Memorandum June 6, 2016 TO: FROM: Steven A. Hovey Chief Personnel Officer Division of Personnel Services Diana Walsh-Reuss, Ed.D. Associate Superintendent Division of Children and Family Services and Division of Student Programs and Services SUBJECT: SB792: Immunization Requirements for Employees Under the new law, SB792, effective September 1, 2016, employees working in day care centers, preschools, and home day cares, are required to be immunized against influenza, pertussis, and measles. Children in this young age range do not have fully developed immune systems and as such, it is required by law that individuals working with students in these environments are fully immunized to protect the students from life-threatening complications from many diseases. Under SB792, employees working in these programs will be required to furnish proof that they have been fully immunized for Pertussis (Whopping Cough) and Measles. Please be advised that employees born prior to 1957 are exempt from the Measles vaccine. Additionally, employees will be required to furnish proof of the annual influenza vaccination between August and December of each school year. By August 1, 2016 the following information needs to be provided to Personnel Services as part of your ongoing employment similar to the regular TB (Tuberculosis) tests: 1. A copy of your immunization record documenting Pertussis and Measles vaccines; or 2. A signed letter from a licensed physician documenting your immunity to Pertussis and Measles; or 3. A signed letter from a licensed physician declaring that immunization is unsafe for you due to a physical condition or medical circumstance. Additionally, between August 1, 2016 and December 1, 2016, and then annually thereafter, you will need to provide: 1. Documentation of influenza vaccination or a written statement that you have declined the influenza vaccine.

Please email the required documentation to Sylvia Gardner at sgardner@rcoe.us. Employees may be vaccinated in a variety of ways including: 1. Contacting your primary physician, or 2. Contacting your local health department (www.cdph.ca.gov); or 3. Contacting private providers offering vaccines to the public (www.vaccines.gov) 4. Contacting one of the various clinics included as an attachment to this letter. Please note that any cost incurred for the vaccine is the responsibility of the individual. Associate Superintendent Division of Children and Family Services and Division of Student Programs and Services ASUNTO: SB792: Requerimientos de inmunización de empleados En conformidad con la nueva ley SB792, a partir del 1 de septiembre de 2016, a los empleados que trabajen en centros de cuidado, preescolares y hogares de cuidado se les exigirá estar inmunizados contra la influenza, pertussis y sarampión. Los niños de tan pequeña edad no tienen sistemas inmunológicos completamente desarrollados y por ello, la ley exige que los individuos que trabajen con estudiantes en este ambiente estén totalmente inmunizados para proteger a los estudiantes de complicaciones de estas enfermedades que pongan en riesgo sus vidas. En conformidad con la SB792, a los empleados que trabajen en estos programas se les exigirá un comprobante de haber sido totalmente inmunizados contra la pertussis (tos ferina) y sarampión. Favor de tener en cuenta que los empleados nacidos antes de 1957 están exentos de la vacuna del sarampión. Además, a los empleados se les exigirá entregar un comprobante de vacunación anual contra la influenza entre agosto y diciembre de cada año. Para el 1 de agosto de 2016, la siguiente información debe entregarse a Servicios de Personal, de forma similar a la prueba de tuberculosis (TB), como parte de su continuidad de empleo: 1. Una copia de su registro de inmunizaciones en el cual se documenten las vacunas de pertussis y sarampión o 2. Un comprobante firmado por un médico con licencia en el cual se documente su inmunidad a pertussis y sarampión o 3. Un comprobante firmado por un médico con licencia que declare que la inmunización no es segura para usted debido a una condición física o estado médico. Además, entre el 1 de agosto de 2016 y el 1 de diciembre de 2016 y posteriormente cada año, usted tendrá que proporcionar: 1. Comprobante de la vacuna contra la influenza o una declaración escrita de que usted se ha negado a recibir la vacuna de la influenza.
