Es esencial que cada quien que esté involucrado en las operaciones aéreas esté familiarizado con las regulaciones principales. 2 GEN Effective 31 MAY 12 AIP-REPUBLICA DOMINICANA f) Ley No sobre Seguridad Aeroportuaria y de la Aviación Civil, publicada en la Gaceta oficial No , de fecha 22 de julio 2011, la misma crea el Cuerpo Especializado en Seguridad Aeroportuaria y de la Aviación Civil (CESAC), en sustitución del Cuerpo Especializado en Seguridad Aeroportuaria (CESA) creado mediante el Decreto No f) Law Nr , about airport safety and civil aviation, published in the Official Gazette Nr , dated July 22nd 2011, which creates the Cuerpo Especializado en Seguridad Aeroportuaria y de la Aviación Civil (CESAC), in substitution of the Cuerpo Especializado en Seguridad Aeroportuaria (CESA) created by means of the decree Nr Decretos Vigentes Current Decrees a) Decreto No. 369 de fecha 28 de noviembre de 1994 y sus modificaciones sobre Tasas y Derechos: Decreto No , de fecha 25 enero de Decreto No , de fecha 14 febrero de Oficio No. 5877, de fecha 11 de abril de 1995, del Poder Ejecutivo. b) Decreto No , de fecha 13 de abril de 1992, que delimita ciertas áreas prohibidas, restringidas y peligrosas. c) Decreto No , del 31 de agosto de 1988, sobre el Pago de Tasas y Derechos Aeronáuticos, modificado por: Decreto No , del 27 de abril de Decreto No , del 12 de septiembre de d) Decreto No , del 11 de octubre de 2005 que establece la tarifa por el derecho al uso de las radioayudas a la navegación aérea de la República Dominicana. e) Decretos Nos y 2819, de fecha 26 de octubre de 1981, que restringen ciertas áreas para el vuelo de aeronaves que no sean militares. f) Decreto No. 1602, de fecha 11 de octubre de 1971, Gaceta Oficial No. 9247, de fecha 18 de diciembre de 1971, sobre zonas prohibidas a la navegación aérea. g) Decreto No. 1929, de fecha 25 de diciembre del 1967, Gaceta Oficial No. 9067, de fecha 31 de diciembre del 1967, que prohíbe el vuelo sobre varios recintos militares. h) Decreto No de fecha 23 de noviembre del 1971, Gaceta Oficial No. 9249, de fecha 18 de diciembre de 1971, que prohíbe el vuelo de aeronaves que no sean militares al servicio del Gobierno sobre ciertas zonas del territorio Nacional. i) Decreto No de fecha 28 de julio del 1989 por medio del cual se crea el Consejo Nacional de Seguridad Aeroportuaria de la República Dominicana. 3 AIP-REPUBLICA DOMINICANA GEN Effective 31 MAY 12 j) Decreto No , de fecha 22 de enero del 1997, del Poder Ejecutivo, que crea el Cuerpo Especializado de Seguridad Aeroportuaria (CESA), con la finalidad proteger las operaciones de la aviación civil contra los actos de Interferencia Ilícita, la seguridad de los pasajeros, la tripulación, instalaciones aeroportuarias, equipos de radioayuda a la navegación y publico en general. k) Decreto No , de fecha 11/10/2005, establece una nueva escala para el cobro por parte del IDAC, de las Tasas y Derechos para el uso de las instalaciones y servicios de navegación aérea ofrecidos por Sobrevuelos. l) Decreto No , de fecha 16/06/2005, que aumenta a US$15.00 dólares la tasa aplicable por pasajeros transportados a las empresas de transporte aéreo de servicios regulares desde y hacia la República Dominicana y a un monto de US$10.00 la tasa aplicable por pasajeros transportados a las empresas de transporte aéreo de servicios no regulares o charters. m) Decreto No , de fecha 26/07/2005, que modifica el Decreto ; dispone el aumento de $2.50 dólares la tasa aplicable por pasajeros transportados a las empresas de transporte aéreo de servicios regulares desde y hacia la República Dominicana y a un monto igual a la tasa aplicable por pasajeros transportados a las empresas de transporte aéreo de servicios no regulares o charters. n) Decreto No , de fecha 03/10/2006, que dispone que todas las empresas comerciales de transporte aéreo pagarán en dólares en igualdad de condiciones, las tasas y derechos aeronáuticos y aeroportuarios por concepto de pasajeros transportados en entrada y salida de la República Dominicana, así como los demás cargos, tasas y derechos por concepto del uso de facilidades y servicios aeronáuticos y aeroportuarios. ñ) Decreto No , de fecha 19/04/2007, que dispone igualar las tasas aeronáuticas y aeroportuarias que actualmente pagan como agentes de retención las líneas aéreas comerciales regulares y no regulares (charters), por los pasajeros transportados en entrada y salida desde y hacia la República Dominicana. o) Decreto No , mediante el cual el Poder Ejecutivo aprobó para estricta aplicación en territorio nacional, el Programa Nacional de Seguridad de la Aviación Civil, (PNSAC), cuya elaboración, mantenimiento, aplicación, administración y actualización son responsabilidad fundamental del CESA. Con la nueva disposición del Poder Ejecutivo de fecha 30 de septiembre del presente año quedó derogado el decreto No , de fecha 25 de septiembre del año 2000, del Programa Nacional de Seguridad de la Aviación Civil contra actos de interferencia ilícita y el Reglamento Nacional de Seguridad de la Aviación Civil. j) Decree Nr , dated January 22th, 1997, from the Executive Government, which creates the Cuerpo Especializado en Seguridad Aeroportuaria (CESA), in order to Project the civil aviation operation against illicit interference acts, passengers safety, crewmembers, air navigations facilities, air navigation aids and the public in general. k) Decree Nr , dated October 11th, 2005, established a new scale for collecting by the IDAC, the tax an rights for using the air navigation facilities offered for over fly. l) Decree Nr , dated June 16th, 2005, which increase to US$15.00 the tax applicable to air carrier for passenger transported in regular services to or from the Dominican Republic and US$10.00 the tax applicable to air carrier for passenger transported in non regular or charter flights. m) Decree Nr , dated July 26th, 2005, which modified the Decree Nr , sets the increase the tax on US$2.50 applicable to air carrier for passenger transported in regular services to or from the Dominican Republic an the same amount to the tax to air carrier for passenger transported in non regular or charter flights. n) Decree Nr , dated October 3rd, 2006, which sets that all commercial air carriers will paid in dollars in the same conditions, the aeronautical and aeroportuarios taxes and rights for transported passengers come in and getting out of the Dominican Republic, as the same as others charges, taxes and rights for the use of air navigation and aeroportuarios facilities. ñ) Decree Nr , dated April 19th, 2007, which sets equaling the aeronautical and aeroportuarias taxes that actually paid as regular and non regular (charters) commercial air carrier's retention agents for transported passenger come in and getting out of the Dominican Republic. o) Decree Nr , by means of which the Executive approved for strict application in national territory, the National Program of Security of the Civil Aviation, (PNSAC), whose elaboration, maintenance, application, administration and update are fundamental responsibility of CESA. With the new disposition of the Executive dated September 30th of the present year it was countermanded the decree Nr , dated September 25th, 2000, the National Program of Security of Civil Aviation against acts of illicit interference and National regulation of Security of Civil Aviation. 4 GEN Effective 31 MAY 12 p) Decreto No , modifica el Decreto No , derogando la letra a) del Articulo No. 12; mediante este Decreto se establecen nuevas tasas aeroportuarias y aeronáuticas, dicho Decreto entrará en vigencia a partir del 1ero. de febrero 2009 para las operaciones aéreas regulares y a partir del 1ero. de mayo del 2009 para las operaciones aéreas no regulares. q) Decreto No , de fecha 03/09/2008, que autoriza a la Corporación Aeroportuaria del Este, S.A., adquirir Sistemas de Información Aeronáutica y demás equipos, y ordena a las empresas de transporte aéreo que operan desde y hacia el Aeropuerto Internacional de Punta Cana, a pagar un US$1.00 por cada pasajero transportado en entrada y salida, como compensación por los gastos de adquisición de dichos equipos. r) Decreto , de fecha 30/05/2008, que faculta al Instituto Dominicano de Aviación Civil a percibir directamente la tasa aeronáutica de un dólar norteamericano por cada pasajero transportado de entrada y salida (asiento ocupado) en vuelos regulares y no regulares o charter en varios aeropuertos del país, y deroga el Decreto No s) Decreto No , de fecha 03/08/2004, que autoriza a las empresas de transporte aéreo desde y hacia la terminal aérea de Punta Cana, en vuelos internacionales regulares y no regulares, a pagar directamente mes por mes, en manos de la administración del Aeropuerto Internacional de Punta Cana, un dólar norteamericano US$1.00 por cada pasajero transportado en entrada y salida (asiento ocupado). t) Decreto No , de fecha 13/09/2003, que autoriza a las empresas de transporte aéreo que operan desde y hacia el Aeropuerto Internacional de Punta Cana, en vuelos internacionales regulares y no regulares, a pagar US$1.00 por cada pasajero transportado en entrada y salida, (asiento ocupado). u) Decreto No , de fecha 19/09/2002, que dispone que toda empresa que en la actualidad o en el futuro se desempeñe como operador, agente o consignatario de vuelos no regulares (charters), deberá obtener una Licencia de la Junta de Aeronáutica Civil que lo acredite como tal. v) Decreto No , de fecha 20/06/2002, que establece la suma que deberán pagar los solicitantes para la instalación de antenas y la construcción de helipuertos, aeródromos o aeropuertos.
