INVESTIGACIÓN DE LA INFORMACIÓN COMERCIAL EN LOS PAQUETES DE PAPEL HIGIENICO

AUTORIDAD DE PROTECCIÓN AL CONSUMIDOR Y DEFENSA DE LA COMPETENCIA DIRECCIÓN NACIONAL DE PROTECCIÓN AL CONSUMIDOR DEPARTAMENTO DE METROLOGÍA INVESTIGACIÓN DE LA INFORMACIÓN COMERCIAL EN LOS PAQUETES DE PAPEL HIGIENICO DEL DE SEPTIEMBRE AL DE OCTUBRE 0

INTRODUCCION Esta investigación nos permite evaluar si los consumidores están recibiendo la cantidad de papel higiénico por la que han tenido que pagar un costo en constante alza. OBJETIVO El objetivo de esta investigación es determinar que los lotes de PAPEL HIGIENICO que se encuentran en los diferentes comercios de la localidad cumplen con la información comercial que declaran en el empaque de acuerdo a lo establecido en el artículo 6, numeral, referente a las obligaciones del proveedor frente al consumidor de la Ley 5 del de octubre de 007. AREA DE APLICACIÓN Esta investigación se llevó a cabo en las diferentes marcas y tamaños de paquetes de papel higiénico que se comercializan en el mercado nacional. FUNDAMENTO LEGAL Ley 5 del de octubre de 007, artículo 6, numeral, referente a las obligaciones del proveedor frente al consumidor. - Reglamento Técnico DGNTI-COPANIT --98, Metrología. Contenido Neto de Preempacados - Norma Técnica 5-000R. Papel y Cartón. Papel Higiénico. Características Generales. PROCEDIMIENTO DE RETIRO DE MUESTRA Al llegar al establecimiento comercial, una vez identificados con las credenciales que nos autorizan a realizar la labor, le explicamos al administrador del establecimiento en que consiste la investigación que estamos efectuando sobre la información comercial de los paquetes de papel higiénico. Se le explica que procederemos a retirar una muestra cuyo tamaño depende de la cantidad de paquetes que estén en estantería para la venta al consumidor. Se le entrega el documento ACODECO-ME-FO- FORMULARIO DE RETIRO DE MUESTRA, con las cantidades de muestras retiradas y mediante el cual el comerciante puede solicitar su reposición al propietario de la marca.

Al Agente Económico se le explicó que se trasladan las muestras del mercado al laboratorio para verificar la información comercial de cada una. Luego se descartan esas muestras porque la verificación en cada paquete es un procedimiento destructivo. Además se le invita a que presencie el desarrollo de los análisis en nuestro laboratorio. PROCEDIMIENTO DE ANALISIS PESO: GRAMOS / ROLLO Se pesa cada rollo a analizar en una balanza semianalítica electrónica calibrada. MEDICION DE LAS DIMENSIONES DE LA HOJA - La medición de las dimensiones de la hoja de papel higiénico se efectúa con un vernier calibrado, se mide el ancho y largo de la hoja. Este análisis se efectúa sobre cada rollo de la muestra tomada. CANTIDAD DE HOJAS La cantidad de hojas de cada rollo se determina desenvolviendo el rollo y contando cada una de las hojas contenidas en el mismo. Cada 0 hojas se anota el conteo para control. DESARROLLO DE LA INVESTIGACION En cada establecimiento comercial con existencia del producto objeto de esta investigación se efectuó un muestreo al azar tomando la cantidad de muestras establecidas en la Tabla N del Reglamento Técnico DGNTI-COPANIT --98, Metrología. Contenido Neto de Preempacados. Utilizando una balanza semianalítica electrónica calibrada se procedió a determinar el peso de cada rollo en gramos en el laboratorio siempre y cuando este aspecto estuviera declarado en el paquete. Utilizando un vernier calibrado se procedió a determinar las dimensiones del ancho y largo de la hoja de papel higiénico en caso de que este aspecto estuviera declarado en el paquete. Se procedió a desenvolver el rollo de papel higiénico y contar la cantidad de hojas contenidas en cada rollo una a una. Una vez verificada la información comercial declarada en el paquete, nos dirigimos al establecimiento comercial a informar al agente económico los resultados mediante el formulario ACODECO-ME-FO- Comportamiento de Información Comercial en Empaques de Productos de Papel y el Acta de Verificación de

Contenido Neto. En los casos en donde el producto no cumplía con la información comercial declarada se procedió al retiro de la estantería del mismo. Se obtuvieron muestras de establecimientos comerciales. El período de la investigación fue del de septiembre al de octubre de 0. En los 9 lotes rechazados (5.00% de los lotes verificados), se retiraron de la venta 577 paquetes de papel higiénico, un.% de los paquetes encontrados al momento de llegar a efectuar el control a los diferentes establecimientos comerciales.

CONCLUSIONES La investigación ha detectado que las empresas: PAPELERA ISTMEÑA, S.A., KIMBERLY CLARK, FEA INTERNATIONAL, ALMACEN OCA LOCA y TAMEK (El Fuerte), S.A., están colocando en el mercado rollos de papel higiénico que no cumplen con la información comercial declarada en los paquetes tal como lo estipula el artículo 6, numeral, referente a las obligaciones del proveedor frente al consumidor de la Ley 5 del de octubre de 007. Esta situación, por ser un producto de consumo masivo, afecta a los consumidores debido a que no están obteniendo el producto por el que están pagando. RECOMENDACIONES.- Aplicarle las sanciones que estipule la ley a las empresas que están colocando en el mercado rollos de papel higiénico que no cumplen con la información comercial declarada..- Realizar periódicamente verificaciones que nos permitan evaluar y darle seguimiento a estos productos. - Cuadro de resultados de la investigación.
