1 PERSETUJUAN ANT ARA PEMERINTAH REPUBLIK INDONESIA DAN PEMERINTAH MEKSIKO SERIKA T MENGENAI KERJASAMA PENDIDIKAN DAN KEBUDAY AAN Pemerintah Republik Indonesia dan Pemerintah Meksiko Serikat, selanjutnya disebut "Para Pihak"; BERKEINGINAN untuk menjalin dan memperkokoh kerjasama serta pertukaran dalam bidang pendidikan, seni, budaya, penerangan, pemuda dan olah raga; BERKEYAKINAN bahwa kerjasama tersebut merupakan sarana yang penting untuk meningkatkan saling pengertian dan persahabatan antara kedua negara; MENGAKUI pentingnya pembentukan mekanisme yang dapat mempererat kerjasama dalam bidang-bidang yang menjadi kepentingan bersama dan perlunya melaksanakan program-program khusus melalui kerjasama dan pertukaran dalam bidang pendidikan, seni, budaya, penerangan, pemuda dan olah raga yang bersifat mendukung peningkatan pemahaman yang lebih luas antara kedua negara; BERDASARKAN pada hukum dan peraturan yang berlaku di masingmasing negara dan konvensi internasional yang mengatur masalah-masalah yang berkaitan dengan tujuan dari Persetujuan ini, yang mengikat kedua Pihak. TELAH MENYETUJUI hal-hal sebagai berikut : Pasal I Tujuan Tujuan dari Persetujuan ini adalah untuk mengadakan kerjasama antara lembaga-lembaga kedua Pihak dalam bidang pendidikan, seni, budaya, penerangan, pemuda dan olah raga, dengan melaksanakan kegiatan-kegiatan yang dapat memberikan sumbangan bagi pengertian yang lebih mendalam antara kedua bangsa.

2 Pasal II Kerjasama dalam bidang Pendidikan Para Pihak akan memajukan kegiatan-kegiatan kerjasama di bidang pendidikan, sebagai berikut : 1. Mendorong kerjasama antar lembaga pendidikan dan ilmu pengetahuan di semua tingkatan serta kerjasama antar para ahli masing-masing negara; 2. Mengadakan jaringan kerjasama antar universitas-universitas, pendidikan tinggi dan lembaga-lembaga penelitian untuk menyusun proyek-proyek akademis bersama; dan 3. Mengadakan, sesuai dengan kemampuan yang ada, program beasiswa secara timbal balik dengan menyelenggarakan program-program sarjana, spesialis dan studi penelitian pada lembaga-lembaga pendidikan tinggi di negara mitra. Pasal Ill Kerjasama dalam bidang Kebudayaan Para Pihak akan mendorong kegiatan-kegiatan kerjasama di bidang kebudayaan, sebagai berikut: 1. Meningkatkan kegiatan-kegiatan pertukaran kebudayaan; 2. Mengusahakan diadakannya jaringan kerjasama di bidang pemugaran, perawatan dan perlindungan terhadap peninggalan-peninggalan bersejarah, benda-benda kuno dan budaya; 3. Membantu pengadaan jaringan kerjasama dan pertukaran-pertukaran antar perpustakaan, arsip dan museum masing-masing dengan mengirimkan dan menerima bahan-bahan informasi dan dokumentasi, memberi kemudahan untuk mendapatkan informasi dan dokumentasi tersebut; 4. Meningkatkan pertukaran-pertukaran di bidang-bidang radio, televisi, sinema dan media massa lainnya, dengan maksud untuk menyebarluaskan hasil karya terbaru dan mendukung penyebarluasan informasi dan budaya masing-masing;

3 5. Membantu kerjasama antar lembaga-lembaga yang bertanggung jawab menangani kebijakan mengenai wanita dan keluarga, pemuda, rekreasi, pendidikan fisik dan olah raga; 6. Mendukung pembentukan jaringan kerjasama diantara lembaga-lembaga kedua negara yang menangani masalah pendidikan, kebudayaan, pelayanan peristirahatan dan rekreasi bagi manusia lanjut usia dan penyandang cacat; 7. Memajukan kekayaan pengalaman kedua negara di bidang-bidang seni teater dan pementasan serta musik; dan 8. Mendukung pelaksanaan kegiatan-kegiatan untuk menyebarluaskan hasilhasil karya sastra masing-masing, melalui pertukaran para penulis, saling berpartisipasi dalam pameran-pameran buku, dan juga dalam pelaksanaan proyek penterjemahan. Pasal IV Program-program Kerjasama Pendidikan dan Kebudayaan 1. Untuk tujuan-tujuan dari Persetujuan ini dan sesuai dengan prioritasprioritas masing-masing negara, Para Pihak akan bersama-sama dan secara berkala menyusun program-program pendidikan dan kebudayaan dalam lingkup rencana dan strategi masing-masing dalam bidang pengembangan pendidikan, seni, budaya, penerangan, pemuda dan olah raga. 2. Masing-masing program ini akan menentukan tujuan, metode kerjasama, sumber-sumber keuangan dan teknis, jadwal kerja, dan juga tempat pelaksanaan proyek-proyek tersebut. Program tersebut juga merinci kewajiban-kewajiban, termasuk masalah pembiayaan oleh masing-masing Pihak. 3. Secara berkala, masing-masing program tersebut harus dievaluasi atas permintaan Badan-badan Koordinator sebagaimana diatur dalam Pasal VII.

4 Pasal V Peninggalan Budaya Para Pihak akan melaksanakan seluruh kegiatan kerjasama yang ditujukan untuk mencegah impor, ekspor dan pemindahan yang tidak sah dari peninggalan budaya yang merupakan milik dari masing-masing negara. Para Pihak juga akan melaksanakan tindakan-tindakan yang memungkinkan pengembalian benda-benda yang diimpor dan diekspor secara tidak sah tersebut. Pasal VI Hak Cipta Para Pihak akan memberikan perlindungan terhadap hak cipta yang berkaitan dengan karya sastra, pengajaran, karya ilmiah, karya seni dan drama serta menyediakan sarana-sarana dan tata cara bagi pematuhan terhadap ketentuan-ketentuan yang mengatur hak cipta berdasarkan pada peraturan perundang-undangan nasional masing-masi ng serta konvensi-konvensi internasional dimana mereka menjadi Pihak. Pasal VII Komisi Bersama Kerjasama Pendidikan dan Kebudayaan 1. Untuk tujuan Persetujuan ini, Para Pihak akan membentuk Komisi Bersama Kerjasama Pendidikan dan Kebudayaan; 2. Komisi ini akan dikoordinasikan oleh masing-masing Kementerian Luar Negeri dan akan terdiri dari wakil-wakil dari kedua Negara yang akan mengadakan pertemuan secara bergantian di Indonesia dan Meksiko pada tanggal yang disepakati Para Pihak, melalui saluran diplomatik; 3. Komisi Bersama Kerjasama Pendidikan dan Kebudayaan mempunyai fungsi-fungsi, sebagai berikut : a) melakukan penilaian dan menentukan bidang-bidang prioritas kegiatan untuk melaksanakan secara bersama proyek-proyek khusus di bidang-bidang pendidikan, seni, budaya, penerangan, pemuda dan olah raga, dan juga sumber-sumber keuangan dalam pelaksanaannya;

5 b) menganalisa, memnjau, menyetujui, menindaklanjuti dan menilai Kerjasama Pendidikan dan Kebudayaan; c) mengawasi terlaksananya Persetujuan ini secara benar termasuk pelaksanaan proyek-proyek yang telah disetujui, menyediakan sarana untuk penyelesaiannya dalam batas waktu yang telah ditetapkan; d) mengajukan cara-cara penyelesaian atas masalah-masalah administrasi dan keuangan yang timbul selama pelaksanaan kegiatan-kegiatan yang diatur dalam kerangka Persetujuan ini; dan e) memberikan rekomendasi kepada Para Pihak, apabila dianggap perlu. 4. Tanpa mempengaruhi ketentuan yang diatur dalam ayat 1 Pasal ini, masing-masing Pihak setiap saat dapat mengajukan proyek-proyek khusus kerjasama di bidang pendidikan dan kebudayaan kepada Pihak lainnya untuk mendapatkan pertimbangan dan persetujuan akhir dari Komisi Bersama. Pasal VIII Sumber Keuangan Lainnya Apabila dianggap perlu, Para Pihak dapat meminta dukungan keuangan dari sumber-sumber lainnya, seperti misalnya organisasi-organisasi internasional atau negara-negara pihak ketiga untuk pelaksanaan programprogram dan proyek-proyek yang diatur dalam Persetujuan ini. Pasal IX Keikutsertaan Lembaga Swadaya Masyarakat Apabila dipandang memungkinkan, Para Pihak akan mendorong keikutsertaan Lembaga Swadaya Masyarakat yang mempunyai kegiatan yang langsung berkaitan dengan dunia pendidikan dan kebudayaan, dengan tujuan untuk memperkuat dan memperluas mekanisme yang mendukung pelaksanaan Persetujuan ini secara efektif.

6 Pasal X Kemudahan-kemudahan Kerjasama 1. Masing-masing Pihak akan memberikan kemudahan-kemudahan untuk memasuki, tinggal dan kembali ke negara asalnya kepada para peserta yang secara resmi terlibat dalam proyek-proyek kerjasama. Para peserta tersebut tunduk pada ketentuan mengenai imigrasi, fiskal, pabean, kesehatan dan keamanan nasional yang berlaku di negara penerima dan tidak diizinkan terlibat dalam kegiatan lain diluar fungsi-fungsi mereka tersebut, tanpa izin terlebih dahulu dari para pejabat berwenang yang terkait. 2. Para Pihak akan saling memberikan kemudahan-kemudahan administrasi, fiskal dan pabean untuk keluar masuk sementara bahan-bahan dan peralatan yang digunakan dalam pelaksanaan proyek-proyek tersebut. Pasal XI Penyelesaian Sengketa Setiap sengketa yang muncul dalam penafsiran dan/atau pelaksanaan dari Persetujuan ini akan diselesaikan secara bersahabat melalui konsultasikonsultasi dan/atau perundingan-perundingan antar para Pihak. Pasal XII Amandemen Persetujuan ini dapat diubah setiap saat atas persetujuan bersama Para Pihak. Perubahan yang telah disetujui tersebut akan mulai berlaku setelah Para Pihak saling memberitahu, melalui pertukaran Nota Diplomatik, bahwa formalitas yang diperlukan sesuai peraturan perundang-undangan nasional masing-masing telah terpenuhi. Pasal XIII Ketentuan Penutup 1. Persetujuan ini akan mulai berlaku pada tanggal pemberitahuan terakhir dengan mana para Pihak saling memberitahukan, melalui saluran diplomatik, bahwa persyaratan konstitusional masing-masing bagi pemberlakuan Persetujuan ini telah terpenuhi.

7 2. Persetujuan ini akan berlaku selama 5 (lima) tahun dan akan tetap berlaku selama 5 (lima) tahun berikutnya, kecuali salah satu Pihak memberitahukan secara tertulis keinginannya untuk menghentikan Persetujuan ini, 6 (enam) bulan sebelum masa berlaku Persetujuan ini berakhir. 3. Pengakhiran Persetujuan ini tidak akan mempengaruhi keabsahan dan masa berlakunya pengaturan Persetujuan ini hingga selesainya pengaturan tersebut. SEBAGAI BUKTI, yang bertandatangan di bawah ini, dengan diberi kuasa oleh Pemerintah masing-masing telah menandatangani Persetujuan ini. DIBUAT dalam rangkap dua, di Jakarta pada tanggal tiga puluh bulan Mei tahun dua ribu satu dalam bahasa Indonesia, Spanyol dan lnggris, dan semua naskah mempunyai kekuatan hukum yang sama. Dalam hal terjadi perbedaan penafsiran atas Persetujuan ini, naskah bahasa lnggris yang akan berlaku. 8 CONVENIO ENTRE EL GOBIERNO DE LA REPUBLICA DE INDONESIA y EL GOBIERNO DE LOS ESTADOS UNIDOS MEXICANOS DE COOPERACION EDUCATIVA Y CULTURAL El Gobierno de la Republica de Indonesia y el Gobierno de los Estados Unidos Mexicanos, en adelante denominados "las Partes", ANIMADOS por el deseo de establecer y consolidar la cooperaci6n y el intercambio en los ambitos de la educaci6n, el arte, la cultura, la informaci6n, la juventud y el deporte; CONVENCIDOS de que esta cooperaci6n es un instrumento valioso para intensificar el entendimiento mutuo y la amistad entre ambos pafses; RECONOCIENDO la importancia de establecer mecanismos que contribuyan al fortalecimiento de la cooperaci6n en los campos de interes mutuo y de la necesidad de ejecutar programas especificos de colaboraci6n e intercambio en los campos de la educaci6n, el arte, la cultura, la informaci6n, la juventud y el deporte que coadyuven a profundizar el conocimiento mutuo entre los dos paises; TOMANDO en consideraci6n las leyes y reglamentos vigentes en su respective pals, y las convenciones internacionales en las materias objeto del presente Convenio de las que sean Parte; Han convenido lo siguiente: Articulo I Objetivo El presente Convenio tiene como objetivo establecer la cooperaci6n entre instituciones de ambas Partes en las areas de la educaci6n, el arte, la cultura, la informaci6n, la juventud y el deporte, mediante la realizaci6n de actividades que contribuyan a profundizar el conocimiento entre ambos paises.

9 Articulo II Cooperacion en Materia Educativa Las Partes favoreceran las acciones de cooperaci6n en materia educativa que a continuaci6n se detallan: 1. Propiciar la cooperaci6n entre las instituciones educativas y cientificas en todos los niveles y especialistas de cada pais; 2. Establecer vf nculos de cooperaci6n entre las universidades e instituciones de educaci6n superior y de investigaci6n, con el fin de instrumentar proyectos academicos conjuntos, y 3. Favorecer el establecimiento, en la medida de sus recursos disponibles, de un programa reciproco de becas para que sus nacionales realicen estudios de posgrado, especializaci6n o investigaci6n en instituciones publicas de educaci6n superior del otro pa is. Articulo Ill Cooperacion en Materia Cultural Las Partes fomentaran las acciones de cooperaci6n en materia cultural que a continuaci6n se detallan: 1. Promover las actividades de intercambio cultural; 2. Alentar el establecimiento de vinculos de cooperaci6n en materia de restauraci6n, resguardo, conservaci6n y protecci6n del patrimonio hist6rico, artistico y cultural; 3. Propiciar el establecimiento de vinculos y el intercambio entre sus bibliotecas, archivos y museos, a traves del envio y recepci6n de informaci6n y materiales documentales, facilitando el acceso a la documentaci6n e informaci6n; 4. Favorecer el intercambio en las areas de la radio, la television, la cinematograff a y otros medios de difusi6n masiva, con el fin de dar a

10 conocer sus mas recientes producciones y apoyar la difusi6n de la cultura y la informaci6n de los dos pafses; 5. Fomentar la colaboraci6n entre sus instituciones competentes en materia de polftica dirigida a la mujer y a la familia, juventud, recreaci6n, educaci6n ffsica y deportes; 6. Apoyar el establecimiento de vinculos de cooperaci6n entre las instituciones de ambos paises encargadas de otorgar servicios educativos, culturales, de reposo y recreaci6n a personas de la tercera edad y personas discapacitadas; 7. Propiciar el enriquecimiento de sus experiencias en los campos de las artes visuales, escenicas y de la musica, y 8. Apoyar la realizaci6n de actividades encaminadas a difundir su producci6n literaria, a traves del intercambio de escritores, la participaci6n en ferias del libro, asi como la ejecuci6n de proyectos de traducci6n. Articulo IV Programas de Cooperacion Educativa y Cultural 1. Para los fines del presente Convenio, y de acuerdo con las prioridades de cada pais, las Partes elaboraran conjunta y peri6dicamente programas de cooperaci6n educativa y cultural, de conformidad con sus respectivos planes y estrategias de desarrollo en educaci6n, arte, cultura, informaci6n, juventud y deporte. 2. Cada programa debera especificar objetivos, modalidades de cooperaci6n, recursos financieros y tecnicos, cronogramas de trabajo, asi como las areas en las que seran ejecutados los proyectos. Debera, igualmente, especificar las obligaciones, incluyendo las financieras, de cada una de las Partes. 3. Cada programa sera evaluado peri6dicamente a solicitud de las entidades coordinadoras a que se refiere el Articulo VII del presente Convenio.

11 Artlculo V Patrimonio Cultural Las Partes llevaran a cabo todas las acciones de cooperaci6n tendientes a impedir la importaci6n, exportaci6n y transferencia ilicitas de los bienes que integran su respectivo patrimonio cultural. Asimismo, realizaran las acciones conducentes para la devoluci6n de dichos bienes importados o exportados ilfcitamente. Articulo VI Derechos de Autor Las Partes brindaran la protecci6n debida en el campo de los derechos de autor de obras literarias, didacticas, cientificas, artisticas y obras dramaticas, y proporcionaran los medios y procedimientos para la adecuada observancia de las leyes de propiedad intelectual, de conformidad con sus respectivas disposiciones nacionales y de los convenios internacionales en esta materia de los que formen Parte. Articulo VII Comisi6n Mixta de Cooperaci6n Educativa y Cultural 1. Para los fines de este Convenio, las Partes estableceran una Comisi6n Mixta de Cooperaci6n Educativa y Cultural. 2. Esta Comisi6n sera coordinada por las respectivas Cancillerf as y estara integrada por representantes de ambas Partes quienes se reuniran alternadamente en Indonesia yen Mexico, en fechas acordadas entre las Partes, a traves de la via diplomatica. 3. La Comisi6n Mixta de Cooperaci6n Educativa y Cultural tendra las siguientes funciones: a) evaluar y definir las areas prioritarias en que serfa factible la realizaci6n de proyectos especificos de colaboraci6n en los campos de la educaci6n, las artes, la cultura, la informaci6n, la juventud y el deporte, asi como los recursos necesarios para su cumplimiento;

12 b) analizar, revisar, aprobar, dar seguimiento y evaluar los programas de cooperaci6n educativa y cultural; c) supervisar el buen funcionamiento del presente Convenio, asi como la ejecuci6n de los proyectos acordados, instrumentando los medios para la conclusi6n en los plazos previstos; d) proponer soluciones a los problemas de caracter administrativo y financiero que surjan durante las acciones realizadas en el marco de este Convenio, y e) formular a las Partes las recomendaciones que considere pertinentes. 4. Sin perjuicio de lo previsto en el primer parrafo de este Articulo, cada una de las Partes podra someter a la Otra, en cualquier momento, proyectos especificos de cooperaci6n educativa y cultural, para su debido estudio y, en su caso, aprobaci6n por la Comisi6n Mixta. Articulo VIII Financiamiento Externo Las Partes podran, siempre que lo estimen conveniente, solicitar apoyo financiero de otras fuentes, como organismos internacionales o terceros paises, para la ejecuci6n de programas y proyectos realizados de conformidad con el presente Convenio. Articulo IX Participaci6n de lnstituciones No Gubernamentales Las Partes, de estimarlo conveniente, alentaran la participaci6n de instituciones no gubernamentales, cuyas actividades incidan directamente en los campos educativo y cultural, con el prop6sito de fortalecer y ampliar los mecanismos que apoyen una efectiva instrumentaci6n de este Convenio.

13 Articulo X Facilidades de Cooperacion 1. Cada Parte otorgara todas las facilidades necesarias para la entrada, permanencia y salida de los participantes que en forma oficial intervengan en los proyectos de cooperaci6n. Estos participantes se someteran a las disposiciones migratorias, fiscales, aduaneras, sanitarias y de seguridad nacional vigentes en el pals receptor y no podran dedicarse a ninguna actividad ajena a sus funciones sin la previa autorizaci6n de las autoridades competentes. 2. Las Partes se otorgaran todas las facilidades administrativas, fiscales y aduaneras necesarias para la entrada y salida de su territorio, con caracter temporal, del equipo y materiales que se utilizaran en la realizaci6n de los proyectos. Articulo XI Solucion de Controversias Cualquier diferencia derivada de la interpretaci6n y aplicaci6n del presente Convenio sera resuelta de comun acuerdo entre las Partes, a traves de consultas o negociaciones, por la via diplomatica. Articulo XII Modificaciones El presente Convenio podra ser modificado por mutuo consentimiento de las Partes. Las modificaciones entraran en vigor en la fecha en que las Partes se comuniquen mediante un canje de Notas diplomaticas, el cumplimiento de los requisitos exigidos por su legislaci6n nacional.

14 Articulo XIII Disposici6nes Finales 1. El presente Convenio entrara en vigor en la fecha de la ultima notificaci6n en la que ambas Partes se comuniquen, a traves de la vfa diplomatica, el cumplimiento de sus respectivos requisitos constitucionales para tal efecto. 2. El presente Convenio tendra una vigencia de 5 (cinco) anos y permanecera en vigor por otro periodo de cinco afios, a menos que una de las Partes comunique por escrito a la Otra su decisi6n de darlo por terminado, con 6 (seis) meses de antelaci6n a la terminaci6n del Convenio. 3. La terminaci6n del presente Convenio no afectara la validez y duraci6n de cualquier acuerdo que hubiese sido acordado durante su vigencia. EN FE DE LO CUAL, los infrascritos, debidamente autorizados por sus respectivos Gobiernos, firman el presente Convenio. : FIRMADO en la ciudad de Yakarta, Indonesia, el treinta de mayo de dos mil uno, en dos ejemplares originales, en idiomas indonesio, espafiol e ingles, siendo todos los textos igualmente autenticos. En caso de cualquier divergencia en la interpretaci6n el texto en ingles prevalecera. 15 AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND THE GOVERNMENT OF THE UNITED MEXICAN STATES ON EDUCATIONAL AND CULTURAL COOPERATION The Government of the Republic of Indonesia and the Government of the United Mexican States hereinafter referred to as "the Parties"; DESIRING to establish and consolidate cooperation and exchange in the fields of education, art, culture, information, youth and sports; CONVINCED that said cooperation is a valuable instrument to intensify mutual understanding and friendship between both countries; RECOGNISING the importance of establishing mechanisms, that contribute to the strengthening of cooperation in areas of mutual interest and the need to carry out specific programs of collaboration and exchange in the fields of education, art, culture, information, youth and sports conducive to a broader mutual awareness between the two countries; PURSUANT to the prevailing laws and regulations of the respective countries and to the international conventions ruling such matters related to the objective of this Agreement, which are binding to both Parties; Have agreed as follows: Article I Objective The purpose of this Agreement is to establish cooperation between institutions of both Parties in the fields of education, art, culture, information, youth and sports by implementing activities which contribute to the deepening of understanding between the two nations.

16 Article II Cooperation in Educational Matters The Parties shall promote the following cooperation actions in educational matters : 1. To foster cooperation between educational and scientific institutions of all levels and between specialists of each country; 2. To establish cooperation links between universities and higher education and research institutions in order to arrange joint academic projects; and 3. To establish within their available resources, a reciprocal program of scholarships so that their respective nationals may carry out postgraduate, specialization or research studies in public higher education institutions of the counterpart country. Article Ill Cooperation in Cultural Matters matters: The Parties shall encourage the following cooperation actions in cultural 1. To promote cultural exchange activities; 2. To endeavour cooperation links in areas of restoration, preservation and conservation of historic, artistic and cultural heritages; 3. To contribute to the establishment of cooperation links and exchanges among each other's libraries, archives and museums by sending and receiving information and documentary materials, facilitating access to the documentation and information; 4. To promote the exchanges in the fields of radio, television, cinema and other mass media, with a view to disseminate their more recent productions and supporting the dissemination of each other's culture and information;

17 5. To foster collaboration among their competent institutions responsible for policies directed toward woman and the family, youth, recreation, physical education and sports; 6. To provide support for the establishment of cooperation links among institutions of both countries responsible for the provision of educational, cultural, rest and recreational services for the elderly and disabled person; 7. To promote the enrichment of their experience in the fields of visual and theatrical arts and music; and 8. To support the realization of activities seeking to disseminate each other's literary production, through exchanging of writers, participating in book fairs, as well as in the execution of translation projects. Article IV Programs of Education and Cultural Cooperation 1. For the purposes of this Agreement and in accordance with the priorities of each country, the Parties shall jointly and periodically design educational and cultural programs within the scope of their respective plans and strategies for education, art, culture, information, youth and sports development. 2. Each of these program shall specify objectives, methods of cooperation, financial and technical resources, and work schedules, as well as the areas in which the projects are to be carried out. They shall also specify the obligations, including those of financial nature of each of the Parties. 3. From time to time, each program shall be evaluated at the behest of the coordinating bodies mentioned in Article VI I.

18 Article V Cultural Heritage The Parties shall carry out all the cooperation activities tending to prevent the unlawful importation, exportation and transfer of the property comprising their respective cultural heritage. The Parties shall also carry out actions conducive to the return of such unlawful imported or exported property. Article VI Copyright The Parties shall provide the due copyright protection pertaining to literary, didactic, scientific, artistic and dramatic works and shall provide the means and procedures for the proper observance of copyright laws pursuant to their respective national regulations and any related international conventions to which they are Parties. Article VII Joint Educational and Cultural Cooperation Commission 1. For the purposes of this Agreement, the Parties shall establish a Joint Educational and Cultural Cooperation Commission. 2. This Commission will be coordinated by the Parties' respective Ministries of Foreign Affairs and will comprise of representatives from both Parties who shall meet alternately in Mexico and Indonesia on dates agreed upon between the Parties, through diplomatic channels. 3. The Joint Educational and Cultural Cooperation Commission shall have the following functions: a) b) to evaluate and define the priority areas in which it would be feasible to carry out specific projects of collaboration in the fields of education, art, culture, information, youth and sports as well as the ' resources for their implementation; to analyse, review, approve, follow up, and evaluate Educational and Cultural Cooperation;

19 c) to oversee the proper functioning of this Agreement as well as the execution of projects that have been agreed, affording the means for their conclusion within the established deadlines; d) to propose solutions to any administrative or financial problem arising during the execution of actions which come under the framework of this Agreement; and e) to make any recommendation to the Parties if it is deemed relevant. 4. Without affecting the provisions of the first paragraph of this Article, each of the Parties may at any time submit to the other Party specific projects of educational and cultural cooperation for due consideration and later eventual approval by the Joint Commission. Article VIII Outside Financial Sources Whenever they deem necessary, the Parties may request financial support from outside sources such as international organisations or third-party countries for the execution of programs and projects contemplated under this Agreement. Article IX Participation of Non-Governmental Institutions If considered convenient, the Parties shall encourage the participation of non-governmental institutions whose activities directly influence the educational and cultural spheres, with the purpose of strengthening and widening mechanisms supporting the effective execution of this Agreement.

20 Article X Cooperation Facilities 1. Each Party shall grant all the necessary facilities for the entry, stay and departure of participants officially involved in cooperation projects. These participants shall be subject to the immigration, fiscal, custom, health and national security provisions in force in the receiving country and may not become involved in any activity other than that inherent in their functions, without the prior authorization of the corresponding authorities. 2. The Parties shall grant each other all the necessary administrative, fiscal and customs facilities for temporary entry and exit of materials and equipment to be used in the execution of projects. Article XI Settlement of Disputes Any dispute arising out of the interpretation and implementation of this Agreement shall be settled amicably through consultations or negotiations between the Parties, through diplomatic channels. Article XII Amendment This Agreement may be amended by mutual consent of the Parties. The amendments agreed upon shall enter into force on the date when the Parties notify each other, through the exchange of Diplomatic Notes of the Completion of formalities required by their national legislation. Article XIII Final Provision 1. This Agreement shall enter into force on the date of the latest notification by which the Parties inform each other, through diplomatic channels, that their respective constitutional requirements for giving effects to this Agreement have been fulfilled.

21 2. This Agreement shall remain in force for a period of 5 (five) years and shall remain in force thereafter for another period of 5 (five) years unless either Party notifies in writing of its intention to denounce this Agreement 6 (six) months prior to the expiration of this Agreement. 3. The termination of this Agreement shall not affect the validity and duration of any arrangement made under this Agreement until the completion of such arrangement. IN WITNESS WHEREOF, the undersigned, being duly authorised thereto by their respective Governments, have signed this Agreement. DONE in duplicate at Jakarta on this 30th day of May in the year two thousand and one, in the Indonesian, Spanish and English languages, all texts being equally authentic. In case of any divergence of interpretation, the English text shall prevail.
