1 Guide to the Norwalk Fair Rent Commission The Fair Rent Commission is a City Commission that has the power to decide whether a rent increase or rent charged to a tenant is unfairly high. What does the Fair Rent Commission do? 1. Provides information The office at Norwalk City Hall provides information to landlords and tenants regarding their individual rights and responsibilities, including questions about evictions, security deposits, repairs, lockouts and utilities. The staff responds to telephone calls, and accepts walk-ins and appointments. 2. Resolves Complaints The Fair Rent Commission office receives complaints from tenants about rents charged for their apartments. The Commission s staff works with other city departments such as Health and Fire to investigate the complaints and to promote safe housing. If the staff cannot mediate problems between the landlord and tenant, the Commission holds a public hearing. After a hearing, the Commission may order the landlord to reduce the rent. If the apartment needs repairs, the Commission may order the rent to be reduced or may order the tenant to pay the rent into escrow until the landlord has made all needed repairs.

2 Who may file a complaint with the Fair Rent Commission? Only tenants may file a complaint with the Commission. Any tenant who lives in Norwalk may file a complaint. You do not need a written lease. You do not need a lawyer to file a complaint. When should I file a complaint? Your landlord has demanded an increase that you believe is unfair Your landlord wants to charge you for utilities/services when they used to be included in the rent or are shared by all tenants You believe that your present rent is unfair because your apartment has unsafe and unhealthy conditions, or conditions which violate the housing code When does the Commission meet? The Fair Rent Commission meets monthly, on the first Wednesday of the month at Norwalk City Hall. Please call the office for the time and place.

3 How does the Commission make its decision? The law lists 13 Factors to be considered: The rents charged for similar apartments in the city or neighborhood The health and safety conditions of your apartment The number of bathtubs, or showers, toilets, and sinks in your apartment Services (such as utilities, furniture, furnishings and equipment) supplied by the landlord The size/ number of bedrooms in the apartment The repairs needed to make your apartment livable The amount of taxes and other expenses of the landlord Whether your apartment complies with the Norwalk housing code and State statues relating to health and safety Your income and whether there are other apartments you can afford What utilities you have in the unit, and whether you or the landlord pays for them Damages, other than ordinary wear and tear, which you have caused to the apartment How much the landlord has raised your rent in the past How much of the rent increase will be used to improve the apartment and building

4 What happens after the hearing? 1. The Commission can decide that the rent increase is fair, and order you to pay it. 2. The Commission can decide that the rent increase is unfair and: Set the rent at a fair level and order the landlord to accept that amount Or Decide that the rent increase has to be phasedin gradually Or Delay a rent increase until repairs are made. Después de una audiencia, la Comisión puede ordenar al propietario reducir la renta. Si el apartamento necesita reparaciones, la Comisión puede demandar que la renta sea reducida o puede ordenar al inquilino pagar la renta en deposito con la Comisión de Alquiler Justo hasta que el propietario ha reparado todo lo necesario.

6 Quién puede iniciar una queja? Cualquier inquilino que viva en Norwalk puede iniciar una queja. Usted no necesita un contrato del alquiler por escrito. Usted no necesita un abogado para iniciar una queja. Cuándo debo iniciar una queja? Su propietario ha exigido un aumento que usted cree es injusto Su propietario desea cargarle por utilidades /servicios cuando eran incluidos en el alquiler o son compartidos por todos los inquilinos. Usted cree que su actual renta es injusta porque su apartamento está en condiciones con riesgo a su salud, o las condiciones violan el código de vivienda de la Ciudad de Norwalk

7 Cómo la Comisión toma su decisión? La ley enumera 13 factores para ser considerado para la Comisión: Los alquileres cobrados por apartamentos similares en la ciudad o la vecindad. Las condiciones de salubridad y de seguridad de su apartamento. Los números de bañeras, o duchas, tocadores, excusados, fregaderos de la cocina y lavamanos del cuarto de baño en su apartamento. Servicios (tales como utilidades, muebles, mobiliarios y equipo) provistos por el propietario. El tamaño y el número de dormitorios en su apartamento. Las reparaciones necesitadas para hacer su apartamento habitable. La cantidad de impuestos y otros costos del propietario. Si las condiciones de su apartamento están de acuerdo con el código de vivienda de Norwalk y los estatutos del Estado referente a la salubridad y a la seguridad. Su ingreso y si hay otros apartamentos que usted pueda costear. Qué utilidades hay en la unidad, y si usted o el propietario paga por ellas. Daños, con excepción del desgaste normal, que usted ha causado al apartamento. Cuánto ha aumentado el propietario su alquiler en el pasado. Cuánto del aumento del alquiler será utilizado para mejorar el apartamento y el edificio.

8 Qué sucede después de la audiencia? 1. La Comisión puede decidir que el aumento del alquiler es justo, y ordenarle pagarlo. 2. La Comisión puede decidir que el aumento del alquiler es injusto y: Fijar el alquiler a un nivel justo y ordenar al propietario aceptar esa cantidad O Decidir que el aumento del alquiler deber ser gradualmente pagado.
