2 I. General Information The Arlington City Council is comprised of a Mayor and eight City Council members. Elections are conducted every spring in May. Arlington City Council meetings are broadcast live on the Arlington Government Channel (A.G.C.)and replayed throughout the week. Visit the City s Web site for the A.G.C. broadcast schedule. Support or Opposition on Agenda Items Anyone wishing to speak or register their support or opposition on a given matter should fill out a card available at the entrance and give it to a staff member at the main table before the opening of the meeting. If you ve signed up that you wish to speak, and your name is called: Please come to the microphone at the podium and state your name and address before you begin your presentation. To the extent possible, please refrain from repeating testimony which has already been given. Speakers in support or in opposition of an item will be given two minutes to make their statements. Public Hearings: an applicant has five minutes for their presentation and two minutes for any rebuttal. A bell will signal at the end of the speaker s time. Please wrap up your comments promptly. We ask that you address your comments to the Mayor and Council. III. Citizen Participation Citizen participation gives the public an opportunity to make comments or address concerns that are not posted on the evening s agenda. Please understand that the Mayor and Council are not permitted by law to respond to or address your concerns at this time, as these items are not included on the posted Council Agenda for this evening. The Mayor and Council may only ask clarifying questions and/or direct staff to take appropriate action. IV. Rules of Courtesy We ask that citizens and other visitors in attendance assist in preserving the order and decorum of this meeting. Any person making personal, profane, slanderous, or threatening remarks or who becomes disruptive while addressing the Mayor and the City Council or while attending the City Council meeting may be removed from the Council Chambers. Canvassing General and Special Election Results of May 9, 2015 A resolution canvassing the election returns and declaring election results in the general and special elections held in the City of Arlington on May 9, 2015 for the purpose of electing the Mayor and Council Members for Districts 3, 4, 5 and 8, and for the purpose of submitting to the voters an amendment to the Arlington City Charter to prohibit photographic traffic signal enforcement. Meet and Confer Resolution A resolution ordering a certification election to be conducted pursuant to Section of the Texas Local Government Code among the qualified police employees in order to determine whether a police officers association represents a majority of qualified Arlington police employees IV. 4 Staff Report Canvassing General & Special Election Results of May 9, 2015 City Council Meeting Date: Document Being Considered: Resolution RECOMMENDATION Approve a resolution canvassing the general and special election returns and declaring the election results of the May 9, 2015, City of Arlington General and Special Elections. PRIOR BOARD OR COUNCIL ACTION On January 20, 2015, Council adopted Ordinance No , calling a general election to be held on May 9, 2015 and designating June 13, 2015, as the date for a runoff election, if necessary. On February 24, 2015, Council adopted Ordinance No , calling a special election to be held on May 9, On April 14, 2015, the Council approved Resolution No authorizing a Joint Election Agreement with Tarrant County, and Resolution No appointing election officials for the May 9, 2015 general and special elections. ANALYSIS The purpose of the May 9, 2015 general election was to elect the Mayor and the Council Members for single member districts 3, 4 and 5 and at-large district 8. Additionally, a special election was held on May 9, 2015 for the purpose of submitting to voters an amendment to the Arlington City Charter to prohibit photographic traffic signal enforcement. The resolution reflects the number of votes received, plus the total number of votes cast. Staff will provide a certified computer printout, tabulated and printed by the Tarrant County Election Administrator s Office, for approval and execution. Early voting and Election Day totals will be combined into one report and listed by County precinct. Due to timeline requirements, the final confirmation of the election results from the Tarrant County Elections Administration will not be available at the agenda posting date. Staff will provide the final resolution with confirmed numbers at the City Council meeting. 5 Staff Report Meet and Confer City Council Meeting Date: Document Being Considered: Resolution RECOMMENDATION Approve a resolution ordering a certification election among the qualified Arlington police employees to determine whether a police officers association represents a majority of qualified Arlington police employees. PRIOR BOARD OR COUNCIL ACTION On February 14, 2006, by Resolution No , the City Council recognized the Arlington Police Association as the sole bargaining agent for Arlington police officers and covered employees except those exempt from inclusion pursuant to the Meet and Confer provisions in Section (a)(1) of the Texas Local Government Code. On September 17, 2013, by Resolution No , the City Council ordered a certification election among the Arlington qualified police employees pursuant to Section of the Texas Local Government Code. ANALYSIS The City Secretary received a petition from the Arlington Municipal Patrolman s Association (AMPA) on March 18, The petition includes 309 qualified signatures of the 611 qualified police employees for an approximate 50.6% majority. The petition requested the recognition of the association as the sole and exclusive bargaining agent for Arlington police officers pursuant to the Meet and Confer statute contained in the Texas Local Government Code. Currently, Arlington Police Association is the sole and exclusive bargaining agent pursuant to a petition filed on January 23, 2006, and a certification election held on February 3 and 5, When presented with a petition for change or modification of recognition of the sole and exclusive bargaining agent, City Council may require a certification election. A certification election should be conducted pursuant to section of the Texas Local Government Code. FINANCIAL IMPACT There is no immediate financial impact associated with this recommendation.
