2 FOREWORD Es un placer para mí poder presentar este programa de formación para empresas españolas en el ámbito de Naciones Unidas. Se trata de una iniciativa novedosa que pone de manifiesto el apoyo que está dispuesto a prestar el Gobierno español a sus empresas tanto dentro como fuera de sus fronteras, apoyo que es especialmente importante en un entorno en el que el dinamismo e internalización de nuestras empresas se ha convertido en un auténtico motor de recuperación. El volumen general de compras en bienes y servicios de todas las agencias, organizaciones y programas que componen el sistema de Naciones Unidas ascendió en 2012 a millones de dólares americanos. Este importe convierte el sistema de Naciones Unidas en el mercado más importante de bienes y servicios para proyectos de ayuda humanitaria y de desarrollo. El incremento constante del volumen de adquisiciones por parte del Sistema de Naciones Unidas ofrece grandes oportunidades para el sector privado español. Ahora bien, la cuota de las empresas españolas en las licitaciones del sistema de Naciones Unidas es más bien escasa, tanto en términos de los países de nuestro entorno, con un tamaño económico similar, como en términos de las contribuciones que realiza el Estado español al sistema de Naciones Unidas. Y especialmente destaca cuando se tiene en cuenta la capacidad exportadora y las posibilidades de nuestras empresas en cuanto a poder competir en cualquier otro mercado y el éxito alcanzado en otras licitaciones internacionales. En 2012, las empresas españolas captaron 73,4 millones de dólares de las licitaciones de Naciones Unidas, lo que supone ocupar la posición 41 entre los 193 estados miembros, con un 0,48% del volumen total licitado. Esas cifras quedan lejos de las obtenidas por Estados Unidos que, con millones de dólares es el primer país por volumen de contratación ganada en Naciones Unidas, con un 9,75% del total. Desde el punto de vista de las contribuciones, España ha sido uno de los principales contribuyentes al sistema de NNUU. La mayoría de los fondos aportados por el Estado al conjunto del sistema de Naciones Unidas son voluntarios y no están ligados al sector privado español ni al interés nacional, política que no siguen la mayoría de los miembros de Naciones Unidas. Este desequilibrio y escasa presencia española en las licitaciones del sistema de Naciones Unidas tiene causas diversas. Entre ellas el insuficiente conocimiento del sistema de Naciones Unidas y de sus necesidades por parte de las empresas. Un aspecto en el que este programa se centra de forma prioritaria. Este el contexto en el que se enmarca el programa que se inicia en Nueva York. El objetivo es dar a las empresas españolas participantes formación y preparación para que puedan cubrir las necesidades planteadas en las licitaciones del sistema de Naciones Unidas. Para ello, es clave la oportunidad de intercambiar información activamente con las agencias participantes. Es importante agradecer el apoyo que los departamentos de compras de las diferentes agencias han ofrecido en la organización de estas jornadas. Tengo el convencimiento de que este programa es un primer paso muy importante en el apoyo a la empresa española que contribuirá de forma decidida al éxito en las relaciones comerciales con Naciones Unidas. 10 Workshops OVERVIEW OF THE UN ORGANIZATIONS Wednesday March 12, , Theater Participating UN organizations: UN Procurement Division (UN/PD), United Nations Development Program (UNDP), United Nations Children s Fund (UNICEF), United Nations Office for Project Services (UNOPS), United Nations Entity for Gender Equality and the Empowerment of Women (UNWOMEN). The first session of the program consists of brief general presentations to introduce the UN organizations that will participate in this seminar, their mandate and the specific goods and services that they procure. THE TENDER PROCESS Wednesday March 12, , Theater Participating UN organization: UN/PD This presentation gives an overview of the tender process from A to Z. From the requisition within the UN-organization, the decision on how the requirement will be tendered (local/international and RFQ/ITB/RFP), how the UN finds companies and how companies can find, express interest for, and bid on the tender opportunity, to the bid opening & evaluation by the UN. Other areas that will be covered are the contract award stage and the procurement challenges against contract awards. Key words: Framework of policies, Principles of UN Procurement, UN Regulations and Rules on Procurement, How the UN chooses between different types of solicitation (EOI, RFQ, ITB, RFP), How the UN identifies suppliers and creates short lists, Typical solicitation documents, The use of Bid & Performance Bonds, Typical contracting instruments. Furthermore, other parts of the solicitation process, including the Evaluation and Award process and if applicable, the dispute resolution mechanisms, will be discussed. FINDING BUSINESS OPPORTUNITIES AT THE UN Wednesday March 12, , Theater Participating UN organizations: United Nations Global Market & UN Development Business The United Nations Global Marketplace - UNGM - as the common procurement portal of the United Nations system of organizations brings together UN procurement staff and the vendor community. The UNGM acts as a single window, through which potential suppliers may register with the UN organizations using the UNGM as their vendor database. In this segment we will explore how to make the most of the UNGM portal in a pro-active way as may source of information on past projects, projects in the pipeline, upcoming tender notices, etc. and making it your source of information on procurement trends. United Nations Development Business provides access to timely tender announcements, project opportunities and contract awards in 180 countries. It is the official vehicle for the dissemination of procurement information from the UN, the World Bank, the IDB, and other development banks as well as national governments. UN Development Business will guide seminar participants through their new and improved website.

11 Workshops LEGAL ASPECTS OF UN PROCUREMENT Wednesday March 12, , Theater Participating UN organization: UNDP The UN is a sovereign organization. This presentation discusses the legal aspects of doing business with the UN organizations and programs and how it may affect the procurement process and contracts with the private sector. Themes include: UN charter, Convention on privileges and immunities, General terms and conditions of contracts, Legal status of supplier/ privileges and immunities issues, Dispute resolution, Governing law, Use of UN name and logo, Tax issues, Delivery responsibility, Contractor s responsibility for employees and sub-contractors, Anti-Corruption tools, Risk Management tools, Title to Equipment Copyright, Patents and other Proprietary Rights, etc. TRACK 1 : ICT (SAT-) COMMUNICATION & SOFTWARE Wednesday March 12, , Gallery Participating UN organizations: UN/PD, UN Department of Field Support, UNDP, UNICEF, UN WOMEN Telecommunication and Information Communication Technology are a key resource to facilitate communication between the geographically extended UN organizations and offices. It therefore offers major procurement opportunities for companies that provide these goods and services. In this workshop several UN organizations will provide an overview of their specific needs and requirements. TRACK 2: RENEWABLE ENERGY, WATER & SANITATION PROJECTS Wednesday March 12, , Theater Participating UN organizations: UN/PD, UNOPS, UNICEF Different UN Organizations have different requirements for engineering services. This automatically results in organization-specific procurement of construction services, water filtration & purification, sanitation, environmental technology, energy, prefab & modular systems, waste services and/or management, etc. Practically all UN organizations have engineering requirements, however the three participating UN-organizations will give an indicative overview of the requirements that they have and how to fulfill these requirements in the regions where they are active.

12 Workshops PRACTICAL CASES IN UN PROCUREMENT: CURRENT OPPORTUNITIES IN ICT SERVICES FOR UN HEADQUARTERS & UN FIELD MISSIONS Thursday March 13, , Theater Participating UN organizations: UN/PD, DFS/ OICT In February 2014 UN/PD published 2 requests for information (RFI's) on its website that are practical opportunities for companies that offer ICT Services. These RFI's will be distributed to the seminar participants in advance. To prepare for this workshop, companies are encouraged to study the 2 RFI's, prepare questions and ideas for solutions. During the workshop UN/PD and representatives from DFS will be available to exchange ideas with companies about possible solutions that the UN may want to consider WATER AND SANITATION Thursday March 13, , Theater Participating UN organizations: UN/PD How do the rules and regulations of the UN and local conditions influence the daily procurement? UN/PD will prepare in writing two realistic procurement cases, with questions for the companies, where companies will need to choose how they would have made the procurement decision. The participants will work by groups at the session and will explain their solutions. The cases and questions will be distributed in advance so companies will have a chance to prepare. The cases are examples of field procurement relating to goods in Water and Sanitation and in procurement of consultancy services in IT.
