1 NATIONAL IMPLEMENTATION OF ACCESS & BENEFIT-SHARING FOR NON- COMMERCIAL ACADEMIC RESEARCH ARGENTINA This form is an annex of the document Access & Benefit-Sharing in Latin America & the Caribbean, a science- policy dialogue for academic research, Biber-Klemm et al. This document presents the step-by-step application process for access to genetic resources with (diagram 1) or without (diagram 2) associated Traditional Knowledge in Argentina. 2 2 ARGENTINA NATIONAL IMPLEMENTATION OF ACCESS & BENEFIT-SHARING FOR NON-COMMERCIAL ACADEMIC RESEARCH Diagramo 1: Caso de acceso in situ para la investigación con Conocimiento Tradicional Solicitan el permiso de colecta, cumpliendo con la normativa local, la autorización provincial competente, previamente a la aprobación de los proyectos y/o suscripción de contratos, conforme el artículo 124 de la Constitución Nacional y la Ley Nacional Nº Solicitan el Consentimiento Informado Previo (CIP) referente a las Condiciones Mutuamente Acordadas (CMA), conforme el artículo 124 de la Constitución Nacional, la Ley Nacional Nº 24375, la Resolución del Consejo Federal de Medio Ambiente (COFEMA) Nº 208/11 y la Resolución de la Secretaría de Ambiente y Desarrollo Sustentable (SAyDS) Nº 226/10. Autoridades Jurisdiccionales Examinan la solicitud y los documentos anexos. Si es necesario, pueden pedir más información. Proveen toda la información solicitada, cumplimentando las observaciones a las CMA, suscribiendo las mismas. Están obligado a negociar el CIP con las comunidades locales, además tienen que pedir permiso para recoger en sus territorios como así también en el caso de que se trate de un terreno privado. Pueblos Indígenas y Comunidades Locales Examinan la solicitud y los documentos anexos. Si es necesario, pueden pedir más información. Organismos científicos y técnicos tanto públicos como privados Proveen toda la información solicitada, cumplimentando las observaciones a las CMA, suscribiendo las mismas. Pueblos Indígenas y Comunidades Locales Emite el CIP Autoridades Jurisdiccionales Aprueban la colecta y entrega el permiso Emiten el CIP Emiten los documentos que habilitan y autorizan el tránsito interjurisdiccional del material colectado. Secretaría de Ambiente y Desarrollo Sustentable (Gobierno Nacional) Examina la solicitud y los documentos anexos. Si es necesario, puede pedir más información. Además en caso de corresponderse con flora o fauna silvestre se deberá dar cumplimiento a la normativa nacional referente a la misma. Se puede aprobar o denegar el permiso. La documentación complementaria, a presentar, esta conformada principalmente por el proyecto completo, el Permiso de Colecta y Obtención del material, el Consentimiento Fundamentado Previo, el Contrato y/o Convenio y/o Acuerdo de Transferencia de Material que contemple la Distribución de Beneficios, los derechos de Propiedad Intelectual, la Transferencia del Material a Terceros y la Disposición Final del material. Emite la autorización, mediante el Certificado de Acceso a los Recursos Genéticos, que lo habilita y autoriza a realizar la exportación del material.
