RESTRICTED GPA/MOD/JPN/70 14 de febrero de 2014 (14-0929) Página: 1/6 Comité de Contratación Pública Original: inglés MODIFICACIONES PROPUESTAS DEL APÉNDICE I DEL JAPÓN COMUNICACIÓN DEL JAPÓN DE CONFORMIDAD CON EL PÁRRAFO 6 a) DEL ARTÍCULO XXIV 1 DEL ACP La siguiente comunicación, de fecha 12 de febrero de 2014, se distribuye a petición de la delegación del Japón. 1. De conformidad con el párrafo 6 a) del artículo XXIV del Acuerdo sobre Contratación Pública (en adelante el "Acuerdo"), el Gobierno del Japón notifica por la presente al Comité de Contratación Pública las siguientes modificaciones de carácter puramente formal en relación con el Anexo 1 del Apéndice I del Acuerdo: Anexo 1 Añádase "Specific Personal Information " y "Japan Fair Trade Commission" a la "Lista de entidades" y a la "Lista de entidades que contratan los servicios indicados en el Anexo 4". 2. Las modificaciones anteriores obedecen a lo siguiente: i. La Comisión para la Protección de Información Personal Específica (Specific Personal Information ) se estableció como órgano independiente adscrito a la Oficina del Consejo de Ministros el 1º de enero de 2014, de conformidad con las leyes internas pertinentes relativas al establecimiento de la Comisión. El cometido de la Comisión es adoptar medidas necesarias, tales como impartir orientaciones y asesoramiento a las personas que manejan información personal específica para que esto se haga de forma correcta, tomándose en consideración al mismo tiempo la utilidad de esa información. 1 El párrafo 6 a) del artículo XXIV establece lo siguiente: Rectificaciones o enmiendas a) Las rectificaciones, las transferencias de entidades de un Anexo a otro o, en casos excepcionales, las enmiendas de otro tipo que afecten a los Apéndices I a IV serán notificadas al Comité, y en la notificación se facilitará información en cuanto a las probables consecuencias del cambio en el alcance mutuamente convenido previsto en el Acuerdo. Las rectificaciones, transferencias o enmiendas de otro tipo de carácter puramente formal o menores surtirán efecto a condición de que en un plazo de 30 días no se presente objeción a ellas. De no ser así, el Presidente del Comité convocará prontamente una reunión del Comité. El Comité examinará la propuesta y las posibles demandas de arreglos compensatorios, con el fin de mantener un equilibrio de derechos y obligaciones y un nivel comparable del alcance mutuamente convenido previsto en el presente Acuerdo antes de la notificación de que se trate. En caso de que no se llegue a un acuerdo, podrá llevarse adelante la cuestión con arreglo a las disposiciones del artículo XXII.
- 2 - ii. La Comisión de Comercio Leal del Japón (Japan Fair Trade Commission) es un órgano independiente adscrito a la Oficina del Consejo de Ministros desde marzo de 2003. Como se estipula en la Nota 1 al Anexo 1 del Apéndice I del Japón, esta Comisión es una entidad abarcada, independientemente de que se enumere o no en el Anexo 1. Sin embargo, como todos los órganos independientes adscritos a la Oficina del Consejo de Ministros (es decir, la Comisión Nacional de Seguridad Pública, el Organismo de Servicios Financieros, la Oficina de Asuntos del Consumidor) están enumerados en el Anexo 1, la Comisión de Comercio Leal del Japón se añade al Anexo 1 para mayor claridad. 3. Estas modificaciones no alteran el nivel del alcance mutuamente convenido previsto en el Acuerdo. 4. En el suplemento A del presente documento se muestran las modificaciones de las páginas correspondientes del Anexo 1 (1/3 y 2/3) del Apéndice I propuestas por el Japón en esta comunicación. En el suplemento B se indica cómo quedarían dichas páginas una vez introducidas las modificaciones propuestas por el Japón en la presente comunicación. Los cambios se indican con negrita y subrayado. 2 5. El Japón tiene la intención de notificar esas mismas modificaciones tras su aceptación del Protocolo por el que se modifica el Acuerdo sobre Contratación Pública, de conformidad con lo dispuesto en el párrafo 1 del artículo XIX del Acuerdo revisado. 2 Los suplementos A y B existen únicamente en inglés.
