The Pre-Check Cmpany represents and agrees as fllws: 1) The Pre-Check Cmpany is an Ohi crpratin, rganized and authrized t d business in the State f Ohi and is fully in cmpliance with all applicable federal, state and lcal laws and regulatins. 2) The Pre-Check Cmpany will perfrm the requested backgrund checks fr emplyment, retentin, r prmtin purpses upn being furnished, in writing by Client s designated representative(s), all pertinent infrmatin n applicants. Pre-Check will prmptly reprt the findings f its investigatins t Client and will therwise cmply with the requirements f the FCRA. 3) In rder t address security cncerns and t cmply with the FCRA, and ther applicable laws regarding security and emplyment, Pre-Check will identify the subject f the reprt fr infrmatin by name, last fur digits f scial security number and mnth and day f birth. Reprts will nt include the full scial security number r year f birth. 4) Pre-Check will prvide each Client with a user name and passwrd fr the Pre-Check website (lcated at www.pre-check.cm) fr secure access t backgrund reprts t include cnsumer credit reprts and substance abuse infrmatin requested by Client. 5) Pre-Check will ntify Client f the availability f cmpleted reprts n the Pre-Check website by electrnic mail. IT IS MUTUALLY AGREED as fllws: 1) This Agreement shall remain in frce and effect fr a term f ne year frm the last date shwn n the fllwing signature and acceptance lines and shall autmatically renew and thereafter, frm year t year n the same basis as set frth herein, subject t written ntice f cancellatin, which shall be given by either party at least ten (10) days in advance f any given date fr terminatin. All payment fr services shall be within thirty (30) days f invice. Any amunt nt paid within such term shall accrue interest at the rate f ten percent (10%) per annum cmputed daily. 2) If the Client is delinquent in the payment f the mnthly charges, r vilates the terms f this cntract, Pre- Check may, at its electin, discntinue prviding service t the Client and cancel this cntract, withut ntice t the Client. 3) If Pre-Check fails t perfrm the requested backgrund checks fr emplyment purpses, fails t prvide the requested infrmatin t the Client upn cmpletin f Pre-Check s investigatin, r therwise fails t cmply with the requirements f the FCRA, Client may, at its electin, cancel this cntract withut ntice t Pre-Check and pursue any and all ther remedies available under law.
