12 Madera Unified School District School Letterhead English Learner Advisory Committee (ELAC) Ballot Notify the Parent Community of ELAC Election All parents in the school may be elected to serve on the committee. The principal shall notify all parents that an election of ELAC members will occur and that nominations are open. This notification can be sent home to parents in a school bulletin or newsletter. The notification should include the following information: The purpose of ELAC. Determine the percentage of English learners at the school. Clarification that ELAC members are elected by parents/guardians of English learners, not all parents in the school. A description of the nomination procedure. Identify procedures for parents to selfnominate/nominate another person. Be sure to translate the information for parents/guardians of English learners. 17 Complaint Procedure Flowchart UNIFORM COMPLAINT PROCEDURE Must be completed within 60 days STEP 1 File complaint with Chief Academic Officer STEP 2 Complaint forwarded to Compliance Officer STEP 3 Resolution through informal mediation within three days of complaint being forwarded to Compliance Officer. STEP 4 If no resolution through informal mediation investigation begins within five days of complaint being forwarded to Compliance Officer. STEP 5 Investigation complete. Final written report issued to complainant within 35 days of filing. STEP 6 Appeal to MUSD Board of Education available if complainant is dissatisfied. Appeal must come within five days of receipt of written report. STEP 7 MUSD Board of Education responds to appeal within 60 days. STEP 8 If still dissatisfied, complainant may appeal to California Department of Education within 15 days of MUSD Board s ruling. GENERAL COMPLAINTS MUSD requests that complaints not utilizing the Uniform Complaint Procedure be flowed in the following manner: SITE/SCHOOL CHIEF ACADEMIC OFFICERS ASSOCIATE SUPERINTENDENT SUPERINTENDENT MUSD BOARD OF EDUCATION Complaint may be resolved at any point of the above process.

19 Procedimientos Para Presentar Quejas PROCEDIMIENTO UNIFORME DE QUEJAS - Se debe de realizar dentro de 60 días- PASO 1 Presentar queja ante el Jefe Oficial Académico PASO 2 La queja es enviada al representante de Cumplimiento. E (d) QUEJAS EN GENERAL MUSD pide que las quejas que no usen el Procedimiento Uniforme De Quejas sigan los siguientes pasos: Plantel Escolar PASO 3 Una solución por medio de mediación informal es dada dentro de tres días de haber enviado la queja al representante de Cumplimiento. PASO 4 Si no se llega a ninguna resolución por medio de mediación informal- se empieza una investigación dentro de cinco días de haber enviado la queja al representante de Cumplimiento. Jefe Oficial Académico Asistente de Superintendente Superintendente PASO 5 Se termina la investigación. Informe final por escrito será entregado al demandante dentro de 35 días después de presentar la queja. PASO 6 Mesa Directiva de Educación de MUSD La queja puede ser resuelta en cualquier paso del proceso anterior. Apelación a la mesa directiva de Educación de MUSD será disponible al demandante si no esta satisfecho. La apelación debe ser recibida dentro de cinco días de haber recibido el informe por escrito. PASO 7 La mesa directiva de Educación de MUSD responderá a la apelación dentro de 60 días. PASO 8 Si aun no esta satisfecho, el demandante puede apelar a la Secretaria de educación pública de California dentro de 15 días de la decisión de la mesa directiva de MUSD.

21 ADMINISTRATIVE REGULATION AR School District Madera Unified Williams Uniform Complaint Procedures NOTICE TO PARENTS/GUARDIANS: COMPLAINT RIGHTS Parents/Guardians: Education Code requires that the following notice be posted in your child s classroom: 1. There should be sufficient textbooks and instructional materials. For there to be sufficient textbooks and instructional materials, each student, including English learners, must have a textbook or instructional material, or both, to use in class and to take home to complete required homework assignments. 2. School facilities must be clean, safe, and maintained in good repair. Good repair means that the facility is maintained in a manner that assures that it is clean, safe, and functional as determined by the Office of Public School Construction. 3. There should be no teacher vacancies or misassignments. A teacher must be assigned to teach a class at the beginning of the semester and the teacher must be subject matter competent. Additionally, if a teacher is teaching a class with more than 20% English learners, that teacher must have the credential or training to teach English learners. 4. Pupils, including English Learners, who have not passed one or both parts of the high school exit examination by the end of the 12 th grade are to be provided the opportunities to receive intensive instruction and services for up to two consecutive academic years after the completion of grade To file a complaint regarding the above matters, complaint forms can be obtained at the principal s office, district office, or can be downloaded from the school district s or California Department of Education s website. RELACIONES COMUNITARIAS Distrito Escolar Unificado de Madera Procedimientos de Quejas Uniformes Williams AVISO A LOS PADRES DE FAMILIA/GUARDIANES: DERECHOS DE QUEJAS Padres de Familia/Guardianes: El Código de Educación requiere que el siguiente aviso sea publicado en el salón de clases de su niño: 1. Deberá haber suficiente textos y materiales de instrucció. Para que haya suficiente textos y materiales de instrucción, todo estudiante, incluyendo los estudiantes de Ingles, deben tener un texto o material de instrucción, o ambos, para usar en clase y llevar a casa para completar las asignaturas de tareas requeridas. 2. Las instalaciones del plantel deben estar limpias, seguras, y bien reparadas. Bién reparadas significa que la instalación es mantenida de una manera que asegure que este limpia, segura y funcional determinado por la Oficina de Construcción de Escuelas Publicas. 3. No deberá haber puestos vacantes de maestros o puestos mal asignados. Se debe asignar un maestro para enseñar una clase, al comienzo del semestre el maestro debe ser competente en la materia de enseñanza. Adicionalmente, si el maestro dicta una clase con más de 20% de estudiantes de Inglés, el maestro debe tener la credencial o entrenamiento para enseñar a estudiantes de Inglés. 4. Alumnos, incluyendo Estudiantes de Inglés, que no han pasado una o dos secciones del examen de salida de secundaria antes de finalizar el 12vo grado deberán recibir oportunidades para recibir instrucción intensiva y servicios de hasta dos años académicos consecutivos después de completar el 12vo grado. 5. Para presenter una queja con respecto al tema anterior, usted puede obtener formularios en la oficina del director, oficina del distrito, o imprimirlos de la red de internet del distrito escolar o del Departamento de Educación de California.
