2 APACHE COUNTY, ARIZONA SPECIAL ELECTION NOVEMBER 6, 2018 TO THE QUALIFIED ELECTORS OF APACHE COUNTY, ARIZONA: On April 17, 2018, the Board of Supervisors of Apache County ordered and called a special election to be held on November 6, 2018, to submit to the qualified electors of Apache County (the County ) the question of permitting the County to exceed its primary property tax levy limit. The purpose of the special election is to permit the qualified electors of the County to vote on the question of exceeding the County s primary property tax levy limit. If the voters approve, the proceeds of the primary property tax levy limit override will be used to provide additional funding for the following programs and departments: The Juvenile and the Adult Probation Departments The Justices of the Peace The Assessor s Office The County Attorney s Office The Finance Department The Arizona Healthcare Cost Containment System Eligibility Department Indigent Medical Expenses The Human Resource Department The Board of Supervisors The Administration Department The Building And Maintenance Department The Data Processing Department The Community Development Department The County Recorder s Office The County School Superintendent s Office The County Sheriff s Office The County Treasurer s Office The County Elections Department None of the override funds may be used for other County purposes. APACHE COUNTY, ARIZONA SPECIAL ELECTION NOVEMBER 6, 2018 Apache County has prepared this Voter Information Pamphlet to provide information concerning the County s special election. The Board of Supervisors asks each voter to study this pamphlet carefully, ask questions, discuss it with family, friends and neighbors and then make your decision at the polls either by appearing in person at your respective polling place on November 6, 2018, or by voting by early ballot, as explained in this pamphlet. If you have any questions concerning this pamphlet, you should call: Angela Romero Elections Director, Apache County, Arizona Telephone: FINANCIAL INFORMATION The County is requesting authorization from County voters to levy property taxes in excess of the limit prescribed in A.R.S. Section for a period of seven (7) years commencing in fiscal year and terminating in fiscal year The estimated secondary property tax rate which will be levied in fiscal year if the voters approve the primary property tax levy limit override levy will be $0.30 per $100 of assessed valuation. The maximum dollar amount of secondary property tax which may be collected in each year if the voters approve the override is: Fiscal Year Amount Fiscal Year Amount $2,000, $2,800, $2,200, $3,000, $2,400, $3,200, $2,600,000 The Board of Supervisors of the County ordered the special election in order to fulfill its mission of providing adequate services to the citizens of the County. 3 APACHE COUNTY Based on the following tax rate, the following table illustrates the estimated annual and monthly cost to support the override based on the various types of property and levels of property value. TAX RATE PER $100 OF ASSESSED VALUATION USED FOR SECONDARY TAX PURPOSES: $ (a) (b) (c) Value for tax purposes is the value of your property as it appears on your tax bill and does not necessarily represent the market value. Beginning with fiscal year 2015/2016, this value cannot increase by more than five percent from the prior year unless there is new construction, a structural change or a change of use of property. For commercial property, only locally assessed property is subject to this limit. Cost based on the estimated tax rate associated with the first year of the override. A yes vote shall have the effect of casting your vote in favor of authorizing Apache County to levy secondary property taxes in excess of the County primary property tax levy limits. A no vote shall have the effect of casting your vote against authorizing Apache County to levy secondary property taxes in excess of the County primary property tax levy limits. Yes No APACHE COUNTY, ARIZONA GENERAL ELECTION NOVEMBER 6, 2018 ARGUMENTS FOR AND AGAINST THE OVERRIDE ARGUMENTS FOR (None submitted) ARGUMENTS AGAINST Dear Sirs: I am against the Special Levy Limit Override because we are lending Apache County our money without a note which specifies how they are going to repay the Taxpayers back for this loan with improved service or additional income. This is not good business sense on the part of any voter who votes for the Special Levy Limit Override. It s like giving your relatives more money when you know that they are only going to use it for more luxuries, not necessities. I have 4 years of first-hand knowledge of the procedures used to get the work of the County done for the taxpayers they serve. The County is in need of systemic process changes before I could say the good employees could reach their potential for being efficient. a hard look at the processes they support. Their goal should be to live within their existing Property Tax Dollars and the Dollars shared with us by the State and Federal Governments. That would mean that the way certain things being done would have to change, but that s what your taxpayers have to do when faced with the same scenario. That s what a business has to do when their revenue is insufficient to pay their expenses. When you seriously do that and we, who bother to look at the checks you write, see that you are being more conservative and efficient, only then would we consider a Special Levy Limit Override in order. Golden, Apache County Taxpayer Dear Sirs: The Apache County Republican Committee (ACRC) along with promoting constitutional and conservative values is dedicated to holding local government accountable for the funding they receive through taxation of the citizens. The ACRC stands firmly opposed to this 2018 proposed Apache County tax levy override. We in the ACRC ask that all county citizens vote against this levy override for the following reasons: 1.Local government needs to demonstrate transparent accountability for funds they already receive. 2. Local government needs to use funding where the citizens approve the use of that funding. Statutes or Ordinances need to limit government fund flexibility not expand it. 3. Local government needs to meet statutory time requirements for audits and present transparency for all funds under their control. For your consideration in the above performance requirements we offer the following recent Apache County record and information: 1. Inconsistent Financial Audit performance. 2. Significant internal problems that have created public distrust and that have added undue burden to tax payers in several departments chartered to serve the public. For example: Inconsistent assessor valuations, four day work weeks that have not saved the tax payer money, shifting of funds from one department or dedicated revenue source to another under flexibility language. 3. Lack of holding personnel accountable for misused funds. 4. Lost records. 5. Questionable use of Special District tax funds. 5 6. Inconsistent personnel policies resulting in preference to more politically powerful individuals and departments which negatively affect performance and pay for rank and file employees. On behalf of the Apache County Republican Committee, Barry G. Weller, Chairman By a vote of 2 to 1, the Board of Supervisors elected to ask County voters to approve a secondary tax levy. Approval is needed because the proposed tax would increase primary property taxes to an amount in excess of the limits allowed by Arizona law. The dissenting Supervisor has since resigned and the remaining two are both running for President of the Navajo Nation. If approved, the override will cost property owners more than $18 million over the next seven years. This is a huge burden to be asked by elected officials that are seeking to exit their positions. In a July 6th newspaper article, the County Manager stated that 2019 budget is down from He also indicated that some things are going the County s way and that the state was treating the counties really well this year by returning funds that had been previously swept. These statements do not support a need for increased taxes. I retired from Apache County about eighteen months ago. I joined the growing number of baby boomers on a fixed income that must live within a budget. The County needs to do the same. Tens of thousands of dollars from County funds are spent each year on self-promoting merchandise for elected officials to pass out at fairs and events throughout the County. An abundance of County employees and elected officials, unlike their counterparts in other counties, are provided with take home vehicles, at taxpayer cost. The list goes on and on. There are many areas that can be cut. The County needs to examine those, before turning to the taxpayers. I encourage you to vote NO on the override. Your polling place will be open from 6:00 a.m. to 7:00 p.m. Any registered voter may, at his or her option, be accompanied and assisted by a person of his or her own choice or shall be assisted by two election officials, one from each major political party, during any process relating to voting or during the actual process of voting. Sample ballots may be taken to the voting place and into the voting booth on the day of the election. Any qualified elector who, at 7:00 p.m., is in the line of waiting voters, shall be allowed to prepare and cast a ballot. Sí No CONDADO DE APACHE, ARIZONA ELECCIÓN GENERAL 6 DE NOVIEMBRE DE 2018 ARGUMENTOS A FAVOR Y EN CONTRA DE LA ANULACIÓN ARGUMENTOS A FAVOR (Ninguno Recibido) ARGUMENTOS EN CONTRA Estimados Señores: Estoy en contra del Sobrepaso Especial del Límite de Exacción porque estamos prestando nuestro dinero al Condado de Apache sin un pagaré que especifique cómo van a reembolsar a los contribuyentes por este préstamo con mejor servicio o ingresos adicionales. Esto no es un buen sentido comercial por parte de cualquier votante que vota a favor del Sobrepaso Especial del Límite de Exacción. Es como dar más dinero a sus parientes cuando sabe que solo lo usarán para más lujos, no para necesidades. Tengo 4 años de conocimiento de primera mano de los procedimientos 11 utilizados para hacer el trabajo del Condado a favor de los contribuyentes que sirven. El Condado tiene necesidad de cambios en los procesos sistémicos antes de que yo pudiera decir que los buenos empleados podrían alcanzar su potencial de ser eficientes. Antes de considerar un préstamo de los Contribuyentes, el Condado debe analizar bien los procesos que respaldan. Su meta debe ser vivir dentro de sus Dólares de los Impuestos sobre la Propiedad existentes y los dólares que nos comparten los Gobiernos del Estado y lo Federal. Eso significaría que se tiene que cambiar la forma en que se realizan ciertas cosas, pero eso es lo que tienen que hacer los contribuyentes cuando enfrentan el mismo supuesto. Una empresa tiene que hacer lo mismo cuando sus ingresos no son suficientes para pagar sus gastos. Cuando realmente hacen eso y nosotros que nos molestamos en mirar los cheques que escriben vemos que están siendo más conservadores y eficientes, solo en ese caso vamos a considerar que es apropiado un Sobrepaso Especial del Límite de Exacción. Problemas internos importantes que han creado desconfianza pública y que han agregado una carga innecesaria a los contribuyentes en varios departamentos constituidos para servir al público. 12 valoraciones de tasación inconsistentes, semanas laborales de cuatro días que no han ahorrado dinero al contribuyente, transferencia de fondos de un departamento o fuente de ingresos dedicada a otro bajo lenguaje de flexibilidad. 3. Falta de responsabilizar al personal por usar incorrectamente los fondos. 4. Registros perdidos. 5. Uso dudoso de los fondos fiscales del Distrito Especial. 6. Políticas de personal inconsistentes que resultan en preferencia a individuos y departamentos con mayor poder político que tiene resultado negativo al desempeño y salario de los empleados generales. De parte del Comité Republicano del Condado de Apache, Barry G. Weller, Presidente Con un voto de 2 a 1, la Junta de Supervisores eligió pedirles a los votantes del Condado que aprobaran un impuesto secundario. La aprobación es necesaria porque el impuesto propuesto aumentaría los impuestos primarios sobre la propiedad a una cantidad que exceda los límites permitidos por la ley de Arizona. El supervisor disidente ha renunciado y los dos restantes se postulan para Presidente de la Nación Navajo. Si se aprueba, el sobrepaso les costará a los propietarios más de $ 18 millones durante los próximos siete años. Son funcionarios electos que buscan salir de sus puestos que están solicitando esta gran carga. En un artículo periodístico del 6 de julio, el Administrador del Condado declaró que el presupuesto para 2019 se ha reducido desde También mencionó que algunas cosas van al favor del Condado y que el estado estaba tratando a los condados muy bien este año por devolver los fondos que habían sido quitados previamente. Estas declaraciones no respaldan la necesidad de mayores impuestos. Me retiré del Condado de Apache hace aproximadamente dieciocho meses. Me uní al creciente número de baby boomers en un ingreso fijo que deben vivir dentro de un presupuesto. El condado necesita hacer lo mismo. Se gastan cada año decenas de miles de dólares de fondos del Condado en mercancía para la autopromoción de funcionarios electos que se distribuye en ferias y eventos en todo el Condado. Una gran cantidad de empleados y funcionarios electos del Condado, a diferencia de sus contrapartes en otros condados, reciben vehículos para llevar a casa, al costo de los contribuyentes. Cualquier elector inscrito puede ser, a su elección, acompañado y ayudado por una persona de su propia elección o deberá ser ayudado por dos oficiales de elección, uno de cada partido político principal, durante cualquier proceso relacionado con la votación o durante el proceso de votación propiamente dicho. Se puede llevar las muestras de boletas a los centros de votación y adentro de la cabina de votación en el día de la elección.
