1 MULTILATERAL TRADE NEGOTIATIONS THE URUGUAY ROUND RESTRICTED MTN.TNC/W/67 11 February 1991 Special Distribution \ Trade Negotiations Committee Original: Spanish COMMUNICATION FROM COLOMBIA Preliminary, Conditional Offer of Colombia Concerning Initial Commitments The attached communication is circulated at the request of the delegation of Colombia. 1. Colombia attaches particular importance to the satisfactory conclusion of a multilateral agreement organizing international trade in services. In the absence of an internationally agreed nomenclature,.and prior to the conclusion of the work for a "framework agreement" in this area, including the necessary sectoral annotations, Colombia submits the following conditional and provisional offer concerning initial commitments. 2. In the present state of the negotiations on a general agreement on international trade in services, Colombia would be prepared to enter into the commitments listed in the annex hereto. 3. This offer is understood as applying solely for the services and modes of delivery described in the attached list and to the extent indicated therein. 4. Colombia reserves the right to maintain, modify or reduce this offer at any time prior to the entry into force of the multilateral agreement, depending, inter alia, on the final text of the agreement and its sectoral annexes and the quality and number of offers of other parties. Colombia also reserves the right to make changes of a technical nature in its offer. 5. With regard to the financial sector, this offer is also dependent upon the legal status of the multilateral agreement and the annex on financial services, and in particular: (i) the legal precision and rigour of the most-favoured-nation clause; (ii) national treatment; (iii) market access provisions; (iv) mutual recognition of qualifications; (v) definition of a concession or binding; (vi) scope of the relationship of the Spanish only GATT SECRETARIAT UR

2 Page 2 multilateral agreement to the GATT multilateral system; (vii) scope and content of the financial services annex as regards what has been called the "two-track approach"; (viii) scope and content of any texts that might be included concerning the provisions of the multilateral agreement relating to harmonization and recognition, payments and transfers and restrictions on services to safeguard the balance of payments; and (ix) matters relating to the authority that will discharge the functions provided for in the annex on financial services. 6. Colombia's offer on financial services should be understood as being without prejudice to the prudential regulations applicable to financial operations in Colombia, as well as to the rules governing foreign capital flows in the context of the Bretton Woods Agreement. 7. Colombia's offer does not include or affect measures adopted for the purpose of regulating entry into or departure from Colombian territory nor residence therein. Nor are changes contemplated, as a result of the offer submitted here, in the Colombian Constitution, in current practices in the local labour market or in the jurisdiction relating to activities carried out within Colombian territory.
