1 DISCLOSURE NOTICE RENT STABILIZATION ORDINANCE (RSO) TENANT RIGHTS BUYOUT OFFERS & AGREEMENTS Cash for Keys THIS NOTICE IS REQUIRED PER LOS ANGELES MUNICIPAL CODE (LAMC) Tenants are not required to accept a Cash for Keys Buyout Offer or Agreement to move out of their rental unit. The Rent Stabilization Ordinance (RSO) allows 14 legal reasons for eviction. Refusing compensation (money, free rent, etc.) to move-out is NOT a legal reason for eviction under the RSO. The Los Angeles City Council amended the RSO (Ordinance #184673) effective January 25, 2017, to provide that all landlords must do the following if they wish to offer a tenant compensation (money, free rent, etc.) to vacate their rental unit. The landlord must give this Disclosure Notice to the tenant prior to executing a Buyout Agreement. The landlord must file this Disclosure Notice and the executed Buyout Agreement with the Housing + Community Investment Department (HCIDLA) within 60 days of the tenant and landlord signing the Buyout Agreement. Under LAMC , a tenant has the following rights when considering a BUYOUT OFFER: The right to not accept - A tenant is not required to accept a Buyout Offer, and the landlord may not retaliate against a tenant for not accepting the offer. The right to consult an attorney and/or HCIDLA - A tenant has the right to consult an attorney, legal agency or HCIDLA before deciding to accept a Buyout offer. 30-Day right to rescind - A tenant may rescind the Buyout Agreement at anytime during the thirty days after the agreement has been signed by both the landlord and tenant. The right to rescind at any time if the Buyout Agreement does not comply with LAMC Section A Buyout Agreement can be rescinded, if it does not meet the specifications required under LAMC and if this Disclosure Notice is not signed by the landlord and tenant. 2 THIS NOTICE IS REQUIRED PER LOS ANGELES MUNICIPAL CODE TENANT RELOCATION ASSISTANCE AMOUNTS FOR Tenant relocation is due if a tenant is evicted for a no-fault reasons allowed by the RSO (See LAMC A). If a landlord is evicting a tenant for a no-fault reason, the landlord must fill out an application with HCIDLA to determine the amount of relocation assistance due. The amount of relocation assistance required depends on whether the tenant is an Eligible or Qualified tenant, the length of tenancy, and the tenant s income. Qualified tenants include seniors (aged 62 or older), disabled tenants, or families with one or more minor dependent children. In accordance with Sections G. and D. of the RSO, the required relocation assistance amounts per household effective July 1, 2016 through June 30, 2017 are: Tenants with Less Than 3 Years Tenants with 3 or More Years Income Below 80% of Area Median Income* Eligible Tenant $ 7,900 $ 10,400 $ 10,400 Qualified Tenant $ 16,650 $ 19,700 $ 19,700 Under the RSO, relocation assistance is not due if a tenant is evicted for non-payment of rent, violation of their rental agreement or lease, nuisance, using the rental unit for an illegal purpose, refusal to sign a new lease with similar terms and not providing the landlord access to the unit after proper notification. 3 AVISO DE DECLARACION DE LOS DERECHOS DEL INQUILINO SOBRE OFERTAS Y ACUERDOS DE COMPRAS DE TENENCIA DE ACUERDO A LA ORDENANZA DE ESTABILIZACION DE RENTA (RSO) PAGO POR LLAVES Rent Stabilization Bulletin ESTE AVISO ES REQUERIDO POR EL CÓDIGO MUNICIPAL DE LOS ÁNGELES (LAMC) Los inquilinos no están obligados aceptar una Oferta para Salir o un acuerdo de "Pago por llaves" para mudarse de su unidad de alquiler. La ley de la Estabilización de Alquileres (RSO, por sus siglas en inglés) permite 14 razones legales para desalojos. Rehusarse aceptar una compensación (dinero, renta gratis, etc.) a cambio de salir de la unidad no es una razón legal para un desalojo de acuerdo al RSO. El Consejo Municipal de Los Ángeles enmendó el RSO (Ordenanza #184673) efectiva el 25 de enero del 2017, que provee que todos los propietarios deben hacer lo siguiente si quieren ofrecer al inquilino una compensación (dinero, renta gratis, etc.) para desocupar la unidad de alquiler. El propietario debe dar este aviso de declaración al inquilino antes de ejecutar un acuerdo para salir de la unidad. El propietario debe archivar este aviso de declaración y el acuerdo de compra para salir de la unidad firmado con el Departamento de Vivienda + Inversión Comunitaria (HCIDLA) dentro de los 60 días de haber sido firmado el acuerdo de compra de tenencia entre el inquilino y el dueño. Según el Código Municipal de Los Ángeles (LAMC, por sus siglas en ingles) Sección , un inquilino tiene los siguientes derechos cuando considere una Oferta para Salir de la unidad: El derecho de no aceptar - Un inquilino no está obligado aceptar una oferta para salir de la unidad, y el propietario no puede tomar represalias contra el inquilino por no aceptar tal oferta. El derecho de consultar un abogado y/o HCIDLA - Un inquilino tiene derecho a consultar un abogado, una agencia legal o HCIDLA antes de decidir aceptar una Oferta para Salir de la unidad. Derecho de rescindir de 30 días - Un inquilino puede rescindir el acuerdo de compra para salir de la unidad en cualquier momento durante los 30 días después de ejecutar tal acuerdo entre el propietario y el inquilino. El derecho a rescindir en cualquier momento si no cumple el acuerdo de compra con LAMC Sección Un acuerdo de compra puede ser rescindido si no cumple con las requisitos de acuerdo al LAMC y el aviso de declaración no sea firmado por el propietario y el inquilino. Si un propietario esta desalojando a un inquilino por desalojo sin culpa, el propietario debe archivar una solicitud con HCIDLA para determinar la cantidad de asistencia de reubicación debida al inquilino. La cantidad de asistencia de reubicación requerida depende si el inquilino es elegible o calificado, la duración de la tenencia, y los ingresos del inquilino. Inquilinos calificados incluyen personas mayores (mas de 62 años), incapacitados, o familias con uno o más dependientes menores. De acuerdo con las secciones G. y D del RSO, las cantidades de asistencia de reubicación por hogar, efectiva el 1 de julio del 2016 hasta el 30 de junio del 2017 son: Inquilinos con menos de 3 años Inquilinos con 3 o más años Ingresos por debajo de 80% del ingreso medio del área Inquilinos Elegible $ 7,900 $ 10,400 $ 10,400 Inquilinos Calificado $ 16,650 $ 19,700 $ 19,700 De acuerdo al RSO, el pago de asistencia de reubicación no es requerida si un inquilino ha sido desalojado por falta de pagar renta, violación al contrato de alquiler o arrendamiento, molestias, uso de la unidad de alquiler para un fin ilegal, rehusar a firmar un nuevo contrato con términos similares, o negarle el acceso a la unidad al propietario después de una aviso de 24 horas.
