CONDICIONES GENERALES DE VENTA GENERALIDADES Las ventas y suministros a efectuar por Distribuciones Suner SLU se regirán por las presentes Condiciones Generales de Venta, excepto en todo aquello que esté expresamente acordado de forma distinta en la oferta correspondiente y que constituya las Condiciones Particulares de la misma. Por ello, no tendrán valor ni efecto jurídico otras condiciones que no se hayan aceptado explícitamente por Distribuciones Suner SLU. Se considerará que las presentes Condiciones Generales han sido comunicadas al comprador desde el momento en que éste las acepta en su registro como cliente en la página web de Distribuciones Suner S.L.U. www.suner.es o recibe una oferta, albarán o factura acompañada de las mismas y no manifiesta oposición por escrito en plazo no superior a 4 días de la fecha de emisión del documento. PEDIDOS Los clientes deberán remitir sus pedidos y consultas por fax, e-mail o a través de la página Web. En el caso excepcional de admitir pedido y/o consultas telefónicas, no se admitirán devoluciones ni anulaciones, ya que este medio puede dar lugar a errores de interpretación. El importe mínimo para realizar pedidos es de 50 netos aproximadamente. De todos los artículos que sean bajo pedido no se admitirá devolución bajo ningún concepto. Distribuciones Suner SLU se atendrá en los pedidos de cliente al código marcado, las fotografías son orientativas y no vinculantes. Distribuciones Suner SLU se reserva el derecho de variar los precios sin previo aviso, en función de fluctuaciones imprevistas de precios de materias primas que den lugar a subidas de tarifas de proveedores. Dichas variaciones se actualizarán semanalmente a través de la página Web. Se cobrarán portes de todos los pedidos inferiores a 800 netos (sin IVA). Los envíos a Islas Baleares, Islas Canarias, Ceuta, Melilla y Extranjero correrán siempre a cargo del cliente, independientemente del importe del pedido. No se aceptarán agrupaciones de pedidos para alcanzar dicho importe. Los artículos que se queden pendientes se suministrarán a posteriori, por NUESTRO TRANSPORTE a portes en factura, previo aviso al cliente. En los pedidos que superen dicha cantidad pero contengan: vasos de expansión, ánodos, depósitos, acumuladores, grupos de presión, garrafas Sotin y bombas de circulación (excepto cantidades), los portes del material detallado se incluirán en factura. Todos los envíos se realizarán por NUESTRO TRANSPORTE, incluyendo los portes debidos en factura cuando proceda. Si el cliente solicita otra agencia, la expedición será SIEMPRE a cargo del destinatario. FORMAS DE PAGO Las condiciones de pago serán acordadas previamente con Distribuciones Suner SLU. Las primeras compras de cualquiera de nuestros clientes han de ser mediante transferencia anticipada. En ningún caso podrán excederse las condiciones marcadas por la Ley 15/2010. Todo pago se realizará en las condiciones acordadas, sin ninguna deducción tal como: retenciones no acordadas, descuentos, gastos, impuestos o tasas, o cualquier otra. Cualquier gasto que se origine como consecuencia de una transacción de pago a Distribuciones Suner SLU será a cargo siempre del pagador. El impago, retraso y/o devolución de cualquier efecto o recibo, conllevará la inmediata suspensión de suministros y servicios. Para iniciar las relaciones comerciales nuevamente, el cliente pagará la factura devuelta más los gastos financieros que se le imputen, o los intereses devengados según el Tipo de Interés Legal del Dinero por Demora Comercial contemplado en los Presupuestos Generales del Estado del ejercicio que corresponda. El impago de efectos o el retraso reiterado en el pago de facturas supondrá automáticamente la pérdida de crédito por parte de Distribuciones Suner S.L.U. La formulación de una reclamación por parte del comprador no da derecho al mismo a la suspensión o deducción alguna en los pagos comprometidos.
CONDICIONES GENERALES DE VENTA RECLAMACIONES Las reclamaciones de material y/o administrativas deberán informarse en un plazo máximo de 4 días a partir de la salida de éste de los almacenes de Distribuciones Suner, S.L.U. Sólo se admitirán devoluciones en el plazo de 7 días desde la fecha de entrega. Las devoluciones y garantías deben acompañar el correspondiente formulario con su nº de incidencia facilitado previamente por Distribuciones Suner, S.L.U. y ser enviadas en óptimas condiciones de embalaje y según las condiciones especificadas en los formularios. Todo material que se reciba en nuestras instalaciones sin que le acompañe el mencionado formulario será automáticamente devuelto al destinatario. Todo el material recepcionado por el cliente en malas condiciones (roto, golpeado,...) lo deberá reclamar al transportista, en un plazo máximo de 24 horas y no a Distribuciones Suner, S.L.U. El transporte dispone de seguro para estos casos. Así mismo, toda reclamación por importe cargado por el transportista deberá realizarse ante éste. Distribuciones Suner SLU no es responsable de las tarifas que apliquen las empresas de transporte, y la disconformidad con ellos no justificará devoluciones de material o anulaciones de pedido. Este tipo de reclamación, al igual que las de roturas y retrasos, se planteará al Transporte dentro de las 24 horas siguientes. No se admitirán devoluciones de material manipulado y/o bajo pedido. Devoluciones por causas ajenas a Distribuciones Suner SLU (errores de cliente, error/retraso transportista/fabricante etc.), si son aceptadas por razones comerciales, tendrán un recargo del 15% al 30% dependiendo de los gastos ocasionados y se realizarán a portes pagados por el cliente. Siempre se requerirá el formulario de devolución para aceptar la misma. NO SE ADMITIRÁ NINGÚN TIPO DE DEVOLUCIÓN FUERA DE LOS PLAZOS Y CONDICIONES INDICADAS. GARANTÍAS Las Garantías que se conceden son las que cada fabricante tiene establecidas, dada la índole comercial de nuestra empresa. Esta garantía cubre la reparación, sustitución o abono del elemento averiado, siempre que el desperfecto sufrido sea imputable a fallos de fabricación, declinando no obstante, toda responsabilidad por desperfectos directos o indirectos, ocasionados por el inadecuado funcionamiento o mal uso en el empleo de los mismos. La aplicación efectiva de la Garantía se hará como resultado de un estudio y análisis de la avería y dependerá exclusivamente del dictamen que emita el departamento técnico correspondiente del fabricante. La Garantía nunca se aplicará antes de dicho dictamen, y todo material averiado ha de ser remitido a Distribuciones Suner SLU a Porte Pagado para su gestión, previa puesta en contacto para incluir el Formulario de Garantía correspondiente.
