ABC Digital/ - Policiales, Qui, 31 de Maio de 2012 CLIPPING INTERNACIONAL (Corte Penal Internacional) Libia dice que está listo para juzgar a seguidores de Gadafi Los juicios son vistos como una prueba de la habilidad del nuevo Gobierno para juzgar a seguidores de alto perfil de Gadafi y miembros de su familia, incluyendo a su hijo, Saif al-islam, quien podría ser transferido a la Corte Penal Internacional (CPI) en La Haya."El juicio de Buzeid Dorda y de otros símbolos del ex régimen comenzará el 5 de junio en un tribunal de Trípoli", dijo el fiscal general Abdul Azizi al-hassadi a Reuters. Dorda, quien fue arrestado en septiembre pasado en Trípoli, será el primer funcionario de alto rango de Gadafi que va a juicio en Libia desde que una revuelta popular derrocó al Gobierno el año pasado.un Gobierno de transición designado en noviembre para llevar a Libia hacia elecciones está luchando por imponer el orden sobre los grupos armados que derrocaron a Gadafi. El Gobierno ha sido proclive a juzgar a miembros de la familia de Gadafi y sus seguidores en el país, pero activistas de derechos humanos temen que una administración central débil y la falta de leyes pueda privarlos de un juicio justo.si la CPI dictamina que Libia no puede o no tiene voluntad para juzgar a Saif al-islam, quien está acusado de crímenes de lesa humanidad por la matanza de manifestantes civiles, afirma que asumirá la jurisdicción del caso. Saif al-islam, el hijo más conocido de Gaddafi, fue capturado por combatientes militantes en noviembre.dorda había estado con Gadafi desde que tomó el poder por primera vez en un golpe de Estado en 1969. Era conocido como un tecnócrata y no como un oficial de inteligencia. Los libios no lo asocian con algunos de los primeros períodos más sangrientos de la autocracia de Gaddafi, como la década de 1980. Se cree que asumió el cargo en el 2009. 8

Por disposición de la Corte Suprema de Justicia Estigarribia vuelve al Tribunal de origen en Villa Hayes.En remplazo de Estigarribia asumió como presidenta de la circunscripción de Misiones, la Dra. Mirian Alegre de Agüero y el Consejo de la circunscripción de Misiones quedó constituido de la siguiente manera: Mirian Alegre presidenta, vicepresidentes los camaristas: Víctor Rodríguez y Magno Vargas.Con relación a su alejamiento el Dr. Estigarribia explicó que pidió por nota su desafectación, porque no quiero ser causal de ista en esta circunscripción judicial, dijo.añadió que el superintendente, ministro Fretes y la Corte Suprema de Justicia comprendió y resolvió trasladar a él al Tribunal donde fue nombrado en la Circunscripción de Villa Hayes. Yo vine para trabajar, no vine a buscar dinero ni fama, dijo Estigarribia al despedirse. Añadió que vino en silencio pero se va aplaudido por los funcionarios del palacio de Justicia.Mencionó que implementó en pocos tiempo un sistema de seguridad en el poder judicial, capacitación de los funcionarios, cursos de notariado que se desarrolla los sábados, supervisado por Uninorte, curso de derecho procesal civil que empezará en junio, además de que los juzgados de paz tengan local propio.el juez en lo penal de garantías Miguel Ángel Mendoza de Misiones denunció por distintos medios caso de nepotismo en el poder judicial de Misiones.Mendoza dijo que Estigarribia no puede estar en el palacio de justicia de San Juan Bautista, Misiones, porque es pariente del ministro Antonio Fretes.Estigarribia dijo que no quiere responder a la acusación de su colega Mendoza. Añadió que por ética presentó su renuncia y pidió su traslado. 9

Bizjournais/ - News, Qui, 31 de Maio de 2012 CLIPPING INTERNACIONAL (Constitutional Law) Family Research Council Criticizes First Circuit Ruling on the Defense of Marriage Act WASHINGTON, May 31, 2012 Family Research Council (FRC) today criticized a decision by the U.S. Court of Appeals for the First Circuit striking down Section Three of the Defense of Marriage Act (DOMA), which defines marriage as the union of one man and one woman for federal law. FRC filed an amicus curiae ("friend of the court") brief in the case, known as Gill v. Office of Personnel Management. Today"s ruling by a three-judge panel upheld a lower court decision issued in July 2010.Family Research Council President Tony Perkins released the following statement:"today"s decision was disappointing but leaves us with hope that DOMA will be upheld when it is reviewed by the United States Supreme Court. "FRC has always argued that DOMA should be reviewed under a level of scrutiny lawyers refer to as the "rational basis test." The First Circuit directly stated that using that standard "the Gill plaintiffs cannot prevail." We believe the Supreme Court will agree with us in applying the rational basis test and uphold DOMA."It has become too common for courts to show great disrespect to the American people and their representatives in arguing that efforts to defend marriage have been motivated by bias, bigotry, or animus. I note that the First Circuit opinion decisively rejects that idea. In reaching its decision, the Court stated it "(did) not rely upon the charge that DOMA"s hidden but dominant purpose was hostility to homosexuality." It also observed that "traditions are the glue that holds society together... The desire to retain them is strong and can be honestly held.""the Court was correct on this point. Congress enacted DOMA in 1996 by a vote of 85-14 in the Senate and a vote of 342-67 in the House of Representatives. It was then signed into law by President Bill Clinton. Those supporting DOMA represented a broad swath of American society who did not bear ill-will or animosity toward homosexuals. "Citizens in 32 states have voted to uphold the historic and natural definition of marriage as the union of one man and one woman. Thirty states have actually inserted such a definition into the text of their state constitutions. Bloomberg/ - Politics, Qui, 31 de Maio de 2012 CLIPPING INTERNACIONAL (Supreme Court) Obama Tells Donors Health-Care Fight May Loom After Court Rules President Barack Obama is confiding to Democratic donors that he may have to revisit the health-care issue in a second term, a position at odds with his publicly expressed confidence that the U.S. Supreme Court will uphold the Affordable Care Act, according to three Democratic activists. As he previewed his agenda for donors at a May 14 fundraiser, Obama said he may be forced to try to revise parts of his health-care plan, depending on how the court rules later this month, said one activist, who requested anonymity to discuss the president s comments. Guests at the $35,800-a-plate dinner in the Manhattan apartment of Blackstone Group LP (BX) President Tony James were asked to check their smart phones and BlackBerries at the door. The president has made similar remarks, usually in response to questions, at other fundraising events since the Supreme Court heard arguments in the case during the last week of March, according to two other activists, who also requested anonymity. Obama s answers, which begin with the president repeating his contention that the high court will uphold the law, have led some contributors to conclude the White House is making contingency plans should the justices strike down parts of the law, which would give Republicans a powerful talking point about one of his signature issues. A challenge by 26 states centers on the law s requirement that individuals purchase health insurance or face a penalty. Outside Groups While Obama is discussing with wealthy donors the prospect of a rebuke from the court, administration officials are coordinating with health-care-reform groups on how to manage their public response in the aftermath of the decision. While I won t discuss in detail the president s private conversations, I can say that your reporting, attributed to unnamed sources, inaccurately reflects the president s views, Jay Carney, Obama s spokesman, said in an e-mail. On April 3, Obama professed enormous confidence the law is constitutional and the court is going to exercise its jurisprudence carefully, in response to a question at the Associated Press s annual meeting. A day earlier, he said the Supreme Court would have to take an unprecedented, extraordinary step to throw out a law that was passed by a strong majority in Congress. Yet a planning memo, including a reminder that it s important to continue projecting confidence that the court will uphold the law, was discussed at a May 29 meeting hosted by a group called Protect Your Care, attended by officials from the White House and Department of Health and Human Services, said one of the attendees, who requested anonymity to discuss a private meeting. Staging Events The best way to demonstrate public outrage or public celebration about the decision is to stage an event that shows average people actually responding to the news, according to the memo, e-mailed on May 16 by an official at the Herndon Alliance, a coalition of groups that backs the health-care overhaul. The White House is obviously very involved in this stuff, said Bob Crittenden, executive director of the Herndon Alliance. Some of the groups we work with have very close connections with the White House. Nick Papas, a White House spokesman, and Anton Gunn, director of external affairs at Health and Human Services, make regular appearances at the Protect Your Care meetings, which are held every other week. Private Meetings Last week, Gunn and Hilary Haycock from the White House attended, along with representatives from Families USA, Health Care for America Now, the Center for American Progress and labor organizations including the Service Employees International Union and American Federation of State, County and Municipal Employees. There s a really strong feeling that getting out there and trying to do contingency planning out in public is not a very smart thing to do, said Crittenden, also a professor of medicine at the University of Washington. What we really want to do is to make sure that everyone is prepared to talk about the law when it comes up. Based on the tone of the justices questions to the lawyers arguing the case, some of the law s supporters are concerned that the court will strike down the requirement that uninsured individuals purchase health insurance or else pay a fine. Overturning Mandate The odds are that it s slightly more likely to overturn the individual mandate, said Richard Kirsch, a senior fellow at the Roosevelt Institute and the former campaign manager for Health Care for America Now, a group that fought for the overhaul. After the court makes its ruling, one of the battles will be to define what s happened. Even if the mandate is removed, supporters of the law should organize media events to have people who continue to benefit from the law to tell their stories, said Kirsch, author of Fighting for Our Health: The Epic Battle to Make Health Care a Right in the United States. Public opinion is divided on the different parts of the law, said Bob Blendon, an associate dean at the Harvard School of Public Health. Nobody wants the whole bill thrown out, he said. If you answered, totalitarian censorship, you are right -- and you are old. In the Internet age, censorship is all about allowing partial, temporary free speech, then shutting it down once enough has been said. The innovator, as usual these days when it comes to nondemocratic governance, is China, where the leading microblog site, Sina Weibo, unveiled its modified censorship model this week. Users get 80 points. Monitors will take away points for violations. These include the censors old favorite, criticizing the government. You can also lose points for spreading rumor (which I thought was the whole point of the Internet) or promoting cults (a provision apparently aimed at the banned spiritual movement Falun Gong). The monitors will also scour your comments for puns or other circumlocutions used to avoid censorship in the past. If you run out of points, you re cut off. If free speech is so threatening, why don t the powers- that-be in China just shut down the microblogs altogether? Part of the answer is that with 324 million users, Sina Weibo has become too big to fail, or at least too much a part of normal Chinese life to be eliminated. But the deeper reason to keep the masses microblogging is that the Chinese government reaps important gains from it. This is not your father s Communist Party. Nor your grandfather s. China s leadership is engaged in a complicated, risky process of trying to gain some of the advantages of democratic government without the disadvantage of putting itself up for direct election. Free speech is a crucial part of the experiment. Releasing Pressure A major benefit of allowing people to complain on the Web is that it allows society to blow off steam. This is a venerable value of free speech, recognized by U.S. Supreme Court Justice William O. Douglas in a famous dissent in 1951, responding to the court s choice to uphold the conviction of 11 American Communists for teaching subversive ideas. The airing of ideas releases pressures which otherwise might become destructive, Douglas wrote. If such release is beneficial in a democracy, it s doubly so in a place where there is no robust public sphere. Another advantage of limited free speech is that it allows the government to gather information about public concerns. Chinese authorities can t rely on ordinary polling data, because pollsters in China can t operate freely, lest they learn of serious opposition to the government. And it s impossible to spy on 1.3 billion people all the time. The microblogs serve as the abstract and brief chronicles of the time, as Hamlet called the theater. Once the microblogs have conveyed what people are thinking, the government can respond to their concerns, as it did last summer after the Zhejiang train derailment when Premier Wen Jiabao made a special visit to the site in apparent reaction to public frustration with bureaucratic silence and denials. Responding to public opinion is the hallmark of accountable government. Without elections to provide oversight, China s leaders need every opportunity they can get to demonstrate that they respond to people s concerns. Seen this way, limited free speech, followed by government action, is an important part of how the Chinese Communist Party seeks to sustain its legitimacy. Proxy Battle The party is utterly aware that free speech could help bring the government down. That is why it is experimenting with freedom in moderation, and using quasi-private entities like Sina Weibo as its proxies. China s leaders are trying to gain the advantages of free speech without paying its full price. First Amendment absolutists will probably raise their eyebrows at this. After all, Americans have been raised to believe that free speech has a life of its own; that truth is great and shall prevail. Yet there is an extraordinary precedent for China s censorship model: the history of free speech in England and the U.S. before the modern era. When it was drafted, the First Amendment to the U.S. Constitution didn t contemplate the radical freedom Americans now enjoy. Its language, drawn from English precedents, was aimed essentially at prohibiting what is called prior restraint: government censorship of books and newspapers before they could be published. As with the Sina Weibo rules, once you had spoken or written, you could still be punished for what you had freely said. You were accountable under the crime of seditious libel. That law punished -- you guessed it -- criticizing the government, spreading false rumor and impugning religion. It was, according to the great English legal scholar William Blackstone, necessary for the preservation of peace and good order, of government and religion. It existed in the U.S. even after the Constitution was ratified, sustaining convictions through the late 18th century. The U.K. didn t officially take it off the books until 2009. Censors, take note. Or on second thought, please don t. I want to keep all 80 of my points in case I need them.
