7 CITY OF SELMA TRANSIENT OCCUPANCY TAX INCREASE MEASURE K Shall the City of Selma increase the existing transient occupancy tax for the privilege of occupancy in any room, hotel, inn, motel or other lodging, for occupancy for a period of less than 30 days, from 6% to 12% of the rent charged by the operator of such lodging? FULL TEXT OF MEASURE ORDINANCE NO AN ORDINANCE OF THE VOTERS OF THE CITY OF SELMA AMENDING SECTIONS 1 AND 3 OF TITLE V, CHAPTER 15 OF THE SELMA MUNICIPAL CODE (SECTIONS AND ) INCREASING THE TRANSIENT OCCUPANCY TAX PROVIDED FOR BY THOSE PROVISIONS FROM 6% TO 12% OF THE RENT CHARGED BY AN OPERATOR OF A HOTEL, INN, TOURIST HOME, MOTEL OR OTHER LODGING OR OCCUPANCY FOR A PERIOD OF LESS THAN THIRTY DAYS WHEREAS, Sections 1 and 3 of Chapter 15 of Title V of the Selma Municipal Code (Sections and ) entitled Transient Room Tax Ordinance currently imposes a tax for the privilege of occupancy of 6% of the rate or rental charged by the operator for occupancy of any room in any hotel, inn, tourist home, house, motel or other lodging unless the occupancy is for a period of more than thirty days; and WHEREAS, Title I, Chapter I, Section 3 (1-1-3) of the Selma Municipal Code permits amendments to the provisions thereof and California Constitution Article XIIIC, Section 2(d) provides that no local government entity may impose, extend, or increase any general tax until such tax is submitted to the electorate and approved by a majority of the electorate voting on the tax and that the election to approve the general tax must be consolidated with a regularly - scheduled general election; and WHEREAS, the voters of the City of Selma desire to amend the aforementioned sections included in Chapter 15 of Title V of the Selma Municipal Code to change the title of the ordinance and increase the Transient Occupancy Tax imposed thereby from 6% to 12% of the rents charged by the operator of any of the aforementioned lodgings. NOW, THEREFORE, THE PEOPLE OF THE CITY OF SELMA DO HEREBY ORDAIN as follows: Section 1. Title V, Chapter 15, Section 1 of the Selma Municipal Code (5-15-1) is amended to read as follows: TITLE This Chapter shall be known as the Transient Occupancy Tax Ordinance of the City of Selma. Section 2. Title V, Chapter 15, Section 3 of the Selma Municipal Code (5-15-3) is hereby amended to read as follows: : TAX IMPOSED For the privilege of occupancy in any hotel, inn, tourist home, house, motel or other lodging, unless occupancy is for a period of more than thirty days, the transient is subject to and shall pay a tax in the amount of 12% of the rent charged by the operator. Said tax constitutes a debt owed by the transient to the City which is extinguished only by payment to the operator or to the City. The transient shall pay the tax to the operator of the hotel at the time the rent is paid. If the rent is paid in installments, a proportionate share of the tax shall be paid with each installment. Any unpaid tax shall be due upon the transient s ceasing to occupy the space in the hotel, inn, tourist home, motel or other lodging. If for any reason the tax bill is not paid to the operator of the hotel or other lodging, the Tax Administrator may require that such tax shall be paid directly to him or her. Section 3. This Ordinance relates to the levying and collecting of a general tax of the City and shall take effect 10 days following certification of the vote by the City Council. Section 4. The City Clerk shall certify the passage of this ordinance and publish the same as required by applicable law. Section 5. If any provision of this Ordinance, or the application thereof, to any person or circumstance is held invalid, the remainder of this Ordinance and the application of such provision to any other persons or circumstances shall not be affected thereby. IMPARTIAL ANALYSIS BY CITY ATTORNEY CITY OF SELMA TRANSIENT OCCUPANCY TAX INCREASE MEASURE [ELECTIONS CODE SECTION 9280] The City of Selma has an existing transient occupancy tax (TOT). The existing rate of the tax is 6% of what is charged by the operator of any hotel, motel or similar lodging for a period of less than thirty (30) days. The tax is paid by visitors, travelers and others who stay in hotels or similar lodging within the City and is not a direct tax on residents of the City. The TOT has not been increased since On July 1, 2013, the City Council of the City of Selma adopted a Resolution calling for a City wide municipal election to be consolidated with the general election on November 5, 2013, on Measure K the City of Selma Transient Occupancy Tax Increase Measure. Measure K provides for an increase in the transient occupancy tax from six percent (6%) to twelve percent (12%) of the rate charged to the transient for the privilege of occupying any room or rooms in any inn, hotel, motel, or lodging within the City for a period of less than thirty (30) days. The measure and the implementing ordinance adopted by the Selma City Council will amend that part of existing City ordinances which imposes the tax by increasing the tax rate from six percent (6%) to twelve percent (12%) and changing the name of the existing City ordinance from the Transient Room Tax Ordinance to the Transient Occupancy Tax Ordinance. 8 The City is authorized to impose the transient occupancy tax pursuant to Revenue and Taxation Code The existing transient occupancy tax and the 6% increase of the tax provided for by Measure K and the implementing ordinance is a general tax in that the revenues from the 6% increase may be used for any general governmental purposes. Article VIIIC of the California Constitution (Proposition 218) requires the increase in the tax rate be approved by a majority vote of the electorate. In adopting the resolution which places this measure on the ballot, the City Council unanimously found that the increase is necessary to fund added expense of providing City service generally and of providing parks and recreation, arts and cultural activities for persons who are non-residents that stay in City hotels and motels. The above statement is an impartial analysis of Ordinance No and Measure K. Costanzo City Attorney for the City of Selma ARGUMENT IN FAVOR OF MEASURE K Most cities impose a Transient Occupancy Tax (TOT) at a specified percentage of the rate or rental charged by an operator of any hotel, motel or other temporary lodging within the city. Selma currently imposes a TOT of 6% of the rate charged by the hotel or motel operator. The rate was set in 1982 and has never been adjusted for inflation. The rate charged by most neighboring cities is 12%. Approval of the Measure will increase the rate of Selma s TOT to 12%. The TOT is not a tax that is charged to or paid by residents of the City, unless that resident stays at a Selma hotel or motel. It is paid by persons who visit or travel to Selma and stay in hotels or motels within the City. The TOT funds the added expense of providing City services generally, including parks and recreation and cultural activities for persons who are not residents of the City. The increase in the TOT tax rate will allow for the continuing funding of the added expense of providing City services to persons who are not residents of our City so that the added expense is not required to be subsidized by City residents. Even with no new hotels or motels in the City, the rate increase will immediately double the revenues available to the City from the TOT for providing City services, and for enhancing its park, recreational, art and cultural activities and facilities to attract even more visitors who contribute to economic activity within the City. TEXTO COMPLETO DE LA INICIATIVA DE LEY ORDENANZA NÚM ORDENAZA DE LOS ELECTORES DE LA CIUDAD DE SELMA QUE ENMIENDA LAS SECCIONES 1 Y 3 DEL TÍTULO V, CAPÍTULO 15 DEL CÓDIGO MUNICIPAL DE SELMA (SECCIONES Y ) PARA AUMENTAR EL IMPUESTO A LA OCUPACIÓN TRANSITORIA PREVISTO EN ESAS DISPOSICIONES DEL 6% AL 12% DE LA RENTA QUE COBRA EL OPERADOR DE UN HOTEL, HOSTAL, CASA DE TURISTAS, MOTEL U OTRO LUGAR DE HOSPEDAJE U OCUPACIÓN DURANTE UN PERÍODO DE MENOS DE TREINTA DÍAS CONSIDERANDO que las Secciones 1 y 3 del Capítulo 15 del Título V del Código Municipal de Selma (Secciones y ) titulado Ordenanza de Impuesto a la Ocupación Transitoria actualmente impone un impuesto por el privilegio de ocupación de 6% de la tarifa o renta que cobra el operador por la ocupación de una habitación en cualquier hotel, hostal, casa de turistas, casa, motel u otro lugar de hospedaje a menos que la ocupación sea por un período de más de treinta días; y CONSIDERANDO que el Título I, Capítulo I, Sección 3 (1-1-3) del Código Municipal de Selma permite enmiendas a las disposiciones previstas en el mismo y que el Artículo XIIIC, Sección 2(d) de la Constitución de California estipula que ninguna entidad gubernamental local puede imponer, ampliar, o aumentar ningún impuesto general hasta que dicho impuesto haya sido sometido a votación del electorado y aprobado por una mayoría de los electores que acudieron a votar sobre el impuesto y que la elección para aprobar el impuesto general debe consolidarse con una elección general programada regularmente; y CONSIDERANDO que los electores de la Ciudad de Selma desean enmendar las secciones anteriormente mencionadas que se incluyen en el Capítulo 15 del Título V del Código Municipal de Selma para cambiar el título de la ordenanza y aumentar el Impuesto a la Ocupación Transitoria establecido en el mismo del 6% al 12% de la renta que cobra el operador de cualquiera de los lugares de hospedaje antes mencionados. EN VIRTUD DE TODO LO ANTERIOR, EL PUEBLO DE LA CIUDAD DE SELMA POR LA PRESENTE DECRETA lo siguiente: Sección 1. Título V, Capítulo 15, Sección 1 del Código Municipal de Selma (5-15-1) se enmienda para quedar como sigue: TÍTULO Este Capítulo se conocerá como Ordenanza de Impuesto a la Ocupación Transitoria de la Ciudad de Selma. Sección 2. como sigue: Título V, Capítulo 15, Sección 3 del Código Municipal de Selma (5-15-3) por la presente se enmienda para quedar : IMPUESTO ESTABLECIDO Por el privilegio de ocupación en cualquier hotel, hostal, casa de turistas, casa, motel u otro lugar de hospedaje, a menos que la ocupación sea por un período de más de treinta días, el huésped estará sujeto al pago de un impuesto por un monto equivalente al 12% de la renta que cobra el operador. Dicho impuesto constituye una deuda del huésped con la Ciudad que sólo se salda por medio del pago al operador o a la Ciudad. El huésped deberá pagar el impuesto al operador del hotel en el momento de pagar la renta. Si la renta se paga a plazos, una parte proporcional del impuesto se pagará con cada plazo. Todo impuesto pendiente de pago deberá cubrirse en cuanto el huésped deje de ocupar el espacio en el hotel, hostal, casa de turistas, motel u otro lugar de hospedaje. Si por alguna razón el impuesto adeudado no se paga al operador del hotel u otro lugar de hospedaje, el Administrador de Impuestos puede exigir que dicho impuesto se pague directamente a él o ella. Sección 3. Esta Ordenanza se relaciona con la imposición y recaudación de un impuesto general de la Ciudad y entrará en vigor 10 días después de la certificación de los votos emitidos por el Concejo Municipal. Sección 4. El Secretario Municipal certificará la aprobación de esta ordenanza y la publicará de conformidad con que lo estipula la ley aplicable. Sección 5. Si alguna disposición de esta Ordenanza o la aplicación de la misma a cualquier persona o circunstancia se considera inválida, el resto de la Ordenanza y la aplicación de dicha disposición a otras personas o circunstancias no resultarán afectadas por esa razón. ANÁLISIS IMPARCIAL POR EL ABOGADO MUNICIPAL INICIATIVA DE LEY PARA AUMENTAR EL IMPUESTO A LA OCUPACIÓN TRANSITORIA DE LA CIUDAD DE SELMA [CÓDIGO ELECTORAL SECCIÓN 9280] La Ciudad de Selma tiene actualmente un impuesto a la ocupación transitoria (TOT). La tasa vigente del impuesto es de 6% de lo que cobra el operador de cualquier hotel, motel o lugar similar de hospedaje por un período de menos de treinta (30) días. Los visitantes, viajeros y otras personas que se hospedan en hoteles o se quedan en lugares similares de hospedaje dentro de la Ciudad pagan este impuesto y, por lo tanto, no es un impuesto directo que afecte a los residentes de la Ciudad. El TOT no se ha incrementado desde SMKS-1 FR

10 El 1 de julio de 2013, el Concejo Municipal de la Ciudad de Selma adoptó una Resolución para convocar a una elección municipal en toda la Ciudad que se consolidará con la elección general del 5 de noviembre de 2013, sobre la Iniciativa de Ley K la Iniciativa de Ley para Aumentar el Impuesto a la Ocupación Transitoria de la Ciudad de Selma. La Iniciativa de Ley K dispone un aumento del impuesto a la ocupación transitoria del seis por ciento (6%) al doce por ciento (12%) de la tarifa cobrada al huésped por el privilegio de ocupar cualquier habitación o habitaciones en cualquier hostal, hotel, motel u otro lugar de hospedaje dentro de la Ciudad por un período de menos de treinta (30) días. La iniciativa de ley y la ordenanza que la implementa adoptada por el Concejo Municipal de Selma enmendarán la parte de las ordenanzas de la Ciudad donde se establece el impuesto, aumentando la tasa impositiva de seis por ciento (6%) a doce por ciento (12%) y cambiará el nombre de la ordenanza actual de la Ciudad de Ordenanza de Impuesto a la Ocupación Transitoria de Habitación a Ordenanza de Impuesto a la Ocupación Transitoria. La Ciudad cuenta con autorización para establecer el impuesto a la ocupación transitoria de conformidad con lo previsto en el Código de Rentas e Impuestos El impuesto vigente a la ocupación transitoria y el aumento de 6% del impuesto que prevé la Iniciativa de Ley K y la ordenanza que la implementa es un impuesto general en el sentido que la recaudación proveniente del aumento de 6% podrá usarse para cualquier propósito gubernamental general. El Artículo VIIIC de la Constitución de California (Propuesta 218) exige que el aumento de la tasa impositiva sea aprobado por una mayoría de votos del electorado. 13 Information for Voters Voting at the Polls What happens when I go to the polls on Election Day? First, a precinct officer will ask you to state your name and address out loud. Second, you will be asked to sign the Roster of Voters. Third, the precinct officer will give you a ballot and secrecy sleeve and direct you to a voting booth. Finally, you mark your ballot and take it to the ballot box. If you need assistance with the voting process, ask the precinct officer to help you. Do I need identification to vote? The only voters who will be asked for ID at the polls are those who registered by mail but didn t provide a drivers license number on the registration form and are voting for the first time in a federal election. What if my name isn t on the Roster of Voters or I don t have my Vote-By- Mail ballot to surrender? If your name is not on the Roster of Voters at the polling place, or you are a Voteby-Mail voter, but do not have your ballot to surrender, a precinct officer will offer you a provisional ballot. What is a provisional ballot? A provisional ballot is an official ballot that the voter gets at the polls and puts inside a special pink envelope after they have signed the provisional roster. The voter fills out and signs the form on the envelope, and returns it to a precinct officer. The ballot inside the envelope is counted after Election Day provided the voter is registered to vote in Fresno County and has not voted elsewhere in that election. Provisional voters get a receipt with a phone number they can call after the election to check if their ballot was counted. Why would my name not be printed on the Roster of Voters at the polls? The most common reasons are: You are in the wrong polling place, or You changed your name and did not re-register to vote, or You moved into Fresno County or moved to a new precinct within Fresno County but did not re-register to vote, or You never registered or registered after the Roster was printed.
