2 ~ : ENTENDIMIENTO RELA TIVO AL EST ABLECIMIENTO DE LA SECRET ARiA DE ASUNTOS AMBIENT ALES BAJa EL TRA T ADO DE LIBRE COMERCIO REPUBLICA JDOMINICANA -CENTRO AMERICA -EST ADOS UNIDOS 18 de febrero del 2005 Los Gobiernos de la Republica de Costa Rica, la Republica Dominicana, la Republica de- El Salvador, la Republica de Guatemala, la Republica de Honduras, la Republica de Nicaragua, y los Estados Unidos de America ("los Gobiernos del TLC") hall llegado a los siguientes entendimientos con respecto a la implementaci6n de log Articulos 177 (Comunicaciones Relativas a la Aplicaci6n de la Legislaci6n Ambiental) y 178 (Expediente de Hechos y Cooperaci6n Relacionada) del Capitulo Diecisiete (Ambiental) del Tratado de Libre Comercio Republica Dominicana-Centro America-Estados Unidos firmado e15 de agosto de 2004 (el "Tratado"): 1 Los Gobiernos del TLC solicitaran a la Secretaria de Integraci6n Econ6mica Centroamericana ("SIECA ") que establezca una nueva unidad dentro de SIECA que sirva como la "secretaria u otro organismo apropiado" a que se refiere el Articulo 1771 del Tratado r para emprender lag funciones establecidas en log Articulos 177 y 178 del Tratado 2 Con posterioridad al consentimiento de SIECA a dicha solicitud, log Gobiernos del TLC, par medic de un arreglo 0 acuerdo apropiado con SIECA, estableceran planes de trabajo, incluyendo, segun sea apropiado, procedimientos y lineamientos, bajo log cuales funcionara2 la unidad, que proveeran entre otros, que: (a) (b) (c) El Consejo de Asuntos Ambientales ("el Consejo"), establecido segun el Articulo 175 del Tratado, nombrara a un Coordinador General y el personal profesional permanente de la unidad La unidad sera de un tamafio apropiado y estara conformada par personas con los conocimientos especializados pertinentes en derecho ambiental y en su aplicaci6n, incluyendo conocimientos especializados regionales, y con un historial comprobado de buen juicio y objetividad; La unidad funcionara como una entidad independiente dentro de SIECA y cantara con: log conocimientos especializados pertinentes en materia ambiental y regional; La unidad estara bajo la exclusiva direcci6n y supervisi6n del Consejo, y realizara unicamente lag funciones establecidas en log Articulos 177 Y 178 del Tratado; 1 Los Gobiemos del TLC adem as deberan asegurar que cualquier recomendaci6n del Consejo bajo el Articulo 1788 del Tratado debera estar limitada a asuntos dentro del ambito de una potencial cooperaci6n ambiental 2 Mediante decisi6n del Consejo, con base en una solicitud especifica, gobiemos y/u organizaciones pertinentes podran compartir experiencias y conocimientos especializados pertinentes relacionados con la administraci6n de procedimientos segun 10 dispuesto en log Artfculos 177 Y 178 del Tratado

3 (d) (e) (f) El Consejo establecera una lista de expertos arnbientales, compuesta par personas con un historial comprobado de buenjuicio, objetividad y conocimientos especializados en materia arnbiental, incluyendo conocimientos especializados regionales, de la cualla unidad seleccionara, segun sea apropiado, de conformidad con los procedimientos establecidos par el Consejo, a individuos para que asistan a la unidad, bajo su direcci6n, con la preparaci6n de los expedientes de hechos segun el Articulo 178 del Tratado; El Coordinador General y el personal de la unidad no recibiran instrucciones de ningun gobiemo, ni de ninguna otra autoridad que no sea el Consejo, y se reportaran unicamente ante el Consejo; y El Consejo establecera las disposiciones apropiadas para la protecci6n y no divulgaci6n de informaci6n confidencial recibida de los peticionarios y gobiemos 3 Cada Gobiemo del TLC hara to do el esfuerzo razonable par brindar oportunamente a la unidad informaci6n suficiente que Ie permita realizar sus funciones segun los Articulos 177 y 178 del Tratado, sujeto alas disposiciones establecidas de conformidad con el parrafo 2(f) arriba El presente entendimiento entrara en vigor en la fecha de entrada en vigor del Tratado POR EL GO 0 DE COSTA ZA: ~a4c;yi, ICA D"T'A: OR: LA: POR EL GOBIERNO POR EL (~M1; POR EL GOBIERNO DE LOS f~ :/!;/ tt<g T ADOS UNIDOS DE AMERICA: 2

4 UNDERSTANDING REGARDING THE ESTABLISHMENT OF A SECRET ARIA T ENVIRONMENTAL MATTERS UNDER THE DOMINICAN REPUBLIC -CENTRAL AMERICA -UNITED STATES FREE TRADE AGREEMENT February 18, 2005 The Governments of the Republic of Costa Rica, the Dominican Republic, the Republic ofei Salvador, the Republic of Guatemala, the Republic of Honduras, the RepublIc of Nicaragua, and the United States of America ("FT A Governments") have reached the following understandings regarding the implementation of Articles (Submissions on Enforcement Matters) and 178 (Factual Records and Related Cooperation) of Chapter Seventeen (Environment) of the Dominican Republic -Central America -United States Free Trade Agreement signed on August 5, 2004 ("the Agreement"): 1 The FT A Governments shall request the Secretariat for Central American Economic Integration ("SIECA ") to establish a new unit within SIECA to serve as the "secretariat or other appropriate body" referred to in Article 1771 of the Agreement and to undertake the functions set out in Articles 177 and 178 of the Agreement' 2 On consent of SIECA to such a request, the FT A Governments, through an appropriate arrangement or agreement with SIECA, shall establish working arrangements, including, as appropriate, procedures and guidelines, under which the unit shall operate,2 which shall provide, among other things, that: O' (a) (b) (c) (d) The Environmental Affairs Council ("the Council") established under Article 175 of the Agreement shall appoint a General Coordinator and permanent professional staff of the unit The unit shall be of appropriate size and comprise persons with relevant expertise in environmental law and its enforcement, including regional expertise, and having a demonstrated record of good judgment and objectivity; The unit shall function as an independent entity within SIECA and shall have appropriate environmental and regional expertise; The unit shall be under the sole direction and supervision of the Council, and shall perform only those functions set out in Articles 177 and 178 of the Agreement; The Council shall establish a roster of environmental experts, comprising persons with a demonstrated record of good judgment, objectivity, and environmental expertise, including regional expertise, from which the unit shall select, as appropriate, according to procedures established by the Council, individuals to assist the unit, under its direction, with the preparation of factual records pursuant to Article 178 of the Agreement;, The FT A Governments shall also ensure that any recommendations by the Council under Article 1788 of c the Agreement shall be limited to matters in the context of potential environmental cooperation 2 Through a decision of the Council, based upon a specific request, governments and/or relevant organizations may share relevant experiences and expertise concerning the administration of procedures as set forth in Articles 177 and 178 of the Agreement
