1 SAN ANTONIO POLICE DEPARTMENT IMMIGRATION PRACTICES QUESTIONS AND ANSWERS 1. If an immigrant reports a crime (any crime) to the San Antonio Police Department (SAPD) will they be referred to or turned over to Immigration and Customs Enforcement (ICE)? No. Immigration issues are the responsibility of the federal authorities and not the SAPD. The SAPD wants and needs all residents and people in the San Antonio area to feel safe and secure in calling the police for assistance or to report a crime. The only exception to this would be if the person has a federal deportation warrant or a notice from ICE that they are a previously deported felon. Additionally, there are provisions to obtain a U-Visa if the person is a victim or a witness to a crime and is cooperating with an active law enforcement investigation. 2. Can a person be detained by the SAPD only on suspicion of being an illegal immigrant? No. SAPD officers can only detain and/or arrest an individual based on the reasonable suspicion that they have committed a crime or are a witness to a crime. Otherwise our officers are not authorized to detain and/or arrest a person simply on the suspicion that they are in the United States illegally. 3. Is it the policy of the SAPD to ask all people they encounter for proof of legal residence/status? No. SAPD officers do not, and will not, ask people they contact for proof of citizenship or legal residency. 4. Will the SAPD arrest persons solely based on their being a foreign national? No. SAPD officers only have arrest powers when they have probable cause that a person has committed a crime. National origin, immigration status, ethnicity and race are not a basis for arrest and the SAPD does not base any arrest on those conditions. 5. Does the SAPD run a background check on all people they encounter? No. SAPD officers will only run background checks on people they are issuing a citation to, legally detaining, arresting or processing into jail. 6. When a person is arrested and taken to jail by SAPD will ICE be called?

2 No. The only time ICE will be contacted is if the person is found to have criminal warrants issued by ICE, a deportation warrant, or is a previously deported felon. 7. If a person is stopped by the SAPD and is found to be driving without a license will they get arrested and will ICE be contacted? A person driving without a license will be required to provide some form of valid identification. If they cannot provide valid identification and the SAPD officer cannot verify their identity through other means, the person may be detained and taken to jail for driving without a license so the person can be properly identified. If they are booked into the Bexar County Jail, the jail may run the information through the Secure Communities Program. 8. What does the SAPD consider to be valid identification? A state issued driver s license or identification card and other government IDs including passports, military ID, etc., including a Matricula Consular issued by the Mexican Consulate. 9. If an SAPD officer believes I am involved in a criminal activity or I am suspected of committing a crime will they ask me for identification? Yes. SAPD officers are authorized to check/confirm the identity of any person whom they have a reasonable suspicion that the person was involved in criminal activity or has committed a crime. 10. What will an SAPD officer do if they find I have no identification? Any person stopped for a traffic violation or a crime will be asked for identification by the officer. Any person, who cannot provide valid identification or cannot provide sufficient information for an officer to confirm their identity, may be placed into custody by the officer until their identity can be verified. An officer will not arrest you because you do not have proper identification unless you are suspected of having committed a crime. Please keep in mind that due to safety concerns during an investigation, an officer needs to know who they are interacting with. 11. Can I be arrested and deported for a minor traffic violation? Any person who commits a traffic violation and does not have a valid form of ID and who the officer cannot verify their identity, may be arrested. If you have outstanding warrants or are a wanted person you will be arrested. Officers do have the authority to check the status of any individual that has been legally detained. If the officer s routine ID check reveals the individual is a previously deported felon or has an outstanding federal deportation warrant, that person will be taken to the City Magistrate s Office and possibly processed into the Bexar County Jail. If they are booked into the Bexar County Jail, the jail may run the information through the Secure Communities Program. The SAPD does NOT make decisions on whether or not to deport an individual. 12. Can an illegal immigrant who is in possession of a firearm be arrested? Deported? 2

3 Any person in illegal possession of a firearm may be arrested by an SAPD officer. Once arrested, if the officer s routine ID check reveals the individual is a previously deported felon or has an outstanding federal deportation warrant, ICE will be contacted. It will be up to ICE to determine if a person will be deported. The SAPD does NOT make decisions on whether or not to deport an individual. It must be noted, that should a person return illegally to the United States after a felony conviction of being in possession of a firearm, that person may be prosecuted for illegal re-entry which is a criminal offense punishable with up to 20 years in prison. 3

Si un inmigrante reporta un crimen (cualquier crimen) al Departamento de Policía de San Antonio (SAPD) puede ser referido o entregado a las autoridades migratorias (ICE)? No, los asuntos migratorios son responsabilidad de las autoridades federales y no de SAPD. El Departamento de Policía de San Antonio quiere y necesita que todos los residentes y las personas en San Antonio se sientan seguros de llamar a la policía cuando requieran asistencia o para reportar un crimen. La única excepción sería si la persona tiene una orden federal de deportación o un alerta de ICE de que fue previamente deportado. Para promover la denuncia de delitos, inclusive, existen disposiciones que permiten la obtención de una visa U para aquellas personas que son víctimas o testigos de un crimen, y que cooperan con las autoridades dentro de una investigación. 2. La Policía de San Antonio puede detener a una persona sólo bajo la sospecha de ser un migrante indocumentado? No. Nuestros oficiales no están autorizados para detener y/o arrestar a una persona por el sólo hecho de sospechar que está ilegalmente en los Estados Unidos. Los oficiales de la Policía sólo pueden detener y/o arrestar a aquellos individuos sobre los que exista una sospecha razonable de que hayan cometido un delito o hayan sido testigos de uno. 3. Es política de la Policía pedirles a todas las personas prueba de residencia o estatus legal? No, los oficiales de la Policía no pedirán a las personas prueba de ciudadanía o residencia legal. 4. Detendrá la Policía a personas por el sólo hecho de que son extranjeros? No. Los oficiales de la Policía sólo pueden arrestar a aquellas personas sobre las que existe una causa probable de que hayan cometido un delito. La nacionalidad, el estatus migratorio, la etnicidad y la raza no se toman en cuenta para realizar detenciones, y la Policía no se basa en esas condiciones para realizar arrestos. 5. Es verdad que los oficiales de la Policía investigarán/verificaran los antecedentes penales de todas las personas con las que tienen contacto? 4

5 No, los oficiales de la Policía solamente verificarán los antecedentes de aquellas personas que hayan recibido una multa, hayan sido detenidos legalmente, arrestados o sean procesados para ingresar a la cárcel. 6. Cuándo la Policía arresta y lleva a una persona a la cárcel, le llamará a ICE? No, los únicos motivos por los que se le llamará a ICE es cuando la persona tiene una orden de arresto o deportación de ICE, o es un criminal previamente deportado. 7. Si una persona es detenida por la Policía, y se encuentra que maneja sin licencia de conducir, será arrestada y se notificará a ICE? A la persona que maneje sin licencia de conducir se le exigirá proporcionar alguna forma de identificación válida. Si la persona no puede proporcionar alguna identificación válida y el oficial de Policía no puede verificar su identidad a través de otros medios, la persona puede ser detenida y llevada a la cárcel por conducir sin una licencia y para que la persona pueda ser identificada adecuadamente. Si son trasladados a la cárcel del condado de Bexar su información puede ser referida al Programa de Comunidades Seguras. 8. Qué considera la Policía una identificación válida? La licencia de conducir o tarjeta de identificación del gobierno estatal o cualquier otra identificación gubernamental, el pasaporte, la identificación militar, etc., inclusive la "Matrícula Consular" expedida por el Consulado de México. 9. Si un oficial de la Policía cree que estoy involucrado en alguna actividad delictiva o sospecha que he cometido algún delito, me pedirán mi identificación? Sí, los oficiales de la Policía tienen la autoridad de comprobar/confirmar la identidad de cualquier persona que razonablemente sospechen esté involucrada en actividades delictivas o haya cometido un delito. 10. Qué hará un oficial de la Policía si encuentra que no tengo identificación? Cualquier persona que ha sido detenida por una infracción de tráfico o por haber cometido un delito, el oficial le pedirá su identificación. Cualquier persona que no puede proporcionar una identificación válida, o no puede proporcionar suficiente información para confirmar su identidad, puede ser puesta en custodia/detención hasta que su identidad pueda verificarse. El oficial no lo arrestará por no tener identificación apropiada a menos que usted esté bajo sospecha de haber cometido un delito. Por favor tenga presente que debido a cuestiones de seguridad, un oficial de la Policía necesita saber con quién está tratando durante la investigación. 11. Puedo ser arrestado y deportado simplemente por una violación de tráfico menor? Cualquier persona que comete una violación de transito y no tiene una forma de identificación valida y quien el oficial no pueda comprobar su identidad, ser arrestada. Si usted tiene orden de detención o es una persona buscada por las autoridades, usted será arrestado. Los oficiales de la Policía tienen la autoridad de verificar la identidad y los antecedentes de cualquier individuo que 5

6 haya sido legalmente detenido. Si la revisión rutina de su identificación que haga el oficial confirma que el individuo tiene antecedentes penales y ha sido previamente deportado, o tiene alguna orden federal de deportación, esa persona se llevada a la Oficina del Magistrado de la Ciudad y posiblemente se procesará a la Cárcel del Condado de Bexar. Si ellos son puestos en la Cárcel del Condado de Bexar, la cárcel puede ejecutar la información a través del Programa de las Comunidades Seguro. El SAPD no toma decisiones adelante si o para no deportar a un individuo. 12. Un migrante indocumentado que está en posesión de un arma de fuego puede ser arrestado? Deportado? Cualquier persona en posesión ilegal de un arma de fuego puede ser arrestada por un oficial del SAPD. Una vez arrestado, si la revisión rutina de identificación revela que el individuo es un delincuente previamente deportado o tiene una orden de deportación pendiente, se llamará a ICE. Será la decisión de ICE determinar si la persona será deportada o no. El Departamento de Policía de San Antonio no decide sobre la deportación de una persona. Es necesario destacar que si una persona regresa ilegalmente a los Estados Unidos después de haber cumplido una condena por un delito mayor o de haber estado en posesión de un arma de fuego, la persona puede ser procesada por reingreso ilegal, que es un delito con un pena de hasta a 20 años de prisión. 6
