1 Ordinance No An ordinance declaring unopposed candidates elected to the offices of City Council District 1, District 2, District 3, and District 4, declaring an emergency, providing for savings, and providing an effective date. Whereas in accordance with Article II, Section 3 of the City Charter as amended by Agreed Order Nunc Pro Tunc entered in the Voting Rights Acts lawsuit ( Civil Action N. V , U. S. District Court for the Southern District of Texas, Victoria Division), and Chapter 2, Section 2-1 of the City Code of the City of Victoria, Texas, and the laws of the State of Texas, by Ordinance No , a joint general election was called for May 5, 2018 for the purpose of electing the City Council District 1, City Council District 2, City Council District 3, and City Council District 4; and Whereas Sections through of the Texas Election Code permit a political subdivision to declare candidates elected to office if no candidates in the election are opposed; and the City Secretary has certified that no candidates have filed for the office of City Council Districts 1, 2, 3 or 4 other than the person who currently holds office in the aforesaid three- year term: district; Now therefore be it ordained by the City Council of the City of Victoria, Texas: 1. The following unopposed candidates are declared elected to the following offices for a Councilmember, District 1 Rafael De La Garza, III Councilmember, District 2 Josephine E. Soliz Councilmember, District 3 Jeff Bauknight Councilmember, District 4 Jan Scott 2. If any provision of this ordinance, or the application thereof to any person or circumstances, shall be held invalid or unconstitutional by a court of competent jurisdiction, such invalidity shall not affect the other provisions, or application thereof, of this Ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable. 3. Early voting is scheduled to begin on April 23, 2018; therefore, an emergency is declared and the requirement of Article II, 9 of the City Charter that no ordinance shall be passed finally on the date of its first reading is suspended, and this Ordinance shall become effective immediately upon passage and approval by the City Council of the City of Victoria, Texas. 3 mandato Ordenanza N Una ordenanza que declara candidatos unicos elegidos para los cargos de Concejal Municipal del Distrito 1, Distrito 2, Distrito 3, y Distrito 4, declara una emergencia, estipula ahorros y estipula una fecha efectiva. Considerando que de acuerdo con el Articulo II, Seccion 3 del Fuero Municipal en su forma enmendada por la orden nunc pro tune presentada en el litigio de la Ley de Derecho al Voto( accion civil N. V , Tribunal de Distrito de Estados Unidos para el Distrito Sur de Texas, Division de Victoria) y el Capitulo 2, Seccion 2-1 del Codigo Municipal de la ciudad de Victoria, Texas, y las leyes del estado de Texas, por Ordenanza N , se convocaron elecciones generales conjuntas para el 5 de mayo de 2018 con el fin de elegir Concejal Municipal Distrito 1, Concejal Municipal Distrito 2, Concejal Municipal Distrito 3 y Concejal Municipal Distrito 4; y Considerando que las secciones a del Codigo electoral de Texas permiten que una subdivision politica declare candidatos elegidos al cargo y anule las elecciones si todos los candidatos en las elecciones son Onicos; y la Secretaria Municipal ha certificado que ningun candidato se ha postulado para el cargo de Concejal Municipal para los Distritos 1, 2, 3 o 4, aparte de la persona que actualmente ocupa dicho cargo en los distritos mencionados; Ahora, por lo tanto, el Concejo Municipal de la ciudad de Victoria, Texas, ordena que: 1. Los siguientes candidatos unicos se declaran elegidos para los siguientes cargos por un de tres anos: Concejal del Distrito 1 Rafael De La Garza, III Concejal del Distrito 2 Josephine E. Soliz Concejal del Distrito 3 Jeff Bauknight Concejal del Distrito 4 Jan Scott 2. Si cualquier disposicion de esta ordenanza, o la aplicacion de esta a cualquier persona o circunstancia, llega a considerarse invalida o inconstitucional por un tribunal de jurisdiccion competente, dicha nulidad no afectara a las otras disposiciones de esta Ordenanza, ni a la aplicacion de las mismas. La Ordenanza puede entrar en vigencia sin la disposicion o aplicacion invalida, y por este motivo las disposiciones de la presente Ordenanza se declaran divisibles. 3. La votacion anticipada esta programada para comenzar el 23 de abril de Por lo tanto, se declara una emergencia y se anula el requisito del Articulo II, 9 del Fuero Municipal que estipula que ninguna ordenanza debera ser aprobada finalmente en la fecha de su primera lectura, y esta Ordenanza entrara en vigencia inmediatamente despues de su aprobacion por parte del Concejo Municipal de la ciudad de Victoria, Texas.
