2 20 Hudson Yards State Facility Air Permit Application Public Participation Plan CERTIFICATION DOCUMENT Introduction Hudson Yards Gen-Par, LLC (the applicant) is seeking a State Facility Air Permit from the New York State Department of Environmental Conservation (DEC) for the construction and operation of a combined heat and power (CHP) plant to be located at the Retail Podium Building (aka 20 Hudson Yards 500 West 30th Street), as well as all related emission sources in included in the air application, including boiler plant and emergency generator equipment (the proposed project ) at five buildings included in the air application throughout the project site, which is bounded by Tenth Avenue, West 30th Street, Eleventh Avenue, and West 33rd Street in Manhattan, of the previously approved eastern portion of the Caemmerer Yard (Subarea A1) development. The project site consists of Block 702, Lots 4, 10, 125, and 150, exclusive of the Culture Shed site, which contains the five buildings with air emissions sources included in the proposed project. Portions of the project site are currently under construction, including portions of the platform being constructed over the rail yard. Ongoing construction at the project site includes the 10 Hudson Yards office tower, 20 Hudson Yards Retail Podium Building, the 30 Hudson Yards office tower foundations, and the foundations for 15 and 35 Hudson Yards. The proposed CHP plant would be located atop 20 Hudson Yards (the Retail Podium Building) and would provide electrical power and hot and chilled water to that building as well as to each of the proposed project s towers (10, 15, 30, and 35 Hudson Yards). The CHP plant would not provide power or hot water to the Culture Shed. The proposed project would also include a boiler plant located in 20 Hudson Yards, and exempt boilers in each of the other buildings (i.e., 10, 15, 30, and 35 Hudson Yards), exempt small microturbines at 30 Hudson Yards, and one or more engine generators located in 20 Hudson Yards, and the towers of 10, 15, 30, and 35 Hudson Yards, which would be used to provide emergency back-up power and potentially for peak load shaving. As described above, the applicant is proposing to construct a CHP plant, boiler plant and emergency generator equipment to service 20 Hudson Yards. The proposed facility has applied to be classified as a minor source under federal and state regulations, and has applied for a cap on annual emissions of NO x from the CHP, boilers and emergency generators to be limited to less than 24.9 tons per year (TPY). Annual emissions of all other regulated pollutants are also below their respective major source thresholds. Therefore, the proposed project has applied to obtain a State Facility Permit. The proposed project will operate in full compliance with all applicable federal, state and local air quality regulations and standards and the application submitted presents data to support that the proposed project will not be subject to New Source Review (NSR) because of its operational parameters. ~ 1 ~ August 2015

3 20 Hudson Yards State Facility Air Permit Application Public Participation Plan Certification Document The operation of the CHP plant, boilers, and the site s various emergency back-up generators, is the subject of the State Facility Permit being sought from DEC. As part of the permitting process; in accordance with Commissioner Policy-29 Environmental Justice and Permitting (CP-29), DEC required the permit applicant to develop and execute a public participation plan targeting the local community, and conduct outreach as part of the environmental permit review process. As part of the 20 Hudson Yards permitting application to the DEC for a State Facility Air Permit, Hudson Yards Gen-Par, LLC (the applicant) prepared a Public Participation Plan (PPP) in accordance with CP-29. The PPP was submitted to DEC for review in May 2015 (further updated in June 2015) and the applicant was directed to proceed with the outreach plan pursuant to the submitted and approved PPP in June By issuing this Public Participation Plan Certification Document, Hudson Yards Gen-Par, LLC concludes the public participation aspect of the State Facility Air Permit application, and certifies that the requirements and tasks described in the project s PPP have been completed. The remainder of this document describes how the public participation and outreach tasks outlined in the PPP approved by DEC (June 2015) were completed. Completion of the Public Participation Plan The PPP for this permit application included a number of activities and six (6) primary outreach tasks that were to be undertaken to inform stakeholders about the proposed project and the State Facility Air Permit being sought from DEC. In June 2015, DEC directed the applicant to proceed with the outreach plan pursuant to the submitted and approved PPP. The methods employed to fulfill the requirements of the various outreach tasks identified in the approved PPP are presented in the sections below. Task # 1 -- Identify Affected Area As described in the June 2015 PPP (see Appendix A), the affected area for the project for outreach purposes was identified in consultation with DEC, and was established as the study area for this project. Because the project site is near the Hudson River, and adjacent to active rail yards, several active construction sites, and commercial uses, in a moderately densely populated area, the affected area for the project chosen represents an approximately ½-mile radius from the 20 Hudson Yards project site. Consideration of the uses and resident populations within this area ensured that potential Environmental Justice (EJ) concerns and effects were captured, that outreach would be undertaken to an appropriate area, and that interested entities (stakeholders) were identified, in particular stakeholders representing the area s minority and low-income populations, also known as EJ communities. Task #2 -- Identify Stakeholders and Create an Outreach Contact List Stakeholders who may be affected by the operation of the proposed CHP plant, boilers, and emergency back-up generator equipment at the 20 Hudson Yards site were identified. This was done in coordination with DEC representatives, referring to the Manhattan Community Board (CB) 4 and CB5 calendars, consulting available databases, and with input from the applicant. Stakeholders identified included the following groups: ~ 2 ~ August 2015

4 20 Hudson Yards State Facility Air Permit Application Public Participation Plan Certification Document Residents/neighborhood groups who reside or are active in the vicinity of the proposed project; Site adjacent and nearby property owners; Residents/neighborhood groups who participated in the previous environmental review for the 2005 No. 7 Subway Extension Hudson Yards Rezoning and Development Program Final Generic Environmental Impact Statement (FGEIS); Manhattan Community Board 4 (CB4), where the site is located, and Manhattan Community Board 5 (CB5), which lies adjacent to CB4, east of Eighth Avenue, and is included in a portion of the PPP outreach Study area; Local community and civic organizations, and any entities recommended by these groups; Environmental and business groups, and any entities recommended by these groups; Neighborhood Houses of Worship and religious establishments; Elected officials; and Other appropriate state and local government officials. The outreach contact list for the project was assembled, including names, addresses, telephone numbers (if available) and addresses (if available) of individuals and organizations (as described above) with a potential interest in the permit application and proposed facility improvements. Appendix A: PPP, Attachment A shows the outreach contact list that was developed for this project s PPP. In addition, as portions of the project are currently under construction, the applicant has been conducting ongoing outreach and coordination activities independent of this permitting process, with other local elected officials and groups, as identified in Appendix A: PPP, Attachment B. These individuals and groups were also included as contacts for this permitting application for outreach purposes. Task #3 -- Prepare Written Information Written information about the proposed action and the environmental permit review process was prepared for posting and distribution to the public and area stakeholders. The following written materials were prepared and made available to the public as part of this outreach effort via one or more of the following methods: general project mailings, and hard copies for public review at the project s five (5) local Document Repositories (see Task #4, below), as well as on the Hudson Yards project website found at the following link: Public Participation Plan (PPP), June 2015 (see Appendix A); Project Fact Sheets prepared in English and Spanish (see Appendix B); Information Availability Notice Mailings bilingual English/Spanish (see Appendix C); SEQRA Full Environmental Assessment Form (FEAF) and attachments; Environmental Justice Analysis; ~ 3 ~ August 2015

5 20 Hudson Yards State Facility Air Permit Application Public Participation Plan Certification Document Selected Project Drawings; State Facility Air Permit Application; and No. 7 Subway Extension Hudson Yards Rezoning and Development Program Final Generic Environmental Impact Statement (2005 FGEIS), January 2005 (in Separate Binders) In addition to this PPP Certification Document, once issued by the DEC, the Notice of Complete Application, and the Draft and Final State Facility Air Permits will also be made available to the public for review at the local document repositories, as well as on the project website. Task #4 -- Establish Document Repositories/Distribute Project Information In accordance with the June 2015 approved PPP, easily accessible document repositories were established within or near the outreach area (defined as part of Task 1, above), which are locations close to the 20 Hudson Yards project site. The locations of the PPP Document Repositories are shown in Appendix A, Attachment D, and included three (3) local libraries, and the offices of Manhattan CB4 and CB5. Additionally, project information was made available at the following project website: The locations of the document repositories were included in the Project Fact Sheets (English and Spanish versions) that were distributed, as well as in the bilingual Project Information Availability Notice mailings. The contents of the repositories were updated regularly, and were checked to ensure that no documents were missing. A list of document contents was prepared and updated, to help keep the repositories organized. The approved PPP (June 2015), Project Fact Sheets prepared in English and Spanish, Project Information Availability Notice letters bilingual English/Spanish, SEQRA Full Environmental Assessment Form (FEAF) and attachments, Environmental Justice Analysis, Selected Project Drawings, State Facility Air Permit Application; and the No. 7 Subway Extension Hudson Yards Rezoning and Development Program Final Generic Environmental Impact Statement (2005 FGEIS), January 2005 (in a Separate Binder), prepared as outreach materials for this project, were all made available more than 2 weeks in advance of the July 23, 2015 Public Information Session, at the project s five (5) local Document Repositories, and on the project website (noted above). These project materials, in outreach binders, were hand delivered to the Document Repositories on July 8, The project mailing also occurred on July 8, 2015, and included copies of the Project Information Availability Notice letters (English and Spanish) and the Project Fact Sheets (English and Spanish). These materials will remain available until four (4) months after the issuance of the Final State Facility Air Permit, as required by DEC. It is noted that no questions or comments were raised as a result of PPP outreach activities. No comments were received during the project s Public Information ~ 4 ~ August 2015

6 20 Hudson Yards State Facility Air Permit Application Public Participation Plan Certification Document Session held on July 23, 2015, nor were any comments submitted during the public comment period (ending on August 6, 2015) from stakeholders or the public at large. The Draft and Final State Facility Air Permit, and this PPP Certification Document, will be added to the Document Repositories so they will also be available for public review, once DEC has issued the Draft and Final State Facility Air Permits, and this PPP Certification Document has been submitted to, and accepted by, DEC. As required by DEC, the Document Repositories will be maintained for four (4) months after issuance of the final permit. Task #5 -- Conduct Public Information Session In accordance with the PPP, a Public Information Session was held to provide information about the proposed 20 Hudson Yards CHP plant, boilers, and emergency back-up generators, and the associated DEC permit application and permitting process. The Public Information Session was held on July 23, 2015 (from 6:00 PM until 8:00 PM) at the Baryshnikov Arts Center, located at: 450 West 37th Street, New York, NY a local indoor venue that is a familiar location to area residents. This meeting was a distinct standalone information session. Stakeholders were invited to the Public Information Session, and the applicant as well as consultant team members were available to receive and answer questions from the public about the proposed 20 Hudson Yards CHP plant, boilers, and emergency generators, and the State Facility Air Permit application. In accordance with the approved PPP, the logistics for the Public Information Session were publicized more than 14 days in advance, in order to give the public reasonable notification of the meeting date. The information session notices for the July 23, 2015 meeting were published in newspapers of local distribution, the Chelsea Clinton News/Westsider (English) and in El Diario (Spanish), on July 9, Copies of the Chelsea Clinton News/Westsider (English) and El Diario (Spanish) Ads and Affidavits of Publication are included in Appendix C. In addition, and as specified in the PPP (and described above in Task #4), more than 14 days in advance of the July 23, 2015 Public Information Session, Project Information Availability Notices were mailed to all interested stakeholders on the Contact List (and on the site construction ongoing local coordination list) announcing the project s Public Information Session, and availability of information. The Project Fact Sheet (English and Spanish versions) was also sent to the local organizations and all other stakeholders identified on the Contact Lists for posting at those locations as part of the general mailing. A copy of the Project Notices (English/Spanish) for the Information Session are included in Appendix C. As specified in the draft PPP, an agenda was prepared and made available for attendees at the public information session, and a power point presentation was prepared to present information about the proposed 20 Hudson Yards CHP plant, boilers, and emergency generators, the DEC permit being sought, and the permitting process, and how the public could provide comments on project materials, and the permit application in writing to a specified Hudson Yards Gen-Par, LLC consultant team representative. ~ 5 ~ August 2015

7 20 Hudson Yards State Facility Air Permit Application Public Participation Plan Certification Document Task #6 - Prepare Participation Plan Outreach Summary/Certification Document This report satisfies Task #6 of the PPP, and serves as the public participation plan s Certification Document, confirming that the permit applicant (in this case Hudson Yards Gen-Par, LLC) has complied with the provisions of the DEC approved PPP, and includes a written summary of the outreach conducted under the PPP. It is noted that no questions or comments were raised as a result of PPP outreach activities. No comments were received during the project s Public Information Session held on July 23, 2015, nor were any comments submitted during the open public comment period (ending on August 6, 2015) from stakeholders, elected officials, or the public at large. Appendix D contains the names of attendees at the Public Information Session (see copy of the Sign-In Sheet). In addition, Appendix D contains a copy of the Agenda for the Public Information Session that was prepared for the attendees, a copy of the Power Point presentation given at the Public Information Session, as well as a copy of the transcript from the Public Information Session. This Certification Document, including its Appendices, will become part of the permit application and will be made available to the public at the local Document Repositories (including the project website) upon its completion, and will remain at the five (5) local project Document Repositories (and the project website) for a period of not less than 4 months after the Final State Facility Air Permit is issued by DEC, in compliance with DEC policy. ~ 6 ~ August 2015

Once complete, the Project Site will include office towers on the northeast and southeast corners of the site (Tower A aka 30 Hudson Yards [500 West 33rd Street], and Tower C aka 10 Hudson Yards [501 West 30th Street], respectively); a residential tower on the southwest corner of the site (Tower D aka 15 Hudson Yards [553 West 30th Street]) connected to a cultural facility with a retractable roof (Culture Shed 545 West 30th Street), which is not part of the air application; a mixeduse tower on the northwest corner of the site (Tower E aka 35 Hudson Yards [560 West 33rd Street]), and 20 Hudson Yards (the Retail Podium Building) occupying the eastern midblock portion of the site. Existing Operations: The project area is the eastern portion of the Caemmerer Yard (Subarea A1) from the 2005 No. 7 Subway Extension Hudson Yards Rezoning and Development Program Final Generic Environmental Impact Statement (FGEIS), which is currently occupied by the Eastern Rail Yard Section of the Long Island Rail Road s (LIRR) John D. Caemmerer West Side Yard (the project area Block 702); an active below grade rail yard. The project site is a portion of the project area (Block 702, Lots 4, 10, 125, and 150), exclusive of the Culture Shed site, which contains the five buildings with air emissions sources included in the proposed project. Portions of the project site are currently under construction, including portions of the platform being constructed over the rail yard. Ongoing construction at the project site includes the 10 Hudson Yards office tower, 20 Hudson Yards Retail Podium Building, the 30 Hudson Yards office tower foundations, and the foundations for 15 and 35 Hudson Yards. Future Operations: The 20 Hudson Yards proposed project will have substantial energy needs, as well as heating and cooling needs. The proposed CHP plant aims to consolidate the power, heating and cooling needs of all of the buildings to create a more sustainable community, conserve energy, improve utility reliability and resiliency, and minimize greenhouse gas (GHG) emissions. The CHP plant would improve building energy efficiency by producing three utilities electric power and hot and chilled water for the five buildings on the project site with more efficiency than a conventional system. On-site power will reduce the electric load that is typically supplied by existing power plants, helping to manage peak electricity usage, particularly during the summer months. The proposed CHP plant would also improve the site s resiliency in the event of a utility grid outage, like the one that happened during Hurricane Sandy. In the event of a utility grid disruption, the proposed CHP plant would be electrically interconnected to 20 Hudson Yards (the Retail Podium Building) and the 30 ~ 1 ~ June 2015

Hot and chilled water would also continue to be generated and distributed to all five buildings on the project site. The proposed CHP plant would be located atop 20 Hudson Yards (the Retail Podium Building) and would provide electrical power and hot and chilled water to that building as well as to each of the proposed project s towers (10, 15, 30, and 35 Hudson Yards). The CHP plant would not provide power or hot water to the Culture Shed. The proposed project would also include a boiler plant located in 20 Hudson Yards, and exempt boilers in each of the other buildings (i.e., 10, 15, 30, and 35 Hudson Yards), exempt small microturbines at 30 Hudson Yards, and one or more engine generators located in 20 Hudson Yards, and the towers of 10, 15, 30, and 35 Hudson Yards, which would be used to provide emergency backup power and potentially for peak load shaving. Therefore, the project site is defined as Block 702 exclusive of the Culture Shed site (see Figure 1). The proposed CHP plant would have a capacity of approximately 13 megawatts (MW) and consist of four identical 3.3 MW natural gas fired engines equipped with selective catalytic reduction (SCR) for nitrogen oxides (NO x ) control and an oxidation catalyst for volatile organic compounds (VOC) and carbon monoxide (CO) control. The proposed project s operational parameters will include a NO x facility emissions cap, with monthly tracking of fuel usage and operating hours, which will ensure that emissions are below the major source thresholds for all regulated pollutants. The application submitted presents data to support that the boilers for the proposed project will not be subject to permitting per NYCRR 201-3, with the exception of the boilers in 20 Hudson Yards. Installation of the CHP plant equipment as well as the boilers and back-up generators is anticipated to begin in February 2016, with the completion of the CHP plant in the Fall of 2018, the boiler plant in 20 Hudson Yards in the summer of 2017, and some of the site s back-up generators in 2018, with the other boilers and back-up generators coming on line subsequently as they are completed in the other buildings on the project site. The proposed project will operate in full compliance with all applicable federal, state and local air quality regulations and standards and the application submitted presents data to support that the proposed project will not be subject to New Source Review (NSR) because of its operational parameters. Environmental Review and Permitting Process: Previous Environmental Review The project site was rezoned in 2005 as part of the larger rezoning of the Hudson Yards, which aimed to transform the Hudson Yards area into a high-density, mixed-use neighborhood. The Special Hudson Yards District was created to promote the transit-oriented redevelopment of the Hudson Yards area as a mixed-use community with new commercial and residential space, as well as a substantial amount of new open space. The project site is located within the Large-Scale Plan Subdistrict A, Subarea A1 of the Special Hudson Yards District. The Hudson Yards Rezoning was the subject of Uniform Land Use Review Procedure (ULURP) applications approved by the City Planning Commission (CPC) on November 23, 2004 and by the New York City Council on January 19, 2005 (C (A) ZMM and N ~ 2 ~ June 2015

The rezoning was analyzed in the No. 7 Subway Extension Hudson Yards Rezoning and Development Program Final Generic Environmental Impact Statement (FGEIS) completed on January 1, 2005 (the 2005 FGEIS). The 2005 FGEIS included a development plan for the eastern portion of the Caemmerer Yard (Subarea A1). The rezoning allowed for the eastern portion of the Caemmerer Yard (Subarea A1)to be developed with approximately 6.6 million gross square feet (gsf) of mixed-use development, including office, residential, hotel, retail, cultural and parking facilities, and public open space. The proposed CHP plant and the proposed State Facility Air Permit Application were not included in the 2005 FGEIS. The Special Hudson Yards District zoning regulations (the Hudson Yards regulations) were amended in 2009, 2012, and 2013, accompanied by further environmental review. In 2009, the Hudson Yards regulations were amended to revise the site planning and parking regulations (N ZRM). The amendment was analyzed in an Environmental Assessment Statement (EAS) and a Negative Declaration was issued on December 3, 2008 (CEQR No. 09DCP031M). In 2012, the Hudson Yards regulations were amended relative to the design of the public access areas, sign regulations and retail requirements, as well as to allow the use of the High Line as part of the required public access areas (N ZRM and N ZRM). The amendment was analyzed in an EAS, and a Negative Declaration was issued on January 25, 2012 (CEQR No. 12DCP095M). In 2013, the Hudson Yards regulations were amended relating to the development of the Culture Shed, a cultural facility that will offer exhibits, events, expositions, presentations, festivals and fairs related to visual arts, performing arts, culinary arts, literature, journalism, broadcasting, crafts, technology, fashion and design. The Eastern Rail Yard Culture Shed Text Amendment was analyzed in an EAS completed on February 1, A Negative Declaration was issued on February 4, 2013, and a Revised Negative Declaration was issued on June 17, 2013 (CEQR No. 13DCP083M). The Proposed Project As described above, the applicant is proposing to construct a combined heat and power (CHP) plant, boiler plant and emergency generator equipment to service 20 Hudson Yards. The proposed facility has applied to be classified as a minor source under federal and state regulations, and has applied for a cap on annual emissions of NO x from the CHP, boilers and emergency generators to be limited to less than 24.9 tons per year (TPY). Annual emissions of all other regulated pollutants are also below their respective major source thresholds. Therefore, the proposed project has applied to obtain a State Facility Permit. Since the State Facility Permit is considered a discretionary action, an environmental impact assessment is necessary to satisfy the requirements of the State Environmental Quality Review Act (SEQRA). As part of the permitting process, a SEQRA Environmental Assessment Form (EAF), examining the potential impacts of the proposed CHP plant, boilers, and back-up generators, was prepared and submitted to DEC in June The operation of the CHP plant, boilers, and the site s various emergency back-up generators, is the subject of the State Facility Permit being sought from DEC. This Public Participation Plan (PPP) is part of the 20 Hudson Yards permitting application. In accordance with Commissioner Policy-29 Environmental Justice and Permitting (CP-29), DEC requires the permit applicant to develop and execute a public participation plan targeting the local community, and conduct outreach as part of the environmental permit review process. ~ 3 ~ June 2015

14 Public Participation Plan 20 Hudson Yards State Facility Air Permit Application Public Participation Plan The PPP for this permit application includes a number of activities and tasks that will be undertaken to inform stakeholders about the proposed project and the State Facility Permit being sought from DEC. This will provide stakeholders access to information about the project and permit application and encourage dialogue. Task # 1 -- Identify Affected Area A 1/2-mile radius from the proposed project site has been selected in consultation with DEC staff, to ensure that outreach to an appropriate area and interested entities (stakeholders) is undertaken. This is shown in Figure 2, attached. Because the project site is near the Hudson River, and adjacent to active rail yards, several active construction sites, and commercial uses, in a moderately densely populated area, this outreach area was deemed to be appropriate by DEC. This area will serve as an initial component in identifying stakeholders. Particular emphasis will be placed on identifying stakeholders representing the area s minority and low-income populations for outreach during the public participation process. The project site is occupied by a below-grade rail yard, with the 10 Hudson Yards office tower currently under construction on the southeastern corner of the project site. The remainder of the project site is under construction, including the platform over the rail yard, and portions of the 20 Hudson Yards Retail Podium Building, the 30 Hudson Yards office tower foundations, and the foundations for the 15 and 35 Hudson Yards buildings. The surrounding area is dominated by transportation and utility uses, large parking facilities, US Postal Facilities, the Jacob. Javits Convention Center, and a number of active construction sites. The 1/2-mile outreach study area also includes a mix of commercial, residential and open spaces, including the High Line. There are still several areas zoned for manufacturing within close proximity of the project site, particularly along the waterfront, and the area does include a number of industrial/manufacturing uses. Within this 1/2-mile radius of the project site lies an approximately 1-mile section of the West Side Highway (12th Avenue), the Lincoln Tunnel approach roadways and Entrance/Exits, the Hudson River Greenway, and portions of the Hudson Yards/West Mid-town neighborhoods. Task #2 -- Identify Stakeholders and Create an Outreach Contact List Stakeholders who may be affected by the operation of the proposed CHP plant, boilers, and emergency back-up generator equipment at the 20 Hudson Yards site will be identified. This will be done in coordination with DEC and Community Board representatives, and with input from the applicant. It is expected that the stakeholders for this plan will include, but may not be limited to: Residents/neighborhood groups who reside or are active in the vicinity of the proposed project; Site adjacent and nearby property owners; Manhattan Community Board 4 (CB4), where the site is located, and Manhattan Community Board 5 (CB5), which lies adjacent to CB4, east of Eighth Avenue, and is included in a portion of the PPP outreach Study area; ~ 4 ~ June 2015

An outreach contact list of stakeholders has been assembled, including names, addresses, telephone numbers of individuals and organizations (as described above) with a possible interest in the proposed project. The overall eastern portion of the Caemmerer Yard (Subarea A1) development was included in a larger rezoning action in 2005, which aimed to transform the Hudson Yards area into a high-density, mixed-use neighborhood. The rezoning was analyzed in the 2005 FGEIS. The Hudson Yards regulations were amended in 2009, 2012, and 2013, accompanied by further environmental review, as described above. This in-depth environmental review process evolved and continued over approximately 10 years and resulted in the development of an outreach contact list for this permitting process that includes many of the entities that expressed an interest in the previous review process and/or provided comments on the 2005 FGEIS. This list will be updated regularly to include new stakeholders identified as the public participation process continues. The outreach contact list that has been developed to date for this plan is attached as Attachment A. In addition, as portions of the project are currently under construction, the applicant has been conducting ongoing outreach and coordination activities with other local elected officials and groups, as identified in Attachment B. Task #3 -- Prepare Written Information Written information on the proposed project and the permit review process will be prepared for posting and distribution. The following written materials will be prepared and made available to the public as part of this outreach effort: Project Fact Sheet bilingual English/Spanish (see Attachment C.); Information Availability Notice bilingual English/Spanish; Newspaper Advertisements for the Public Information Session bilingual English/Spanish; State Facility Air Permit Application; State Facility Air Permit (when available); SEQRA Full Environmental Assessment Form (FEAF) and attachments; Environmental Justice Analysis; and Public Participation Plan Prepared materials will be written in clear, concise language, avoiding legal or overly technical terminology. 17 20 Hudson Yards State Facility Air Permit Application Public Participation Plan Task #4 -- Establish Document Repositories/Distribute Project Information Easily accessible public Document Repositories will be established at locations close to the project site and easily accessible to stakeholders. It is anticipated that these will include local libraries and Community Board offices in or near the outreach area (defined above), and postings on the designated project website: The proposed locations of these document repositories are shown in Attachment D. The availability of any additional public Document Repositories, if they are established, will be noted in the Outreach Packages available at the Document Repositories, and on the website (identified above), when they become active. The repositories will contain a copy of the written information prepared for the proposed project s PPP, (as outlined above in Task #3) as well as copies of the permit applications and draft permits, once they are available. The contents of the repositories will be checked and updated regularly to ensure that no documents are missing. A list of document contents will be prepared and updated, to help keep the repositories organized. The locations and web address of the physical and web-based Document Repositories will be included in the Project Fact Sheet and in any project notices and/or flyers distributed publicly. Task #5 -- Conduct Public Information Session/Informational Briefings One Public Information Session will be held at a publicly accessible location in the outreach area to provide information about the proposed CHP plant, boilers, and emergency back-up generator equipment at the project site, and the associated DEC permitting process. In addition, project information will be sent to elected officials and Manhattan Community Boards 4 and 5, to provide information about the proposed project and the associated DEC permitting process. Stakeholders will also be invited to the Public Information Session and will be invited to provide comments on project materials and the PPP, in writing to a specified project team representative. The applicant and consultant team staff members will be available to receive and answer questions about the project at the Public Information Session and/or at any project briefings held. The information session (and any elected official briefings requested) will be scheduled after consulting Community Board calendars and with municipal and agency officials. This will help to avoid conflicts with important meetings or events that are regularly held or already scheduled within the community. It is anticipated that the Public Information Session will be held on July 23, 2015 (from 6:00 PM until 8:00 PM) at the Baryshnikov Arts Center, 450 West 37th Street, New York, NY a location nearby the project site that is conveniently accessible for the public. The Public Information Session will be held after the permit application has been submitted to DEC and is available for public review. The Document Repositories will be maintained for four (4) months after issuance of the final permit. Logistics for the Public Information Session will be publicized approximately two (2) to three (3) weeks ahead of the gathering date, in order to give stakeholders reasonable notification of the information session. A general mailing will be prepared for the project for delivery to all potentially interested parties on the Contact List (see Attachment A). This mailing will include a Project Notice announcing the project s Public Information Session, as well as a copy of the Project Fact Sheet, which will also be sent to the local organizations and all other stakeholders identified on the Contact List for posting at those locations. These Project Information Notices will include: the name of the project sponsor; the name and address of the proposed project; a brief description about the project information available for review; the description of why the project information is being sent; the comment period being provided for submitting comments on the project, and when the comment period will end; contact information for any questions about the project information, or how and where to provide comments (written or via website); and Where answers to any questions or comments submitted will be made available, and approximately by when, after the comment period has concluded. An agenda will be prepared and distributed when the Public Information Session is held. Attendees will also be informed of where they can obtain answers to any questions they may have after the information session has concluded. Outreach documents related to the proposed CHP plant, boilers, and emergency back-up generator equipment at the 20 Hudson Yards facility and the associated permit application will be available at the Document Repositories, and at the following website: Task #6 - Prepare Participation Plan Outreach Summary/Certification Document A written summary of the outreach conducted under the PPP will be prepared and submitted to the DEC. This report will serve as the participation plan s Certification Document, and will include: A summary of PPP milestones, outlining plan implementation; Methods used to engage the public and solicit outreach; Time and date of the Public Information Session; Time and date of project informational briefings undertaken (if any); Any substantive concerns/issues raised during outreach activities or received during the public comment period from stakeholders or the public at large; Descriptions of how the issues raised were addressed [in the form of a Response to Comments document(s)]; and A description of any unresolved or outstanding issues. The written Certification Document will confirm that the applicant has complied with the PPP, and will include a summary detailing the activities that occurred pursuant to the plan. 32 STATE FACILITY AIR PERMIT APPLICATION /20 HUDSON YARDS DEVELOPMENT SITE DESCRIPTION Hudson Yards Gen-Par, LLC (the applicant) is seeking a State Facility Air Permit, in accordance with 6 NYCRR Part 201-5, from the New York State Department of Environmental Conservation (DEC) for the construction and operation of a combined heat and power (CHP) plant in 20 Hudson Yards (a Retail Podium Building), as well as related boiler plant and emergency generator equipment (the proposed project ) at various locations throughout the overall project site of the previously approved eastern portion of Caemmerer Yards (Subarea A1) on a block bounded by Tenth Avenue, West 30th Street, Eleventh Avenue, and West 33rd Street in Manhattan. Once complete, the 20 Hudson Yards development will include office towers on the northeast and southeast corners of the site (30 Hudson Yards and 10 Hudson Yards, respectively); a residential tower on the southwest corner of the site (15 Hudson Yards); a mixed-use tower on the northwest corner of the site (35 Hudson Yards), and 20 Hudson Yards (Retail Podium Building) occupying the eastern midblock portion of the site. The project site is defined as Block 702, exclusive of the Culture Shed site. Figure 1 shows the locations of the project buildings and their street addresses. Figure 2 shows an artist s rendering of 20 Hudson Yards, where the CHP plant would be located. ISSUES/PROJECT GOALS The proposed project would meet the 20 Hudson Yards development's substantial energy, heating, and cooling needs and would provide a resilient energy generation system that will allow for continuous electrical and heat service so that the development would remain fully operational in the event of future events resulting in the disruption of utility services. THE PROPOSED PROJECT The proposed CHP plant would have a capacity of approximately 13 megawatt (MW) and consist of four identical 3.3 MW natural gas fired engines equipped with selective catalytic reduction (SCR) for nitrogen oxides (NO x ) control and an oxidation catalyst for volatile organic compounds (VOC) and carbon monoxide (CO) control. The CHP plant engines would exhaust from four stacks on the roof of 20 Hudson Yards. The CHP plant would provide electrical power and hot water to that building as well as to each of the towers at 10, 15, 30, and 35 Hudson Yards. A boiler plant would also be located in 20 Hudson Yards, which would serve this building and the lower portion of 30 Hudson Yards. Boiler plants would also be located at each of the other buildings (i.e., 10, 15, 30, and 35 Hudson Yards) to supply heating and hot water during peak demand periods. Finally, one or more emergency generators would be located in each of the 10, 15, 20, 30 and 35 Hudson Yards buildings, to provide life safety back-up power in the event of a utility power interruption. These generators will be enrolled in a demand response management program to provide additional power to reduce utility electric usage during periods of peak demand. The energy plan for the development is shown in Figure 3, showing schematically where the CHP plant, boilers, emergency generators would be located and how hot and cold water would be interconnected at the project site. The application submitted presents data to support that the boilers for the Proposed Project will not be subject to permitting per NYCRR 201-3, with the exception of the boilers in 20 Hudson Yards. PROJECT EFFECTS AND BENEFITS Certain environmental impacts are generally associated with combustion sources such as CHP plants, including air pollution. The applicant intends to implement measures that reduce or eliminate these impacts: this includes the use of clean fuels (natural gas for the CHP plant and boilers, and ultra low sulfur diesel for the emergency generators). In addition, the CHP plant will be equipped with an oxidation catalyst selective catalytic oxidation system for NO x control and an oxidation catalyst for control of volatile organic compounds and carbon monoxide, and the Retail Podium boilers will utilize low NO x burner technology. The proposed CHP plant would consolidate the power, heating and cooling needs of all of the towers to create a more sustainable new community, conserve energy, improve utility reliability and resiliency, and minimize greenhouse gas (GHG) emissions. Improve building energy efficiency by producing three utilities power and hot and chilled water for the five project site towers more efficiently than a conventional system. Reduce the cost of direct electrical distribution and create flexibility to match the supply and demand loads in each building. Reduce the electric load that is typically supplied by existing power plants, helping to manage peak electricity usage, particularly during the summer months. Reduce electrical transmission losses that occur when electricity is transmitted and distributed over long distances. Improve the site s resiliency to utility grid outages. In the event of a utility grid disruption, the proposed CHP plant would be electrically interconnected to 20 Hudson Yards and 30 Hudson Yards to provide these facilities with backup power and generate hot and chilled water to distribute to all five project site buildings. Installation of the CHP plant equipment as well as the boilers and back-up generators is anticipated to begin in February The CHP plant is expected to be completed in the Fall of 2018, with the 20 Hudson Yards boiler plant completed in the summer of 2017, and some of the project site s back-up generators completed in The other proposed boilers and back-up generators would come on line subsequently as they are completed in the other buildings on the project site. 42 STATE FACILITY AIR PERMIT APPLICATION /20 HUDSON YARDS DEVELOPMENT SITE DESCRIPTION Hudson Yards Gen-Par, LLC (the applicant) is seeking a State Facility Air Permit, in accordance with 6 NYCRR Part 201-5, from the New York State Department of Environmental Conservation (DEC) for the construction and operation of a combined heat and power (CHP) plant in 20 Hudson Yards (a Retail Podium Building), as well as related boiler plant and emergency generator equipment (the proposed project ) at various locations throughout the overall project site of the previously approved eastern portion of Caemmerer Yards (Subarea A1) on a block bounded by Tenth Avenue, West 30th Street, Eleventh Avenue, and West 33rd Street in Manhattan. Once complete, the 20 Hudson Yards development will include office towers on the northeast and southeast corners of the site (30 Hudson Yards and 10 Hudson Yards, respectively); a residential tower on the southwest corner of the site (15 Hudson Yards); a mixed-use tower on the northwest corner of the site (35 Hudson Yards), and 20 Hudson Yards (Retail Podium Building) occupying the eastern midblock portion of the site. The project site is defined as Block 702, exclusive of the Culture Shed site. Figure 1 shows the locations of the project buildings and their street addresses. Figure 2 shows an artist s rendering of 20 Hudson Yards, where the CHP plant would be located. ISSUES/PROJECT GOALS The proposed project would meet the 20 Hudson Yards development's substantial energy, heating, and cooling needs and would provide a resilient energy generation system that will allow for continuous electrical and heat service so that the development would remain fully operational in the event of future events resulting in the disruption of utility services. THE PROPOSED PROJECT The proposed CHP plant would have a capacity of approximately 13 megawatt (MW) and consist of four identical 3.3 MW natural gas fired engines equipped with selective catalytic reduction (SCR) for nitrogen oxides (NO x ) control and an oxidation catalyst for volatile organic compounds (VOC) and carbon monoxide (CO) control. The CHP plant engines would exhaust from four stacks on the roof of 20 Hudson Yards. The CHP plant would provide electrical power and hot water to that building as well as to each of the towers at 10, 15, 30, and 35 Hudson Yards. A boiler plant would also be located in 20 Hudson Yards, which would serve this building and the lower portion of 30 Hudson Yards. Boiler plants would also be located at each of the other buildings (i.e., 10, 15, 30, and 35 Hudson Yards) to supply heating and hot water during peak demand periods. Finally, one or more emergency generators would be located in each of the 10, 15, 20, 30 and 35 Hudson Yards buildings, to provide life safety back-up power in the event of a utility power interruption. These generators will be enrolled in a demand response management program to provide additional power to reduce utility electric usage during periods of peak demand. The energy plan for the development is shown in Figure 3, showing schematically where the CHP plant, boilers, emergency generators would be located and how hot and cold water would be interconnected at the project site. The application submitted presents data to support that the boilers for the Proposed Project will not be subject to permitting per NYCRR 201-3, with the exception of the boilers in 20 Hudson Yards. PROJECT EFFECTS AND BENEFITS Certain environmental impacts are generally associated with combustion sources such as CHP plants, including air pollution. The applicant intends to implement measures that reduce or eliminate these impacts: this includes the use of clean fuels (natural gas for the CHP plant and boilers, and ultra low sulfur diesel for the emergency generators). In addition, the CHP plant will be equipped with an oxidation catalyst selective catalytic oxidation system for NO x control and an oxidation catalyst for control of volatile organic compounds and carbon monoxide, and the Retail Podium boilers will utilize low NO x burner technology. Improve building energy efficiency by producing three utilities power and hot and chilled water for the five project site towers more efficiently than a conventional system. Reduce the cost of direct electrical distribution and create flexibility to match the supply and demand loads in each building. Reduce the electric load that is typically supplied by existing power plants, helping to manage peak electricity usage, particularly during the summer months. Reduce electrical transmission losses that occur when electricity is transmitted and distributed over long distances. Improve the site s resiliency to utility grid outages. In the event of a utility grid disruption, the proposed CHP plant would be electrically interconnected to 20 Hudson Yards and 30 Hudson Yards to provide these facilities with backup power and generate hot and chilled water to distribute to all five project site buildings. Installation of the CHP plant equipment as well as the boilers and back-up generators is anticipated to begin in February The CHP plant is expected to be completed in the Fall of 2018, with the 20 Hudson Yards boiler plant completed in the summer of 2017, and some of the project site s back-up generators completed in The other proposed boilers and back-up generators would come on line subsequently as they are completed in the other buildings on the project site.
