8 BBC News/IN, 28 de janeiro de 2011 Gay Ugandan Brenda Namigadde loses UK court appeal Brenda Namiggade says she fears for her life if she is returned to Uganda where gay sex is against the law. The Home Office said a judge earlier ruled she was "not homosexual" and therefore did not have a genuine claim. Prominent gay rights campaigner David Kato was beaten to death near the Ugandan capital Kampala on Wednesday. 'Real risk' Lawyers for Ms Namiggade lodged papers at the High Court asking a judge to grant an injunction against her deportation, due to take place on Friday evening. They say they will file a fresh appeal. When the BBC spoke to Ms Namiggade by phone on Friday afternoon she was already being escorted to Heathrow airport. Her lawyer, Abdulrahman Jafar, said he would argue that Ms Namiggade should be allowed to remain in the UK regardless of her sexuality. "The press coverage about her activities certainly expose her to a UK real risk if she is to be returned to Uganda," he said. David Kato, who was recently beaten to death, led condemnation of the Anti-Homosexuality Bill Ms Namigadde,who was held at adetention centre just outside London, has told the BBCs Network Africa programme she was "shaking" with fear at the prospect of returning to Uganda. She said she fled to the UK in 2002 after being beaten and victimised because of her sexuality. The United Nations High Commissioner for Refugees, Antonio Guterres, has said people facing persecution for their sexual orientation in Uganda should be given refugee status in other countries. Human rights campaigner Peter Tatchell has urged Home SecretaryTheresa May tohalt the removal of Ms Namigadde and allow her to make a fresh asylum appeal. 'Hang them' Matthew Coats, head of immigration at the UK Border Agency, said: "Ms Namigaddes case has been carefully considered by both the UK Border Agency and the courts on two separate occasions and she has been found not to have a right to remain here. "An immigration judge found on the evidence before him that Ms Namigadde was not homosexual." Mr Katohadsued alocal newspaper which outed him as homosexual. Ugandas Rolling Stone newspaper published the photographs of several people it said were gay, including Mr Kato, with the headline "Hang them". It is unclear whether the killing of Mr Kato was linked to his campaigns. Homosexual acts are illegal in Uganda, with punishments of 14 years in prison. An MP recently tried to increase the penalties to include the death sentence in some cases. pg.8

9 The Guardian Londres/IN, 28 de janeiro de 2011 Rahm Emanuel allowed to stand for Chicago mayor Former White House chief of staff Rahm Emanuel waiting for the verdict from the supreme court of Illinois Rahm Emanuel, Barack Obama's former chief of staff at the White House, will be allowed to stand for mayor of Chicago after the Illinois supreme court overturned an earlier ruling that he was ineligible under residency requirements. The decision of the highest court in the state clears the way for the famously straight-talking Chicagoan to press ahead with his bid to run the third most populous city in the US. There was jubilation at his campaign headquarters, and the candidate received a call on Thursday night from President Obama. The ruling comes not before time for Emanuel: early voting for the WORLD mayor's position opens on Monday,andthe vote itself is on 22 February. "The voters deserved the right to make the choice of who should be mayor. And what the supreme court said basically, in short, that the voters should make the decisions of who will be mayor," Emanuel said after the ruling was handed down. Under local rules, any candidate for Chicago mayor must be able to show that he or she has "resided" in the city for a year preceding the election. Emanuel had argued his White House fixture was always temporary and that he had continued to keep a home and pay taxes. But his opponents challenged his claim. An initial ruling from the Board of Election Commissioners backed Emanuel, but an appellate court threw him off the ballot jeopardising his chances to gain a high-profile political platform after the White House. In a majority ruling, the Illinois supreme court on Thursday delivered a categorical finding that history was on Emanuel's side. "What it means tobearesident for election purposes was clearly established long ago, and Illinois law has been consistent on the matter since at least the 19th century." One of Emanuel's main opponents, Gery Chico, announced "Game on" after the ruling. In a statement he said that the judicial wrangling over Emanuel's eligibility to stand had turned "this election into a circus instead of a serious debate about the future of Chicago. With less than 30 days to go until election day, there is no time to waste." pg.9

Photograph: Frank Baron for the Guardian An appeal court ruling which denies volunteer workers the anti-discrimination employment protection enjoyed by staff has been described as unfair by the Equality and Human Rights Commission. In a landmark judgment, the court of appeal ruled against a woman who claimed she had been discriminated against on grounds of disability, after she was told to stop volunteering for Mid-Sussex Citizens Advice. The woman, named only as "X" by the court, originally lostanemployment tribunal hearing against Citizens Advice over the matter in November Her appeal against the verdict, which included a representation by the EHRC, was based on European equal treatment legislation covering those in"occupation", a definition the woman argued ought to apply to volunteers. But her case was unanimously rejected by the court of appeal. The decision, which could have implications for the coalition government's 'big society' plans for local service provision by networks of volunteers, means voluntary workers are not protected by the UK's Disability Discrimination Act 1995 unless there is a contract between the volunteer and the organisation. But John Wadham, the EHRC's legal group director, said the ruling was unfair and suggested it might yet be challenged in the supreme court. "We are disappointed that the court of appeal has decided that volunteers do not have legal protection from workplace discrimination," he said. "If discrimination laws don't apply to this sector it will be legal for organisations when taking on people to discriminate against groups such as the disabled or ethnic minorities. "Given that many employees begin their working life as volunteers, which provides them with valuable experience which they can use as a step up to paid employment, it seems unfair that certain groups of people can legally be denied this experience. If this case does go to the supreme court, the commission will hope to have our views heard." In reaching the verdict, the appeal judge Lord Justice Elias said: "Volunteers are extensively employed throughout Europe and it is unrealistic to believe they were intended to be covered by concepts of employment and occupation which would not normally embrace them." Jason Galbraith-Marten, the barrister representing Citizens Advice, said the verdict would be a great relief to much of the sector, whose operations inevitably depended greatly on voluntary labour. "The cost of litigation, successful or otherwise, that would be generated from the extension of anti-discrimination rights, would be too great a financial burden for many [voluntary organisations] to bear," he said. Earlier this week, the extent to which the government's big society plans for local service provision would rely on volunteers became clearer, with a poll showing that 70% of charities saw Cameron's scheme merely as a cover for budget cuts. "The big society initiative is clearly encouraging individuals to volunteer and from that perspective the law could do with some clarity, both for individuals and for employers," she said. "The reality is that employers are being told they don't carry the liability for volunteers. Having said that, I think most organisations would want to protect everyone under their roof. Discrimination is not the sort of behaviour anyone would want to tolerate, be it from an employer or an employee." pg.11

12 The Guardian Londres/IN, 28 de janeiro de 2011 The billionaires are coming: Obama's richest enemies to hold summit Rightwingers, Wall Street chiefs and industrial magnates at the California meeting will discuss Barack Obama's government and it's 'anti-business' stance. Amid great secrecy, about 200 of America's wealthiest and most powerful individuals from the worlds of finance, big business and rightwing politics are expected to come together on Sunday in the sun-drenched California desert near Palm Springs, for what has been billed as a gathering of the billionaires. They will have the chance to enjoy the Rancho Mirage resort's many pools, spa treatments and tennis courts, as well as walk in its 240 acres away from the prying eyes of TV cameras. But the organisers have made clear that the two-day event is not just "fun in the sun". This will be a meeting of "doers", men and women willing to fight the Obama administration and its perceived attack on US free enterprise and unfettered wealth. As the invitation says: "Our goal must be to beat back the unrelenting attacks and hold elected leaders accountable." The reference to the accountability of America's elected WORLD leaders is ironic, bearing in mind that the gathering has been convened by two brothers who have never been elected to public office andare among the mostunaccountable and secretive political players in the country. David and Charles Koch enjoy a combined fortune of $35bn ( 22bn), run the second largest private company in the US, Koch Industries, and are increasingly using their fabulous riches to push their special interests within America's political process. Yet they do so largely behind closed doors. Nobody knows precisely how much they spend on influencing elections and lobbying Congress, but it is thought to be in the scores of millions of dollars. By similar vein, the guestlist for their gathering on Sunday is unknown, though those who in the past have attended this twice-yearly event include supreme court judges, rightwing media celebrities such as Glenn Beck and Rush Limbaugh, prominent governors of southern states such as Bobby Jindal (Louisiana) and Haley Barbour (Mississippi), as well as leading figures from Wall Street and energy companies, and titans of industry. The format of the gathering will be similar to past Koch events, the last of which was held in Aspen, Colorado, in June. The assembled tycoons will talk about some of the Koch brothers' pet horrors - the growth of government and state regulations, what they call climate change "alarmism" and "socialised" healthcare. Then they will share ideas about how to tighten their grip on politics and the judiciary by shaping election campaigns. But this year's reception will differ in one important regard: it will have an opposition. For the first time, a coalition of progressive and liberal groups has formed to trytocounter the power of the Koch brothers. The anti-koch gathering will be staged just down the road from the Rancho Mirage resort. It will hold its own - open as opposed to secretive - panel discussion and a rally designed to highlight what its organisers see as the pernicious impact of the Kochs on the democratic process. Among the panel speakers will be Robert Reich, former US labour secretary under Bill Clinton. He believes the Kochs represent what he calls a perfect storm that is battering American democracy. "This is the worst I've seen it in my lifetime. In the late 19th century, robber barons would deposit bags of silver and gold on the desks of legislators. We've progressed significantly since then, but once again big business is engaging in politics." The reach of corporate agitators personified by the Kochs has been greatly extended by Citizens United, a landmark ruling by the supreme court in January 2010 that opened the door to corporate spending on political campaigns for the first time since The ruling led to a splurge of secret outside funding in the 2010 midterm elections in which about $300m was spent, a three-fold increase on The Koch brothers made good use of the ruling. Again, how much they invested in the elections is not known, but Americans for Prosperity, the Tea Party-alligned movement founded and funded by the Kochs, has put its own spending at $45m. Common Cause this week called on the US attorney general to investigate a possible conflict of interest. The group pointed out that two supreme court judges had taken part in strategy sessions in a previous Koch gathering - Clarence Thomas and Antonin Scalia. Both ruled in favour of lifting the ban on corporate political spending, a move that directly forwarded the Koch brothers' political aspirations. "What we are seeing is a form of legalised bribery," said Rick Jacobs, founder of the Courage Campaign that is participating in Sunday's counter-gathering. "Here are the Koch brothers with their unbridled wealth, using it to shape society as they see fit. It's our obligation to do everything we can to stop them." Critics of the brothers point out that many of the ways they seekto influence politics serves their own personal and corporate interests. They lobby for lower personal and corporate taxes, which doubly benefits them as individual taxpayers and as owners of a company with an annual turnover of about $100bn. Since 2006, the Kochs have been the largest political funders of any energy company in the US. They have backed thinktanks and campaigns that have spread doubts about climate change, which suits their purposes as oil and coal magnates who have been named among the top 10 air polluters in the country. Their sustained fight through the Tea Party movements against government regulations also benefits their multiple concerns, that range fromoil pipelinestopaper cups, wood, carpets and Lycra. "I don't want to demonise the Koch brothers personally," Reich said. "But they demonstrate how vast wealth is now being funnelled into the political process in secret, undermining our democracy." pg.13

MPs and MEPs have called on the government to stop the imminent deportation of a Ugandan lesbian amid deepening concerns for her safety, following the murder of gay rights activist David Kato. Andy Slaughter, the shadow justice minister, expressed "grave concern" over the fate of Brenda Namigadde, 29, who lives in his constituency. Slaughter, the MP for Hammersmith, said: "Whatever the circumstances surrounding Ms Namigadde's presence in Britain, it is clear that she cannot be deported to Uganda at present. Both the public mood and the official stance towards homosexuals in Uganda are lethal at the moment - we should not be contemplating sending my constituents back to a society where she will be in grave danger of her life. "I call upon Damian Green to intervene personally to halt this deportation immediately and suspend the removal notice against my constituent, until we can find a resolution to this case WORLD that does not involve sending Ms Namigadde to face certain persecution and possible death." David Bahati, the Ugandan MP behind the anti-homosexuality bill, which would impose the death penaltyfor gaypeople insome circumstances, has called on Namigadde to "repent or reform" or she will be arrested on her return. Namigadde, who is currently being held at Heathrow airport, due for removal to Uganda at 9pm tonight, said she was praying for a miracle. Her lawyer, Alex Oringa, from Cardinal Solicitors, who has submitted a fresh claim for asylum on her behalf, is awaiting a high court injunction to stop her deportation. In a letter to the immigration minister, Slaughter said: "Given the recent, tragic murder of David Kato in Uganda, the poor treatment of homosexuals in Uganda and the disturbing comments made by the Ugandan politician, David Bahati, about this particular case, it seems wrong that the decision has been taken to remove Ms Namigadde to Uganda where there is averyhighchancethat she will face persecution." MEP Michael Cashman, has written to the home secretary, Theresa May, on behalf of the European parliament's intergroup on LGBT rights, to re-examine her case. He said: "There is no better-known, clearer, or more certain a fate for LGBT people than in Uganda. Respectable international human rights organisations such as Human Rights Watch, Amnesty International, the International Gay and Lesbian Human Rights Commission and the International Lesbian, Gay, Bisexual, Trans and Intersex Association have consistently documented Uganda as one of the most dangerous places for lesbian, gay, bisexual and transgender people today." However, in stark contrast to the situation in Uganda painted by Cashman and others, the UKBA's operational note on Uganda, published in March 2009, does not contain any reference to LGBT people. The shadow home secretary, Yvette Cooper, said: "I understand that Brenda Namigadde's case is being looked at again. The UK Border Agency's operational guidance for Uganda is now nearly two years old and does not mention LGBT rights. It needs to be updated as fast as possible to reflect the current situation on the ground." Clare Bracey, Amnesty International UK's LGBT campaign manager, said: "Amnesty International has got serious concerns about the welfare of any openly gay or lesbian people in Uganda at the moment. Homophobic attitudes have been escalating for some time and aggressive and inappropriate rhetoric from the media and politicians serves to fuel the fire. "It is unacceptable that a lesbian is 'welcomed' back to the country only on the condition that they repent and reform. All individuals should be free to live without fear or discrimination, regardless of their sexual orientation." It is clear after comments made on her case by Bahati that Namigadde is considered a lesbian by the ruling party in Uganda. But an online campaign to support Namigadde has gained momentum. Gay rights groups, AllOut, a US based group and LBGT Asylum News have 40,000 signatures from 160 countries on its online petition urging supporters to write to May, to halt Namigadde's deportation. New guidance issued to UKBA staff on claims based on sexuality, following a supreme court ruling on the issue last July, recommends they consider not just whether an applicant is gay but whether they are "someone who would be treated as gay by potential persecutors in the country of origin". Reminded of such guidance, a spokeswoman for the Home Office said that it would have been used when deciding on Namigadde's case and referred to a statement made yesterdayon Thursday. In it, Matthew Coats, head of immigration at the UKBA, said her case had been considered by both the UKBA and the courts on two separate occasions. "She has been found not to have a right to remain here," he said. "An immigration judge found on the evidence before him that Ms Namigadde was not homosexual." But he added that a fresh asylum claim filed by her lawyers would be reviewed "prior to any removal". pg.15

16 Reuters/IN, 28 de janeiro de 2011 Myanmar court upholds dissolution of Suu Kyi party YANGON YANGON (Reuters) - A special appeals court in army-ruled Myanmar on Friday rejected a move by pro-democracy leader Aung San Suu Kyi to have her political party reinstated after it was dissolved for boycotting last year's election. The Special Appellant Court in Naypyitaw ruled that the National League for Democracy (N- LD), whose 1990 election victory was ignored by the military junta, will remain an "unlawful association" for its failure to register for the November 7 poll. The decision leaves Myanmar's biggest opposition force on the sidelines of a new, army-dominated political system and raises questions about the hugely popular Nobel laureate's ability to initiate any change in the former British colony, despite her release on November 13 from a seven-year stint of detention. The NLD shunned the election because of what it said were "unfair and unjust" rules that prohibited hundreds of its detained members from running for seats in a parliament due to hold its first session on Monday. The special appeal was submitted on January 13 following a Supreme Court ruling on November 22 that the NLD was anillegal organization because it failed to re-register as a party to contest the nationwide polls, which were the first since "Since it was the last legal avenue, the right to appeal has finished here," Nyan Win, an NLD lawyer and spokesman of the now-defunct party said by telephone. "We will do whatever we can after discussing with our leaders as soon as we get back to Yangon," he said. Many experts believe the NLD might serve as some kind of social organization but warn any moves against a new government due to be formed in the next few weeks could result in the re-arrest of many of its members, including Suu Kyi. A bicameral national parliament will convene on Monday and will be dominated by the pro-military Union Solidarity and Development Party and middle-ranking army personnel appointed by junta strongman, Senior General Than Shwe, to serve as lawmakers. The composition of the legislature suggests there will be little change to the status quo and analysts expect the government to be heavily influenced, or even led directly, by Than Shwe. 17 El Mercurio Santiago de Chile/BR, 28 de janeiro de 2011 Muerte de Allende: "Se va a investigar todo" A 37 años del suicidio del ex Presidente Salvador Allende, la justicia chilena investigará la muerte del ex Mandatario, quien, según la autopsia y lo que han dicho sus propios familiares y cercanos, se quitó la vida en La Moneda en Fue el propio Poder Judicial el que decidió presentar un requerimiento- y no una querella como se ha asegurado- para que se indagara su fallecimiento. La fiscal de la Corte de Apelaciones de Santiago, Beatriz Pedrals, presentó el lunes 726 requerimientos por ejecutados políticos y víctimas de violaciones a los derechos humanos entre el 11 de septiembre de 1973 y el 11 de marzo de 1990, casos que nunca habían sido indagados. La fiscal judicial hizo uso de las facultades que le confiere el artículo 360 y 361 del Código Orgánico de Tribunales, que les permite "defender los intereses que le están encomendados en la forma que sus convicciones se lo dicten" y "dar conocimiento de cualesquiera asuntos en que se hallan comprometidos los intereses cuya defensa les ha confiado la ley". La fiscal explicó ayer que el supremo Sergio Muñoz dirigió las investigaciones, y se juntó el material revisando las bases de datos del Poder Judicial, llegándose a la conclusión que había 728 víctimas sin indagar. Pero a última hora se presentaron dos familiares para realizar una denuncia particular. Pedrals justificó la decisión en que "en el fondo queremos judicializar todo lo ocurrido de modo que en 10 años más no se diga: 'quedó esto pendiente y ahora vamos a investigarlo'. Se va a investigar todo". Al ser consultada por el caso de Allende, explicó que no existía una causa en el sistema, y que es necesario "dar un corte con todo lo que dice relación con detenidos desparecidos o personas fallecidas, sean las razones que sean. Entre los casos hay gente fallecida por una bala pérdida, en una manifestación, un niño, etcétera. Hay una diversidad de casos". Hasta ahora la familia nunca ha presentado una querella pues le consta que Allende se suicidó. Sin embargo, el Programa de Derechos Humanos del Ministerio del Interior evalúa desde hace meses interponer una acción judicial por la muerte de Allende, junto con otros casos. La propia directora del programa, Rossy Lama, adelantó a "El Mercurio" en los primeros días de enero que se esperan nuevas querellas para 2011, tal como lo hicieron con el ex ministro de Allende, José Tohá. Lama justificó en su momento la investigación de la muerte de Tohá en que la "facultad para querellarse por ejecutados políticos surgió en diciembre de 2009, cuando se creó el Instituto de Derechos Humanos. Antes, el programa no tenía la facultad". El ministro en visita Mario Carroza será el encargado de investigar el caso de Allende y de las otras 725 personas. 19 La República/IN, 28 de janeiro de 2011 Justicia chilena investigará la muerte de Salvador Allende La justicia chilena investigará por primera vez las circunstancias de la muerte del presidente Salvador Allende, fallecido durante el golpe militar que ejecutó en su contra Augusto Pinochet el 11 de septiembre de 1973, informaron fuentes judiciales. El presidente Allende murió de un disparo mientras el Palacio de La Moneda -sede de gobiernoera bombardeado por la Fuerza Aérea, en un cruento golpe de Estado que terminó instalando al dictador Pinochet en el poder durante los siguientes 17 años. Una autopsia determinó que Allende se suicidó con un fusil que le había regalado el presidente cubano, Fidel Castro, una versión que ha sido aceptada históricamente aunque los resultados forenses siguen siendo cuestionados por algunos sectores políticos y de derechos humanos."se tendrá queversi hubo o no suicidio y en qué circunstancias", explicó ayer jueves a la AFP una fuente del poder judicial, que requirió anonimato. Allende fue un marxista que llegó al poder en 1970 tras ganar de manera estrecha en las elecciones y terminó derrocado por fuerzas conservadoras que consideraron MUNDO que su mensaje de "Chile hacia el socialismo" podría convertir el país en un Estado comunista bajo la égida de Moscú. Ahora la justicia chilena quiere investigar su caso junto con otros 725 casos de violaciones a los derechos humanos en el régimen de Pinochet que nunca fueron vistos por la justicia. Allende "no tiene causa dentro del poder judicial", explicó este jueves la fiscal Beatriz Pedrals, quien presentó querella por la muerte del presidente y por otros 725 casos de violaciones a los derechos humanos durante la dictadura ( ) que nunca fueron investigados. El juez Mario Carroza, quien se encargará de las investigaciones, dijo que "es una responsabilidad tremenda" la tarea que le espera. "Todo aquel elemento, testigo, documento, antecedente que sea necesario al cual recurrir, obviamente lo haré", añadió. La portavoz de gobierno Ena Von Baer, aseguró que el gobierno respeta "todas las decisiones de los tribunales y como Gobierno creemos que todas las situaciones que tengan que ser investigadas se investiguen". "Lo que no se investigó, la justicia lo investigará", señaló Pedrals, quien expresó la voluntad de la justicia de "judicializar todo lo ocurrido". "Verdad y justicia sigue siendo un pendiente en Chile, y cualquier iniciativa para que se haga verdad siempre será bien recibida por nosotros", declaró por su parte el presidente del Partido Socialista de Chile, Osvaldo Andrade, tienda política a la que perteneció Allende. La noticia fue bienvenida por la Agrupación de Familiares de Detenidos Desaparecidos, cuya presidenta Lorena Pizarro calificó de "potente señal a los otros poderes del Estado". "Ningún crimen se debe dejar sin investigar. Estamos hablando de más de 700 casos que nunca se han investigado, y que se incluya aallende hace quecobre unafuerza mayor", dijo Pizarro a la AFP. EL UNIVERSAL 06:55 AM París.- La prohibición de los matrimonios homosexuales no es contraria a la Carta Magna francesa, según la decisión adoptada hoy por el Consejo Constitucional, que decidió que corresponde al legislativo, si así lo considera, cambiar la ley para autorizar este tipo de uniones. La sentencia, muy esperada por las asociaciones francesas de homosexuales, supone un jarro de agua fría para los anhelos dequienes contaban con esta vía para autorizar en Francia un tipo de matrimonio que ya existe en países vecinos como España, Bélgica u Holanda, informó Efe. Pero el Constitucional les dio la espalda y remitió la cuestión a los políticos, que deberán decidir si lo colocan en el centro de la campaña electoral de las Presidenciales del año próximo. INTERNACIONAL Esa es ahora la esperanza de las asociaciones de gais y lesbianas, que pretenden alimentar el debate apoyados en su percepción de que una mayoría de franceses son favorables a ese tipo de uniones. El Consejo consideró que no es discriminatorio que la ley recoja diferencias entre las uniones homosexuales y las heterosexuales y que la definición de matrimonio como la unióndeun hombre y una mujer tal y como recoge el Código Civil no supone una discriminación. Un principio que no acepta Corinne Cestino, una lesbiana que junto con su pareja, Sophie Hasslauer, inició el combate jurídico que llevó la cuestión del matrimonio homosexual hasta la máxima instancia judicial francesa. "Las parejas de hecho no tienen los mismos derechos que los matrimonios. Por ejemplo, nuestros hijos están más desprotegidos que los demás en caso de fallecimiento de uno de los dos miembros de la pareja", aseguró.
