1 NOTICE OF ORDER AND CALL OF DISTRICT ADDITIONAL ASSISTANCE BUDGET LIMIT OVERRIDE ELECTION FOR LAVEEN ELEMENTARY SCHOOL DISTRICT NO. 59 OF MARICOPA COUNTY, ARIZONA TO THE QUALIFIED ELECTORS OF LAVEEN ELEMENTARY SCHOOL DISTRICT NO. 59 OF MARICOPA COUNTY, ARIZONA: A budget override question will be included on the ballot for the special election to be held on November 6, 2018 (the Election ). The purpose of the Election is to permit qualified electors of Laveen Elementary School District No. 59 of Maricopa County, Arizona (the District ), to vote specifically on the following question: SHALL THE GOVERNING BOARD OF LAVEEN ELEMENTARY SCHOOL DISTRICT NO. 59 OF MARICOPA COUNTY, ARIZONA (THE SCHOOL DISTRICT ), ADOPT A TOTAL AGGREGATE BUDGET WHICH ALLOWS THE SCHOOL DISTRICT TO EXCEED THE DISTRICT ADDITIONAL ASSISTANCE BUDGET LIMIT SPECIFIED BY LAW BY THE LESSER OF $5,489,991 OR TEN PERCENT (10%) OF THE APPLICABLE REVENUE CONTROL LIMIT FOR FISCAL YEAR 2019/2020 AND THE NEXT SUBSEQUENT SIX (6) FISCAL YEARS THEREAFTER? THE 2019/2020 PROPOSED BUDGET INCREASE OF THE PROPOSED BUDGET OF THE SCHOOL DISTRICT WILL EXCEED THE ALTERNATE PROPOSED BUDGET OF THE SCHOOL DISTRICT BY APPROXIMATELY $1,686,001. Any budget increase authorized by this election shall be entirely funded by a levy of taxes on the taxable property within this school district for the year for which adopted and for six subsequent years, shall not be realized from monies furnished by the state and shall not be subject to the limitation on taxes specified in article IX, section 18, Constitution of Arizona. Based on the current net assessed valuation used for secondary property tax purposes, to fund the proposed increase in the school district s budget would require an estimated tax rate of $2.44 per one hundred dollars of net assessed valuation used for secondary property tax purposes and is in addition to the school district s tax rate that will be levied to fund the school district s district additional assistance allowed by law. The capital improvements that are proposed to be funded through this override election are to exceed the state standards and are in addition to monies provided by the State. The School District is proposing to increase its budget by not more than the lesser of $5,489,991 or ten percent of the School District s revenue control limit to fund capital improvements over and above those funded by the State. Under the Students FIRST Capital funding system, the School District is entitled to State moneys for

2 new construction and renovation of school buildings in accordance with State law. BUDGET INCREASE, YES BUDGET INCREASE, NO The Election shall be held at the polling places for the precincts indicated in the Informational Pamphlet to be mailed to the residence of each registered voter in the District not less than thirtyfive (35) days before the date of the Election which shall be open at 6:00 a.m. and close at 7:00 p.m. Early/absentee voting shall be permitted in accordance with the provisions of Title 16, Chapter 4, Article 8, Arizona Revised Statutes. El Distrito Escolar está proponiendo aumentar su presupuesto por no más de lo que sea menor entre $5,489,991 o el diez por ciento del límite de control de ingresos del Distrito Escolar para financiar mejoras de capital sobre y superiores a las financiadas por el Estado. Bajo el sistema de financiamiento de Capital Students FIRST, el Distrito Escolar tiene derecho a dineros del Estado para construcción nueva y renovación de edificios escolares de conformidad con la ley del Estado. 5 REQUEST FOR ARGUMENTS FOR AND AGAINST THE PRO- POSED INCREASE IN THE 2019/2020 AND SUBSEQUENT FISCAL YEARS BUDGETS TO BE CONSIDERED BY THE VOTERS OF LAVEEN ELEMENTARY SCHOOL DISTRICT NO. 59 OF MARICOPA COUNTY, ARIZONA, AT AN ELECTION TO BE HELD ON NOVEMBER 6, Pursuant to a resolution adopted by the Governing Board of Laveen Elementary School District No. 59 of Maricopa County, Arizona (the District ), on June 14, 2018 (the Resolution ), a special election in and for the District was ordered and called to be held on November 6, 2018 (the Election ). Notice of the Election will be given by mailing an Informational Pamphlet. Such Informational Pamphlet is to include arguments for and against the authorization of an override to exceed the otherwise allowable district additional assistance budget limit for the District for fiscal year 2019/2020 and thereafter for the next six subsequent fiscal years to be funded from ad valorem property taxes. The estimated tax rate to fund the $5,489,991 override in fiscal year 2019/2020 is $2.44 per one hundred dollars of net assessed valuation used for secondary property tax purposes. (The text of the question to be considered at the Election are included in the Resolution which is available at the Office of the Superintendent of the District, 5001 West Dobbins Road, Laveen, Arizona ) The arguments shall be in a form prescribed by the County School Superintendent of Maricopa County, Arizona, and each such argument shall not exceed two hundred words. The names of those persons and entities submitting written arguments shall be included in the Informational Pamphlet. The County School Superintendent shall review all factual statements contained in the written arguments and correct any inaccurate statements of fact. The County School Superintendent shall not review and correct any portion of such written arguments which are identified as statements of the author s opinion. The County School Superintendent shall make the written arguments available to the public as provided by law. 6 SOLICITUD DE ARGUMENTOS A FAVOR Y EN CONTRA DEL PROPUESTO AUMENTO EN EL PRESUPUESTO DE 2019/2020 Y DE AÑOS FISCALES SUBSIGUIENTES A CONSIDERACIÓN DE LOS VOTANTES DEL DISTRITO ESCOLAR PRIMARIO NÚM. 59 DE LAVEEN DEL CONDADO DE MARICOPA, ARIZONA, EN UNA ELECCIÓN QUE SE LLEVARÁ A CABO EL 6 DE NOVIEMBRE DE Conforme a una resolución adoptada por el Consejo Directivo del Distrito Escolar Primario Núm. 59 de Laveen del Condado de Maricopa, Arizona (el Distrito ), el 14 de junio de 2018 (la Resolución ), se ordenó y se convocó a una elección especial en y para el Distrito que se llevará a cabo el 6 de noviembre de 2018 (la Elección ). Se dará aviso de la elección enviando un Folleto Informativo por correo. Dicho Folleto Informativo incluirá argumentos a favor y en contra de la autorización de un aumento al presupuesto para sobrepasar el límite del presupuesto de asistencia adicional del distrito de otra forma autorizado para el Distrito para el año fiscal 2019/2020 y a partir de ahí para los próximos seis años fiscales subsiguientes para ser financiado por impuestos de propiedad ad valorem. Se calcula que el índice de impuestos para financiar el aumento al presupuesto de $5,489,991 en el año fiscal 2019/2020 es de $2.44 por cien dólares de valoración neta tasada usada para fines de impuestos secundarios a la propiedad.
