5 Preface The first OECD workshop on New Industrial Chemical Notification Schemes (February 1996, Paris) noted that the existing diversity of new chemical notification schemes among OECD countries had the potential for duplicative assessment effort. Emerging schemes in both OECD and non-oecd countries had further potential to increase duplication of effort placing additional demands for resources on national authorities and industry. Therefore, it was agreed as one of the follow-up activities that co-operation between non-oecd countries and OECD countries, industry and international organisations be extended to assist the development of compatible notification and assessment schemes and that workshops be organised. UNEP Chemicals and OECD Environmental Health and Safety Division initiated a collaboration to promote the awareness raising in developing countries and countries in transition regarding New Industrial Chemicals Notification and Assessment Schemes. A first workshop to discuss new chemicals notification schemes and information sharing was held for the Asia-Pacific region in Kuala Lumpur, Malaysia, on 7-9 January 1997 and the second one in Buenos Aires, Argentina on 8-10 March These Workshops form part of a global chemical management capacity-building programme undertaken by UNEP to help providing developing countries and countries in transition with a broad knowledge of chemical management approaches and tools. It also aims at making mutually supportive the work of UNEP Chemicals in encouraging strategic partnerships between countries and that of the OECD Environmental Health and Safety Programme in developing chemical hazard assessment and risk management methodologies with the support of its member countries.

10 Workshop Report Introduction The Workshop was hosted by the government of Argentina, through the Direction of Environmental Affairs, Ministry of Foreign Affairs International Trade and Worship, with the support of GTZ/Germany and Chemical Industry Associations. The Workshop was attended by 49 experts (see the list in Annex 1) from primarily Latin America and other regions (i.e., Europe and North America) including governmental and nongovernmental bodies and international organisations. The main purpose of the Workshop was to share information on procedures for new industrial chemical notification and assessment and to learn from the experiences of others. A Scheme for new industrial chemical notification and assessment represents one component in a chemical management strategy that can be considered by national governments. A number of countries in the Latin American region are considering developing and implementing such schemes. Given the diversity of existing schemes, emerging schemes in both OECD and non OECD countries have the potential to increase duplication of effort placing additional demands for resources on national authorities and industry. Existing schemes for new industrial chemicals notification and assessment are relatively sophisticated regulatory approaches for managing chemicals both in terms of technical capacity and resource needs. There are a number of such schemes already in existence, which have been developed progressively over the last twenty years. There is much experience to be shared about the merits of different approaches, the resource needs and the issues and problems faced. Objectives The objectives of the Workshop were to: discuss major consideration in developing and implementing appropriate new chemical notification systems (NCNSs), including consideration of resources and infrastructure needs; place new chemical notification requirements into the overall context of chemicals management; share experiences of government and industry from countries having operating new chemical notification systems with other countries possibly considering such systems; outline similarities and differences in various existing notification and assessment schemes for new industrial chemicals; assist to consider possible NCNSs compatible with current schemes which may be applicable to developing countries; help countries to determine whether notification and assessment of new industrial chemicals is an important element of their national chemical management programme at this point in time; review draft UNEP s Toolbook for new chemical notification systems; and 7

11 discuss further needs of participating countries for access to information on chemicals. THOUGH STARTER During a previous workshop in Mexico, April 1998, the following issues were identified for further consideration by the sub regional meeting. 1. Even though Latin American countries are mostly consumers of chemicals and not producers, they do need to set up country specific chemical management programs. In order to do so, they should first establish their own priorities for these programs. 2. Countries should be careful to avoid duplication. They need to review existing legislation to determine what is currently being done by others. They need to confer with industry and interested parties (NGOs) when establishing their regulations and guidelines. 3. If appropriate, countries may decide that they want to adopt a chemical inventory or a new chemical notification scheme if it meets their needs, and can be implemented under existing legislation. Mexico decided to adopt the US existing inventory (TSCA) due to the prohibitive cost of developing an inventory de novo. 4. Capacity building for information systems, risk evaluation, and laboratories must be strengthened. Countries need to look for types of support, other than financial, such as training of analytical chemists. 5. Countries should also investigate the possibility of establishing voluntary programs in cooperation with industry and NGOs. OUTCOMES Using the UNEP Toolbook as a starting point, participants discussed the role of new industrial chemicals notification schemes in the overall context of chemicals management, notification and assessment procedures and ways to manage new industrial chemicals notification schemes with limited resources by making better use of available information. The current regulatory situation of some Latin American countries was discussed as well as the status of NCNSs in Latin American Countries. CONCLUSIONS Specific Conclusions Chemical Inventories Value Chemicals inventories have value for identifying existing and new chemicals manufactured in or imported into the country. They provide clarity concerning the chemicals which are in 8

12 commerce, which is of value to government agencies (environment, occupational, customs, etc.) and industry. They may be a key tool used in enforcement activities. Problems and limitations Inventories can be difficult and costly to develop and maintain as they require specialised expertise. Confidentiality issues must be addressed, adding to the development cost. Inventories do not ensure chemical safety or management. Issues to consider when developing inventories Using one or more existing inventories from other countries, as such or modified to meet the specific needs, may help reduce cost and workload. Size and coverage can be limited by excluding certain substances (e.g., mixtures, naturally occurring substances) or focus on specific subsets such as known problem chemicals. New Industrial Chemicals Notification Schemes Value A NCNS requires each company that will manufacture or import a new chemical to gather and provide information on their new chemical for government(s) where the chemical will be manufactured or imported so that authorities can assess hazards and/or risks the new chemical may pose to the environment or human health. As a result, new chemicals posing an unreasonable risk to the environment or human health are not introduced into commerce and new chemicals that are safer for the environment or human health than those already in commerce can be identified. This facilitates the introduction of safer chemicals onto the market by industry. Limitations As a chemical management tool, NCNS targets new chemicals which make up only a small fraction of total chemical production (1-2 %). In addition new chemicals are not necessarily the most hazardous fraction, since most new chemicals present equal or lesser risks in comparison to existing chemicals. Further, NCNS can discourage the development or introduction of new chemicals due to costs or problems associated with new chemical review. Issues To Consider When Making Decision An essential issue is to consider whether establishing a program to review new chemicals is the best use of resources. Linkages New and existing chemicals are closely linked. Hence, inventories and NCNSs influence each other in permanence. If a country starts with a simple scheme, it can provide a basis for building capacity and that will help as it implements a somewhat larger or more comprehensive scheme later as experience is gained. General Conclusions Countries presented their views and needs related to chemicals management including NCNS. 9

13 1. New Chemical Notification Systems were explained based on the Toolbook. The presentations and outline of NCNS in the Toolbook were helpful to understand NCNS and proved the Toolbook to be a valuable resource document. 2. Even though Latin American countries are mostly consumers of chemicals and not producers, they do need to set up country specific chemical management programmes. In order to do so they should first establish their own priorities for these programs and they need to confer with industry and interested parties (NGOs) when establishing their regulations and guidelines. 3. At present, a NCNS is not a top priority for participating countries, except for Mexico. However, this could change with further analysis of chemical management priorities within individual countries. 4. Many suggestions were made beyond the scope of this workshop including: harmonization of legislation within the Latin American region; development of classification systems for industrial chemicals; improved access to material safety data sheet (MSDS) and information on new and existing chemicals available from industry, OECD Member countries, and international organizations; and development of capacity and capability to assess information and use of this information in legislative framework. A Non-Government Organization stressed that when planning future meetings pertaining to chemical management, all relevant parties should be invited, including workers and other stakeholders, to extend the basis of discussion. Industry representatives emphasized that introduction of NCNS in Latin American countries should not lead to non-tariff trade barriers. RECOMMENDATIONS 1. The need for capacity building beyond the scope of the PIC convention through cooperation between OECD Member countries and non-oecd countries should be stressed. 2. Mexico s draft proposal for a NCNS should be provided to UNEP for incorporation into the Toolbook. 3. The European Commission is encouraged to provide, upon request from participating countries, information on the 2,500 high production volume (HPV) chemicals. 4. After completion of the survey questionnaire on MSDSs, industry is encouraged to determine the problems encountered in developing countries in accessing MSDSs for chemicals and receiving test data when it exists, and working with authorities to address this problem. 5. Industry and OECD Member countries are encouraged to provide, upon request from participating countries, appropriate training on MSDS. 10

14 6. International industry s recommendations on practices and procedures for ensuring safe handling of CBI by developing countries should be added as an annex to the Toolbook. 7. UNEP is encouraged to continue improving the Toolbook module on NCNS and to request experience from developing countries and economies in transition. 8. UNEP is encouraged to ensure that the Toolbook includes a section that puts NCNS into an overall context of chemical management systems. 9. Industry is invited to develop an annex to Toolbook describing strategies and techniques that can be used by companies operating in developing countries (as well as smaller companies in developed countries) to understand and meet obligations in other countries if they intend to export their products. 10. While resource constraints are recognized, OECD and international industry are encouraged to consider organising an effort to share Member countries experience in enforcement and compliance practices and approaches. Furthermore, the OECD and international industry should consider organising and sharing this information to provide assistance, perhaps in the form of guidance, to developing countries in meeting the needs for these critical components. OECD Member countries and international industry are encouraged to facilitate training for developing countries in relation to enforcement and compliance. 11. MSDSs for Latin American region should be standardized according to ISO 1600 standard. 12. OECD is encouraged to consider developing a composite inventory for use by countries considering development of chemical inventories or NCNSs. OECD is also encouraged to continue its efforts to encourage harmonisation of NCNS. 13. OECD and IPCS (in the framework of IFCS), are encouraged to consider improving approaches that take into account the needs of countries under different climatic/ecological conditions (e.g., tropical, subtropical) and approaches to human (and environmental) exposure assessment under these climatic conditions. 14. UNEP/UNITAR are encouraged, with assistance of industry and interested countries, to develop a module on MSDSs to be included in the Toolbook. 15. The request from Latin American countries to obtain information on new and existing chemicals from OECD Member countries and non-oecd countries should be addressed with the understanding that the amount and type of information that can be provided is subject to CBI and legal restrictions. 11
