasi pengembangan pertukaran dan riset tentang permasalahan yang berkaitan dengan kepentingan bersama dalam bidang kebudayaan dalam arti oleh arti yang seluas-luasnya;

Promosi dan fasilitasi kontak-kontak langsung dalam bidang kesusasteraan, kerajinan plastik, seni lukis, film, arsitektur, museum, perpustakaan, aekeologi dan kearsipan, serta bidang-bidang kebudayaan lainnya; c. Peningkatan dan fasilitasi pertukaran informasi dan kerjasama mengenai hal-hal yang bertujuan untuk melestarikan dan melindungi warisan kebudayaan masing-masing. Pasal2 Pendidikan Para Pihak bermaksud mendorong pengembangan hubungan antara kedua negara dalam bidang pendidikan: a. memfasilitasi kerjasama, kontak-kontak dan pertukaran langsung antar perorangan, lembaga-lembaga dan badan-badan yang menangani pendidikan di kedua negara. b. c. memfasilitasi pembelajaran dan pengajaran bahasa dan kesusasteraan masing-masing pihak. memfasilitasi kerjasama dan pertukaran metode maupun materi pengajaran. d. mempelajari persyaratan-persyaratan untuk dapat saling mengakui ijazah dan gelar pendidikan universitas di kedua negara. Pasal3 Kepemudaan Para Pihak akan mengembangkan dan memfasilitasi kerjasama diantara kaum pemuda dan berbagai organisasi kepemudaan kedua negara. Pasal4 Olahraga Para Pihak akan mempromosikan dan memfasilitasi kerjasama diantara organisasi-organisasi olah raga, serta partisipasi dalam berbagai kegiatan olah raga yang diselenggarakan di kedua negara.

3 Pasal5 Seminar Para Pihak akan memfasilitasi kehadiran dalam berbagai seminar, festival, pertandingan, pameran, konferensi, simposium dan pertemuan dalam bidangbidang yang tercakup dalam Persetujuan ini dan yang diselenggarakan di kedua negara. Pasal6 Hubungan dengan Organisasi lnternasional lainnya Para Pihak akan mendorong kerjasama dalam bidang-bidang yang tercakup dalam Persetujuan ini tanpa mempermasalahkan hak dan kewajiban yang timbul bagi keduanya berkaitan dengan keikutsertaan sebagai pihak dalam persetujuan-persetujuan internasional lainnya, serta akan menaati ketentuan organisasi-organisasi internasional dimana kedua negara menjadi anggota. Pasal7 Komisi Bersama Bidang Kebudayaan dan Pendidikan \\ ( Untuk melaksanakan dan mengawasi pelaksanaan Persetujuan ini, Para Pihak ~ akan membentuk Komisi Bersama Bidang Kebudayaan dan Pendidikan., Komisi ini akan dikoordinasikan oleh Kementerian Luar Negeri masing-masing dan akan terdiri dari wakil-wakil dari Para Pihak. Komisi Bersama Bidang Kebudayaan dan Pendidikan akan mengevaluasi pelaksanaan dan prospek kerjasama, menetapkan berbagai pengaturan, program atau proyek serta mengawasi pelaksanaannya. Komisi Bersama Bidang Kebudayaan dan Pendidikan akan melakukan pertemuan secara berkala, secara bergantian di setiap negara: tanggal dan tempat pertemuan akan ditentukan melalui saluran diplomatik. Pasal8 Bentuk Pelaksanaan Kegiatan-kegiatan yang dicantumkan dalam Persetujuan ini akan dilaksanakan melalui pengembangan berbagai pengaturan, program atau proyek tertentu diantara institusi-institusi atau organisasi-organisasi terkait kedua negara. Berbagai pengaturan, program atau proyek tersebut harus menyebutkan secara rinci antara lain tujuan-tujuannya, pengaturan keuangan dan keterangan lainnya yang berhubungan dengan tanggung jawab pihak-pihak terkait.

4 Pasal9 Hak atas Kekayaan lntelektual Semua hasil dari kegiatan-kegiatan dalam bidang kebudayaan, kesenian dan kesusateraan yang dilakukan berdasarkan Persetujuan ini, tunduk kepada hukum dan peraturan yang terkait dengan perlindungan hak kekayaan intelektual dan ketentuan-ketentuan terkait lainnya yang berlaku di wilayah masing-masing Pihak, selama tidak diatur oleh persetujuan umum yang berlaku secara internasional. Pasal10 Pembiayaan Pembiayaan yang berkaitan dengan pelaksanaan Persetujuan ini ditanggung oleh masing-masing pihak berdasarkan keperluan dan sumber-sumbernya. Pasal11 Penyelesaian Sengketa. Setiap sengketa yang muncul dalam hal penafsiran dan/atau pelaksanaan dari Persetujuan ini akan diselesaikan secara bersahabat melalui konsultasi dan/atau perundingan. Pasal12 Perubahan Persetujuan ini dapat dikaji ulang atau diubah setiap saat dengan persetujuan tertulis dari masing-masing pihak. Revisi atau perubahan tersebut akan berlaku pada tanggal yang telah disepakati oleh Para Pihak dan merupakan bagian yang tidak terpisahkan dari Persetujuan ini. Pasal13 Pemberlakuan, Masa Berlaku dan Pengakhiran Persetujuan ini akan mulai berlaku pada tanggal diterimanya pemberitahuan terakhir dari masing-masing pihak melalui saluran-saluran diplomatik, yang menyatakan bahwa persyaratan konstitusional masing-masing Pihak telah dipenuhi untuk pemberlakuan persetujuan ini.

5 Persetujuan ini akan berlaku untuk jangka waktu 5 (lima) tahun dan akan diperpanjang untuk jangka waktu 5 (lima) tahun berikutnva. kecuali apabila salah satu Pihak memberitahukan secara tertulis mengenai keinginannya untuk mengakhiri persetujuan ini paling lambat 6 (enam) bulan sebelum berakhirnya Persetujuan ini. Pengakhiran Persetujuan ini tidak akan mempengaruhi keabsahan dan masa berlaku dari berbagai program atau kegiatan yang dibuat menurut Persetujuan ini hingga selesainya pelaksanaan program atau kegiatan tersebut. SEBAGAI BUKTI, yang bertandatangan di bawah ini, dengan diberi kuasa penuh oleh pemerintah masing-masing, telah menandatangani Persetujuan ini. DIBUAT dalam rangkap dua di Madrid pada tanggal tiga bulan Desember tahun dua ribu empat, dalam bahasa Indonesia, bahasa Spanyol dan bahasa lnggris, keseluruhan naskah mempunyai kekuatan hukum yang sarna. Dalam hal terjadi perbedaan penafsiran atas Persetujuan ini, naskah bahasa lnggris yang akan berlaku. 6 ACUERDO DE COOPERACION CULTURAL Y EDUCATIVA ENTRE EL GOBIERN O DE LA REPUBLICA DE INDONESIA Y EL GOBIERNO DEL REINO DE ESPANA E l Gobierno de Ia Republica de Indonesia y el Gobierno del Reino de Espana, en adelante denominados "las Partes"; DESEOSOS de estrechar las r.elaciones de amistad entre los dos palses. y entre sus pueblos y de promover el entendlmiento y el conoci:miento mutuos a traves de Ia cultura, Ia educaci6n, Ia juventud y el deporte; INSPIRADOS por un compr-omiso comun de intenslflcar., dentro, de los lfmites de sus capacidades, ;l.a promocion de fa cooperaci6n en los campos mencionados sobre Ia base de Ia igualdad y del respeto y el beneficia mutuos; CONVENCI.DOS de que Ia cooperaci6n es un instrumento id6neo para ampliar el entendim!iento mutua entre ambos pueblos; O,E CONFORMIDAD con las leyes y reglamentos vigentes en ambos pafses;!i~ HAN CONVENIDO en lo siguiente: ARTICULO 1 Cultura Las Partes promoveran el desarrollo de las relaciones entre los dos paises en el campo de Ia cultura: a) promoviendo y facuitando el desarrollo de intercambios y de investigaciones en relacion con problemas de lnteres comun en el campo de Ia cultura en su acepci6n mas ampua; b) promoviendo y facili'tando los co:ntactos di're.ctos en IOS ambitos de Ia literatura, las artes. plasticas, las artes escenicas, el cine, Ia arquitectura, l.os museos, las blbllotecas y archivos, Ia arqueologia y otros ambltos culturales;

7 2 c) promoviendo y facilitando ej, intercambio de informacion y Ia cooperacibn en relacion con las medidas encaminadas a conservar y prote9er su :patrimonio cultural respective. ARTiCULO 2 Educaci6n las Partes promoveran el desarrouo de las relaciones entre los dos paises en el ca.mpo de Ia educaci6n: a1) facihtando Ia coo.peraci,6n, l.os contactos y los intercambios entre los ctudadanos, las instituciones y los 6rganos res.ponsab:les de 'Ia educacion de ambos paises; b) fachitando el estudio y Ia enseiianza de las lenguas y Ia Uteratura de Ia otra Parte.; c) facilitando Ia coopetaoi6n y los intercambios de metodos y materiales didacticos; d) estudi'ando las condi'ciones necesarias para el reconooimiento mutua de dip ~lomas, tltulos 'Y grados unlversltarios en cada uno de los dos parses. ARTICULO 3 Juventud Las Partes fomentaran y facilitaran Ia ~cooperacion entre los j6venes y las organizaciones juveniles de ambos parses. 1/z_ ARTICULO 4 Deporte Las Partes fomentaran y facilitaran la coop~raci6n entre las organizadones deportivas y Ia pa:rticipa.ci6n en los eventos deportivos que se cel ebren en los dos paises. ARTICUlO 5 Sem,inarios Las Partes facilltaran Ia asistencia a los seminarios, festivales, concursos, exposici'ones, conferenclas, simpos,jos y reuniones en los campos a los que se aplica el presente Acuerdo qu~ se celebren en los dos paises.

8 3 ARTICULO 6 Relaci6n con otras organlzaclones internacionales Las Partes fomentaran Ia cooperaci6n en los ambitos mencionados en el presente Acuerdo sin perjuicio de los derechos y obligaciones d:imanantes para las Partes de otros acuerdos internacionales que hayan concluido, y de conformidad con l,as normas de las organizaciones internadonales a las que pertenezcan. ARTICULO 7 Comisi6n M:ixta de Cultura y Educaci6n Con objeto de dar ejecucion al presente Acuerdo y de efectuar el seguimiento de su aplicaci6n,,las Partes crearan una Comisi6n Mixta de Cultura y Educaci6n. Esta Comisi6n estara ~ coordlnada por los Ministerios de Asuntos Exteriores de las Partes y fa integraran representantes de ambas Partes. La Comisi6n Mixta de Cultura y Educaci6n evaluara la puesta en practi:ca y las perspectivas de Ia cooperaci6n, definira los acuerdos, programas o proyectos y supe.rvisara su reauzaci6n. La Comisi6n Mixta de Cul'tura y Educaci6n se reunira de forma 1/z_ perl6dica, alternativamente en un o y otro pais; Ia fecha y el Iugar de Ia reunion sa fijaran por conducto diplo,matico. ARTICULO 8 Formas de ejecuci6n las acti'vidades expresadas en el presente Acuerdo podrah ejecutarse mediante :Ja elaboracion de.acuerdos, programas o proyectos espedficos entre las instituciones u organi zaciones pertinentes de las Partes. En did1os acuerdos, programas o proyectos especfficos se estableceran, entre otros aspectos, los objet,ivos,.acuerdos financieros y otros detalles relatlvos a Ia intervencion concreta de cada uno de los,particlpantes. ARTiCULO 9 Propiedad rntelectual Cualquier resu,ltado de las actividades desarrolladas en los cam,pos de Ia cultura, el arte y Ia llteratura en virtud del presente Acuerdo estara sujeto a las disposiciones l'egales y reglamentarias relativas a Ia protecci6n de los derechos de autor y de otros derechos aflnes en 10S territorios respectivos de

9 4 las Partes, en Ia medida en que no este comprendido en el ambito de apucacion ~de un acuerdo general con caracter internacional. ARTICULO 10 Presupuesto Los gastos que se deriven para Espana de las actividades desarrolladas. en virtud del presente Acuerdo se cubriran con los credltos previstos en el presupuesto ordinario. ARTICULO 11 Soludon de controversias Cualqui:er controversia entre ras Partes derivada de Ia interpretacion y/o l!a aplicaci6n del presente A.cuerdo se resolvera de forma amlstosa mediante consultas y/o negociaciones. ARTICULO 12 Enmienda El presente Acuerdo podra ser rev ~isado o enmendado en cualquier momento con el consentimtento n1utuo por escrito de las Partes. Dichas revisiones o enmiendas entraran en vigor en Ia fecha que determinen las Partes y formaran parte.integrante del presente Acuerdo. ARTICULO 13 Entrada en vigor, duraci6n y terminaci6n El presente Acuerdo entrara en vigor en Ia fecha de Ia ultima de las notificaciones por las q,ue las Partes se comuniquen mutuamente, por conducto dipl.omatico, que se han cumplido sus respectivos requisitos constituclonales para dar efecto al presente. Acuerdo. El Acuerdo permanecera vigente por un perlodo de S (cinco} a nos y se prorrogara tacitamente por otro periodo de 5 (cinco) anos, salvo que una de las Partes notifique por escrito su intench)n de denunciar el presente Acuerdo 6 (seis) meses antes de Ia expiracion del mlsmo. La terminaci6n del presente Acuerdo no afectara a Ia validez ni a Ia duracion de ningun programa o activldad en curso que se desarrolle en virtud del presente A cuerdo hasta l ~a finalizaci6n de dicho programa o actividad.

Hecho en Madrid, el tres de diciembre de dos mil cuatro, por duplicado, en indonesio, espanol e ingles, siendo todos los textos igualmente autenticos. En caso de divergencia en Ia interpretacl6n del presente Acuerdo prevalecera el texto ingles. 11 AGREEMENT ON CULTURAL AND EDUCATIONAL COOPERATION BETWEEN THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND THE GOVERNMENT OF THE KINGDOM OF SPAIN The Government of the Republic of Indonesia and The Government of the Kingdom of Spain, hereinafter referred to as "the Parties"; DESIRING to strengthen the friendly relations between the two countries and its peoples and to promote mutual understanding and knowledge through culture, education, youth and sports; INSPIRED by a common commitment to enhance within their capabilities, the promotion of cooperation in the afore-mentioned fields on the basis of equality, mutual respect and benefit; CONVINCED the cooperation is a viable instrument for deepening mutual understanding between both peoples; PURSUANT to the prevailing laws and regulations of their respective countries; ~ HAVE AGREED as follows: Article I Culture The Parties will promote the development of relations between the_ two countries in the field of culture through: a. promoting and facilitating the development of exchanges and research in relation to problems of mutual interest in the fields of culture in the broadest sense; b. promoting and facilitating direct contacts in the fields of literature, plastic arts, scenic arts, films, architecture, museums, libraries, archives, archaeology and in other areas of culture; c. promoting and facilitating information exchanges and cooperation on measures aimed at conserving and protecting their respective cultural heritage.

12 Article 2 Education The Parties shall promote the development of relations between the two countries in the field of education : a. facilitating cooperation, contacts and direct exchanges between people, institutions and bodies responsible for education in both countries; b. facilitating the study and teaching of the languages and literature of the other party ; c. facilitating cooperation and exchanges of teaching methods and materials; d. Studying the conditions necessary for the mutual recognition of diplomas, degrees and university grades in each of the two countries. Article 3 Youth The Parties shall promote and facilitate cooperation between young people and youth organizations of both countries. Article 4 Sport The Parties shall promote and facilitate cooperation between sports organizations, as well as participation in sports events that take place in the two countries. Article 5 Seminars The Parties will facilitate attendance at seminars, festivals, competitions, exhibitions, conferences, symposia and meetings in the fields contemplated in this Agreement and which are held in both countries.

13 Article 6 Relationship to other International Organisations The Parties will stimulate cooperation in the fields referred to in this Agreement without prejudice of rights and duties arising to both under other international agreements entered into, and in compliance with the rules of the international organizations to which they belong. Article 7 Joint Cultural and Educational Commission In order to execute this Agreement and to verify the state of its application, the Parties shall establish a joint Cultural and Educational Commission. This Commission will be coordinated by the Parties' respective Ministries of Foreign Affairs and will comprise of representatives from the Parties. The Joint Cultural and Educational Commission shall evaluate the implementation and prospect of cooperation, define the arrangements, programs or projects and supervise their realization. 11 The Joint Cultural and Educational Commission will meet periodically, alternately in each country : the date and place of meeting will be decided through diplomatic channels. Article 8 Forms of Implementation Activities described in this Agreement may be implemented through the development of specific arrangements, programs or projects between the appropriate institutions or organization of the parties. Such arrangements, programs or projects should specify, inter-alia, the objectives, financial arrangement and other details relating to specific undertakings of all participants involved. Article 9 Intellectual Property Right Any result of activities in the fields of culture, arts and literature which performed under this Agreement shall be subject to the laws and regulations concerning the protection of intellectual property right and its neighboring rights in the respective territories of the parties insofar as these are not covered by a general agreement on an international character. /t

14 Article 10 Budget The Spanish costs arising from the activities pursued under this Agreement will be charged to the credits provided for in the ordinary budget. Article 11 Settlement of Disputes Any disputes between the Parties concerning the interpretation and/or implementation of this Agreement shall be settled amicably through consultations and/or negotiations. Article 12 Amendment This Agreement can be reviewed or amended at any time by mutual written consent by the Parties. Such revisions or amendments shall enter into force on such date as may be determined by the Parties and shall form an integral part of this Agreement. Article 13 Entry Into Force, Duration and Termination This Agreement shall enter into force on the date of the latest notification by which the Parties inform each other, through diplomatic channels, that their respective constitutional requirements for giving effects to this Agreement have been fulfilled. This Agreement shall remain in force for a period of 5 (five) years and shall tacitly be extended for another period of 5 (five) years, unless either Party notifies in writing of its intention to terminate this Agreement 6 (six) months prior to the expiration of this Agreement. The termination of this Agreement shall not affect the validity and duration of any ongoing programs or activities made under this Agreement until the completion of such programs or activities.

15 IN WITNESS WHEREOF, the undersigned, being duly authorized thereto by respective Governments, have signed this Agreement. Done in Madrid on the third day of December in the year two thousand and four, in duplicate, in Indonesian, Spanish and English languages, all texts being equally authentic. In case of any divergence on the interpretation of this Agreement, the English text shall prevail.
