AIC C08/08 A08/08 25 SEP 2008 PROCEDIMIENTOS PARA LA AUTORIZACION DE SOBREVUELO O SOBREVUELO Y ATERRIZAJE DE AERONAVES DE ESTADO EXTRANJERAS EN EL TERRITORIO COLOMBIANO; AERONAVES CIVILES EN AERODROMOS RESTRINGIDOS Y BASES AEREAS DE LA FUERZA AEREA COLOMBIANA PROCEDURES FOR THE AUTHORIZATION OF OVERFLY OR OVERFLY AND LANDING FOR FOREIGN STATE AIRCRAFT IN THE COLOMBIAN TERRITORY; CIVIL AIRCRAFT IN RESTRICTED AIRPORTS AND AIR COLOMBIAN FORCE BASES FECHA DE EFECTIVIDAD 23 OCTUBRE 2008 EFECTIVENESS DATE 23 OCTOBER 2008 INTRODUCCION La Aeronáutica Civil con el objetivo de preservar la seguridad operacional a nivel nacional da a conocer los procedimientos enunciados. 1) PROCEDIMIENTOS (a) Autorización de sobrevuelo o sobrevuelo y aterrizaje de aeronaves de estado extranjeras en el territorio Colombiano. 1. Corresponde al Ministerio de Defensa Nacional por intermedio del Comando de la Fuerza Aérea Colombiana, conceder los permisos de sobrevuelo y/o sobrevuelo y aterrizaje de aeronaves de Estado Extranjeras en el territorio Nacional. 2. En las autorizaciones de Sobrevuelo y/o Aterrizaje que emite la Fuerza Aérea Colombiana para aeronaves extranjeras, se concederá el mismo tratamiento, requisitos, condiciones, procedimientos y criterios de aprobación, que el otorgado a las aeronaves de Estado Colombianas, aplicando el principio de reciprocidad. 3. El aterrizaje y despegue del territorio Colombiano deberá de realizarse a través de los aeropuertos internacionales, salvo en las siguientes circunstancias excepcionales con previo concepto de la Jefatura de Operaciones Aéreas del Comando de la Fuerza Aérea Colombiana. En operaciones de búsqueda y salvamento. En apoyo en casos de desastres naturales. En asistencia humanitaria. En apoyo directo a la Fuerza Pública. INTRODUCTION The Aeronáutica Civil with the objective to preserve the national operationall safety announce the procedures enunciated. 1) PROCEDURES (a) Authorization for overfly or overfly and landing for State foreign aircraft in the Colombian territory. 1. Las solicitudes de sobrevuelo, o de sobrevuelo y aterrizaje para aeronaves de Estado de otros Gobiernos, incluso de aquellas aeronaves que operen desde buques u otras plataformas, serán tramitadas por la Misiones Diplomáticas acreditadas ante el Gobierno Colombiano, a través de la Dirección de Soberanía Territorial y Desarrollo Fronterizo del Ministerio de Relaciones Exteriores con un tiempo no menor a cinco (5) días hábiles de anticipación a la fecha prevista para la realización de la operación aérea. 5. Recibidas las solicitudes por parte de la Dirección de Soberanía Territorial y Desarrollo Fronterizo, éstas serán remitidas a la Jefatura de Operaciones Aéreas del Comando de la Fuerza Aérea Colombiana. 6. Las solicitudes podrán tramitarse directamente a la Fuerza Aérea Colombiana Jefatura de Operaciones Aéreas, solo en las siguientes circunstancias excepcionales: En apoyo en caso de emergencia de aeronaves. En coordinación de esfuerzos de búsqueda y salvamento. Apoyo en caso de desastres. En apoyo directo a la Fuerza Pública. En asistencia humanitaria. Nota: En todos los casos citados anteriormente se deberá comunicar a la Dirección de Soberanía Territorial y Desarrollo Fronterizo del Ministerio de Relaciones Exteriores 7. La Jefatura de Operaciones Aéreas a través de la Dirección de Navegación Aérea informará su decisión a la Unidad Administrativa Especial de Aeronáutica Civil, a las Misiones Diplomáticas y a la Dirección de Soberanía territorial. 8. Las solicitudes deberán tramitarse de acuerdo al formato especificado en el Apéndice A, diligenciando la totalidad de los campos en idioma español. (b) Autorización para aterrizaje de aeronaves Civiles en un aeródromo restringido. 1. Los vuelos hacia los aeródromos restringidos serán aprobados bajo condiciones especiales y podrán ser cancelados por parte de la Fuerza Aérea Colombiana en cualquier momento, sin previo aviso ni justificación pública. 2. Mediante una programación mensual, la Jefatura de Operaciones Aéreas del Comando de la Fuerza Aérea Colombiana designará los días que serán autorizados los vuelos hacia las pistas restringidas; estos serán programados equitativamente entre las empresas solicitantes y el resultado será enviado a las respectivas empresas en el tiempo establecido por la Fuerza 4. The Headquarters of Air Operations across the Direction of Air Navigation will inform his decision to the Unidad Administrativa Especial de Aeronáutica Civil, to the Diplomatic Missions and to the Direction of territorial Sovereignty. 8. The requests will have to be proceeded in agreement to the format specified in the Appendix A, dealing with the totality of the fields in Spanish language. (b) Authorization for landing for Civil aircraft in a restricted airport. 1. The flights towards the restricted airports will be approved under special conditions and will be able to be cancelled by the Air Colombian Force at any time, without previous notice or public justification. 2. By a monthly programming, the Headquarters of Air Operations of the Air Colombian Force commad will designate the days that will be authorized the flights towards the restricted runways; these they will be programmed equitably between the companies solicitors and the result it will be sent to the respective companies in the time established by the Air 2

No se autorizará el intercambio de fecha programadas, ni los vuelos adicionales hacia los aeródromos restringidos, a excepción de las siguientes circunstancias: En operaciones de búsqueda y salvamento. No se autorizaran aplazar para una fecha posterior los vuelos programados hacia los aeródromos restringidos, a excepción de las siguientes circunstancias: Por condiciones meteorológicas adversas en el aeródromo de salida, en ruta o en el aeródromo de destino. Por fallas técnicas de la(s) aeronave(s). En este caso la empresa deberá enviar la certificación del estado de la aeronave emitido por la Unidad Administrativa Especial de Aeronáutica Civil. Nota: La Fuerza Aérea se reserva el derecho de solicitar a las empresas explotadoras o a la persona natural o jurídica, cualquier información adicional, la cual deberá ser presentada dentro de las cuarenta y ocho (48) horas siguientes. 5. Las solicitudes deberán tramitarse de acuerdo al formato especificado en el Apéndice B, diligenciando la totalidad de los campos en idioma español. (c) Autorización para sobrevuelo en zonas restringidas o sobrevuelo y aterrizaje en aeródromos controlados y no controlados que se encuentren en las zonas restringidas del territorio Colombiano. 1. Las aeronaves de la aviación civil comercial o privada, nacionales o extranjeras que requieran sobrevolar una zona restringida o sobrevolar una zona restringida y aterrizar en un aeródromo controlado o no controlado, público o privado, que se encuentre dentro de la misma, deberán obtener autorización de la Jefatura de Operaciones Aéreas del Comando de la Fuerza Aérea Colombiana 2 Las solicitudes deberán tramitarse de acuerdo al formato especificado en el Apéndice C, diligenciando la totalidad de los campos en idioma español. (d) Autorización para pernoctada en aeródromos que no cuenten con presencia de Fuerza Pública. 1. En consideración a las operaciones de reconocimiento que desarrolla la Fuerza Aérea Colombian Force. 3. La vigencia y las condiciones de las autorizaciones de pernoctada serán determinadas por la Fuerza Aérea Colombiana. 3. Las solicitudes deberán tramitarse de acuerdo al formato especificado en el Apéndice C, diligenciando la totalidad de los campos en idioma español. (e) Autorización para aterrizaje en una Base Aérea de la Fuerza Aérea Colombiana. 1. Será potestad del Señor General Comandante de la Fuerza Aérea Colombiana autorizar el aterrizaje de aeronaves de Estado y de aviación civil comercial o privada en las Bases Aéreas FAC. 2. Los fletadores que planeen contratar aeronaves de la aviación civil comercial o privada y las agencias que prestan apoyo a la Fuerza pública Colombiana, que por cualquier motivo pretendan aterrizar en alguna(s) Base(s) Aérea(s) de la Fuerza Aérea Colombiana, deberán tramitar la solicitud de acuerdo al formato especificado en el Apéndice D, por lo menos tres (03) días antes de la fecha prevista del vuelo. 3. En caso de ser aprobada la solicitud, los responsables de las empresas de aviación civil comercial o privada, nacionales o extranjeras que sean contratados para cumplir el vuelo, o las Agencias extranjeras responsables de las aeronaves, deberán solicitar a la Jefatura de Operaciones aéreas la autorización de aterrizaje por lo menos 48 horas antes a la fecha prevista del vuelo, de acuerdo al formato especificado en el Apéndice C, diligenciando la totalidad de los campos en idioma español. 4. El permiso para aterrizar en una Base Aérea de la Fuerza Aérea Colombiana tendrá una vigencia máxima de un (01) día. 5. El permiso de sobrevuelo y aterrizaje certifica que la aeronave(s) se encuentra(n) autorizadas para aterrizar en la respectiva unidad aérea; sin embargo, los gastos generados por los servicios de control y plataforma deberán ser cancelados a través de la Agencia Logística de las Fuerzas Militares, de acuerdo a los plazos y tarifas establecidas por esa entidad. 6. The permission to land in an Air Base of the Air Colombian Force will have a maximum force of one (01) day. 5. The overfly and landing permission certifies that the aircraft is authorized to land in the respective air unit; nevertheless, the expenses generated by the Control services and apron will have to be cancelled across the Logistic Agency of the Military Forces, of agreement to the period and tariffs established by this entity. 6. The crews authorized to overfly and land in air units must expire strictly with the standards and 4

Los pilotos de las aeronaves de ala fija y rotatoria del Ejercito, la Armada y la Policía Nacional que requieran ingresar a Espacio Aéreo Restringido o aterrizar en una Base Aérea de la FAC, deberán coordinar con la Jefatura de Operaciones Aéreas Centro de Comando y Control FAC, con antelación al decolaje de la aeronave, informando: Misión. Fecha y hora prevista del vuelo, de llegada y salida de la Base Aérea. Punto y hora de ingreso y salida de la zona restringida. Destino exacto. 8. En caso de operaciones de orden público, las aeronaves de ala fija y rotatoria del Ejercito, la Armada y la Policía Nacional que requieran ingresar a Espacio Aéreo Restringido y/o aterrizar en una Base Aérea de la FAC, deberán coordinar con consola aeronáutica de la Base Aérea o del Radar que ejerce el control del espacio aéreo de dicha Zona, la cual se comunicará con la Jefatura de Operaciones Aéreas Centro de Comando y Control FAC. 9. Así mismo deberán hacer contacto en frecuencia aeronáutica con la Torre de Control de la Base Aérea o del Radar que ejerce el control del espacio aéreo de dicha Zona, diez (10) minutos o 20 millas antes del ingreso a la zona restringida. (f) Autorización para sobrevuelo de aeronaves de aviación civil comercial o privada que desarrollen misiones de aerofotografía, reconocimiento o registros fílmicos en el territorio Colombiano. 1. Por razones de seguridad y defensa nacional es necesario controlar el sobrevuelo de aeronaves con equipos electrónicos especiales, sensores de operación activa y pasiva, utilizados en la recolección de datos tales como fotografía, imágenes, videos o cualquier otro medio; en cumplimiento de misiones de reconocimiento, obtención de información técnica cartográfica y afines. 2. Las aeronaves tripuladas y no tripuladas que posean y empleen equipos electrónicos especiales, sensores de operación activa y pasiva que tengan como misión e intención la recolección de datos tales como fotografía, imágenes, videos, etc., deberán obtener la Correspondiente autorización de la Fuerza Aérea procedures established in the Manual of Air Local Regulations of the respective unit. 7. (2) INSTRUCCIONES DE COORDINACION (a) La Dirección de Navegación aérea recibirá, analizará y emitirá el permiso de sobrevuelo y aterrizaje a las aeronaves y tripulaciones que cumplan con las siguientes condiciones: 1. El (los) piloto(s) deberá(n) cumplir con los requisitos exigidos por la Unidad Administrativa Especial de Aeronáutica Civil para desempeñarse en el cargo; además deberá(n) contar con el Certificado de carencia de informes por tráfico de estupefacientes, expedido por la Dirección Nacional de Estupefacientes (DNE). 2. La(s) aeronaves deberán cumplir los requisitos técnicos y de operación exigidos por la Unidad Administrativa Especial de Aeronáutica Civil presentando la debida autorización expedida por la Fuerza Aérea Colombiana y registrar en la casilla 18 del formato de Plan de vuelo los número de autorización, también deberán contar con el Certificado antinarcóticos vigente, expedido por el grupo control de aviación civil de la Policía Nacional. (b) La Fuerza Aérea Colombiana podrá solicitar a las empresas o personas solicitantes en cualquier momento, los documentos que se consideren necesarios y sirvan para determinar la viabilidad de aprobar la solicitud. (c) Posterior al análisis técnico y si no median impedimentos para hacerlo, se otorgará el permiso de sobrevuelo o sobrevuelo y aterrizaje en las condiciones y plazos designados por la Jefatura de Operaciones Aéreas. (d) Una vez autorizado, se dará conocimiento de la autorización por los medios designados por la Jefatura de Operaciones Aéreas, a las siguientes dependencias: (2) COORDINATION INSTRUCTIONS (a) The Direction of air Navigation will receive, will analyze and emit the overfly and landing permission to the aircraft and crews that fulfil with the following conditions: 1. 7 Unidad Administrativa Especial de Aeronáutica Civil (Grupo de Comunicaciones Regional Bogotá) Empresa Solicitante. Unidades Aéreas. Nota: El Grupo de Comunicaciones Regional Bogotá deberán hacer llegar la autorización a los supervisores de los centros de control de Bogota y Barranquilla. El Grupo FDP imprimirá los documentos respectivos y los entregará al supervisor de turno. (e) Las solicitudes de sobrevuelo y aterrizaje para aeronaves nacionales, serán solicitadas por el representante legal de la empresa o la persona natural o jurídica propietaria de la aeronave, el cual deberá estar debidamente inscrito en el Registro Aeronáutico Nacional. (f) Cuando se trate de aeronaves con matricula extranjera al servicio de una empresa Colombiana explotadora de la actividad civil aérea, se deberá anexar a la solicitud, el correspondiente permiso de permanencia otorgado por la Unidad Administrativa Especial de Aeronáutica Civil. (g) En ningún caso, la recepción de la documentación requerida constituye un compromiso de aprobación por parte de la Fuerza Aérea Colombiana. (h) En caso que una empresa aeronáutica titular de un permiso de operación haya incumplido cualquier instrucción contenida en el permiso de sobrevuelo y/o aterrizaje, la Fuerza Aérea Colombiana podrá reservarse el derecho de tramitar y expedir futuras autorizaciones por el tiempo que se considere necesario, sin perjuicio de la responsabilidad que pueda recaer sobre los propietarios, administradores o dependientes de la empresa sancionada. (i) Hasta tanto la Jefatura Operaciones Aéreas de la Fuerza Aérea Colombiana se pronuncie sobre cada solicitud, los interesados deben abstenerse de realizar cualquier gestión con el propósito de dar principio a la actividad propuesta. (n) Las personas naturales o jurídicas propietarias de vehículos Ultralivianos, cumplirán con todas las disposiciones contenidas en la presente circular y se sujetarán a lo dispuesto en los Reglamentos Aeronáuticos de Colombia en su parte pertinente. (o) Las empresas de aviación civil comercial o privada, que sean explotadoras o propietarias de aeronaves nacionales o extrajeras, deberán tramitar las solicitudes de sobrevuelo y/o aterrizaje ante la Jefatura de Operaciones Aéreas- Dirección de Navegación Aérea, por lo menos cuarenta y ocho (48) horas antes a la fecha propuesta del vuelo. (p) La Fuerza Aérea Colombiana designará los mecanismos y procedimientos utilizados para la recepción, tramite y divulgación de los permisos de sobrevuelo y/o aterrizaje; estos serán desarrollados y establecidos de acuerdo a los avances tecnológicos disponibles, procurando en todo momento optimizar los procesos y disminuir los gastos. (q) Es responsabilidad de las empresas solicitantes, establecer la infraestructura tecnológica necesaria que permita gestionar los documentos a través de los mecanismos designados por la Fuerza Aérea Colombiana. (r) La Fuerza Aérea Colombiana hará pública su decisión a través de la Unidad Administrativa Especial de Aeronáutica Civil; se informará la decisión a las empresas de aviación o personas solicitantes; sin embargo, en ningún caso la Fuerza Aérea Colombiana será responsable por los vuelos que no se cumplan por desconocimiento de las autorizaciones, ni por las consecuencias que esto ocasione. (s) Las solicitudes por motivo de fuerza mayor ocurran fuera del horario laboral (07:30 a 1700 Horas) del Cuartel General de la FAC (UNICAMENTE TRANSPORTE DE ENFERMOS O HERIDOS), deberán tramitarse ante el Centro de Comando y Control FAC (CCOFA, TEL: EXT ).
