1 NOTICE OF TAX RATIFICATION ELECTION THE STATE OF TEXAS NEW DIANA INDEPENDENT SCHOOL DISTRICT COUNTIES OF UPSHUR AND HARRISON TO THE RESIDENT QUALIFIED ELECTORS OF THE NEW DIANA INDEPENDENT SCHOOL DISTRICT: TAKE NOTICE that an election will be held in the NEW DIANA INDEPENDENT SCHOOL DISTRICT on the 7 th day of November, 2017, in accordance with an order adopted by the Board of Trustees which is a part of this notice for all purposes and reads substantially as follows: AN ORDER calling a tax ratification election to be held in the New Diana Independent School District, making provision for the conduct of the election and resolving other matters incident and related to such election WHEREAS, the Board of Trustees of the New Diana Independent School District hereby finds a tax ratification election shall be held under the provisions of Texas Tax Code, Chapter 26, as amended; now, therefore, BE IT ORDERED BY THE BOARD OF TRUSTEES OF THE NEW DIANA INDEPENDENT SCHOOL DISTRICT: SECTION 1: An election shall be held on the 7 th day of November, 2017, in the New Diana Independent School District, which date is seventy-eight (78) or more days from the date of the adoption hereof, and is a uniform election date pursuant to Texas Election Code, Section , for the purpose of submitting the following measure: "Shall the Board of Trustees of the New Diana Independent School District be authorized to levy, pursuant to an order of such Board adopted on August 14, 2017, an ad valorem tax rate of $1.19 per $100 of the taxable assessed valuation of property within the New Diana Independent School District for the current tax year, being a rate that is comprised of a maintenance and operations tax rate of $1.11 per $100 of such taxable assessed valuation and a debt service tax rate of $0.08 per $100 of such taxable assessed value (an amount that is set annually by the Board), which combined tax rate of $1.19 represents an increase of $0.07 per $100 of such taxable assessed valuation when compared to the prior year s total tax rate and is $ higher per $100 of such taxable assessed valuation than the school district rollback tax rate for the current tax year, calculated pursuant to Section 26.08, as amended, Texas Tax Code?" SECTION 2: In accordance with the provisions of an election services contract with the Upshur County Elections Administrator (the "Upshur Contract") for that portion of the District located in Upshur County and an election services contract with the Harrison County Elections Administrator (the "Harrison Contract") for that portion of the District located in Harrison County, the election shall be conducted by the Upshur County Elections Administrator and the Harrison /

2 County Elections Administrator, respectively, in accordance with the provisions of the respective election contracts or agreements (collectively, the Contracts ). SECTION 3: (a) With respect to that portion of the District located in Upshur County, the locations, dates and times for early voting for this election shall be as shown in Exhibit A. Lory Harle, Upshur County Elections Administrator, is hereby appointed early voting clerk and shall appoint and designate deputy clerks for early voting in accordance with the Upshur Contract. (b) With respect to that portion of the District located in Harrison County, the locations, dates and times for early voting for this election shall be as shown in Exhibit A. Michael McMurry, Harrison County Elections Administrator, is hereby appointed early voting clerk and shall appoint and designate deputy clerks for early voting in accordance with the Harrison Contract. For purposes of processing ballots cast in early voting, the election officers for the early voting ballot board for this election shall be appointed and designated in accordance with the provisions of the respective Contracts. SECTION 4: Pursuant to the provisions of the Contracts, the vote centers for voters in Upshur County and election precincts and polling locations for voters in Harrison County are shown in Exhibit B attached hereto and hereby incorporated herein by reference as a part hereof for all purposes. The election officers and maximum number of clerks for each polling place or voting center shall be determined and appointed in accordance with the provisions of the respective Contracts. On election day, the polls shall be open from 7:00 A.M. to 7:00 P.M. SECTION 5: A voting system or systems meeting the standards and requirements of the Texas Election Code, as amended, is hereby adopted and approved for early voting by personal appearance and by mail and for election day voting. Ballots shall be prepared in accordance with the Texas Election Code, and permit electors to vote "FOR" or "AGAINST" the aforesaid measure which shall appear on the ballot substantially as follows: NEW DIANA INDEPENDENT SCHOOL DISTRICT PROPOSITION B "APPROVING THE AD VALOREM TAX RATE OF $1.19 PER $100 VALUATION IN THE NEW DIANA INDEPENDENT SCHOOL DISTRICT FOR THE CURRENT YEAR, A RATE THAT IS $ HIGHER PER $100 VALUATION THAN THE SCHOOL DISTRICT ROLLBACK TAX RATE, FOR THE PURPOSE OF INCREASING REVENUE FOR MAINTENANCE AND OPERATIONS" SECTION 6: With respect to the voters of the District residing in Upshur County, the Central Counting Station for the tabulation and counting of ballots for this election shall be located at the Upshur County Elections Administration Office, Upshur County Courthouse, 2 nd Floor, 100 West Tyler Street, Gilmer, Texas. With respect to the voters of the District residing in Harrison County, the Central Counting Station for the tabulation and counting of ballots for this election shall be located at the Harrison County Elections Office, 415 East Burleson Street, Marshall, Texas /

3 The Manager, Tabulation Supervisor, Presiding Judge and Alternate Presiding Judge at each Central Counting Station shall be appointed and designated in accordance with the provisions of the respective Contract. The Manager and Presiding Judge of the Central Counting Station may appoint clerks to serve at such Station, as provided by Section of the Election Code. SECTION 7: All resident qualified voters of the District shall be permitted to vote at said election and, on the day of the election, such voters shall vote at the designated polling places. This election shall be held and conducted in accordance with the Texas Election Code, except as modified by the provisions of the Texas Education Code, and to the extent required by law, all election materials and proceedings shall be printed in both English and Spanish. SECTION 8: A substantial copy of this Order shall serve as proper notice of said election. Said notice shall be published at least one time not more than thirty (30) days or less than ten (10) days before the day of the election in a newspaper of general circulation in the District. Additionally, the notice shall be posted (i) on the bulletin board used for posting notices of Board meetings and at three public places within the District not later than twenty-one (21) days prior to election day, (ii) prominently on the District s Internet website during the twentyone (21) days prior to election day, and (iii) in a prominent location at each polling place on the day of the election and during early voting. SECTION 9: This Order hereby incorporates the provisions of the Contracts, and to the extent of any conflict between this Order and the Contracts, the provisions of the Contracts shall control. The Superintendent of Schools or his designee, is hereby authorized to correct, modify or change the information in this Order and the attached Exhibits, including the final locations, dates and times agreed upon by the Upshur County Elections Administrator and/or the Harrison County Elections Administrator and the District as well as incorporate additional voting locations as designated by the Upshur County Elections Administrator and/or the Harrison County Elections Administrator. 8 AVISO DE ELECCIÓN DE RATIFICACIÓN DE IMPUESTOS EL ESTADO DE TEXAS DISTRITO ESCOLAR INDEPENDIENTE DE NEW DIANA CONDADOS DE UPSHUR Y HARRISON A LOS ELECTORES CALIFICADOS RESIDENTES DEL DISTRITO ESCOLAR INDEPENDIENTE DE NEW DIANA: SE INFORMA que se llevará a cabo una elección en el DISTRITO ESCOLAR INDEPENDIENTE DE NEW DIANA el 7 de noviembre de 2017, de acuerdo con una orden adoptada por el Consejo de Administración, que es parte de este aviso para todos los propósitos y dice substancialmente lo siguiente: UNA ORDEN que convoca llevar a cabo una elección de ratificación de impuestos en el Distrito Escolar Independiente de New Diana, que dispone realizar la elección y resolver otros asuntos incidentales y relacionados a dicha elección CONSIDERANDO QUE, el Consejo de Administración del Distrito Escolar Independiente de New Diana por este medio encuentra que se debe llevar a cabo una elección de ratificación de impuestos bajo las cláusulas del Código de Impuestos de Texas, Capítulo 26, como ha sido modificado; ahora, por lo tanto, ORDÉNESE POR EL CONSEJO DE ADMINISTRACIÓN DEL DISTRITO ESCOLAR INDEPENDIENTE DE NEW DIANA: SECCIÓN 1: Se deberá llevar a cabo una elección el 7 de noviembre de 2017 en el Distrito Escolar Independiente de New Diana, fecha que es setenta y ocho (78) o más días de la fecha de adopción de esto, y es una fecha uniforme de elección conforme al Código de Elección de Texas, Sección , con el propósito de presentar la siguiente medida: " Deberá el Consejo de Administración del Distrito Escolar Independiente de New Diana estar autorizado para gravar, conforme a una orden de dicho Consejo adoptada el 14 de Agosto de 2017, una tasa de impuestos de acuerdo a su valor de $1.19 por $100 de valuación fiscal gravable de propiedad dentro del Distrito Escolar Independiente de New Diana para el año fiscal actual, siendo una tasa que es compuesta de una tasa de impuestos de mantenimiento y operaciones de $1.11 por $100 de tal valuación fiscal gravable y una tasa de impuestos de servicio de deuda de $0.08 por $100 de dicho valor fiscal gravable (una cantidad que es fijada anualmente por el Consejo), cuya tasa combinada de impuestos de $1.19 representa un incremento de $0.07 por $100 de dicha valuación fiscal gravable cuando se compara con la tasa total de impuestos del año previo, y es $ más alta por $100 de dicha valuación fiscal gravable que la tasa reducida de impuestos del distrito escolar para el año fiscal actual, calculada conforme a la Sección 26.08, como ha sido modificada, del Código de Impuestos de Texas?" /

9 SECCIÓN 2: De acuerdo con las cláusulas de un contrato de servicios de elección con el Administrador de Elecciones del Condado de Upshur (el "Contrato de Upshur ) para esa porción del Distrito localizada en el Condado de Upshur y un contrato de servicios de elección con el Administrador de Elecciones del Condado de Harrison (el "Contrato de Harrison") para esa porción del Distrito localizada en el Condado de Harrison, la elección deberá ser conducida por el Administrador de Elecciones del Condado de Upshur y por el Administrador de Elecciones del Condado de Harrison, respectivamente, de acuerdo con las cláusulas de los respectivos contratos de elección o acuerdos (colectivamente, los Contratos ). SECCIÓN 3: (a) Con respecto a esa porción del Distrito localizada en el Condado de Upshur, las ubicaciones, fechas y horas para la votación anticipada para esta elección deberán ser como se muestra en el Cuadro A. Lory Harle, Administradora de Elecciones del Condado de Upshur, es por este medio nombrada encargada de la votación anticipada, y ella deberá nombrar y designar encargados asistentes para la votación anticipada de acuerdo con el Contrato de Upshur. (b) Con respecto a esa porción del Distrito localizada en el Condado de Harrison, las ubicaciones, fechas y horas para la votación anticipada para esta elección deberán ser como se muestra en el Cuadro A. Michael McMurry, Administrador de Elecciones del Condado de Harrison, es por este medio nombrado encargado de la votación anticipada, y él deberá nombrar y designar encargados asistentes para la votación anticipada de acuerdo con el Contrato de Harrison. Para fines de procesar los votos en la votación anticipada, los oficiales de elección para el consejo de votación anticipada para esta elección deberán ser nombrados y designados de acuerdo con las cláusulas de los respectivos Contratos. SECCIÓN 4: De conformidad con los Contratos, los centros de votación para los votantes en el Condado de Upshur y los recintos electorales y lugar de votación para los votantes en el Condado de Harrison se muestran en el Cuadro B, que se anexa e incorpora aquí dentro por referencia como parte de esto para todos los propósitos. Los oficiales de elección y el número máximo de encargados para cada lugar de votación o centro de votación deberán ser determinados y nombrados de acuerdo con las cláusulas de los respectivos Contratos. El día de la elección, las casillas deberán estar abiertas de 7:00 A.M. a 7:00 P.M. SECCIÓN 5: Por este medio se adopta y se aprueba un sistema o sistemas de votación que cumple con los estándares y requerimientos del Código de Elección de Texas, como ha sido modificado, para la votación anticipada por medio de presencia física personal y por correo y para la votación el día de la elección. Con respecto a los votantes del Distrito que residen en el Condado de Harrison, la Estación de Conteo Central para la tabulación y el conteo de los votos para esta elección deberá estar localizada en la Oficina de Elecciones del Condado de Harrison, ubicada en 415 East Burleson Street, Marshall, Texas. El Administrador, Supervisor de Tabulación, Juez que Preside y Juez Alterno que Preside en dicha Estación de Conteo Central deberán ser nombrados y designados de acuerdo con las cláusulas del respectivo Contrato. El Administrador y el Juez que Preside de la Estación de Conteo Central podrán nombrar encargados para servir en dicha Estación, de conformidad con la Sección del Código de Elección. SECCIÓN 7: A todos los votantes calificados residentes del Distrito se les deberá permitir votar en dicha elección, y el día de la elección, dichos votantes deberán votar en los lugares de votación designados. Esta elección deberá ser llevada a cabo y conducida de acuerdo con el Código de Elección de Texas, excepto como haya sido modificado por las cláusulas del Código de Educación de Texas, y en la medida que lo requiera la ley, todos los materiales y procedimientos de la elección deberán estar impresos tanto en inglés como en español. SECCIÓN 8: Una copia substancial de esta Orden deberá servir de aviso apropiado de dicha elección. Dicho aviso deberá ser publicado por lo menos una vez, no más de treinta (30) días o menos de diez (10) días antes del día de la elección en un periódico de circulación general en el Distrito. Además, el aviso deberá ser expuesto (i) en el tablero de anuncios usado para exponer avisos de juntas del Consejo y en tres lugares públicos dentro del Distrito a más tardar veintiún (21) días antes del día de la elección, (ii) prominentemente en el sitio de Internet del Distrito durante los veintiún (21) días antes del día de la elección, y (iii) en una ubicación prominente en cada lugar de votación el día de la elección y durante la votación anticipada. SECCIÓN 9: Por este medio, esta Orden incorpora las cláusulas de los Contratos, y en caso de que exista cualquier conflicto entre esta Orden y los Contratos, las cláusulas de los Contratos deberán controlar.
