1 Administrative Regulation Community Relations AR (a) WILLIAMS UNIFORM COMPLAINT PROCEDURES Types of Complaints The District shall use the following procedures to investigate and resolve complaints when the complainant alleges that any of the following has occurred: (Education Code 35186; 5 CCR 4681, 4682, 4683) 1. Textbooks and instructional materials a. A student, including an English learner, does not have standards-aligned textbooks or instructional materials or stateor District-adopted textbooks or other required instructional materials to use in class. b. A student does not have access to textbooks or instructional materials to use at home or after school. c. Textbooks or instructional materials are in poor or unusable condition, have missing pages, or are unreadable due to damage. (cf Selection and Evaluation of Instructional Materials) 2. Teacher vacancy or misassignment a. A semester begins and a teacher vacancy exists. b. A teacher who lacks credentials or training to teach English learners is assigned to teach a class with more than 20 percent English learner students in the class. (cf Staff Teaching Students of Limited English Proficiency) c. A teacher is assigned to teach a class for which the teacher lacks subject matter competency. Teacher vacancy means a position to which a single designated certificated employee has not been assigned at the beginning of the year for an entire year or, if the position is for a one-semester course, a position to which a single designated certificated employee has not been assigned at the beginning of the semester for an entire semester. (Education Code 35186; 5 CCR 4600) Beginning of the year or semester means the first day classes necessary to serve all the students enrolled are established with a single designated certificated employee

2 Community Relations AR (b) WILLIAMS UNIFORM COMPLAINT PROCEDURES (continued) assigned for the duration of the class, but not later than 20 working days after the first day students attend classes for that semester. (5 CCR 4600) Misassignment means the placement of a certificated employee in a teaching or services position for which the employee does not hold a legally recognized certificate or credential or the placement of a certificated employee in a teaching or services position that the employee is not otherwise authorized by statute to hold. (Education Code 35186; 5 CCR 4600) (cf Certification) (cf Assignment) 3. Facilities a. A condition poses an emergency or urgent threat to the health or safety of students or staff. Emergency or urgent threat means structures or systems that are in a condition that poses a threat to the health and safety of students or staff while at school, including but not limited to, gas leaks; nonfunctioning heating, ventilation, fire sprinklers, or airconditioning systems; electrical power failure; major sewer stoppage; major pest or vermin infestation; broken windows or exterior doors or gates that will not lock and that pose a security risk; abatement of hazardous materials previously undiscovered that pose an immediate threat to students or staff; or structural damage creating a hazardous or uninhabitable condition. (Education Code ) b. A school restroom has not been cleaned, maintained, or kept open in accordance with Education Code Clean or maintained school restroom means a school restroom has been cleaned or maintained regularly, is fully operational, or has been stocked at all times with toilet paper, soap, and paper towels or functional hand dryers. (Education Code ) Open restroom means, except as necessary for student safety or to make repairs, the school has kept all restrooms open during school hours when students are not in classes and has kept a sufficient number of restrooms open during school hours when students are

3 Community Relations AR (c) WILLIAMS UNIFORM COMPLAINT PROCEDURES (continued) Filing of Complaint in classes. (Education Code ) A complaint alleging any condition(s) specified above shall be filed with the principal or designee at the school in which the complaint arises. The principal or designee shall forward a complaint about problems beyond his/her authority to the Superintendent or designee in a timely manner, but not to exceed 10 working days. (Education Code 35186; 5 CCR 4680) The principal or designee shall make all reasonable efforts to investigate any problem within his/her authority. He/she shall remedy a valid complaint within a reasonable time period not to exceed 30 working days from the date the complaint was received. (Education Code 35186; 5 CCR 4685) Complaints may be filed anonymously. If the complainant has indicated on the complaint form that he/she would like a response to the complaint, the principal or designee shall report the resolution of the complaint to him/her within 45 working days of the initial filing of the complaint. If a response is requested, the response shall be made to the mailing address of the complainant as indicated on the complaint form. At the same time, the principal or designee shall report the same information to the Superintendent or designee. (Education Code 35186; 5 CCR 4680, 4685) When Education Code is applicable and the complainant has requested a response, the response shall be written in English and in the primary language in which the complaint was filed. (Education Code 35186) If a complainant is not satisfied with the resolution of a complaint, he/she has the right to describe the complaint to the Governing Board at a regularly scheduled meeting. (Education Code 35186; 5 CCR 4686) For any complaint concerning a facilities condition that poses an emergency or urgent threat to the health or safety of students or staff as described in item #3a above, a complainant who is not satisfied with the resolution proffered by the principal or Superintendent or designee may file an appeal to the Superintendent of Public Instruction within 15 days of receiving the District s response. The complainant shall comply with the appeal requirements specified in 5 CCR (Education Code 35186; 5 CCR 4687) All complaints and written responses shall be public records.

4 Community Relations AR (d) WILLIAMS UNIFORM COMPLAINT PROCEDURES (continued) (Education Code 35186; 5 CCR 4686) (cf Access to District Records) Reports The Superintendent or designee shall report summarized data on the nature and resolution of all complaints to the Board and the County Superintendent of Schools on a quarterly basis. The report shall include the number of complaints by general subject area with the number of resolved and unresolved complaints. These summaries shall be publicly reported on a quarterly basis at a regularly scheduled Board meeting. (Education Code 35186; 5 CCR 4686) Forms and Notices The Superintendent or designee shall ensure that the District's complaint form contains a space to indicate whether the complainant desires a response to his/her complaint and specifies the location for filing a complaint. A complainant may add as much text to explain the complaint as he/she wishes. 6 Con Relación a la Comunidad AR (a) PROCEDIMIENTOS UNIFORME PARA RESOLVER QUEJAS DE WILLIAMS Tipos de Quejas El Distrito deberá usar los siguientes procedimientos para investigar y resolver quejas cuando el querellante alega que cualquiera de los siguientes ha ocurrido: (Código Educativo 35186; 5 CCR 4681, 4682, 4683) 1. Libros de textos y materias de instrucción a. Un alumno, incluyendo un aprendiz de Inglés, no tiene libros de textos alineados con las normas o materias de instrucción o libros de textos adoptados por el Distrito o el estado u otras requeridas materias de instrucción para usar en la clase. b. Un alumno no tiene acceso a libros de textos o materias de instrucción para usar en el hogar o después de la escuela. c. Libros de textos o materias de instrucción están en pobre condición y no se pueden usar, les faltan páginas o no se pueden leer debido al deterioro. (cf Selección y Evaluación de las Materias de Instrucción) 2. Vacancia de maestros o mal asignación a. Un semestre empieza y una vacancia de maestro existe. b. Un maestro a quien le hace falta los credenciales o el entrenamiento para enseñar a los aprendices de Inglés es asignado a enseñar una clase con más de 20 por ciento alumnos de aprendiz de Inglés en la clase. (cf Personal que Enseña a los Alumnos que son Limitados en la Proficiencia de Inglés) c. Un maestro es asignado para enseñar a una clase por cual al maestro le falta la capacidad del curso de estudios. Vacancia de maestro significa una posición en cual un solo designado empleado certificado no ha sido asignado al inicio del año por todo el año o, si la posición es para un curso de un semestre, una posición en cual un solo designado empleado certificado no ha sido asignado al inicio de un semestre por un semestre entero. (Código Educativo 35186; 5 CCR 4600)

7 Con Relación a la Comunidad AR (b) PROCEDIMIENTOS UNIFORME PARA RESOLVER QUEJAS DE WILLIAMS (continuación) Inicio del año o semestre significa que el primer día de las clases necesarias para servir a todos los alumnos inscritos son establecidos con un solo designado certificado empleado asignado para la duración de la clase, pero no mas después que 20 días de trabajo después del primer día que los alumnos asisten a las clases para ese semestre. (5 CCR 4600) Mal asignación significa la colocación de un empleado certificado en una posición de enseñanza o de servicios por cual el empleado no detiene un reconocido certificado o credencial o la colocación de un empleado certificado en una posición de enseñanza o de servicios que un empleado no esta de otra manera autorizado en detener por ley. (Código Educativo 35186; 5 CCR 4600) (cf Certificación) (cf Asignación) 3. Facilidades a. Una condición propone un daño emergente o urgente para la salud o la seguridad de los alumnos o el personal. Daño emergente o urgente significa las estructuras o sistemas que están en la condición que proponen un daño a la salud y la seguridad de los alumnos o el personal mientras en la escuela, incluyendo pero no limitado a los agujeros de gas; calefacción que no funcionan, ventilación, rociadura para la extinción de incendios, o los sistemas del acondicionamiento del aire; falta de la energía eléctrica; mayor cesación de aguas fecales; mayor infestación de sabandija o peste de insectos; ventanas quebradas o puertas o cercos exteriores que no cierran con llave y que proponen un riesgo de seguridad; disminución de materiales peligrosos que no se han descubierto previamente y que proponen un daño inmediato a los alumnos o al personal; o daño estructural creando una condición peligrosa o inhabitable. (Código Educativo ) b. El baño de la escuela no se ha limpiado, mantenido, o mantenido abierto en acuerdo con el Código Educativo Baño limpio o mantenido de la escuela significa que el baño de la escuela ha sido limpiado o se mantiene regularmente, esta completamente de operación, o ha sido proveído a todo tiempo con papel higiénico, jabón, y papel

8 Con Relación a la Comunidad AR (c) PROCEDIMIENTOS UNIFORME PARA RESOLVER QUEJAS DE WILLIAMS (continuación) para secarse las manos o secadores de manos que funcionan. (Código Educativo ) Baños abiertos significa, a menos que sea necesario para la seguridad del alumno o para hacer reparaciones, la escuela ha mantenido todos los baños abiertos durante las horas escolares cuando los alumnos no están en clases y ha mantenido un número suficiente de baños abiertos durante las horas escolares cuando los alumnos están en las clases. (Código Educativo ) Presentación de Una Queja Una queja alegando cualquiera condición(es) específicas arriba deberá ser presentado al director(a) o con su designado en la escuela en cual la queja se originó. El director(a) o su designado deberán entregar una queja sobre los problemas más allá de la autoridad de él/ella al Superintendente o su designado en una manera oportunamente, pero que no excede 10 días de trabajo. (Código Educativo 35186; 5 CCR 4680) El director(a) o su designado deberá hacer todos los esfuerzos razonable para investigar cualquier problema dentro la autoridad de él/ella. Él/ella deberá remediar una queja válida dentro un periodo de tiempo razonable que no excede 30 días de trabajo desde la fecha que se recibió la queja. (Código Educativo 35186; 5 CCR 4685) Las quejas se pueden presentar anónimamente. Si el querellante ha indicado en la forma de queja que él/ella quisiera una respuesta a la queja, el director(a) o su designado deberá reportar la resolución de la queja a él/ella dentro de 45 días de trabajo de la presentación inicial de la queja. Si una respuesta se pide, la respuesta deberá ser dirigida a la dirección de correo del querellante como indicado en la forma de queja. Al mismo tiempo, el director(a) o su designado deberá reportar la misma información al Superintendente o su designado. (Código Educativo 35186; 5 CCR 4680, 4685) Cuando el Código Educativo es aplicable y el querellante ha solicitado una respuesta, la respuesta deberá ser por escrito en Inglés y en el idioma natal en cual la queja fue presentada. (Código Educativo 35186) Si un querellante no esta satisfecho con la resolución de una queja, él/ella tiene el derecho de describir la queja a la Mesa Gobernante en una junta regularmente programada. (Código Educativo 35186; 5 CCR 4686)

9 Para cualquier queja a cerca de las condiciones de las facilidades cual propone un daño emergente o urgente a la salud o seguridad de los Con Relación a la Comunidad AR (d) PROCEDIMIENTOS UNIFORME PARA RESOLVER QUEJAS DE WILLIAMS (continuación) alumnos o el personal como descrito en el artículo #3a arriba, un querellante que no esta satisfecho con la resolución ofrecido por el director(a) o Superintendente, o su designado puede archivar una apelación al Superintendente de la Instrucción Pública dentro de 15 días al recibir la respuesta del Distrito. El querellante deberá cumplir con los requisitos de la apelación especificados en 5 CCR (Código Educativo 35186; 5 CCR 4687) Todas las quejas y respuestas por escrito deberán ser récords públicos. (Código Educativo 35186; 5 CCR 4686) (cf Acceso a los Récords del Distrito) Informes El Superintendente o su designado deberá reportar el resumen de información sobre el origen y la resolución de todas las quejas en una base trimestralmente a la Mesa Directiva y al Superintendente de las Escuelas del Condado. El informe deberá incluir los números de quejas por el área de sujeto general con el número de quejas que se resolvieron y que no se resolvieron. Estos resúmenes deberán ser reportados públicamente en la base trimestralmente en una junta de la Mesa Directiva regularmente programada. (Código Educativo 35186; 5 CCR 4686) Formas y Avisos El Superintendente o su designado deberán asegurar que la forma de queja del Distrito contiene un espacio para indicar si el querellante desea una respuesta a la queja de él/ella e indica la localidad para presentar la queja. Un querellante puede añadir tanto texto para explicar la queja como desea él/ella.
