1 SHIPMENT CONDITIONS Customs & Foreing Trade Deparment Scope: All the supplier who provide foreign trade merchandise to ArcelorMittal Mexico Group should comply the shipping conditions in order to achieve and maintain a safe and efficient chain supply aligned to the Mexican customs legislation. 2 1. SHIPPING INSTRUCTIONS All the purchase order should comply the instructions as follow: A. All shipping documents must be indicated the purchase order. B. All shipping documents, without exception must be consigned and notified to Arcelormittal (addressing to the appropriated company according to the purchase order; see the Annex 1. C. The batch number should be indicated in the packing list and the SAP code according to the purchase order. D. Electronic Customs documents must be send by to: and the buyer s address. E. Original documents must be directed to Monica Garcia Villegas address to Av. Francisco J. Mujica 1, Col. Centro C.P Lázaro Cárdenas, Michoacán. F. The economic damages caused by delays of the customs documentation, will be charged to the supplier, the same way if such documents are apocrypha or they contain inaccuracies. G. The delivery conditions established in the purchase order are according to the Incoterms issued by the international chamber of commerce (2010). H. The only custom entry authorized are: Maritime mode: Lazaro Cardenas, Veracruz and Manzanillo port. Air mode: International Airport of Mexico City and Airport of Toluca. Land mode: Laredo, Colombia, Nogales, Mexican and USA border. Provider should be liable to review and to know these notes. I. Invoice must be issued with the following requirement according to the Mexican Customs Law: Issued date and place Invoice number Provider information: Company name, tax ID number, address. Client information: Company name, tax ID number, address Merchandise value: total value, unit value, (if there a discount it should be declare on value) Merchandise description: it should be clear and with details if is need it. NO CODES Quantity and unit of measurement. If the merchandise is identifying as individual, it must provide the serial number and the brand. Note: the original documents are not necessary except when Arcelormittal has requested in this manner. 2. SHIPPING DOCUMENTS Borders: commercial invoice, certificate of origin NAFTA or NAFTA duly completed and signed, packing list, certificate of analysis, mill test and / or quality should apply. Axys warehouse do not accept partial shipments, the only acceptable shipment should be complete and shall comply with all the required documents to be import. ArcelorMittal Mexico Page 2

3 Our warehouse in Laredo will not receive the merchandise if it is not accompanied by customs documentation in the truck, the expenses caused by this situation will be charged to the provider NOTE: only a critical or urgent good may be the exception and will be acceptable in partial shipments with a previous notification by through the buyer. Handlings and extra cost on a partial shipment without notification should cover by the supplier. Maritime: commercial invoice, packing list (breakdown the weight, amount, number packages and containers), Bill of Lading issued as sea Way Bill, Express Release or Surrendered (Not BL original): certificate of origin EUR.1 or statement of goods originating in exporting from Europe; certificate NAFTA / NAFTA duly filled, sealed, visa and signed required; certificate of analysis / quality, weight certificate, certificate of spraying for wood packaging. Arcelormittal can request additional documents depending on the merchandise, for example there are goods that need a mill test certificate to steel products in order to obtain a government import license. Arcelormittal will be accepted only the follow carrier company for cargo containers to carry on 20 and 40 feet: msc, maersk, hamburg sud, cma cgm, csav, Hapag Lloyd and COSCO. Air: commercial invoice, air way bill, packing list, certificate of origin EUR.1, invoice or statement on the exporter, certificate Nafta / Nafta duly filled, sealed, visa and signed required, analysis and / or quality certificated. SPECIFIC NOTES 1. Is necessary that the shipper arranges the maritime document as Sea Way Bill as first option or surrendered depending to the shipping company, the point is when the containers or break bulk cargo arrives at the destination port, Arcelormittal will be able to release and revalidate BL immediately. 2. See Way Bill should be consigned to Arcelormittal according to the purchase order (see Annex 1). 3. The supplier/shipper must contract the only 5 shipping lines mentioned, they have an agreement with Arcelormittal (no need to deposit money to ensure the returns containers on time and good conditions). 4. If the supplier or shipper contracts a different cargo company, extra costs must be cover by provider account. 5. Loose cargo, bulk cargo or no container cargo not need a specific shipping company; however the maritime document must be issued according to the specific note 2. Usually this type of cargo includes spare parts, equipment and machinery. 6. In case the supplier does not provide the requested NAFTA, EUR1 or any other Certificate of Origen in order to avoid duties, the extra amount paid to customs due to lack of documentation to be charged back to the supplier.
