1 CARTA SUPLEMENTARIA DE CONVENIO ENTRE LA UNIVERSITY OF, CANADÁ Y LA UNIVERSIDAD DE GUADALAJARA, MÉXICO i- S/ 171 /2UUU 1. PREÁMBULO 1.1 Según el Convenio de Cooperación Académica entre University of Calgary ("UofC") y la Universidad de Guadalajara ("UdeG "), las Partes acuerdan un Intercambio de personal académico y administrativo, y de estudiantes (en lo sucesivo denominado el "Intercambio"), sujeto a los siguientes términos: 2. DEFINICIONES 2.1 En esta Carta Suplementaria de Convenio: a) La "Universidad de Origen" significa la universidad de la cual un estudiante pretende graduarse o la universidad que es el patrón del personal académico; b) La "Universidad Receptora" significa la universidad que ha acordado recibir los participantes del Intercambio; y c) El "Estudiante de Intercambio" se refiere a un estudiante participando en el Intercambio por una sesión o semestre académico. 3. TÉRMINOS DE INTERCAMBIO DE PERSONAL ACADÉMICO Y ADMINISTRATIVO 3.1 Los Intercambios de Personal Académico y Administrativo podrán ser negociados por cualquiera de las Partes de acuerdo a los procedimientos institucionales apropiados, incluyendo los Convenios Colectivos relevantes y requisitos de seguro. 3.2 El número, las fechas y la duración de los Intercambios del Personal Académico y Administrativo podrán variar según las necesidades del programa en particular. 3.3 Se harán esfuerzos razonables para involucrar números iguales de personal académico de la UdeG y de UofC en el Intercambio durante la vigencia del Convenio de Cooperación Académica. 2 3.4 La Universidad Receptora no tendrá ninguna responsabilidad financiera para con el personal académico y administrativo visitante, excepto en casos específicos, mediante documentación explícita. 3.5 El Personal Académico y Administrativo participante someterá un informe de su experiencia a ambas Partes. 3.6 La Universidad Receptora hará esfuerzos razonables para proporcionar información y asesoría con respecto a asuntos que pudieran mejorar la experiencia del Intercambio del Personal Académico y Administrativo, por ejemplo: las instalaciones universitarias, opciones de hospedaje y requisitos de visa. 4. TÉRMINOS DE INTERCAMBIO DE ESTUDIANTES 4.1 El Intercambio será abierto para estudiantes de nivel licenciatura y de nivel posgrado. 4.2 Cada Parte nominará un Coordinador quien será responsable del desarrollo y realización del Intercambio. En UofC, el Intercambio será coordinado por Centre for International Students and Study Abroad: Correo electrónico: cissa@ucalgary.ca Teléfono: En la UdeG, el Intercambio sera coordinado por la Coordinación General de Cooperación e Internacionalización: Correo electrónico: jocelyne@cgci.udg.mx Teléfono: 52 + (33) Los candidatos de Intercambio serán nominados por la Universidad de Origen y serán aprobados por la Universidad Receptora según los procedimientos normales. a) Los estudiantes permanecerán inscritos en la Universidad de Origen durante el periodo de Intercambio. b) Se espera que los estudiantes cumplan con los requisitos de idioma de la Universidad Receptora. c) El programa de estudios propuesto en la Universidad Receptora deberá ser aprobado por la Universidad de Origen antes del Intercambio. d) Los estudiantes podrán elegir cualquier curso que esté disponible en UofC y en la UdeG, siempre y cuando cumplan con los requisitos del curso Página 2 de 5

3 Q^o UNIVERSITY OF individual y haya disponibilidad de espacio. En la UdeG no están incluidos en el Intercambio los programas de extensión ofrecidos por sus empresas universitarias, Centro de Estudios Para Extranjeros (CEPE) y el Sistema Coorporativo PROULEX-COMLEX. e) La participación en el Intercambio no les dará a los estudiantes ninguna preferencia o estatus especial para solicitar un programa completo en la Universidad Receptora después de completar un periodo académico a través del Intercambio. 4.4 Los estudiantes se inscribirán como estudiantes de tiempo completo en la Universidad Receptora por un semestre académico, o un año académico como máximo. Un año académico en UofC incluye los semestres de otoño (septiembre-diciembre) y de invierno (enero-abril). Por lo general, no se permite que los estudiantes de Intercambio tomen clases en la sesión de primavera/verano en UofC, debido a la oferta limitada de cursos. Un año académico en la UdeG incluye el semestre de primavera (febrero-junio) y semestre de otoño (agosto-diciembre). 4.5 Durante el primer año del Intercambio, un máximo de tres (3) estudiantes de Intercambio por cada parte podrán participar en el programa. El número anual de estudiantes intercambiados podrá ser incrementado bajo mutuo acuerdo de las Partes. 4.6 Se espera que haya un equilibrio del número de estudiantes de Intercambio recibidos y enviados por ambas universidades durante la vigencia del Convenio. Para lograr un balance, dos (2) estudiantes que participen en el Intercambio por una (1) sesión /semestre académica serán considerados como el equivalente a un (1) estudiante que participe en el Intercambio por dos (2) sesiones/semestres académicos. 4.7 Las cuotas para los estudiantes serán evaluadas según los siguientes términos: a) Un principio fundamental del Intercambio será que los estudiantes no pagarán las cuotas de matrícula en la Universidad Receptora. Los estudiantes pagarán en su Universidad de Origen los costos de matrícula correspondientes a sus programas académicos. b) La Universidad Receptora exentará la cuota por concepto de solicitud/inscripción de Estudiantes de Intercambio entrantes. c) Los estudiantes pagarán las cuotas obligatorias correspondientes a sus programas académicos en su Universidad de Origen. Los Coordinadores del Intercambio negociarán lo que constituye una cuota obligatoria. Página 3 de 5

4 d) Se informará a los estudiantes de cualquier cuota obligatoria establecida por la Universidad Receptora, como una condición de inscripción, en su oferta de aceptación. 4.8 La responsabilidad financiera de los estudiantes se basará en lo siguiente: a) La Universidad Receptora no será responsable de ningún gasto del estudiante excepto que sea arreglado y documentado explícitamente para casos específicos. b) Se espera que los estudiantes paguen todos sus gastos personales, incluyendo pero no limitado a: transporte, hospedaje, alimentación, libros, visas, seguro médico y entretenimiento. c) Será la responsabilidad de los estudiantes obtener seguro médico y de salud adecuado (que incluya evacuación en caso de emergencia médica), así como seguro de vida, muerte accidental y desmembramiento, que cubra los requisitos de la Universidad Receptora. 4.9 En el caso de que los estudiantes de posgrado de UofC realicen actividades de investigación, las Partes determinarán la posesión de la Propiedad Intelectual al inicio del proyecto como parte de la investigación de tesis Al final de la estancia académica, o bajo solicitud, la Universidad Receptora enviará a la Universidad de Origen las calificaciones obtenidas por cada Estudiante de Intercambio Las Partes acuerdan cumplir con las disposiciones de The Freedom of Information and Protection of Privacy Act (Alberta) como se encuentre aprobado en su momento. 5. GENERAL 5.1 La Universidad Receptora les apoyará a los estudiantes de Intercambio con la búsqueda de hospedaje apropiado, ofrecerá orientación sobre el campus, y proporcionará asesoría sobre los asuntos que podrán mejorar la experiencia del Intercambio. 5.2 Los Estudiantes de Intercambio se apegarán a las reglas y normas de la Universidad Receptora y a las leyes del país anfitrión durante el periodo del Intercambio. 5.3 Las Partes manifiestan que la firma de la presente Carta Suplementaria del Convenio y los compromisos contraídos en él, son producto de su buena fe, por Página 4 de 5

5 lo que realizarán todas las acciones necesarias para su debido cumplimiento, cualquier disparidad será resuelta bajo mutuo acuerdo. 5.4 Cualquier disputa que surja bajo los términos de este Convenio que no pueda ser resuelta por las Partes, será remitida a un mediador independiente aprobado por las dos Partes. Leído el presente instrumento, enteradas las Partes del contenido y alcance de cada una de sus cláusulas e indicando que en su celebración no existe dolo, mala fe, o cualquier otro motivo que vicie su consentimiento, lo firman por duplicado en inglés y español, ambas versiones con mismo contenido y validez. 6 1" UNIVERSITY OF SUPPLEMENTAL LETTER OF AGREEMENT Between THE UNIVERSITY OF, CANADA And UNIVERSIDAD DE GUADALAJARA, MEXICO ícs/171/ PREAMBLE 1.1. Pursuant to the Academic Co-operation Agreement between the University of Calgary ("UofC") and the Universidad de Guadalajara ("UdeG"), the Parties agree to a Staff and Student Exchange (hereinafter referred to as the "Exchange"), subject to the following terms: 2. DEFINITIONS 2.1. In this Supplemental Letter of Agreement: a) "Home University" means the University from which a student intends to graduate or the university which is the regular employer of staff participants; b) "Host University" means the University which has agreed to host Exchange participants; and c) "Exchange Student" refers to one student participating in the Exchange for one academic session/semester. 3. TERMS OF STAFF EXCHANGE 3.1. Staff Exchanges may be negotiated by either Party according to appropriate institutional procedures including relevant Collective Agreements and insurance requirements The number, timing and duration of Staff Exchanges may vary according to the needs of the particular program Reasonable efforts shall be made to involve equal numbers of staff from UdeG and UofC in the Exchange over the period of the Academic Co-operation Agreement The Host University shall not bear any financia) responsibility for visiting staff participants except as may be arranged and explicitly documented for specific cases Staff participants shall submit a report on the experience to both Parties The Host University shall make reasonable efforts to provide information and advice regarding matters which may enhance the Exchange experience for staff participants, such as campus facilities, housing options, and visa requirements. 7 4. TERMS OF STUDENT EXCHANGE 4.1. The Exchange shall also be open to undergraduate and graduate students Each Party shall appoint a Co-ordinator who shall be responsible for the development and conduct of the Exchange. At the UofC, the Exchange shall be coordinated by the Centre for International Students and Study Abroad: cissa@ucalgarv.ca Telephone: At UdeG, the Exchange shall be coordinated by the Coordinación General de Cooperación e Internacionalización: jocelyne@cgci.udg.mx Telephone: 52 + (33) Exchange candidates shall be nominated by the Home University and shall be approved by the Host University according to normal procedures. a) Students shall remain registered at the Home University throughout the period of the Exchange. b) Students shall be expected to meet the language proficiency requirements of the Host University. c) The proposed program of studies at the Host University must be approved by the Home University prior to the Exchange. d) Students shall be free to choose courses from the fui range of courses available at the UofO and UdeG, when the students satisfy the individual course prerequisites and space is available. At UdeG, the academic extension programs offered by its university enterprises, the Centro de Estudios para Extranjeros (CEPE) and the Sistema Corporativo PROULEX - COMLEX are not included in this Exchange. e) Participation in the Exchange shall not give students any preferente or special status to register for a degree programme at the Host University subsequent to the completion of an academic session under the Exchange Students shall register fui -time at the Host University for one academic semester or for a maximum of one academic year. An academic year at UofC includes both the fa (September-December) and wínter (January-April) sessions. Exchange students are not generally permitted to take spring/summer session classes at UofC due to limited course offerings. An academic year at UdeG includes the spring (February-June) and fa (August-December) sessions During the first year of the Exchange, a maximum of three (3) exchange students from each university may be exchanged. The annual number of students exchanged may be increased by mutual agreement of the Parties. Page 2 of 4

8 4.6. It is expected that there will be a balance in the number of exchange students hosted and received by both universities during the period of the Agreement. In assessing balance, two (2) students each participating in the Exchange for one (1) academic session/semeste r shall be regarded as equivalent to one (1) student participating in the Exchange for two (2) academic sessions/semesters Students shall be assessed fees according to the following terms: a) A fundamental principie of the Exchange shall be that students shall not pay tuition at the Host University. Students shall pay tuition for their respective programmes at the Home University. b) The Host University shall waive institutional application /enrolment fees for incoming Exchange Students. c) Students shall pay the normal compulsory fees for their respective programmes at the Home University. Agreement as to what constitutes a compulsory fee shall be negotiated by the Exchange Co-ordinators. d) Students shall be advised of any mandatory fees assessed by the Host University as a condition of enrolment, in their offer of admission from the Host University Financia) responsibility for Students shall be based on the following: a) The Host University shall not bear any financia) responsibility for students except as may be arranged and explicitly documented for specific cases. b) Students shall be expected to pay for all personal expenses, including but not limited to transportation, accommodation, meals, books, visas, health insurance and entertainment. c) Students shall be responsible to obtain adequate medica)/health insurance coverage (including emergency medical evacuation), life insurance, accidental death and dismemberment insurance to the satisfaction of the Host University Where UofC graduate students are involved in research, the parties shall determine ownership of intellectual property at the outset of the project conducted as part of thesis research At the end of the academic stay, or upon request, the Host University shall send to the Home University an official transcript of the academic achievement of each student The Parties at all times agree to comply with the applicable provisions of the Freedom of Information and Protection of Privacy Act (Alberta), as amended. 5. GENERAL 5.1. Host University shall assist Exchange participants in Iocating suitable accommodation, Page3of4

9 shall offer a campus orientation, and shall provide advice regarding matters which may enhance the Exchange experience Exchange participants shall be bound by the rules and regulations of the Host University and the laws of the host country during the Exchange The parties state that the signing of the current Supplemental Letter of Agreement and the commitments contained therein, are made in good faith and, therefore they shall undertake all actions necessary for its proper execution; any discrepancy in the interpretation of the agreement shall be resolved by common accord 5.4. Any dispute arising under the terms of this Agreement which cannot be resolved by the Parties shall be referred to an independent mediator to be approved by both Parties. Having read this document, both institutions being aware of the contents and extent of each clause and affirming that there is no deceit, reticence, or any other reason that might corrupt its approval, both institutions sign in duplicate, in English and Spanish, both versions with the same content and validity.
