MAJOR CHANGES: GUIDELINE This replaces bulletin No. BUL on the same subject issued by the Office of the C ief Operating Officer, dated September 12, The responsibility for District implementation of the Williams/Valenzuela Complaint Procedur s is being transferred to the Educational Equity Compliance 0 Ice in the Office of General Cou el effective July 1,2009. The following guidelines apply. I. BACKGROUND The Eliezer Williams, et al., vs. State of California, et al. (Williams) case was fijed as a class action in 2000 in San Francisco County Superior Court. The plaintiffs included nearly 100 San Francisco County pupils, who filed suit against the State of California and state education agencies, ioel ding the CaJifi rnia Department of Education (CDE). The basis of the lawsuit was that the agencies failed to provide public school pupil with equal access to instructional materials, safe and decent school facilities, and qualified teachers. After four years of intense litigation, the parties in the case reached a Settlement Agreement on August 13, Governor Arnold Scbwarzenegger signed laws implementing the legi lative proposals set forth in the parties' Settlement Agreement on September 29, The Valenzuela vs. O'Connell et a!., lawsuit filed in February 2006 challenging the California High School Exit Ex ination (CAHSEE) was settled in July On October 12,2007, the Governor signed AB 347, which expands the services available to pupils for up to two consecutive years after completion of grade twelve (currently pupils in the Classes and 2007) who have not yet passed the CAHSEE under the Intensive Service and Instruction and the Middle and High School Counseling Programs. The bill also makes other changes to Education Code sections 1240, 35186, 37254, and to impl ment the settlement. The text of AS 347 carl be found at Office of General Counsel Page 1 of6

That means each pupil, including English learners, must have textbooks or instructional materials, or both, to use in class and to take orne or use after class. B. School facilities must be clean, safe, and maintained in good repair. C. There should be no teacher vacancies. 1. Teacher vacancy means a position to which a single designated certificated employee has not been assigned at the beginning of the year for an entire year or, if e sition is for a one-semester course, a position to which a single designated certificated employee has not been assigned at the beginning ofa semester for an entire semester. 2. There should be a teacher assigned to each class and not a serie of substitutes or other temporary teachers. D. There should be no teacher misassignments. 1. Misassignment means the placement of a certificated employee in a teaching or services position for which the employee does not hold a legally recognized certificate or credential or the placement of a certificated employee in a teaching or services position that the employee is not otherwise authorized by statute to hold. 2. The teacher should have the proper credential to teach e class, including the certification required to teach English learners if present. E. Pupils, including English learners, who have not passed one or both farts of the high school exit examination (CAHSEE) by the end of the Ii grade, are to be provided the opportunities to receive intensive instruction and services for up to two consecutive academic years after the completion of Grade 12. III NOTICE POSTING REQUIREMENT A. "Notice to Parents, Guardians, Pupils, Teachers and Other Stakeholders Important Information About Your Complaint Rights WilliamsNalenzuela Legislation" (Attachment A) must be posted in each classroom visible to staff, pupils, parents and other stakeholders. IV. COMPLANT PROCEDURES A. Complaint Filing 1. Complaints may be filed anonymously and the complainant need not use the "Williams/Valenzuela Uniform Complaint Procedures Form" to file a complaint. 2. Completed complaint forms may be submitted to school sites (main office, principa~, etc.), local district offices and/or district offices. In those instances, the site administrator is requested to promptly forward a copy of the written complaint/form to the Educational Equity Compliance via fax at (213) or throut school mail to Educational Equity Compliance Office, Beaudry - 20 Floor. 3. Complainants may also submit a written complaint or completed WilIiamsNalenzuela Uniform Complaint Procedures Form by mail, fax, or as follows: Los Angeles Unitled School District Educational Equity Compliance Office 333 S. To receive a response, the complainant's contact information must be completed and a check-off mark must be indicated on the form. If Section of the Education Code is applicable, the response, if requested, and report shall be written in English and the primary language in which the complaint was filed. Schools, local district offices, or other offices in receipt of a completed WilliamsNalenzuela Uniform Complaint Procedures Form are to promptly forward all complaint forms/written complaints by either fax to (213) , towilliam-valenzuela@lausd.net. or school mail to the Educational Equity Compliance Office, Beaudry Building 20 th Floor. 2. The principal or designee shall make all reasonable efforts to investigate any problem within his/her authority. He/she shall remedy a valid complaint within a reasonable time period not to exceed 30 working days from the date the complaint was received. Information regarding the resolution of the complaint must be provided in writing to the Educational Equity Compliance Office within 30 working days from the date the complaint was received. 3. A complaint regarding issues beyond the authority of the school principal shall be forwarded in a timely manner, but not to exceed ]0 working days, to the Educational Equity Compliance Office. Upon receipt, the Educational Equity Compliance Office will promptlly forward the complaint to the appropriate school district official for resolution. 4. Within 45 working days of the initial filing of the complaint, the Educational Equity Compliance Office win mail a response with the resolution to the following: a. Complainant, if contact information provided and a check-off mark indicated on the complaint form b. Loca'i District Superintendent/Division ofauthority c. Principal d. Division Contact Personnel (Textbook/Instructional Materials, Human Resources, Facilities or CAHSEE) 5. If no response information was provided or requested by the Complainant, a resolution of the complaint wiji be forwarded to the principal, local district superintendent/division of Authority and the Division contact personnel. VI. APPEALS PROCESS A. Complainants shall comply with the appeal requirements of California Code ofregujations, Title 5, Section Office ofgeneral Counsel Page 40f6

To obtain information regarding Board meeting schedules, please contact Board Secretariat at (213) or log on to <inet. C. Complainants not satisfied with the resolution involving emergency or urgent school facilities conditions can file an appeal to the Superintendent ofpublic Instruction within 15 days ofreceiving the report. V. WILLIAMSNALENZUELA COMPLAINTS DATA REPORTING A. The Director of the Educational Equity Compliance Office will report summarized data regarding the Williams/Valenzuela Uniform Complaints on a quarterly basis to the Board of Education at a regular scheduled Board meeting and to the County Superintendent of Education. B. The report shall include the number of complaints by general subject area with the number of resolved and unresolved complaints. Reports, complaints and written responses will be available as public records. VI. COMPLAINT TRACKING SYSTEM WilliamslValenzuela Complaint Tracking System (Attachment D) is provided to show the process used to handle each complaint received. AUTHORITY: This is a policy of the Superintendent of Schools.
