If this information is correct and you wish to receive a payment from the settlement, you must complete and return the enclosed form. 5 FREQUENTLY ASKED QUESTIONS What is this settlement about? The DOJ filed a lawsuit against Countrywide claiming that it discriminated against more than 200,000 qualified Hispanic and African-American borrowers across the country who received mortgage loans from 2004 through Countrywide denies this allegation. The DOJ and Countrywide agreed on a settlement, which was approved by the United States District Court for the Central District of California on December 28, The settlement, among other provisions, established a $335 million fund to pay African-American and Hispanic borrowers identified as victims by the DOJ. How could I have been discriminated against? The DOJ claims that Countrywide discriminated because of race and national origin by charging higher interest rates and fees to African-American and Hispanic borrowers. The DOJ also claims that African-American and Hispanic borrowers were more than twice as likely to be placed in subprime loans than non-hispanic white borrowers who had similar credit qualifications. To be eligible, a borrower must be identified by the DOJ as overcharged, be Hispanic or African-American and have obtained a mortgage loan from Countrywide between January 1, 2004, and December 31, You do not have to currently have a loan from Countrywide, and it does not matter whether your loan went into default or foreclosure. Is this the same as settlements with Countrywide about foreclosure? No. This only involves the DOJ s $335 million lending discrimination settlement with Countrywide. It is separate from the National Mortgage Settlement with the United States and state Attorneys General that includes the nation s five largest mortgage servicers. If you want to participate in the settlement, return the enclosed form by Monday, January 7, 2013 to register to get a payment. In mid 2013, everyone who registered will receive letters with their exact payment amounts. Once you receive that letter, you and all other borrowers on the loan will need to sign a Release Form to formally accept the payment amount and to receive a check. How will the settlement handle loans with multiple borrowers? Only one borrower needs to sign the form enclosed with this letter to register to get a payment. But you should try to find every borrower named on the first page of this letter, and share the letter with each of them, because every borrower named on the first page of this letter must sign the Release Form that will be sent in mid A single check will be mailed that will be made payable to all of those names. What if I do not think that I will be able to get a signature from one of the borrowers named on the first page of this letter?
