ANDERSON- GENERAL MANAGER NOTICE OF PUBLIC HEARING ON PROPOSED RATE INCREASES FOR SOLID AND GREEN WASTE COLLECTION AND RECYCLING SERVICES To comply with Proposition 218 (California Constitution Article Xlll D Section 6), the Malaga County Water District hereby gives the following Notice: 1. Date, time, location and purpose of Public Hearing: At 6:00 p.m. on October 25, 2016, at the Malaga County Water District ( District ) Boardroom located at the District office 3580 South Frank Street, Fresno, California 93725, The Board of Directors of the District ( Board ) will hold a Public Hearing on Proposed Increases in Rates for Solid and Green Waste Collection and Recycling Services provided by the District through a Franchise Agreement with Industrial Waste and Salvage ( IWS ) and to hear and consider objections and protests to the proposed increases, the basis for calculating those increases, the Report described in paragraph 3, and the reason(s) for the proposed rate increases. 2. What do Solid and Green Waste and Recycling Rates Fund? The District provides residential solid and green waste collection and recycling services ( Sanitation Service ) within the District boundaries by contracting for those services through a Franchise Agreement. The revenues collected by the District for Sanitation Services pay the Contractor, in this case IWS, to preform said services for the District and include an administrative fee which is used by the District to cover the District s costs which include, but are not limited to, billing, postage, notice costs and staff costs. Rates cannot be used for general governmental services. 3. What is the Basis for the Change? The District contracts for Sanitation Services and its current contract with IWS has expired. Pursuant to Water Code 31140, the District solicited public bids for Sanitation Services and after thorough consideration of all bids received the Board of Directors selected the bid of IWS to provide Sanitation Services. In addition to the contract amount paid to IWS for Sanitation Services, the proposed rates also include the Administrative Fee described in paragraph 2 of this Notice. A Report on the bid process, IWS s bid and the Administrative Fee has been prepared by the District and is available for review at the District office (the Report ). 4. New Solid and Green Waste and Recycling Services Rates: The proposed rates for Sanitation Services are as follows:

2 Residential Services Monthly Rate Full Service $ Solid Waste: 96 gallon Recycled Waste: 96 gallon Green Waste: 96 gallon Reduced Volume Service $ Solid Waste: 64 gallon Recycled Waste: 96 gallon Green Waste: 96 gallon Curb-Side Clean-Up $ 7.05 Fall and Spring Administrative Fee $ 2.46 Full Service Rate (monthly total) $ Reduced Volume Rate (monthly total) $ Supplemental Work-Order (on-call services) Solid Waste: 96 gallon $ 7.80 Recycled Waste: 96 gallon $ 3.60 Green Waste; 96 gallon $ 5.00 Roll-Off Container $ Bulk Item pick-up (2 cuyd max) $ Automatic Inflationary Increases: In addition to the proposed rates effective November 1, 2016, shown above, beginning August 1, 2017, rates may also be adjusted based on the annual change in the California Consumer Price Index, as published by the California Office of Policy, Research and Legislation, ( Annual CPI ) and annual change in the Department of Labor, Bureau of Labor Statistics, Producer Price Index- Commodities, #2 Diesel fuel, ( Fuel Cost Adjustment ) In no event will the Annual CPI Rate Adjustment and the Fuel Cost Adjustment combined exceed fifteen percent (15%) in any year. 6. When Will the New Rates be Effective? If approved, the new rates will be effective November 1, Public Hearing Process and Determination of a Majority Protest : At the time and place shown in paragraph 1 of this Notice, the Board of Directors

3 will hear and consider all objections and protests, if any, verify all written protests to the proposed rate increases and any other matter described in the Report and in this Notice and will listen to and consider all objections and challenges, if any, to the Proposed Rate Increases, including the proposed Annual CPI and Fuel Costs Adjustment Increase(s) beginning August 1, The Board may continue the Public Hearing. The Board will not consider written protests submitted after the conclusion of the Public Hearing. Both the owner of the parcel and the person receiving service for which the fees or rate is charged may submit a written protest. Only one protest per parcel is counted. The written protest must include; (i) original signature; (ii) Identification of the parcel by parcel number or street address; (iii) Identification as the Owner of the parcel or person receiving the service for which the fee or rate is charged; and (iv) your statement that you protest the increase in the rate. Written protests may be mailed to the Malaga County Water District 3580 South Frank Street, Fresno, California 93725, Attention Clerk to the Board of Directors. Written protests are not accepted by or facsimile. If sufficient written protests against the Proposed Rate Increases are presented and not withdrawn by a majority of the record owners or persons receiving service for or to the parcel subject to the increased rates, the District may not imposed the increased rate; rather the rates for Solid and Green Waste Collection and Recycling Services would continue at the current amounts, which have been previously approved. If at the close of the Public Hearing, there is no majority protest as described above, the Board of Directors may approve the rate increase as proposed to be effective and commence on November 1, Preserving the Right to Challenge: Any person who wants to preserve the opportunity to file a lawsuit or legal action challenging the Proposed Rate Increase for Solid and Green Waste Collection and Recycling Services, or other matters described in the Report or in this Notice, must file a written protest with the Board, stating the specific grounds of the protest. Any grounds not stated in a written protest filed with the Board before the close of the Public Hearing on October 25, 2016, will be deemed waived and may not be raised in any subsequent lawsuit or legal action. 9. ANDERSON- GENERAL MANAGER AVISO AL PUBLICO AUDIENCIA PÚBLICA PARA PROPONER UN AUMENTO DE TARIFAS EN EL SERVICIO DE BASURA RESIDUAL Y COLECCION DE BASURA ORGANICA Y RECICLAJE Para cumplir con la Proposición 218 (Constitución de California Articulo XIIID, Seccion 6), Malaga County Water District por este medio da esta notificación: 1. Fecha, horario, locación y el propósito del Aviso Publico: A las 6:00 de la tarde, el 25 de Octubre del 2016, en la sala del consejo en Málaga County Water District ( Distrito ), localizado en la oficina del Distrito en 3580 S. Frank Street, Fresno, California 93725, la Junta Directiva del Distrito llevara a cabo una junta publica proponiendo un aumento de tarifas en el servicio de colección de basura residual, basura orgánica y reciclaje que es proporcionado por el Distrito, a través de un acuerdo de franquicia con Industrial Waste and Salvage ( IWS ) y para escuchar y considerar objeciones y protestas sobre la propuesta de aumento de tarifas, la base en la calculación del aumento, un Reporte que esta descrito en el párrafo número 3, y las razón(es) para el incremento de tarifas. 2. Que financia las tarifas de basura residual, basura orgánica y reciclaje? El Distrito provee servicios de colección de basura residual, basura orgánica y reciclaje ( Servicio de Saneamiento ) a los residentes que están en los límites del Distrito al contratar estos servicios por un acuerdo de franquicia. Los ingresos serán recibidos por el distrito para poder pagar al servicio de saneamiento, que en este caso es IWS, para que ellos puedan dar sus servicios al Distrito e incluirá una tarifa administrativa que será usado por el Distrito para cubrir costos, que incluyen, pero no está limitado, al franqueo de facturación, notificaciones de costo y el costo de empleados. Estas tarifas no pueden ser usadas para el servicio gubernamental. 3. En que se Basa en Cambio? El Distrito contrata el servicio de saneamiento y el contrato actual con IWS se ha vencido. Conforme con el Código de Agua 31140, el Distrito solicitó ofertas públicas para el servicio de saneamiento y después de haber recibido todas las ofertas, la Junta Directiva selecciono IWS para que ofrezca servicio de saneamiento. Además de la cantidad del contrato que se pagó a IWS para sus servicios de saneamiento, también incluirá una tarifa administrativa, descrita en el párrafo 2 de este aviso. El reporte del proceso de las ofertas, la oferta de IWS y la Tarifa Administrativa ha sido preparado y estará disponible en la oficina del Distrito ( el Reporte ).

Nuevas Tarifas para el servicio de Basura Residuales, Basura Orgánica y Reciclaje La Propuesta de Tarifas para los Servicios de Saneamiento es como sigue: Servicios Residenciales Tarifa Mensual Servicio Completo $ Basura Residual: 96 galónes Basura Recicable: 96 galónes Basura Organica: 96 galón Servicio de Volumen Reducido $ Basura Residual: 64 galón Basura Recicable: 96 galón Basura Organica: 96 galón Limpieza Comunitaria $ 7.05 Otoño e Invierno Tarifa Administrativa $ 2.32 Tarifa de Servicio Completo (cantidad mensual) $ Tarifa de Volumen Reducido (cantidad mensual) $ Hechos Suplementarios (Servicios de atencion continuada) Basura Residual: 96 galón $ 7.80 Basura Recicable: 96 gallon $ 3.60 Basura Organica; 96 gallon $ 5.00 Contenedores Rodantes $ Recoger Bulto Grande (max. 2 cuyd) $ Los Aumentos Automáticos Inflacionarias: Adicionalmente, las tarifas propuestas será efectiva el 1 de Noviembre, 2016 que se mostró anteriormente, empezando el 1 de Agosto, 2016, tarifas pueden ser ajustadas al basándose en el cambio anual de California Índice de Precios al Consumidor, como está publicado por la Oficina de Póliza, Investigación y Legislación en California, ( CPI Anual ) y el cambio anual del Departamento de Labor, Oficina de Estadísticas Laborales, Índice de Precios al Productor-Comodidades, Diésel Combustible #2, ( Ajuste de los Costos de Combustible ). Por ninguna razón el Ajuste de Tarifas Anual CPI y el Ajuste de Costo de Combustible, al combinarlo, no excederá el quince por ciento (15%) en cualquier año. 6. Cuándo Será las Nuevas Tarifas Efectivas?

6 Si es aprobado, las nuevas tarifas tomaran efecto el 1 de Noviembre, El Proceso de la Audiencia Pública y la Determinación de una Protesta Mayor: En el horario y locación descrita en párrafo 1 de este aviso, la Junta Directiva escuchara y tomara en cuenta estas objeciones, si lo hay, verificara todas las cartas de protesta sobre este aviso de aumento de tarifa y cualquier otro asunto que es descrito en el Reporte y en este Aviso, se consideraran todas las objeciones y los retos, si lo hay, a la Propuesta de Aumento de Tarifas, incluyendo la Propuesta Anual CPI y el Aumento Costos de Ajuste del Combustible que empezara el 1 de Agosto, La Junta Directiva podría continuar la Audiencia Pública. La Junta Directiva no considerara cartas recibidas después de la conclusión de la Audiencia Pública. Tanto el dueño de la propiedad y la persona que estén recibiendo servicio por las que la cuota o tarifas se están aumentando, podrá enviar una carta de protesta. Solo una carta protesta por parcela es contada. La carta escrita de protesta debe incluir; (i) Firma original; (ii) Identificación por número de parcela o dirección; (iii) Identificación como el propietario de la parcela o la personal que esté recibiendo los servicios por la cual estará aumentado la cuota o tarifa; y (iv) su declaración que usted está protestando el aumento de la tarifa. Las protestas pueden ser mandadas por correo a Málaga County Water District 3580 South Frank Street, Fresno, California 93725, Atención Secretaria de la Junta Directiva. Cartas de Protestas por correo electrónico o por fax no serán aceptadas. Si se presentan suficiente cartas escritas en contra el Aumento de Tarifas Propuestas y no hayan sido retiradas por la mayoría de los propietarios de registros o personas que reciben el servicio a favor o en la parcela objeto al aumento de tarifas, el Distrito no podrá imponer el aumento de tarifas; en lugar, las tarifas del servicio de Basura Residuales, Basura Orgánica y el Reciclable continuaran en la cantidad actual, que han sido previamente aprobados. Si al cerrar la Audiencia Pública no hay la mayoría de la protesta como esta descrita arriba, la Junta Directiva podrá aprobar el aumento de tarifas que tomara efecto y comenzara el 1 de Noviembre, Conservar el Derecho a Impugnar: Cualquier persona que desee conservar la oportunidad de presentar una demanda o acción legal desafiando la Propuesta de Aumento de Tarifa del Servicio Basura Residual, Basura Orgánica, y Basura Reciclable, u otros asuntos descritos en el Reporte o en este aviso, deberá de presentar una carta escrita a la Junta Directiva, explicando las razones por su protesta con detalles específicos. Cualquier motivo no declarado en una protesta por escrito ante la Junta antes del cierre de la Audiencia Publica el 25 de Octubre, 2016, se considerara renunciado y no podrá ser planteada en cualquier demanda o acción legal. 9.
