3 Information Notice to Quit for Nonpayment of Rent or Other Breach If it becomes necessary for a Landlord to notify a Tenant that they need to vacate certain leased premises due to non-payment of rent or due to some other breach, the notice should be in writing. This is not only a good idea, but it also often required by law and/or by the lease. This is a written notice from a Landlord to a Tenant who has failed to comply with an obligation under the lease or term of the lease. Some of the possible breaches under a lease may include (a) tenant failed to make rent payments; (b) tenant made alterations without permission; (c) tenant refuses to allow the landlord access to the rental unit after reasonable notice; (d) tenant is severely disturbing other tenants or seriously damaging the property; (e) tenant conducts serious illegal activity on the rental property, etc. This type of notice is sometimes called a "Notice to Quit". This notice can be used with either a commercial or residential tenant. Usually, a notice to the tenant that rent is overdue (or that another obligation under the lease is not met) is sent before the Notice To Quit is sent out. When the tenant fails to respond to the notice (i.e. that rent is overdue), it is customary to then send out a Notice To Quit. 5 Información Aviso de Desalojo por Suspensión de Pagos de Renta o Cualquier otro incumplimiento Si se vuelve necesario que un Arrendador notifique a su Inquilino de la necesidad de desalojar ciertas propiedades previamente arrendadas debido a la suspensión de pagos de renta o debido a cualquier otro incumplimiento, este aviso deberá realizarse por escrito. Esto no es solo una buena idea, sino que es requisito de ley y/ o del contrato de Arrendamiento. Esta es un aviso por escrito del Arrendador dirigida al Inquilino que ha fallado en cumplir con las obligaciones bajo el Contrato o el término del Arrendamiento. Algunas de las causas posibles de incumplimiento de un contrato pueden incluir (a) el inquilino no realizo los pagos de la renta; (b) el inquilino realizó modificaciones sin previa autorización; (c) el inquilino no permite el acceso del Arrendador a la unidad rentada después de un aviso proporcionado en un tiempo razonable; (d) el Inquilino esta molestando severamente a los otros inquilinos o bien dañando gravemente la propiedad; (e) el Inquilino realiza actividades ilegales en la propiedad rentada, etc. Este tipo de aviso se conoce como Aviso de Desalojo. Este tipo de aviso puede ser usado ya sea con inquilinos residenciales o en propiedades comerciales. Por lo general, un aviso dirigido al inquilino cuando la renta esta vencida (o cuando cualquier otra obligación dentro del contrato no ha sido acatada) es mandada antes de que el Aviso de Desalojo sea remitido. Cuando el Inquilino no responde al primer aviso (por ejemplo: que la renta esta vencida), se acostumbra mandar un Aviso de Desalojo.
