Flash News / Septiembre 2015 Flash News 11 de septiembre de 2015 Presentación de Formularios de Remesas para la aplicación de los Tratados para evitar la Doble Imposición Fiscal suscritos por la República de Panamá. En días pasados proporcionamos las nuevas guías correspondientes a la aplicación de los beneficios del Tratado de Doble imposición fiscal de acuerdo a lo establecido en la Resolución No. 201-12083 emitida por la Dirección General de Ingresos. Sin embargo dicha resolución ha sido derogada y sustituida por la Resolución No. 201-15144 realizando ciertos cambios a los expuestos en la primera resolución. Dentro de estos cambios tenemos a bien informarles que es importante considerar que a partir de la fecha todos los contribuyentes deberán presentar las notificaciones para la aplicación de beneficios del Tratado de Doble Imposición, posterior a la realización del pago efectuado hacia el beneficiario y de la remisión del impuesto al Fisco. Así mismo es importante mencionar que las notificaciones que se presenten sin la evidencia del pago y de la remisión de dicho impuesto estarán sujetas a un plazo de dos meses para la presentación de esta www.pwc.com/interamericas
documentación de lo contrario el procedimiento se considerará caducado. Con esto la Autoridad tributaria busca que los contribuyentes cumplan con la presentación de los formularios de remesas así como el pago correspondiente de los impuestos por parte de los contribuyentes. Por ello les hacemos hincapié en cumplir con dicha obligación y en contactarnos de requerir asistencia con la misma. 2 PwC

In recent days we provided new relevant information and guidelines regarding the application of the benefits of the Double Taxation Treaties, in accordance with the provisions of Resolution 12-12083 issued by the General Directorate of Revenue. However that resolution was repealed and replaced by Resolution No. 201-15144 making certain changes to those in the first resolution. Among these changes we wish to inform you that it is important to take into account that in order to file for the application of the benefits of the Double Taxation Treaties signed by Panama, the taxpayer must have previously made the corresponding payment and remittance of the tax to the authorities and provide proof of said remittance. It is also important to mention that if notifications are submitted without said evidence, the taxpayer will have two www.pwc.com/interamericas
months for the submission of this documentation otherwise the procedure shall be considered as terminated. Whit this change, the tax authority seeks to oblige taxpayers to comply with the payment and remittance of the corresponding taxes.
