1 (First published in the High Plains Daily Leader & Times on February 26, 2014, and subsequently on March 5, 2014) NOTICE OF SPECIAL QUESTION ELECTION CITY OF LIBERAL, KANSAS The City Commission of the City of Liberal, Kansas (the City ), has heretofore, pursuant to a resolution duly adopted, declared it advisable to conduct a special question election relating to the imposition of a one-half percent (1/2%) Citywide retailers' sales tax. Notice is hereby given to the qualified electors of the City that such special question election has been called and will be held on April 8, 2014, for the purpose of submitting to the qualified electors of the City the following proposition: Shall the following be adopted? Shall the City of Liberal, Kansas, be authorized, pursuant to the authority of K.S.A et seq., to impose a one-half percent (1/2%) Citywide retailers' sales tax (the Educational Sales Tax ), the revenues to be derived therefrom to be used for the purpose of: (a) assisting Unified School District No. 480, Seward County, Kansas (Liberal) (the District ) in the repayment of a portion of the principal of and interest on general obligation bonds to be issued by the District in an amount not to exceed $127,865,000 (the District Bonds ) to pay the costs to construct, furnish and equip educational facilities in the District (the District Projects ); and (b) providing for the payment of certain City infrastructure improvements to facilitate the use of the District Projects; provided that the collection of the Educational Sales tax shall commence on July 1, 2014, or as soon thereafter as permitted by law, and shall expire upon the earlier of twenty-five (25) years after its commencement or when all costs associated with the District Projects, including the repayment of the District Bonds issued to finance or refinance such costs, shall have been paid; provided further that the imposition of such Educational Sales Tax shall be subject to the following conditions: (i) approval by the electors of the City of this proposition; (ii) approval by the electors of the District at an election held on April 8, 2014, of a proposition authorizing the issuance of the District Bonds; and (iii) the execution of a cooperation agreement between the City and the District regarding the application of the Educational Sales Tax to assist in the repayment of the District Bonds? To vote in favor of any question submitted on this ballot, darken the oval to the left of the word Yes. To vote against it, darken the oval to the left of the word No. The polls will open at 7:00 o'clock A.M. and will close at 7:00 o'clock P.M., on April 8, 2014, the election day. Registered voters are eligible to vote by advance voting ballot upon application to the County Clerk at the address set forth below pursuant to K.S.A et seq. ADDITIONAL INFORMATION Educational Sales Tax. Approval of the special question election would authorize the City of Liberal, Kansas (the City ) to impose a general purpose one-half percent (1/2%) Citywide retailers' sales tax (the Educational Sales Tax ), the revenues to be derived therefrom to be used for the purpose of: (a) assisting Unified School District No. 480, Seward County, Kansas (Liberal) (the District ) in the repayment of a portion of the principal of and interest on general obligation bonds to be issued by the District in an amount not to exceed $127,865,000 (the District Bonds ) described below; and (b) providing for the payment of certain City infrastructure improvements to facilitate the use of the projects to be financed by the District Bonds. The Educational Sales Tax shall commence on July 1, 2014, or as soon thereafter as permitted by law, and shall expire upon the earlier of twenty-five (25) years after its commencement or when all costs associated with the District Projects, including the repayment of the Bonds issued to finance or refinance such costs, shall have been paid. The imposition of the Educational Sales Tax is subject to the following conditions: (a) approval by the electors of the City of this proposition; (b) approval by the electors of the District of a proposition authorizing the issuance of the District Bonds as described below; and (c) the execution of a cooperation agreement between the City and the District regarding the application of the Educational Sales Tax to assist in the repayment of the District Bonds. U.S.D. No. 480 Bond Election. On the same date as the special question election, the Board of Education of the District will submit to the electors of the District the proposition of authorizing the issuance of the District Bonds to pay the costs to: (a) construct, furnish, equip, demolish, repurpose, renovate, and make additions to existing District facilities, including: (1) repurpose the existing Cottonwood Intermediate School to a new K-5 Elementary School, (2) repurpose the existing Sunflower Intermediate School to a new K-5 Elementary School, (3) repurpose the existing High School and West Middle School to a 9-12 High School, (4) demolish the existing MacArthur Elementary School and construct, furnish and equip a new K-5 Elementary School at the site; (b) acquire sites for and construct, furnish, and equip new District facilities, including: (1) a new north K-5 Elementary School and a new south K-5 Elementary School, and (2) a new north Middle School and a new south Middle School; (c) construct, furnish and equip other necessary improvements in the District; and (d) make all other necessary improvements appurtenant thereto (collectively the District Projects ). The issuance of the District Bonds is subject to the following conditions: (i) approval by the electors of the District of the District Bonds; (ii) approval by the electors of the City of the imposition of the Educational Sales Tax; and (iii) the execution of a cooperation agreement between the City and the District regarding the application of the Educational Sales Tax to assist in the repayment of the District Bonds. 2

El aviso se hace a los electores calificados de la Ciudad acerca de esta elección para pregunta especial que se llevara a cabo el 8 de Abril del 2014, con el propósito de exponer a los electores calificados de la Ciudad la siguiente proposición: Debería lo siguiente ser aprobado? INFORMACION ADICIONAL Impuesto sobre Ventas para Educación. La aprobación de la elección para la pregunta especial autorizara a la Ciudad de Liberal, Kansas (la Ciudad ) a imponer con un propósito general un medio (1/2%) impuesto sobre las ventas al menudeo de toda la Ciudad (el Impuesto Sobre Ventas para Educación ), los ingresos derivados del mismo con el propósito de ser usados para: (a) ayudar al Distrito Escolar Unificado No. 480, del Condado de Seward, Kansas (Liberal) (el Distrito ) en el pago de una porción al principal y a los intereses de los bonos de obligación general para ser emitidos por el Distrito por una cantidad que no exceda $127,865,000 (los Bonos del Distrito ) descritos abajo; y (b) para proveer para el pago de ciertas mejoras a la infraestructura de la Ciudad para facilitar el uso de los proyectos a ser financiados por los Bonos del Distrito. El Impuesto sobre las Ventas para Educación deberán comenzar el 1 de Julio del 2014 o tan pronto como la ley lo permita, y deberá expirar hasta dentro de (25) años después de su inicio o cuando todos los costos relacionados con los Proyectos del Distrito, incluyendo el pago de los Bonos emitidos para financiar o refinanciar tales costos, que deberán haber sido pagados. Elección de Bonos del U.S.D. No En la misma fecha de la elección de la pregunta especial, la Junta de Educación emitirá a los electores del Distrito la proposición que autoriza la emisión de los Bonos de Distrito para pagar los costos a: (a) construir, amueblar, equipar, demoler, reusar, renovar, y hacer adiciones a las instalaciones existentes del Distrito, incluyendo (1) reusar la existente Escuela Intermedia Cottonwood a una nueva Escuela Primaria K-5, (2) reusar la existente Escuela Intermedia Sunflower a una nueva Escuela Primaria K-5, (3) reusar la existente Escuela Preparatoria y la Escuela Media West a una Preparatoria del 9-12, (4) demoler la existente Escuela Primaria MacArthur y construir, amueblar y equipar una nueva Escuela Primaria K-5 en el lugar; (b) adquirir lugares para construir, 2

6 amueblar, y equipar nuevas instalaciones del Distrito, incluyendo: (1) una nueva Escuela Primaria Norte K-5 y una nueva Escuela Primaria Sur, y (2) una nueva Escuela Media Norte y una nueva Escuela Media Sur; (c) construir, amueblar y equipar otras mejoras necesarias en el Distrito; y (d) hacer todas las mejoras necesarias correspondientes al mismo (colectivamente los Proyectos del Distrito ). La emisión de los Bonos de Distrito está sujeta a las siguientes condiciones: (i) aprobación por los electores del Distrito acerca de los Bonos de Distrito; (ii) aprobación por los electores de la Ciudad acerca de la imposición de los Impuestos por Ventas sobre la Educación (iii) la ejecución de un acuerdo de cooperación entre la Ciudad y el Distrito relacionado con la aplicación de los Impuestos a las Ventas para Educación para asistir en el pago de los Bonos del Distrito.
