1 PERSETUJUAN ANTARA PEMERINTAH REPUBLIK INDONESIA DAN PEMERINTAH REPUBLIK CUBA MEN GENAl PEMBEBASAN VISA BAGI PEMEGANG PASPOR DIPLOMATIK DAN PASPOR DINAS Pemerintah Republik Indonesia dan Pemerintah Republik Cuba (selanjutnya disebut sebagai "para Pihak"), berhasrat untuk membangun hubungan kerjasama dan untuk meningkatkan hubungan antara kedua negara; Telah menyetujui sebagai berikut: PASAL I PEMBEBASAN 1. Warganegara dari kedua negara pemegang paspor diplomatik atau paspor dinas dibebaskan dari visa masuk, visa transit dan visa keluar yang berlaku, semen tara memasuki, transit atau berdiam di wilayah Pihak lain. 2. Warganegara kedua negara pemegang paspor diplomatik atau paspor dinas, yang dikeluarkan oleh instansi berwenang, dapat diijinkan untuk masuk dan berdiam di wilayah Piahk yang lain selama 14 hari, tanpa harus memperoleh visa terlebih dahulu. PASAL II MASA BERLAKU VISA Masa berlaku Paspor Warga Negara dari masing-masing Pihak adalah paling kurang 6 (enam) bulan sebelum memasuki wilayah Pihak lain.

2 PASAL III PEMBERIAN VISA 1. Anggota Misi Diplomatik atau Konsulat dari salah satu Pihak yang ada di wilayah Pihak lain dapat diberikan visa yang sesuai yang berlaku untuk masa penempatannya atas permintaan tertulis dari Misi Diplomatik atau Konsulat yang bersangkutan, asalkan mereka merupakan warga negara Pihak tersebut dan memegang paspor diplomatik atau paspor dinas. 2. Fasilitas yang disebutkan dalam paragrap 1 Pasal ini juga berlaku pada istri I suami dari suatu anggota Misi Diplomatik atau Konsulat dan anak-anak mereka yang bel urn menikah yang berusia dibawah 25 tahun, asalkan mereka memegang jenis pasport yang sama atau nama-nama mereka tercantum dalam paspor ayah atau paspor ibu mereka. PASALIV KEWAJIBAN Persetujuan ini tidak memberikan kebebasan kepada pemegang paspor dimaksud dari kewajiban untuk menghormati seluruh ketentuan hukum yang ada di negara penenma. Pemegang paspor diplomatik atau paspor dinas dari kedua belah Pihak yang merupakan pegawai sipil intemasional atau yang dipekerjakan oleh suatu organisasi intemasional, badan, perwakilan atau lembaga-lembaga sejenis lainnya, perlu mendapatkan visa sebelum perjalanan mereka ke wilayah dari Pihak lain untuk kunjungan dinas.

3 PASAL V CONTOH DAN PENGELUARAN PASPOR ATAU SURAT PERJALANAN 1. Setelah penandatanganan Persetujuan ini, kedua belah Pihak akan menukarkan melalui saluran diplomatik contoh paspor yang dipergunakan oleh kedua belah Pihak, dalam waktu 30 hari setelah penandatanganan Persetujuan ini, dan contoh setiap paspor baru, selambat-lambatnya 30 hari sebelum berlaku. 2. Apabila seorang warganegara dari salah satu Pihak kehilangan paspomya, maka yang bersangkutan akan memberitahukan kepada instansi terkait dari negara penerima untuk memperoleh tindakan seperlunya. Misi diplomatik atau Konsulat terkait akan mengeluarkan paspor baru atau surat perjalanan kepada warganegara tersebut dan memberitahukan kepada instansi pemerintah setempat. PASAL VI PENUNDAAN 1. Untuk kepentingan keamanan nasional atau kesehatan umum, para Pihak dapat untuk beberapa waktu menunda pelaksanaan dari sebagian atau keseluruhan Persetujuan. Pihak yang menentukan penundaan semen tara terse but, akan segera memberitahukan kepada Pihak yang lain tentang keputusannya melalui saluran diplomatik. Penundaan akan berlaku 30 hari dari tanggal pemberitahuan. 2. Dilanjutkannya pelaksanaan dari sebagian atau keseluruhan Persetujuan akan diberitahukan dengan cara yang sama dan melalui saluran diplomatik. PASAL VII PEMBERLAKUAN, MASA BERLAKU, PENYELESAIAN, SENGKETA DAN AMANDEMEN 1. Persetujuan ini mulai berlaku 30 hari sejak tanggal diterimanya pemberitahuan terakhir dimana para Pihak saling memberitahukan melalui saluran diplomatik bahwa seluruh persyaratan bagi berlakunya Persetujuan ini sebagaimana diatur dalam peraturan perundang-undangan nasional masing-masing telah dipenuhi. 2. Persetujuan ini berlaku untukjangka waktu lima (5) tahun berikutnya dan dapat diperbaharui kembali untuk jangka waktu yang sama, kecuali salah satu dari kedua belah Pihak berkeinginan untuk mengakhiri Persetujuan dengan menyampaikan pemberitahuan terlebih dahulu 6 bulan sebelum tanggal berakhimya Persetujuan.

Setiap perbedaan a tau sengketa yang timbul dari pelaksanaan ketentuan Persetujuan ini akan diselesaikan secara damai melalui konsultasi atau perundingan an tara para Pihak tanpa melibatkan pihak ketiga atau peradilan intemasional. 4. Persetujuan ini dapat diubah atau diperbaiki apabila dipandang perlu, berdasarkan kesepakatan bersama secara tertulis oleh para Pihak. Perubahan atau perbaikan tersebut akan berlaku pada tanggal yang akan ditentukan oleh para Pihak. SEBAGAI BUKTI, yang bertandatangan di bawah mt, telah menandatangani Persetujuan ini. DIBUAT di Havana pada tanggal dua puluh enam bulan Maret tahun dua ribu tiga, dalam dua rangkap asli, masing-masing dalam bahasa Indonesia, Spanyol dan Inggris, semua naskah mempunyai kekuatan hukum yang sama. Dalam hal terdapat perbedaan penafsiran, naskah Bahasa Inggtis yang berlaku. 5 ACUERDO ENTRE EL GOBIERNO DE LA REPUBLICA DE INDONESIA y EL GOBIERNO DE LA REPUBLICA DE CUBA SOBRE LA EXENCION DE VISADO PARA TITULARES DE PASAPORTES DIPLOMA TIC OS Y OFICIALES El Gobierno de Ia Republica de Indonesia y el Gobierno de Ia Republica de Cuba (en lo adelante denominados las "Partes") en su deseo de desarrollar los lazos de cooperaci6n y ampliar las relaciones entre ambos pafses; Han acordado lo siguiente: Articulo I EXENCION (1) Los ciudadanos de ambos pafses, titulares de pasaportes diplomaticos u oficiales vigentes estaran exentos del requisite de visado de entrada, transite y salida, segun sea pertinente, para entrar en, transitar por o salir del territorio de Ia otra Parte. (2) Los nacionales de ambos pafses, titulares de pasaportes diplomaticos u oficiales vigentes, emitidos por las autoridades competentes, podran entrar y permanecer en el territorio de Ia otra Parte por un perfodo de 14 dfas sin tener que obtener una visa previamente. Articulo II PERIODO DE VALIDEZ DEL PASAPORTE El perfodo de validez del pasaporte de los ciudadanos de ambas Partes sera de al menos seis (6) meses antes de entrar en el territorio de Ia otra Parte. Articulo Ill OTORGAMIENTO DE VISAS (1) Los miembros de las Misiones o Consulados diplomaticos de am bas Partes ubicados en el territorio de Ia otra Parte obtendran visas apropiadas, vigentes durante el perfodo de su misi6n, mediante petici6n escrita de Ia Misi6n o Consulado diplomatico competente, siempre que sean ciudadanos de esa Parte y titulares de pasaportes diplomaticos u oficiales.

6 (2) Las facilidades del parrafo 1 de este Articulo se aplicaran tambien al conyuge del miembro de Ia Mision Diplomatica o Consulado y a sus hijos solteros menores de 25 afios de edad, siempre que sean titulares de un pasaporte de categoria similar o que los nombres de sus hijos se encuentren en el pasaporte de Ia madre o el padre. Articulo IV OBLIGACION El presente Acuerdo no eximira al titular del pasaporte mencionado de Ia obligacion de respetar todas las regulaciones de las leyes vigentes en el pais anfitrion. Los titulares de los pasaportes diplomaticos u oficiales de ambas Partes que funjan como funcionarios civiles internacionales o que trabajen para una organizacion, organismo, agencia internacional u otra entidad de esta indole, necesitaran obtener su visado antes de viajar al territorio de Ia otra Parte para realizar visitas oficiales. Articulo V MUESTRA Y EMISION DE PASAPORTE 0 DOCUMENTO DE VIAJE (1) Despues de Ia firma del presente Acuerdo, ambas Partes intercambiaran poria via diplomatica las muestras de los pasaportes en uso por ambas Partes, dentro de los treinta dias posteriores a Ia firma del presente Acuerdo, y Ia muestra de todo nuevo pasaporte con un minima de 30 dias antes de su introduccion. (2) Si un ciudadano de una de las Partes perdiese su pasaporte en el territorio de Ia otra Parte, debera informar a las autoridades competentes del pais anfitrion para que tomen las medidas pertinentes. La Mision Diplomatica o el Consulado competente emitira un nuevo pasaporte o documento de viaje a su ciudadano e informara a las autoridades competentes del Gobierno local. Articulo VI SUSPENSION (1) Por razones de seguridad nacional ode salud publica, cualquiera de las Partes podra suspender temporalmente Ia implementacion total o parcial del presente Acuerdo. La Parte que decida realizar una suspension temporal debera informar su decision a Ia otra Parte mediante Ia via diplomatica. La suspension entrara en vigor despues de treinta (30) dias naturales contados a partir de Ia fecha de notificacion. (2) El reinicio de Ia implementacion parcial o total del presente Acuerdo debera informarse del mismo modo y poria misma via.

7 Articulo VII ENTRADA EN VIGOR, VIGENCIA, SOLUCION DE DIFERENCIAS Y ENMIENDAS (1) El presente Acuerdo entrara en vigor a los treinta (30) dfas posteriores a Ia fecha de Ia ultima notificacion entre las Partes par Ia vfa diplomatica, acerca del cumplimiento de los requerimientos para Ia entrada en vigor del presente Acuerdo segun lo estipulado en sus respectivas legislaciones nacionales. (2) El presente Acuerdo tendra una vigencia de cinco (5) alios, prorrogable par igual periodo de tiempo, a menos que una de las Partes desee denunciarlo mediante previa notificacion, seis meses antes de Ia fecha de su vencimiento. (3) Cualquier diferencia o controversia derivada de Ia implementacion de las disposiciones del presente Acuerdo sera solucionada amistosamente, mediante consulta o negociacion entra las Partes sin referencia a una tercera Parte o a un tribunal internacional. (4) El presente Acuerdo podra ser modificado o revisado, si se considera necesario, par acuerdo escrito entre las Partes. La enmienda o revision entrara en vigor en Ia fecha que las Partes asi determinen. EN FE DE LO CUAL, los abajo firmantes, habiendo estado debidamente autorizados par sus respectivos Gobiernos, han rubricado el presente Acuerdo. DADO en Ia Habana a los 26 dfas del mes de marzo del a no dos mil tres, en dos originales cada uno en los idiomas indonesia, espanol e ingles, siendo todos los textos igualmente autenticos. En caso de surgir cualquier diferencia en Ia interpretacion, prevalecera el texto en ingles. 8 AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND THE GOVERNMENT OF THE REPUBLIC OF CUBA ON VISA EXEMPTION FOR DIPLOMATIC AND OFFICIAL PASSPORT HOLDERS The Government of the Republic of Indonesia and the Government of the Republic of Cuba (hereinafter referred to as the "Parties") in their desire to develop the bonds of cooperation and to enhance the relations between both countries; Have agreed as follows: Article I EXEMPTION 1. Citizens of both countries holding valid diplomatic or official passports shall be exempt from entry visa, transit visa and exit visa where applicable, while entering into, transiting through or exiting from the territory of the other Party. 2. The nationals of both countries who hold valid diplomatic or official passports, issued by the authorities concerned, shall be allowed to enter and stay in the territory of the other Party for a period of 14 days, without having to obtain visa previously. Article II DURATION OF PASSPORT VALIDITY The Duration of Passport Validity of citizen of either Party shall be at least 6 (six) months before entering the territory of the other Party. Article III GRANTING OF VISA l. Members of the diplomatic Mission or Consulate of either Party located in the territory of the other Party shall be granted a suitable visa valid for the duration of his/her assignment at the written request of the diplomatic Mission or Consulate concerned, provided they are citizens of that Party and are holding diplomatic or official passports. 2. The facilities enumerated in paragraph I of this Article shall also apply to the spouse of a member of the diplomatic Mission or Consulate and their unmarried children under the age of 25 years, provided they are holding a similar category of passport or the children's names are entered in their father's or mother's passport.

9 Article IV OBLIGATION This Agreement does not exempt the holder of the said passport from the obligation of respecting all regulations under existing laws of the host country. Either Party has the right to refuse entry or to cut short the duration of stay of any citizen from the other Party. The holders of diplomatic or official passport of either Party who are international civil servants or who are employed by an international organization, body, agency or any other such entity, would required to obtain visa prior to their travel to the territory of the other Party for official visits. Article V SAMPLE AND ISSUANCE OF PASSPORT OR TRAVEL DOCUMENT 1. After the signing of this Agreement, the two Parties shall exchange through diplomatic channels the sample of the passport being used by each Party, within 30 days of the signing of this Agreement, and the sample of any new passport, at least 30 days before it is introduced. 2. If a citizen of one Party loses his/her passport in the territory of the other Party, he/she shall inform the authorities concerned of the host country for appropriate action. The diplomatic Mission or Consulate concerned will issue a new passport or travel document to its citizen and inform the concerned authorities of the local Government. Article VI SUSPENSION 1. In the interest of national security or public health, either Party may temporarily suspend the implementation of a part of or the whole Agreement. The Party which decides such temporary suspension, shall immediately inform the other Party of the decision through diplomatic channels. The suspension shall be effective thirty (30) calendar days from the date of the notification. 2. The resumption of the implementation of a part or the whole Agreement shall be informed in the same manner and through the same channel.

10 Article VII ENTRY INTO FORCE, DURATION, SETTLEMENT OF DISPUTE AND AMENDMENT 1. This Agreement shall enter into force thirty (30) days from the day of the receipt of the last notification in which the Parties have informed each other through diplomatic channels that all requirements for the entry into force of the Agreement as stipulated by their respective national legislations have been met. 2. This Agreement shall remain in force for a period of five (5) years and may further be renewed for the same period, unless either of two Parties intends to tern:inate it by giving a notice in advance, six months prior to the date of its expiry. 3. Any difference or dispute arising out of the implementation of the provision of the Agreement shall be settled amicably by consultation or negotiation between the Parties without reference to any third party or an international tribunal. 4. This Agreement may be amended or revised, if it is deemed necessary, by mutual consent in writing by the Parties. Such amendment or revision shall enter into force on such a date as may be determined by the Parties. IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective Governments, have signed this Agreement. DONE at Havana on this twenty sixth day of March of the year two thousand and three in two originals each in the Indonesian, Spanish and English languages, all the texts being equally authentic. In case of any divergence of interpretation, the English text shall prevail.
