Nº 62/00 PROYECTO DE ACUERDO MARCO PARA LA CREACIÓN DE UN ÁREA DE LIBRE COMERCIO ENTRE EL MERCOSUR Y LA REPÚBLICA DE SUDÁFRICA VISTO: El Tratado de Asunción, el Protocolo de Ouro Preto y la Decisión Nº 36/00 del Consejo del Mercado Común, que autorizó al Grupo Mercado Común a iniciar negociaciones con vistas a la firma de un Acuerdo Marco para la Creación de un Área de Libre Comercio entre el MERCOSUR y la República de Sudáfrica. CONSIDERANDO: Que en el marco de la estrategia del relacionamiento externo del MERCOSUR, una de las prioridades, ha sido la celebración de Acuerdos que incrementen los vínculos comerciales con otros países o bloques de países; Que el MERCOSUR y la República de Sudáfrica podrían beneficiarse de un proceso de liberalización comercial recíproca; El interés en que la aproximación comercial pueda evolucionar para la conformación de un área de libre comercio entre el MERCOSUR y la República de Sudáfrica. EL CONSEJO DEL MERCADO COMÚN DECIDE: Art. 1 Aprobar el "Proyecto de Acuerdo Marco para la Creación de un Área de Libre Comercio entre el MERCOSUR y la República de Sudáfrica", en las versiones de lengua española, inglesa y portuguesa, que figura como Anexo y forma parte de la presente Decisión. ANEXO ACUERDO MARCO PARA LA CREACIÓN DE UN ÁREA DE LIBRE COMERCIO ENTRE EL MERCOSUR Y LA REPÚBLICA DE SUDÁFRICA La República de Argentina, la República Federativa del Brasil, la República del Paraguay y la República Oriental del Uruguay, Estados Partes del MERCOSUR y la República de Sudáfrica, Deseando promover relaciones más estrechas entre sus pueblos; Reafirmando su compromiso de reforzar las reglas del comercio internacional, de conformidad con los principios de la Organización Mundial de Comercio; Reconociendo que reglas multilaterales de comercio más fuertes, claras y previsibles son fundamentales para alcanzar una mayor estabilidad global y mayores flujos internacionales de comercio e inversiones; Convencidos que la integración regional y el comercio Sur-Sur, inclusive por medio de la creación de áreas de libre comercio, son compatibles con el sistema multilateral de comercio y contribuyen a la expansión del comercio mundial, a la inserción internacional de sus economías y al desarrollo social y económico de sus pueblos; Reafirmando la importancia del principio del regionalismo abierto; Entendiendo que el proceso de integración de sus economías incluye la liberalización gradual y recíproca de los intercambios comerciales y el fortalecimiento de sus vínculos de cooperación económica; ACUERDAN: Artículo 1º A los efectos del presente Acuerdo, las Partes Contratantes, en adelante "las Partes", son el MERCOSUR y la República de Sudáfrica. Las Partes Signatarias son los Gobiernos de la República del África del Sur, de la República de Argentina, de la República Federativa del Brasil, de la República del Paraguay y de la República Oriental del Uruguay. 3

Artículo 2º El presente Acuerdo tiene por objetivo fortalecer las relaciones existentes entre las Partes, promover el incremento del intercambio comercial y establecer las condiciones para la creación de un área de libre comercio entre las Partes. Artículo 3º Para dar cumplimiento al objetivo citado en el art 2º, las Partes convienen en establecer las siguientes etapas: a. - Identificación de mecanismos para incrementar el comercio, incluyendo posibilidades para otorgarse recíprocamente preferencias arancelarias; b. - Negociación de un acuerdo para crear un área de libre comercio, en conformidad con las normas de la Organización Mundial de Comercio. Artículo 4º Las Partes acuerdan constituir una Comisión Negociadora. A efectos de cumplir con los objetivos citados en los art 2º y 3º, la Comisión Negociadora establecerá un cronograma de trabajo para las negociaciones. La Comisión Negociadora se reunirá en fechas acordadas por las Partes. Artículo 5º La Comisión Negociadora tendrá las siguientes atribuciones: a) intercambiar información sobre el arancel vigente en cada Parte; sobre comercio bilateral y con terceros países y sobre las respectivas políticas comerciales; b) intercambiar informaciones sobre acceso al mercado de cada Parte incluyendo, entre otros, medidas arancelarias y no arancelarias; normas técnicas, medidas sanitarias y fitosanitarias; normas de origen; disciplinas comerciales tales como régimen de salvaguardias, medidas anti-dumping y derechos compensatorios; mecanismos de solución de controversias y regímenes aduaneros especiales. c) identificar y proponer medidas para alcanzar los objetivos fijados en el apartado a) del artículo 3º, incluyendo medidas de facilitación de negocios; 5
d) establecer los criterios para la negociación de un acuerdo para la creación de un área de libre comercio entre las Partes;. e) negociar, en base a los criterios a que se refiere el apartado d), un acuerdo para la creación de un área de libre comercio entre las Partes; f) cumplir con las demás tareas que las Partes determinen. Artículo 6º Con el objetivo de ampliar el conocimiento mutuo sobre las oportunidades comerciales y de inversiones existentes en ambos lados, las Partes estimularán las actividades de promoción comercial, tales como seminarios, misiones empresariales, ferias, simposios y exposiciones. Artículo 7º Las Partes estimularán el desarrollo de acciones conjuntas orientadas a la ejecución de proyectos de cooperación en los sectores agrícola e industrial, mediante, entre otros, el intercambio de informaciones, la realización de programas de capacitación y el intercambio de misiones técnicas. Artículo 8º Las Partes promoverán la cooperación en el sector de servicios, con vistas a expandir y diversificar el comercio de servicios entre sus territorios, de acuerdo con los compromisos asumidos en el Acuerdo General sobre Comercio de Servicios (GATS). Esa cooperación podrá incluir, entre otros, el intercambio de información, cuando sea conveniente, sobre las reglas, leyes y normas que regulan sus respectivos sectores de servicios, además de las actividades contempladas en el Artículo 6º. Artículo 9º Las Partes acuerdan cooperar, por medio de sus respectivas autoridades competentes, en las áreas de sanidad vegetal y animal, estandarización, calidad de productos alimenticios, reconocimiento mutuo de medidas sanitarias y fitosanitarias, inclusive por medio de acuerdos de equivalencia, de conformidad con los criterios internacionales relevantes. 6

Artículo 10º El presente Acuerdo podrá ser enmendado con el consentimiento mutuo de las Partes, por medio del intercambio de notas por la vía diplomática. Artículo 11º El presente Acuerdo tendrá duración indefinida y continuará en vigencia salvo que ambas Partes, de común acuerdo y por escrito, por vía diplomática, decidan darlo por terminado, o bien por denuncia de una de las Partes, previa notificación por escrito, con seis meses de antecedencia, de su intención de denunciar el Acuerdo. Hecho en Florianópolis, a los quince días del mes de diciembre del año dos mil, en dos ejemplares en lengua española, inglesa y portuguesa, siendo todos los textos igualmente auténticos. FRAMEWORK AGREEMENT FOR THE CREATION OF A FREE TRADE AREA BETWEEN MERCOSUL AND THE REPUBLIC OF SOUTH AFRICA PREAMBLE THE ARGENTINE REPUBLIC, THE FEDERATIVE REPUBLIC OF BRAZIL, THE REPUBLIC OF PARAGUAY, THE ORIENTAL REPUBLIC OF URUGUAY, PARTIES TO THE MERCOSUL, AND THE REPUBLIC OF SOUTH AFRICA: DESIRING to foster closer relations between their peoples; REAFFIRMING their commitment to the further strengthening of the rules of international trade in accordance with the principles of the World Trade Organisation; RECOGNIZING that stronger, clearer and predictable multilateral trade rules are essential to enhancing global economic stability and greater flows of international trade and investment; BELIEVING that regional integration and South-South trade, including through the creation of free trade areas, is compatible with the multilateral trading system, and contributes to the expansion of world trade, to the integration of their economies into the global economy, and to the social and economic development of their peoples; REAFFIRMING the importance of the principle of open regionalism; UNDERSTANDING that the process of integrating their economies includes the gradual and reciprocal liberalisation of trade and the strengthening of economic co-operation ties among themselves; HEREBY AGREE AS FOLLOWS: Article 1 For purposes of this Agreement, the Contracting Parties, hereinafter referred to as Parties, are Mercosul and South Africa. The Signatory Parties are the Governments of the Republic South Africa, of the Argentine Republic, of the Federative Republic of Brazil, of the Republic of Paraguay and the Oriental Republic of Uruguay. 9
Article 2 The aim of this Agreement is to strengthen the existing relations between the Parties, promote the expansion of trade and establish the conditions for the creation of a free trade area between the Parties. Article 3 In order to achieve the aim referred to in Article 2, the Parties agree to undertake the following steps: a) Identification of mechanisms to promote the expansion of trade, including the possibility of the reciprocal granting of preferential tariff reductions; b) Negotiation of an agreement to create a free trade area in conformity with the rules of the World Trade Organisation. Article 4 The Parties agree to create a Negotiating Committee. In order to achieve the aims referred to in Articles 2 and 3, the Negotiating Committee shall establish a schedule of work for the negotiations. The Negotiating Committee shall meet at such times as shall be agreed by the Parties. Article 5 The Negotiating Committee shall: a) exchange information on the tariff rates applied by each Party, on bilateral trade and trade with third parties, and on respective trade policies; b) exchange information on the market access regimes of each Party, covering among others tariff and non-tariff measures, technical standards, sanitary and phytosanitary measures, rules of origin, trade measures such as safeguards, anti-dumping and countervailing measures, dispute settlement mechanisms, and special customs regimes; c) identify and propose measures to achieve the steps contemplated in Article 3(a), including measures to facilitate business; 10
d) establish criteria for the negotiation of an agreement for the creation of a free trade area between the Parties; e) negotiate, on the basis of the criteria referred to in Article 5(d), an agreement for the creation of a free trade area between the Parties; f) fulfil other tasks as may be directed by the Parties. Article 6 In order to broaden mutual knowledge about the existing trade and investment opportunities on both sides, the Parties shall encourage trade promotion activities such as seminars, trade missions, fairs, symposiums and exhibitions. Article 7 The Parties shall encourage the development of joint actions aimed at the implementation of co-operation projects in the agricultural and industrial sectors, by means of, inter alia, the exchange of information and the implementation of training programmes and the exchange of technical missions. Article 8 The Parties shall foster cooperation in the services sector with a view to expanding and diversifying trade in services between their territories, in accordance with the commitments of the General Agreement on Trade in Services (GATS). Such cooperation shall include, inter alia, exchanging, where appropriate, information on the rules, laws and regulations governing the respective services sectors of the Parties, in addition to the actions contemplated in Article 6 above. Article 9 The Parties agree to cooperate in the areas of animal health and plant protection, standardisation and food safety, mutual recognition of sanitary and phytosanitary measures, through their respective competent authorities, including through concluding equivalence agreements in accordance with relevant international criteria. 11
Article 10 This Agreement may be amended by mutual consent of the Parties through an Exchange of Notes between the Parties through the diplomatic channel. Article 11 This Agreement shall remain in force indefinitely unless terminated by written mutual consent of the Parties through the diplomatic channel, or by either Party giving six months written notice in advance through the diplomatic channel of its intention to terminate this Agreement. Done at Florianopolis on this 15 th day of December 2000, in triplicate in the English, Portuguese and Spanish languages, all texts being equally authentic.
