1 NOTICE OF A BOND ELECTION TO BE HELD BY KERR COUNTY, TEXAS Below is a copy of the Order calling a Bond Election to be held on Saturday, May 9, 2015, in Kerr County, Texas, which serves as the notice of such election required by Section of the Texas Election Code. STATE OF TEXAS COUNTY OF KERR ORDER CALLING A BOND ELECTION WHEREAS, the Commissioners Court of Kerr County, Texas (the "County") deems it advisable to call the election hereinafter ordered for the purpose of receiving voter authorization to issue general obligation bonds to finance an expansion of the County Jail (to provide for approximately 144 additional beds) and to renovate and make other improvements to the County Jail; and WHEREAS, such election shall be held in accordance with Chapter 1251, Texas Government Code, and applicable provision of the Texas Election Code; and WHEREAS, it is hereby officially found and determined that the meeting at which this Order was passed was open to the public, and public notice of the time, place, and purpose of said meeting was given, all as required by Chapter 551, Texas Government Code; THAT: THEREFORE, BE IT ORDERED BY THE COMMISSIONERS COURT OF KERR COUNTY, TEXAS 1. TIME OF ELECTION. A bond election in the County shall be held between the hours of 7:00 A.M. and 7:00 P.M. on Saturday, May 9, PRECINCTS AND POLLING PLACES. The polling place for each election precinct of the County for said election shall be as follows: County Election Precinct No. 101, 107, 109, 113, 118, , 211, 215, , 308, 312, , 405, 406, 410, 416, 417 Polling Place River Hills Mall 200 Sidney Baker South Hill Country Youth Event Center 3785 Hwy 27 Callioux City Center 910 Main St Kerr County Courthouse Annex-Ingram 3350 Junction Hwy Ingram, TX 3. PRESIDING JUDGES. The Presiding Judge and Alternate Presiding Judge for each of the election precincts and polling places described above shall be appointed at a later date.

2 4. ELECTION CLERKS. Each Presiding Judge shall appoint not less than two nor more than five qualified election clerks to serve and assist in conducting said election; provided that if the Presiding Judge actually serves as expected, the Alternate Presiding Judge shall be one of such clerks. 5. EARLY VOTING. The Early Voting Clerk shall be Ms. Diane Bolin. EARLY VOTING BALLOT BOARD. An Early Voting Ballot Board is hereby created to process early voting results. The Presiding Judge and the Alternate Presiding Judge of said Board shall be appointed at a later date. The Presiding Judge shall appoint at least two other members of said Board. 7. ELECTORS. All resident, qualified electors of the County shall be entitled to vote at said election. 8. NOTICE OF ELECTION. The County shall cause a substantial copy of this Order (in English and Spanish) to be posted and published as required by Sections 4.003(a)(1)(A), (b) and (f) of the Texas Election Code, and Section (d), Texas Government Code. 9. OFFICIAL PROPOSITION. At the election the following PROPOSITION, setting forth the purpose for which the bonds shall be authorized, shall be submitted in accordance with law: PROPOSITION Shall the Commissioners Court of Kerr County, Texas be authorized to issue bonds of the County, in one or more series, in the aggregate principal amount of $15,000,000 to finance an expansion of the County Jail (to provide for approximately 144 additional beds) and to renovate and make other improvements to the County Jail, with the bonds of each such series, respectively, to mature serially within not to exceed 40 years from their date, to bear interest at such rates, and to be sold at such prices, all in accordance with law at the time of issuance and as shall be determined within the discretion of the Commissioners Court; and shall the Commissioners Court be authorized to levy and pledge, and cause to be assessed and collected, annual ad valorem taxes on all taxable property in the County, sufficient, within the limits provided by law, to pay the principal of and interest on said bonds? 10. FORM OF BALLOT. The official ballots for the election shall be prepared in accordance with the Texas Election Code so as to permit the electors to vote "FOR" or "AGAINST" the PROPOSITION described in Section 9 above, with the ballots for the election to contain such provisions, markings and language as required by law, and with such bond PROPOSITION to be expressed substantially as follows:

3 PROPOSITION FOR AGAINST THE ISSUANCE OF $15,000,000 OF BONDS TO FINANCE AN EXPANSION OF THE COUNTY JAIL AND TO RENOVATE AND MAKE OTHER IMPROVEMENTS TO THE COUNTY JAIL, AND LEVYING THE TAX IN PAYMENT THEREOF 11. ADDITIONAL INFORMATION. In accordance with the provisions of Section 3.009(b), Texas Election Code, it is hereby found and determined that: (a) (b) (c) The proposition language that will appear on the ballot is set forth in Section 10 hereof. The purpose for which the bonds are to be authorized is set forth in Sections 9 and 10 hereof. The principal amount of the debt obligations to be authorized is set forth in Sections 9 and 10 hereof. (d) As set forth in Sections 9 and 10 hereof, if the bonds are approved by the voters, the Commissioners Court will be authorized to levy annual ad valorem taxes, on all taxable property in the County, sufficient, within the limits provided by law, to pay the principal of and interest on the bonds. (e) Based upon the bond market conditions at the date of adoption of this Order, the maximum interest rate for any series of the bonds is estimated to be 4.0% as calculated in accordance with applicable law. Such estimate takes into account a number of factors, including the issuance schedule, maturity schedule and the expected bond ratings of the proposed bonds. Such estimated maximum interest rate is provided as a matter of information, but is not a limitation on the interest rate at which the bonds, or any series thereof, may be sold. (f) As set forth in Section 9 hereof, if the bonds are approved, they may be issued in one or more series, to mature serially, over a period not to exceed 40 years from their date. (g) The aggregate amount of the outstanding principal of the County's debt obligations (all of which are secured by a limited tax levied for debt service purposes) as of the beginning of the County's fiscal year is $13,980, (h) The aggregate amount of the outstanding interest of the County's debt obligations (all of which are secured by a limited tax levied for debt service purposes) as of the beginning of the County's fiscal year is $2,986, (i) The ad valorem debt service tax rate for the County for the fiscal year is $ per $100 of taxable assessed valuation. 12. ELECTION CODE. In all respects said election shall be conducted in accordance with the Texas Election Code. Pursuant to the federal Help America Vote Act ("HAVA") and the Code, at each polling place there shall be at least one voting system that is equipped for disabled individuals, and each such voting system shall be a system that has been certified by the Texas Secretary of State as compliant with HAVA and the Code. 13. BILINGUAL ELECTION MATERIALS. All election materials (including notice of the election, ballots, instruction cards, affidavits, and other forms which voters may be required to sign) and all early voting materials shall be printed in both English and Spanish, or Spanish translations thereof, and/or other assistance shall be provided, as required by the Texas Election Code and the Federal Voting Rights Act of 1965, each as amended.

4 14. EFFECTIVE DATE. Pursuant to the provisions of Section , Texas Government Code, as amended, this Order shall become effective immediately upon adoption thereof. 5 AVISO DE UNA ELECCION DE BONOS QUE CELEBRARA EL CONDADO DE KERR, TEXAS Anexo a la presente se encuentra una copia del Orden que convoca una Elección de Bonos que se celebrará el sábado 9 de mayo de 2015 en el Condado de Kerr, Texas, mismo que sirve de aviso de dicha elección como lo requiere la Sección del Código Electoral de Texas. ESTADO DE TEXAS CONDADO DE KERR ORDEN QUE CONVOCA UNA ELECCION DE BONOS CONSIDERANDO, que la Corte de Comisionados del Condado de Kerr, Texas (el Condado ) considera recomendable convocar la elección de bonos ordenada aquí y en lo sucesivo para el propósito de recibir la autorización de los electores de emitir bonos de obligación general para financiar la ampliación de la Cárcel del Condado (para proveer 144 camas adicionales), y para renovar y realizar otras mejoras a la Cárcel del Condado; y CONSIDERANDO, que dicha elección se celebrará conforme al Capítulo 1251 del Código de Gobierno de Texas y las provisiones aplicables del Código Electoral de Texas; y CONSIDERANDO, que queda aquí formalmente determinado que la reunión en que fue adoptado este orden fue abierta al público, y que se dio aviso de la hora, lugar y propósito de dicha reunión, de acuerdo al Código de Gobierno de Texas, en su Capítulo 551; ORDENA: POR LO TANTO, LA CORTE DE COMISIONADOS DEL CONDADO DE KERR, TEXAS 1. HORA DE LA ELECCION. Se celebrará una elección de bonos en el Condado entre las horas de 7:00 A.M. y 7:00 P.M. el sábado, 9 de mayo de PRECINTOS Y CASILLAS ELECTORALES. JUECES PRESIDENTES. En una fecha posterior se nombrarán el Juez Presidente y el Juez Presidente Suplente para cada uno de los precintos electorales y casillas electorales mencionados arriba.

6 4. OFICIALES ELECTORALES. Cada Juez Presidente nombrará a un mínimo de dos, y a un máximo de cinco oficiales electorales calificados para servir y asistir en la celebración de dicha elección; establecido si el Juez Presidente en realidad ejerce su función como se espera, el Juez Presidente Suplente será uno de dichos oficiales. 5. VOTACION ANTICIPADA. La Oficial de Votación Anticipada será la Sra. Diane Bolin. COMITÉ ELECTORAL DE VOTACION ANTICIPADA. En este acto se forma un Comité Electoral de Votación Anticipada para procesar los resultados de dicha votación anticipada. Serán nombrados el Juez Presidente y el Juez Presidente Suplente en una fecha posterior. El Juez Presidente nombrará a por lo menos dos integrantes más de dicho Comité. 7. ELECTORES. Todos los electores calificados, residentes del Condado tendrán derecho de votar en dicha elección. 8. AVISO. El Condado dará aviso y publicará una copia sustancial de este Orden (en inglés y español) según lo dispuesto en las Secciones 4.003(a)(1)(A), (b) y (f) del Código Electoral de Texas, y la Sección (d) del Código de Gobierno de Texas. 9. PROPUESTA OFICIAL. En dicha elección la siguiente PROPUESTA, que establece el propósito para la autorización de dichos bonos, se someterá a votación de acuerdo a las normas legales PROPUESTA Se autorizará a la Corte de Comisionados del Condado de Kerr, Texas, emitir bonos del Condado, en una o más series, por el monto principal global de $15,000,000 para financiar la ampliación de la Cárcel del Condado (para proveer aproximadamente 144 camas adicionales) y para renovar y realizar otras mejoras a la Cárcel del Condado, con bonos de cada serie o emisión, respectivamente, que se maduren por serie dentro de un periodo que no excederá de 40 años de su fecha, y que se vendan a tal precio y devengan interés a tasas conforme a la ley vigente en el momento de su emisión y que serán determinadas dentro de la discreción de la Corte de Comisionados; y se autorizará a la Corte de Comisionados gravar y asignar, y hacer que se tasen y se recauden impuestos anuales ad valorem sobre toda propiedad gravable en el Condado, suficientes, dentro de los límites de la ley, para pagar el principal y el interés de dichos bonos?

Las boletas oficiales para dicha elección deberán prepararse de acuerdo al Código Electoral de Texas, para permitir que los electores voten A FAVOR o EN CONTRA de la PROPUESTA descrita en la Sección 9 anterior, con boletas que incluyen toda provisión, señalamiento y lenguaje requerido por ley, y que dicha PROPUESTA se exprese sustancialmente como sigue: PROPUESTA A FAVOR LA EMISION DE BONOS POR $15,000,000 PARA FINANCIAR LA EN CONTRA AMPLIACION DE LA CARCEL DEL CONDADO Y PARA RENOVAR Y REALIZAR OTRAS MEJORAS A LA CARCEL DEL CONDADO, Y LA ASIGNACION DE IMPUESTOS PARA PAGARLA. 11. INFORMACION ADICIONAL. En este acto, y de acuerdo a las provisiones de la Sección 3.009(b), del Código Electoral de Texas, se establece y se determina que: (a) (b) (c) 10 presentes. El lenguaje de la propuesta que aparece en la boleta se establece en la Sección 10 presente. El propósito de la autorización de los bonos se establece en las Secciones 9 y 10 presentes. El monto principal de la deuda de las obligaciones a autorizarse, se establece en las Secciones 9 y (d) De acuerdo a lo establecido en las Secciones 9 y 10 presentes, si los electores autorizan los bonos, la Corte de Comisionados tendrá autorización de gravar impuestos anuales ad valorem, sobre toda propiedad gravable en el Condado, suficientes, dentro de los límites que marca la ley, para pagar el principal y el interés de dichos bonos. (e) En base a las condiciones de mercado en la fecha de adopción de este Orden, la máxima tasa de interés para cualquier serie de dichos bonos se estima en 4.0%, calculado de acuerdo a las leyes aplicables. Dicho estimado toma en consideración varios factores, incluyendo el programa de emisión, programa de vencimiento, y la puntuación esperada de los bonos propuestos. Dicha tasa máxima de interés se proporciona de manera informativa, pero no representa una limitación sobre la tasa de interés en la cual podrán venderse los bonos, o cualquier serie de los mismos. (f) De acuerdo a la Sección 9 presente, si se autorizan los bonos, éstos podrán emitirse en una o más series, con vencimiento por serie, durante un periodo que no excederá de 40 años de su fecha respectiva. (g) El monto global del principal pendiente de las obligaciones de deuda del Condado (mismas que están garantizadas por un impuesto limitado que se asigna para propósitos del servicio de deuda) a principios del año fiscal del Condado es de $13,980, (h) El monto global del interés pendiente de las obligaciones de deuda del Condado (mismas que están garantizadas por un impuesto limitado que se asigna para propósitos del servicio de deuda) a principios del año fiscal del Condado es de $2,986, (i) La tasa de impuesto ad valorem del servicio de la deuda para el año fiscal del Condado es $ por $100 de valor gravado. 12. CODIGO ELECTORAL. En todo aspecto, dicha elección se llevará a cabo de acuerdo al Código Electoral de Texas. En cada casilla electoral habrá por lo menos un sistema de votación que esté equipado para el uso de individuos discapacitados, en cumplimiento del Acta Ayuda Votar a América ("HAVA") y dicho Código, y cada una de dichos sistemas de votación será un sistema que ha sido certificado por el Secretario de Estado de Texas de su cumplimiento con HAVA y el Código.

8 13. MATERIALES ELECTORALES BILINGÜES. Todo material electoral (incluyendo el aviso de elección, boletas, tarjetas de instrucción, juramentos, y demás formas que pudieran requerir la firma del elector) y todo material para la votación anticipada, se imprimirá tanto en inglés como en español, o con la traducción correspondiente al español, y/o se proporcionará otra asistencia, de acuerdo al Código Electoral de Texas y el Acta Federal de Derechos Electorales de 1965, con sus enmiendas. 14. FECHA EFECTIVA. De acuerdo a las provisiones de la Sección del Código de Gobierno de Texas con sus enmiendas, este Orden surtirá efecto en el momento de su aprobación.
